0:15Um craddock and a second by Commissioner Bullmash for the approval of item one.
0:22Opposed, and that item is approved.
0:26We don't have any consent agenda items.
0:29Secretary, we please read our rules.
0:33In order to conduct the public hearing in an orderly manner, we ask that you abide the following rules.
0:40The commissioner will first hear from the staff for an explanation of the application, physical facts of the property under application, and the surrounding property, followed by a presentation of the staff's recommendation.
0:55The commission commission will then hear the applicant's presentation not to exceed 15 minutes.
1:01Next, the commission will hear from any interested parties or protestants.
1:06A time limit may per speaker may be imposed.
1:09Those wishing to speak must use the sign-in sheet over to my left by the door.
1:15For the record, please state your name and address if you choose to speak.
1:19Finally, the commission will hear the applicant's rebuttal if any not to exceed 10 minutes.
1:25During the hearing, the commission will hear the applicant's rebuttal if any not to exceed 10 minutes.
1:34During the hearing, the commission may ask questions of staff, the applicant, or interested parties.
1:40In the room are representatives of the City Legal Department and Development Services Department and the Tulsa Planning Office staff.
1:48We do have a taping system, therefore, please direct all of your comments into the microphone.
1:54And these proceedings are broadcast live on cable channel 24.
2:02Moving on to the public hearing rezoning.
2:05Items two and five are together.
2:08Nathan, do you want to come up or no?
2:14So both item two and five, we've received a request from the applicant to continue those items to April 1st.
2:23And I'll answer any questions if you have any, but as of right now, it's just a continuance request.
2:29Any questions for Nathan?
2:31Okay, just so the audience knows, um, we typically grant a continuance to the applicant and a continuance to staff or the opposition historically.
2:44So for items two and five, we will be discussing the continuance.
2:52And if you've signed up to speak on those items, I can call you up, but we will be speaking to the continuance only and not hearing the case today, in all likelihood.
3:04There's a chance we could, but historically, we've can granted these continuances.
3:12So would the applicant like to come up.
3:29Chairman, Lou Reynolds, 2727 East 21st Street, suite 200, Tulsa 74114.
3:36Uh we've asked for this continuance in order to prepare more information to address the concerns raised by staff in the report.
3:43We couldn't have time to get that done in time for today's meeting from the time we got that.
3:47So that's why we requested.
3:49Any questions for the applicant?
3:51Okay, thank you, sir.
3:54So I will call the speakers now, and if you wish to not come up because of the continuance, you can just decline.
4:01But if you would like to speak to the continuance, you can come up and have five minutes if you need it.
4:08Uh first speaker, Adam Levitt.
4:14Adam Levitt, 2259 South Troost Avenue, Tulsa, Oklahoma 74114.
4:22And first one to say just appreciate the commission, what you guys are doing.
4:27I think it's fantastic and really important.
4:29Um I'm representing Ann Landworth Holdings, which owns 78 acres to the west, adjoining this phase two.
4:38Um I'm hoping to be included in the continuance because they're actually considering making an offer on the property.
4:49To be frank, I'm in I'm against it, but I represent the LLC, which my sister is the other beneficial interest owner, and she wants to sell.
5:00So for her benefit, we're hoping they just offer us an amazing value because she would love to sell the property.
5:07So you could see that as a landowner and as the manager of the LLC, you know, I'm even have conflicted uh thoughts around it, as perhaps some of you on the commission.
5:18So I can identify with that.
5:19All I know is that we support the city of Tulsa, the master plan, and the purposeful uh zoning from agriculture where we stand now, you know, potentially even to light industrial if it suits the master plan.
5:37But as you know, so are are you we're just speaking to the continuance case?
5:41So all I would say is uh yeah, that I'm waiting like you are.
5:45Okay, thank you, sir.
5:55Please give your name and address Jessica Peraza, 515 North Atlanta Place, Tulsa, Oklahoma, 74110.
6:13Um I am just a citizen in Tulsa.
6:16I'm in opposition of the continuance of rezoning in phase two.
6:22So you would like to hear the continuance today?
6:28I mean, I we you would like to hear the case today and not have it continued.
6:32Um, I don't understand.
6:37So we we are most likely going to continue this case to April 1st.
6:43So if you'd like to comment on just the continuance, you may.
6:48Oh, I mean, I want to hear about it, yes.
6:53Yeah, if we could, yeah.
6:54Instead of continuing it.
6:56Commissioner Bullmesh?
6:58I think just to clarify, the the app typically when these cases come before us, the applicant makes a presentation, we then listen to that.
7:06We hear from staff presentation, we then hear from anybody who may be opposed to the actual request, which is a rezoning request.
7:13Today, the applicant has asked for more time to make that presentation.
7:16So all that we are likely to consider is whether we grant an extension to the applicant to present their case to this body in two weeks.
7:25Um so if anybody here is opposed to that continuance and they want to hear the case today, that's what we're listening to.
7:31If you're fine with the continuance, you can either submit comments via email to staff or you can come back on the April 1st.
7:38No, I want to hear it today.
7:54Please give your name and address.
7:57My name is Vivian Allen.
7:58It's a 702 South Phoenix Avenue.
8:02Um I think we're all here.
8:05I would rather not have a continuance and not everyone have to come back in two weeks.
8:13I declined to comment.
8:28Linda Allegro, 208 East 19th Street, Tulsa, Oklahoma 74119.
8:34I'd like to hear it today.
8:46Yeah, you can come up.
8:52Please give your name and address.
8:56I apologize, I have not had this type of situation in a meeting before.
9:00I'm Kelly Bogaman, 18176 South Highway 88 in Claremore, Oklahoma.
9:04If I make a comment on the continuance, am I able to make a comment if it is heard today?
9:12Since I signed up to I would be able to if it is heard, we can have you back.
9:15Okay, I'm gonna decline to comment on the continuance.
9:31Hello, my name is Cheyenna Morgan, 9 South 180 Fifth East Avenue, Tulsa, Oklahoma.
9:36Um I am in disagreement with a continuance today.
9:42Phase one has been approved since 2024.
9:44What's so different between 2024 and now?
10:00Hi, Jordan Harman, 3336 East 45th Street, Tulsa.
10:03And I am recommending to deny the continuance and move ahead with hearing the issue.
10:09Project Anthem has been on the table since 2024.
10:13And now they're asking for something very different, twice as large as the original proposal.
10:19And I think that we're prepared to hear about it today.
10:38My name is Bradford Lovett, 715 North Columbia Place, 74110.
10:43Also disagree with the continuance, so I'd like to hear it today.
10:59Robert Ross, 3519 East Sixth Street, Tulsa, Oklahoma.
11:03I'm also against the continuance.
11:23My name is Nera Singh, 1019, East 35th Place, Tulsa 74105.
11:30I just encourage us to deny the continuance.
11:45Harley Haley Parmenter.
11:59Hi, I'm Haley Parmenter, 1439 South College Avenue.
12:03Excuse me, South Florence Place, Tulsa 74104.
12:09I recommend that we hear the case today that and deny the continuance.
12:19And if we continue to grant continuances on this issue, I fear that the public will not have continued faith on this issue.
12:44This is the first continuance for the S.
12:46Mitchell Gilliam, 521 North 29th West Avenue.
12:51I am also against the continuance.
12:54We all live in Oklahoma here.
12:58We're running out of farmland, clean water.
13:01We're in a global crisis.
13:03What are we continuing for?
13:05They've had this planned and they couldn't get their plan together to speak today.
13:10They should be ready to speak.
13:11I vote against the continuance.
13:14That is all the speakers for item two and number five.
13:20So we are in review for the applicant's request for continuance.
13:36I know it's not easy in the middle of a work day.
13:39Um however I would be in favor of the request for continuance because I think the applicant just recently learned from the staff uh the report, and so I think that allowing them more time to explore other options may be beneficial for um a lot of the concerns that I've heard in the past.
13:58So um open for others, but I would be either ready or willing to make a motion, but don't want to stay above other comments.
14:09Um I'd like to know what the additional request for information was.
14:17We can have the applicant back up.
14:29Chairman, I've asked for some breakdowns of data that that and mapping that showed in supporting this cause and and the purpose for it and why that this was justified in this case, and it's just gonna take time to assemble.
14:42And and I know that some of my people are out for spring break this week and and could tell they just said Lou, we can't get it to you in time.
14:50So it's our presentation to put on to support what we're asking for with respect to what we've heard from staff.
14:56Ronald, this is a new application with this is the first request for a continuance.
15:01We have not asked for any continuance on this before.
15:05So I guess I misunderstood earlier there wasn't a request from staff for additional information from you.
15:10You requested additional information from staff.
15:13No, sorry, I requested additional time so I could respond to what the staff has written.
15:18To what they have written.
15:24Any other discussion?
15:28So I heard individuals say this was phase one was approved in 2024.
15:34That's a separate application.
15:36That was a separate application.
15:37So this is a new application.
15:39Just want my clarity.
15:42I would move to grant a continuance for if we do them separately.
15:47We need these separate, Jeff.
15:51I would move to grant a continuance for items number two and five, based on the applicant's request, noting that this is the first request for a continuance for these cases.
16:01We have a motion by Commissioner Bullmash.
16:03A second by Commissioner Q for the continuance of item number two and number five to April 1st.
16:14And those items are continued.
16:27A little bit of deja vu.
16:28Item three has also made a request for a continuance.
16:32This request for continuance was to April 15th.
16:36There is some additional property that is being added to that application that required new notices to be sent out as well as new maps to be created.
16:46So on this particular case, uh staff is supportive as well so that we can make sure we have all the property included in the materials.
16:53Any questions for Nathan?
16:55We do not have any speakers for item three.
16:58Is the applicant here?
17:05I would I would move that we uh on item number three that we continue that to uh April 15th, 2026.
17:14We have a motion by Commissioner Craddock, a second by Commissioner Shivel for the continuance of item three to April 15th.
17:23And that item is continued.
17:29We do have a speaker here.
17:32Item number four is a rezoning request, Z seven eight five three.
17:36Um this request was actually initiated by the Tulsa City Council, and it is intended to rezone a small partial, I mean a half acre uh piece of property adjacent to the historic Route 66 village on Southwest Boulevard from RS3 to CH.
17:53Um this is a piece of property that is owned by the City of Tulsa and currently serves as the Route 66 Main Street office.
18:00The intent is for it to be a supporting use for the historical village that's located on the adjacent properties and that are all already zoned commercial.
18:08There was a request to add a gift shop to the existing office located on this property, and it was determined that the zoning had not been sufficient for the uses that were being proposed.
18:18And so the council initiated that change.
18:34Found it consistent with the comprehensive plan, and we've recommended approval of the rezoning.
18:38So we're just coming into compliance here.
18:41Um I mean we're we're catching up uh basically.
18:43I think that over time some pieces of these properties have been acquired by the city to continue to enhance the the area around the historical village, and so this is going to allow those goals to continue and and I think that will ultimately allow more tourist attractions at this location.
19:02I need to I have a question for Jack today.
19:14I'm sorry, I don't know why I called you Jack, Jeff.
19:18Um since I was involved in that of the allegation of the money, should I recuse myself from the vote?
19:28I've been involved in all the decision making and where the money was allotted.
19:36In this case that were forced in yes, probably.
19:42I mean I mean that's that's up to you.
19:44Yeah, I think I should because if you feel like you have a conflict, then you know the cat the district money then I lauded for that.
19:56So Nathan, are you the applicant?
20:00the decision making and where the money was allotted in this case that we're worse than yes probably okay I just wonder I mean I mean that's that's up to you yeah I think I should because if you feel like you have a conflict then you know the can the district money then okay I allotted for that so okay that's fine so Nathan are you the applicant so you are so we'll have we'll have we'll have one speaker here we can have you back up um Baree Barrett yeah would you like to come up sure oh you're with the city I'm sorry you didn't have to but yeah um I just wanted I um the project manager for um some of the work we're doing over for the Main Street House and the historical village my name is Bree Barrett um I'm with City of Tulsa um City Architectural Building Services which is a division on parks and recreation and um I just wanted to speak about this it's gonna really help um the area uh and the goals for the user groups which is the Tulsa Route 66 Main Street House as well as the historical village.
20:53Okay any questions Ms.
20:55Barrett Okay thank you for coming that is all our speakers move to approve item number four per staff recommendation second okay we have a motion by Commissioner Craddock a second by Commissioner Turner Addison for the approval of item four per staff recommendation all those in favor opposed uh abstained recused that item is approved item number six six Mr.
21:26Chairman before Austin gets there can I read my uh spiel and my role you can go ahead and ask awesome to take a minute in my role as senior advisor for housing in the mayor's office I met with this developer and discussed this proposal uh regardless of those discussions I believe I can remain impartial and unbiased and will base my vote in this matter on the information provided and heard at the hearing today.
21:49Uh item number six is a uh minor plat for a new subdivision called Flat Rock Ridge.
21:56Um the planning commission has actually heard um a preliminary plat for this property prior um previously it was called flat rock terrace um their original preliminary approval expired in February and so they are ready to move forward and get this filed all of the infrastructure is in place um and been released by development services so we can process it as a minor plat which basically means after this meeting uh we can go straight into the signature process with the city council and the mayor um with that uh we recommend approval um a couple notes on the cover page that I sent you an updated uh version it is not three and a half acres it is 78.6 acres um and in addition to that uh staff is not tying any conditions to this request um all of the infrastructure and everything has already been addressed so um we are ready to move forward um and just recommend approval okay any questions for Austin thanks sir is the applicant here are you in agreement with staff recommendation okay we don't have any speakers move approval of item six okay we have a motion by commissioner turner addison a second by commissioner whitlock for the approval of item six per staff recommendation all those in favor opposed and that is approved item number seven Mr Chairman if I could read my feel again these are kind of related developments but uh again in my role of senior advisor for housing in the mayor's office I met with this developer and discuss this project regardless of those discussions I believe I can remain impartial and unbiased and will base my vote in this matter on the information provided and heard at today's public hearing um item number seven is another minor plat for Phoenix at 36th Street North or Phoenix at 36 in what this is is another uh plat this is a multi um or I'm sorry mixed use uh subdivision um so it's the Phoenix at 36th Street North it already has building permits and is constructed uh they were granted an accelerated release similarly to the previous application their preliminary plat um expired um and they're ready to move forward so we do have a release um infrastructure is in place um by the applicant and also there's infrastructure as a part of a capital improvement program um that was put in place so uh staff recommends approval okay any questions for Austin is the applicant here are you in agreement with staff okay thank you we we're interviewed no speakers move approval okay we have a motion by commissioner turner addison a second by commissioner craddock for the approval of item seven per staff recommendation all those in favor opposed and that item is approved um item number eight is a preliminary plat so it has been continued twice um by the commission it is located at the southwest southwest corner of east forty first street south and south 145th east avenue it is a single family subdivision zoned RS5 um I did send an amended staff report today um showing their
25:11Is a preliminary plat.
25:12So it has been continued twice by the commission.
25:16It is located at the southwest southwest corner of East 41st Street South and South 145th East Avenue.
25:22It is a single family subdivision zoned RS5.
25:25I did send an amended staff report today showing their new alignment on the plat.
25:33Staff recommends approval in addition to that approval.
25:37Staff also recommends approval of a modification of the subdivision and development regulations to increase block length.
25:44We worked with the applicant and they were able to add another connection point and eliminated a previously requested modification for the length of a dead end street.
25:54So they did accommodate us there.
25:57Staff does recommend approval of both the preliminary plat and the modification.
26:08But City Legal drafted a sample motion for you all that you might want to use.
26:14So I will just hand that out.
26:20But staff does recommend approval.
26:22Any questions for Austin?
26:24Okay, thanks, Austin.
26:27Is the applicant here?
26:28Would you like to come up?
26:41Good afternoon, Commissioners.
26:42My name is Kevin Mavers.
26:43I'm the director of development services for the Robson Companies 901 North Forest Ridge Boulevard in Broken Arrow.
26:50Um Third Times the charm.
26:52Thank you so much for uh granting us the uh additional time to work out some of our details.
26:58One of the things we wanted to do was uh ensure that we were bringing forward the best possible development with the uh most number of units that would meet a variety of housing types and sizes and styles.
27:10What you have in front of you today is the result of the last couple of three or four weeks of revisions.
27:16The major revision is down in the southeast corner of the site.
27:21We did have a uh a portion of the property that was originally going to be a rent-to-own type unit or a book build-to-rent type unit.
27:30Uh that particular uh builder decided that they did not want to be a part of this project.
27:35So we went back to our other developers, our other builders, and they decided we'll take another neighborhood of our small lots.
27:42We have designed this intentionally with all of our most compact lots adjacent to the street and away from the existing developments, and then they gradually get larger.
27:51They go from the uh the smallest ones to the medium-sized ones to the larger ones, the further you move west and the closer you get to the other development.
27:59Uh one of the unique uh aspects of this particular project is we have nearly 20 percent open space thanks to some of the flood areas.
28:08We also have a very large easement.
28:10You'll see along the which was discussed by uh Austin a minute ago, the easement along the easterly uh property line there that is for a future significant transmission line.
28:22I believe it's an 84-inch transmission line that's going to be coming uh through that area.
28:26So we are providing space for the city of uh uh Tulsa to go ahead and provide water to the balance of the city.
28:33So with those thoughts in mind, unless you have any questions.
28:36I do have our engineer with us if there's any specific engineering questions, but if you have any questions, we are here to answer questions, and we look forward to gaining your approval.
28:45Okay, any questions for Mr.
28:48Okay, thank you, sir.
28:50We do not have any speakers.
28:54I will make a motion for the approval of item eight per staff recommendation subject to the conditions noted in the staff report and including approval of the phasing plan consisting of two phases and approval of the requested modification to section 5-030, table 5.1 of the subdivision and development regulations to permit greater block links for blocks 10 and 16 for the rezoning stated in the staff report and provided by the applicant.
29:24Second any discussion?
29:28We have a motion by Commissioner Walker, a second by Commissioner Humphrey for the approval of item eight.
29:34All those in favor, opposed, and that item is approved.
29:46Um item number nine is actually the same request, so it's a preliminary plat approval uh located at the southwest corner of East 31st Street South and South 193rd East Avenue.
29:55It is a single family subdivision and that will also be requesting uh modifications of the block length.
30:02Similarly, they have significant floodplain on the property that will cut off certain portions of the development.
30:10Staff's in agreement with the modification of the subdivision development regulations.
30:43So with that staff recommends approval.
30:47Any questions for Austin?
30:51Is the applicant here?
30:52Are you in agreement with staff recommendation?
31:04Good afternoon, Chair, Commissioners.
31:07Eric Enyard with Tanner Consulting at 5323 South Lewis Avenue Tulsa.
31:12I'm also joined here with the client.
31:16We are in essential agreement with the staff recommendations.
31:20I did want to point out we had a very productive technical advisory committee meeting, including with uh the county about the roundabout design.
31:31And we'll be working through uh the IVP process in concert with staff to make sure that all of these several moving parts are all in alignment ultimately.
31:43A lot of these things won't be ready or fully designed or finalized until we get through the IDP process.
31:49So when it comes to the alignments of the sewer line, the new water line, the easements that are needed from this property, uh they will be in fully fully in concert with uh the needs of the city and in balance with the client by the time we get through the process.
32:07So, yes, uh in agreement as stated.
32:11And if you have any questions for me, I'll do my best to answer.
32:14Any questions from Mr.
32:16Okay, thank you, sir.
32:19We don't have any speakers.
32:21So I will make a motion for item nine that we approve per staff recommendation subject to the conditions noted in the staff report and including approval of the phasing plan consisting of two phases and approval of the requested modification to section 5-030 table 5.1 of the subdivision and development regulations to pend a greater block links for the reasoning state in the staff report provided by the applicant.
32:49Okay, we have a motion by Commissioner Walker, second by Commissioner Humphrey for the approval of item nine.
32:56Opposed, and that item is approved.
33:08Uh item number 10 is another preliminary plat.
33:11Um there are no modifications requested on it.
33:13It is located at the east east of the northeast corner of East 41st Street, south and south 177th East Avenue.
33:19Uh the commission um in a relative terms uh recently heard a rezoning request on this property uh that I believe has been approved by city council and is pending ordinance publication uh to become effective, so that will become RS5 property.
33:33Um it's a 40-acre tract consisting of I don't have it in front of me, but um uh a decent amount of lots.
33:45Um there is a decent amount of floodplain shown um on the the face of their plat that they are working through um to pull that into their reserve areas.
33:55So um with that noted staff does recommend approval.
33:59Okay, any questions for Austin?
34:09Motion to approve item 10 for staff's recommendations.
34:14Okay, we have a motion by Commissioner Humphrey, a second by Commissioner Shivill for the approval of item 10 per staff recommendation.
34:24And that is approved.
34:34Uh if you don't mind, I would like to discuss item 11 and item 12 together.
34:40Um so this is another preliminary plat.
34:43Um associated with the preliminary plat is a request for an accelerator release of building permits.
34:48Um and just to remind the commission what that is is uh they are able to start construction and get building permits um prior to all the infrastructure being in place and prior to the plat being filed.
35:00As a part of that, they will also uh provide financial guarantees for the infrastructure outstanding um at a hundred and ten percent the value.
35:08Um the actual request is located in the northwest corner of East 51st Street South and South 136 East Avenue.
35:16Um this is a pretty exciting project, um especially if you travel along the BA and need something to look at.
35:23It will be a new uh church for the church of uh Jesus Christ of Latter-day Saints, and I apologize.
35:30I think it will be a meeting house and a temple, uh, which is one of the first in Oklahoma.
35:35Uh staff does recommend approval of both the preliminary plat and the accelerator release.
35:41Okay, any questions for Austin?
35:44Is the applicant here?
35:46Are you in agreement with staff recommendation?
35:51We do have one speaker.
35:58Would you like to come?
35:59I'm on the venture remaining.
36:01Oh, you're 13, sorry, it says 12.
36:05I'll have you back up.
36:09Uh then we do not have any speakers, so we are in review.
36:14Together, Jeff, that's fine.
36:19Move approval of items number 11 and 12 per staff recommendation.
36:26Okay, we have a motion by Commissioner Shivill, a second by Commissioner Turner Addison for the approval of items 11 and 12 per staff recommendation.
36:35Opposed, and those items are approved.
36:41Chair, if I may, my last time today, uh, just letting you know that uh in my role as senior advisor for housing in the mayor's office.
36:48I've met with the developer of these two, 13 and 14, and have discussed these this project.
36:53Regardless of those discussions, I believe I can remain impartial and unbiased and will base my vote in this matter on the in on these matters in the information provided and heard at today's public hearing.
37:07Umil, if we could take items 13 and 14 together, um it uh item 13 is a preliminary plat for the ventura at Mingo.
37:17It is a uh proposed subdivision north of the northwest corner of East 91st Street uh in South Amingo Road.
