I think everybody's just running a little late, which happens, so yeah, not in not including this gentleman, but there'll be need to be three more of us in order to kind of vote and do this, and um and if that doesn't happen, we'll figure something else out so you guys don't have to come back.

0:18

Um but so planning commission looks at all of these um all these cases and I think there are printouts right up here that kind of give Planning Commission's recommendation.

0:31

Fortunately, all of them have Planning Commission's approval or suggesting that we approve them, and it's really up to us to vote on what Planning Commission recommends based on what the situation is.

0:44

So if you want to review their recommendation just to understand kind of where they're coming from.

0:49

Like I said, they're all approved this week.

0:51

That doesn't typically happen, and um so I would I think things are gonna go fairly well, but I don't want to thank you.

1:00

Don't want to overpromise anything.

1:02

So um, but with that also while we're waiting, um if you plan on tending to speak, there's a sign-up sheet um right up here.

1:10

It's just kind of a name and address, and yeah, if you're yeah, like I said, if you intend to speak, please sign in now just to save time when we kind of hopefully kick things off here soon.

1:22

1:26

Are they all gone?

1:27

Yes.

1:30

Secretary, please read the first case.

5:53

BZA 26-00006.

5:58

1271 Tecumseh Street.

6:02

Applicant request variants in order to install a four-foot fence with non-standard materials in front and side yards.

6:22

Hi, I'm Eric L.

6:24

Lyons, the owner of 1271 Tecumsey Street.

6:30

Yes, I do.

6:33

Thanks for coming.

6:34

Just give us a little background on what you're trying to do.

6:36

We have your we have your um application, but thank you.

6:39

Yes.

6:40

Um first I want to uh say forgive me for not attending the first meeting that it was scheduled.

6:44

I had a procedure done on my lower back, a medical condition with sciatica and cervical ridiculopathy.

6:51

I am having um a black aluminum fence installed in front of my home, and the entire house is fenced in, and it's four and a half feet um the back when my grandmother used to live, um, whom I bought the house from to our family is historical, and we keep it in a family because she was the first black woman that uh worked at Kroger's in Toledo, Ohio, and so it is a it is more like uh uh just uh a wonderful thing to have her house, you know, and for me to be the grandchild to have it, and so we just trying to preserve everything that we do in there that I'm doing there, and um I wanted I bought a spa, eleven thousand dollar spa that's in the backyard.

7:37

So I had that fenced off because I know you have to have a fence around the entire place, keeping someone from getting into the yard, and I don't want nobody to have the case of drown, even though I keep it locked, but I also got an revitalized loan to have my driveway uh paved all the way from my yard over to the next property owner next door to me, and I want to have a fence go across the front.

8:02

So this fence here through revamp is gonna cost me 4,700, almost 500, plus I had to pay the 200 fee for the various things.

8:13

So that's what I'm doing, and um I wanted four and a half feet in the front so to look more elegant and more stylish, like um, I want to say like the presidential style looking in front of the the White House.

8:30

So I wanted the that was the theme that I was going with, and so the house is gray and the theme is black, you know, uh what they call that trimmed.

8:40

So that's what I was going with.

8:41

I just want to enhance the property because the value when I first got the house was only like 10,000, 11,000.

8:48

I got it from my mom and her sisters and her brother before they all passed away.

8:52

And um I want to up the value.

8:55

So now I had appraiser out and they valued it for 65,000.

8:59

So I'm grateful for that.

9:01

That the area is a historical area to me because you guys are coming all the way down from Collingwood, you're revitalizing all that.

9:10

So I wanted to be a part of the community to enhance the house so that way no one had to come in, tear it down and all that stuff.

9:18

So if I did decide to sell it, which I probably want, um, I can get a great value for it.

9:23

So that's what I'm here today.

9:25

And revamp has spoken to me and I asked them that they want to come represent me.

9:28

They said they they didn't need to be here.

9:30

They'll come me out of Indiana, and they say just go ahead and see if you guys would okay that four feet higher, so it can look presidential style for me.

9:40

Thank you.

9:43

No, thank you.

9:44

Does anybody else in attendance want to speak um on this case?

9:49

Um, does anybody on the board have any questions?

9:52

I I don't have any questions, just a statement.

9:54

I just appreciate you um getting your grandmother's house.

10:00

I've been trying to get mine too, because it is historic to our families, and I appreciate you not wanting a six-foot fence.

10:04

Thank you so much.

10:05

Okay, thank you so much.

10:07

Thank you guys.

10:11

Mr.

10:12

Secretary, should this um case be approved?

10:15

Christy Sankran.

10:17

Yes, Benice Williams?

10:19

Yes, Robert Pasker.

10:21

Yes, Nathan Knitt.

10:23

Yes.

10:25

You've been approved.

10:26

Yep.

10:35

All right, Mr.

10:35

Secretary Quee.

10:36

Um, please read the next case.

10:38

BZA 26 000 21624 Lombard Avenue.

10:48

Applicant requests a variance in order to install a six-foot fence in the front yard on a double frontage lot.

10:59

Yeah.

11:04

Oh, that's fine.

11:27

Kenya Cunningham, I'm here for 1624 Lombard Avenue to Lee, Ohio.

11:34

Yes.

11:36

Oh, my shortness.

11:38

Yes.

11:41

Um, I am the personal assistant of the owner of the house, Arlena Alexander, and um I'm here just to represent her.

11:48

She is on one of her properties.

11:50

Um in the application right here, it stated that it was supposed to be for the front yard, but all of the documentation that was brought in shows that everything was for the backyard, and it's really just a replacement of the fence that was already there when she bought the property, and really that's all she's trying to do is just replace the fence in the backyard.

12:10

Um the documentation did have pictures and showed the zoning and everything of where that fence is at, and just as she's replacing it, not adding anything to the front yard at all.

12:22

No, I think technically it's too front, it's too front yard, but it but it's not.

12:29

Right.

12:29

And it's off is off the house.

12:31

Yes, it's off of South Detroit.

12:33

Yeah so you'll catch the South Detroit going around on both sides of the house.

12:37

So it's just a replacement.

12:39

The fence is kind of worn and ready.

12:42

I I don't have any and it's different colors that part.

12:51

Does anybody else in attendance?

12:54

Oh I appreciate it.

12:58

If sir, sir, if you please if you want to speak, please come up for the record.

13:19

I tried that almost out.

13:26

So yeah.

13:40

Mark Phyllis, 1612 Lombard.

13:46

Yes.

13:49

Where are you in relation to her house?

13:51

Two doors down to two of her or three doors down from her.

13:54

Okay.

13:55

And I used to live two doors down from her.

13:57

I've been on the streets since 92.

13:59

Okay.

14:00

And what you guys sent out by the city created a bunch of animosity that shouldn't have been there.

14:10

I mean, she's been a good new, I mean, they've been good neighbors, Nat.

14:14

And you guys sent us something that says a privacy fence is gonna go in the front yard.

14:20

And then the whole neighborhood is like looking over there, and it's like, what the heck do they plan on doing?

14:26

Yeah.

14:27

And they're keeping the property nice, and this caused a lot of undue anxiety and friction.

14:34

So please.

14:36

No, I I I can understand the confusion.

14:38

It's because of South Detroit Avenue, it's also I guess a front edge of the property, and so therefore it's considered a front yard, and that's where all the confusion is.

14:47

Please please just to clarify.

14:50

So you have a double frontage, so you have two front yards.

14:54

That's how we define it.

14:56

How do we don't own that property?

14:59

That's city property.

15:00

No, on hair lot.

15:02

So you're still facing Detroit and Lombard.

15:05

Yes.

15:06

Yes, we are facing them, but we do not own the property behind the garages.

15:11

That's that is right away.

15:13

But as long as you're facing the street, you still have to be a little bit more.

15:21

Why would you ever call that the front yard?

15:23

So it's a double frontage.

15:25

Because of because of Detroit being a street and Lombard being a street.

15:32

We are so sorry because it was confusing to me until I looked it up and was like, that's not the front yard.

15:38

I was annoyed when I'm not personally saying it.

15:40

I said this nobody on the front of this street has a bit in their front yard.

15:45

So why would I get a print in the front yard?

15:47

Yeah.

15:49

I understand what it is.

15:52

Oh no, you're good.

15:53

No problem.

15:54

Thank you for taking care of your property.

15:57

No problem.

15:59

No, I I think this is pretty straightforward, honestly.

16:02

But um if everyone's set up, I think we'll vote on this.

16:07

Mr.

16:07

Should this variance be approved?

16:09

Christy Soncrant?

16:11

Yes.

16:12

Benice Williams.

16:13

Yes.

16:14

Robert Pras Pasker.

16:15

Yes.

16:16

Nathan Namke.

16:17

Yes.

16:23

So it is just they're just over the backyard.

16:25

They're not going to do that.

16:27

Yes, sir.

16:28

Okay.

16:30

Yep.

16:30

Apologies.

16:31

I guess I thought everybody was done.

16:37

Okay.

16:39

All right.

16:39

Mr.

16:40

Secretary, please read the next case.

16:42

BZA 26-0002.

16:47

Uh 2007 Scottwood Avenue.

16:52

Applicant requests a variance in order to install a seven-foot tall privacy fence in the side yard setback.

17:01

Michael Clark 2007 Scottwood.

17:05

Yes.

17:11

Yes.

17:13

Uh I have a parking lot on the side of my house, which is for our apartment building, and they have an existing uh seven-foot chain link fence with barbed wire on the top with one of those things that angles like this towards me.

17:28

And I'd like to match the height of their fence.

17:32

That kind of okay.

17:41

Does anybody else in attendance um want to have anything they want to say on this?

17:53

So the park is you're saying the parking lot behind you has the seven-foot fence and you actually, yeah, there's a parking lot behind me and on the side of me.

18:02

Yeah.

18:03

But I'm just I already have a fence in the back, so this is on the side.

18:08

I got pictures of if you need pictures.

18:12

Why is there far wire?

18:14

Because it's a property.

18:16

It's a commercial property.

18:17

Yeah.

18:18

Okay.

18:22

I don't have any.

18:23

I don't have any questions.

18:25

No.

18:27

Go ahead.

18:29

Um should this variance be approved?

18:31

Nathan Napke.

18:33

Yes.

18:33

Robert Pasker.

18:34

Yes.

18:35

Benice Willie.

18:36

Yes.

18:37

Christy Sankra.

18:38

Yes.

18:40

Yep.

18:40

Take care.

18:44

All right.

18:45

Uh last one, Mr.

18:46

Secretary, please read the next piece.

18:54

BZA26-0027.

19:00

1702 and 1710 Oakdale Avenue.

19:05

Applicant requests a variance in order to install a six-foot fence with one foot of barbed wire in the front yard setback within 50 feet of the residential zone property.

19:52

Matt Hittle, Rudolph Lou to Inc.

19:54

1702 Oakdale Avenue.

19:58

I do.

20:01

Rudolph Augusty.

20:08

I do.

20:13

So if you guys remember we were in here earlier this spring under BZA two six-003 to request a six-foot chain link fence with barbed wire in the front yard set back.

20:26

Um that was an extension of their existing fence line.

20:30

Uh that was due to improvements, building addition with site improvements included.

20:35

Um as of now, they have purchased the two adjacent properties to the east at 1702 and 1710 Oakdale.

20:42

They would like to continue that fence line all on that perimeter to enclose the new footprint of the entire property.

20:59

We're dealing with a lot of illegal dumping on that property, and we're trying to clean it up and keep people from dumping on the property.

21:10

Is it is this red is this residential property or is this commercial?

21:15

It's commercial property.

21:16

It's next to residential area on the side and across the street.

21:22

Does anybody else in attendance want to speak on this case?

21:28

Anyone else on the board?

21:36

Um Mr.

21:37

Secretary, should this variance be approved?

21:41

Nathan Napke.

21:42

Yes.

21:43

Robert Pasker.

21:45

Yes.

21:47

Yes.

21:47

Christy Sonker.

21:49

Yes.

21:50

Approved.

21:51

Approved.

21:52

Thank you.

21:54

Thank you.

22:00

Sir, where were you?

22:01

I would look to put the air mines uh twelve step one to come to I didn't put that up here as we'll catch those.

22:11

Okay.

22:12

No, we approved it, so we're thanks for coming.

22:18

Um there any minutes that we need to approve from uh last meeting.

22:22

We do have we have the minutes from the last two meetings since we didn't have a quorum last time.

22:27

Is there any questions or comments on the minutes?

22:31

No.

22:32

I don't.

22:33

We get a motion to approve them.

22:37

I motion.

22:39

I motion to approve the minutes from the last two meetings.

22:42

I second.

22:45

All right.

22:48

Thanks for thanks for coming.

Summary of Proceedings

Toledo Board of Zoning Appeals Hearing – July 20, 2026

The Administrative Board of Zoning Appeals (BZA) of Toledo, Ohio, met on July 20, 2026, to consider four variance requests. All cases had received prior approval from the Planning Commission. A quorum was present with members Christy Sonkrant, Denise Williams, Robert Pasker, and Nathan Natke (Devon Oberton and Eric Craig excused). All variances were approved unanimously, and minutes from the last two meetings were adopted.

Public Comments & Testimony

  • 1271 Tecumseh Street (BZA 26-00006): Applicant Eric L. Lyons, owner of the property, testified that he wished to install a four‑foot black aluminum fence in his front and side yards to enhance the property’s appearance and value. The home is his late grandmother’s, and the property has increased in appraised value from $10,000 to $65,000. No opposing testimony was given.
  • 1624 Lombard Avenue (BZA 26-00021): Kenya Cunningham, personal assistant of owner Arlena Alexander, explained that the requested variance was for a replacement fence in the backyard, not a new front yard fence. The property fronts both South Detroit and Lombard (double frontage lot), causing confusion. Neighbor Mark Phyllis of 1612 Lombard expressed that the city’s notice created unnecessary neighborhood anxiety, as the fence was not intended for the front yard. He supported the replacement.
  • 2007 Scottwood Avenue (BZA 26-0002): Michael Clark, owner of the property, stated that he wanted to install a seven‑foot privacy fence along his side yard to match an adjacent commercial property’s existing seven‑foot chain‑link fence with barbed wire. No public opposition was noted.
  • 1702 and 1710 Oakdale Avenue (BZA 26-0027): Matt Hittle and Rudolph Augusty of Rudolph Lou to Inc. testified that the fence (six‑foot chain‑link with one foot of barbed wire) would extend an existing fence line to enclose newly purchased adjacent lots and prevent illegal dumping. No public comments were made.

Discussion Items

  • The board reviewed each variance, noting that all had Planning Commission approval.
  • For the Lombard case, the board clarified the definition of a double frontage lot and confirmed the fence would only be in the backyard, addressing neighbor concerns.
  • The board approved the minutes from the last two meetings (the prior meeting had lacked a quorum).

Key Outcomes

  • BZA 26-00006 (1271 Tecumseh St.): Approved unanimously (4‑0) to install a four‑foot fence with non‑standard materials in front and side yards.
  • BZA 26-00021 (1624 Lombard Ave.): Approved unanimously (4‑0) for a six‑foot fence; clarified as a replacement backyard fence on a double frontage lot.
  • BZA 26-0002 (2007 Scottwood Ave.): Approved unanimously (4‑0) for a seven‑foot privacy fence in the side yard setback.
  • BZA 26-0027 (1702/1710 Oakdale Ave.): Approved unanimously (4‑0) for a six‑foot chain‑link fence with one foot of barbed wire in the front yard setback within 50 feet of a residential zone.
  • Minutes: Approved from the last two meetings by motion and second.
