11:47I'm with the Plan Commission.
11:49Um so this height was cited for multiple reasons.
11:53There's been a lot of complaints about the fence and the general property, how it's being kept.
12:01Um right now they do have three accessory structures.
12:04The code only allows two, and one of the accessory structures is in the front yet.
12:10It's an they are on the corner lot, so it's difficult to meet um the setback requirements.
12:16But however, the there used to be uh fence that met the regulation.
12:21It was three and a half foot fence prior to the owner purchasing the property, it was a chain link fence which met the requirements.
12:28This was changed to a privacy fence, a six-foot privacy fence without a permit.
12:35And they also have a trailer packed on the property in the front yard.
12:39Predicode if you wanted to um stall a trailer on your property, it has to be in the rear yard.
12:45In this case, it's difficult to meet that because they don't they barely have any um say space to do that.
12:51It's all the front yard.
12:52So we had met with them pro uh pr previously and discussed um options.
12:59Um and the recommendations, it's in there.
13:02We um suggested that they move the fence a little bit back so that it would align with all the houses along both sides of the um street.
13:14We also suggested that they pave some of the area close to the existing garage on site.
13:19They have a garage that can accommodate two vehicles.
13:23So if they had paved an area next to where they could park the stall that recreational vehicle there, and then they would have to move the existing shed, which is close to the fence, further back close to the house.
13:37We presented this to them and they rejected it.
13:40So we I recommended a disapproval for all this because it is affecting the um general aesthetics of the neighborhood.
13:48If they went ahead and agreed to our recommendations, this would bring it closer into compliance, not fully, but it would look better.
14:02I I guess I'm curious why um you um didn't um take any of the suggestions from planning commission.
14:11Is it I I couldn't see movement of fence now, they say I I have not seen no.
14:23I mean, I don't I don't you can't even see what's on my back there.
14:26If I call in the zoning and told them my trailers are sold, my trailers are gone.

18:14Um this is actually the zoning compliance, so it's just talking about your fence in line with the zoning code for the city of Toledo.
18:25It's not um it's not talking about like it's talking about how to get your house in compliance with the city.
18:34So if it's rules are set for a reason.
18:37If we allowed everyone to put tall fences up and impede on the code, it would cause such a havoc.
18:45So we're talking about the zoning and the compliance, and it sounded like they that the city actually offered a compromise and you didn't want to do the compromise, right?
18:55You didn't want to push the fence back.
18:59An another option is you could keep the fence where it's at, it would just have to come down to three and a half feet.
19:04I that's also another option as well.
19:07Well, it made it sound like I have to remove it or put it in the middle of my yard.
19:14You know, there's there's points where people have their corner lots uh zoned for a six foot.
19:22I mean, I can't be the only one that's asking for this.

19:35Keep paying money and we turned in all this paperwork and and nobody knows nothing.
19:42No, I mean you bring up a good point a lot that we turned in all kinds of pictures, she made a collage, and she says, Okay, they'll probably grandfather it in, it shouldn't be a problem.
19:51So she is doctors know saying that he has all these magical problems in that.
19:56This problem gets brought to the board a lot.
20:00And when it gets brought to us, there is the city code that is that was mentioned, and it's just up to us to allow a variance to that code.
20:06I'm trying to sell the property as fast as I can.
20:09I gave it to her, she gave it back to me.
20:11I don't want it, but I maintain it.
20:12In order for us to provide a variance that has to be hardship shown and those hardship requirements and criteria really clearly defined, and planning commission went through all of the hardship criteria and and really determined that there isn't enough for a hardship variance.
20:31Even though that there's people have their life on their line that live there with the gunshots and dynamite sticks, none of that matters.
20:39Just want to make sure zoning is zoning.
20:42It's it's zoning, I I mean, call I would call the the law the police.

23:00That is uh one of the compromises, but then also to cut it down, but it's um I think she would she can help she's right behind you and can talk through the compromises a little bit more.
23:11So yeah, she has so if since you have set it, um the trailer is gone, you may not need this, but it shed is currently dead.

23:29You can move it in place, but cut it on the three and hopefully.

23:37When I talked to Rebecca, she said it wouldn't be a problem giving a grandfather in for the full length, and then I come here and it's something different.
