So item number four, this is a city rezoning case, Z7862, located east of the northeast corner of South Harvard Avenue and East 27th Street.

This is a continuation of a project that's happening immediately west of the subject property and was previously rezoned with the almost an identical application.

The comprehensive plan in this area has anticipated for some time that the properties on the north side of 27th Street and up against the Broken Arrow Expressway would likely become some sort of commercial or multiple use zoning category.

The project that's happening on the west side has come up with some future expansion plans that would utilize that property to the east, and so they've asked to also rezone that property from RS3 to CG.

The CG is consistent with that multiple use land use designation that exists on the property, and we had no issues with the rezoning.

I live at 6730 South Birmingham here in Tulsa, and I represent the owner of this project.

Uh the owner of the project, Nick, he lives in South Tulsa, and he operates three restaurants presently in the South Tulsa area.

Uh this site is located on uh 151st Street South.

It's adjacent to uh Bixby City zone or property within the city limits of Bixby, and it's between Lewis and between Harvard.

Uh, we are in the Bixby fence line, so we've had contact with the planner at the city of Bixby, and as a result, you received an email from uh the city planner.

Uh this particular area, if you're not familiar with it on the 151st between memorial and highway 75 is exploding with housing, both in Bixby and in the county, and it's very interesting.

Right now, uh, having been in that area for over 60 years of my lifetime, that there is literally no places to have uh to buy food or professional services unless you're in memorial in Bixby or Highway 75 in Glenpool.

And so what this owner who owns this property would like to do is he would like on this 2.7 acres, which are bounded to the uh east by an a subdivision that's under construction right now, and they have in the city of Bixby, and they have a portion of theirs already zoned CG, and so I spoke with that owner.

They were thrilled with the project, and I've known that owner for many years, and we would like to do one building, and in it he wants to open up a restaurant.

That's what his business is, restaurant.

In this building, he wants to allow some 25 foot wide spaces on the end of the building.

So if there's professional service that would like to uh come in and uh be a part of this project, then that would be available.

The interesting thing why we included the residential, if you will, is recently, mean recently in the last 12 months, being in Kirkwood in Missouri and in a suburb of Kansas City, they had some similar projects with restaurant and/or professional services, and above they had what they had were you call them a townhouse, or you could have living quarters, and uh they were really nice.

And so the owner he said, Well, uh put that in, don't cut me out because I may get some interest in someone wanting to live there, and if that's the case, there would be like four residents.

They would enter from the back, but that was just as an option that he wanted to include in there.

It's our understanding right now.

If you're familiar with that area, which I know that you are, that a mile to the east, a Walmart super center is planned uh for the future.

You're also aware of what's recently transpired, and I believe uh Senator Mark Wayne Mullen even expressed that the the it's moving forward to get the bridge built between Tulsa and the south side of the river to allow more traffic to come to the south, and so with that, my owner believes this is a great time for his 2.8 acres to be moved forward with a restaurant because he believes that uh being first, and with the type of restaurants that he does, and he's got a great track record, that it'll be advantageous for this area with those many rooftops that's in that.

So, with that, he respectfully request uh this property rezoned to CG for that reason to for those uses and uh the approval of the PUD and the rezoning.

Uh I know that you've received uh today from Lindsay Perkins, who is a developer, been a long time developer.

He has property that's to the west.

I called and left word on the recorder, but I didn't get a ref uh turn phone call.

Uh the property right next to me uh is uh that owner.

I spoke with him on the phone and sent an email.

He just wanted me to keep him in the loop on everything that was done because he told me he said I plan on doing single-family residential within the next 12 to 18 months.

So he'll be bringing his property in for single family residential, and so between the uh owner to the east, which is 1540 Harvard Avenue LLC, and his, they will surround our 2.8 acres with single-family residential, and so they will wrap around it.

Uh so with that, um, be more than happy to answer any other questions.

Uh I know that Lindsay requested a continuance.

I'm asking that you consider this, and that uh we will make sure that we either get with Lindsay or Brandon uh to show them what we're doing, as it is just one building.

Uh, the city of Bixby did their one thing when I talked with them in person, not via email, is they want to make sure that we maintain the same standards with regards to the front and the sides that face the road as what they require in Bixby.

They said we don't know exactly what the county does, but we since you're in our fence line, we want you to maintain that, which means that we're gonna be masonry on both the east and west side in the front, will be masonry as well, and so uh we've done some other buildings over at Glenpool that are nice with masonry, and we believe it'll be a good fit, and we'll be there for these additional rooftops that are in that area.

I've not had a face-to-face meeting with any of them at this time.

Uh I just knowing them except for the one, just making the phone call to them to Sam Hollinger, uh, to the north 151st Street, making the phone call to uh uh Ken Laster, which I've known for 40 years.

So I was just making phone calls since I were familiar with them as opposed to trying to go to their office and sit down with them and present this PUD to them.

Um, this is a very uh uh interesting area, as you guys know 151st Street, yes, and go commercial, yes, there's a lot of high-end residential there.

My father did do uh a development that's 325 feet away from this property, and so he didn't get noticed, uh, which is unfortunately 25 feet past what notice, but you would think that since there's about 40 million dollars worth of houses going up out there, they might be notified, but and also uh uh Mr.

Well, we didn't find out about this until uh a day and a half ago when Mr.

Sereny, who's to the left west of us, uh, the west of you all, when he got a phone call from the owner's agent and said, Oh, by the way, do you know that there's a zoning case going on?

He didn't open his mail, but um and I guess that's when there was a phone call made.

But so this wasn't smoothly done months ago or whenever the planning process happened.

Uh, this is all of a sudden everybody's running around going, Oh my gosh.

So I just request that continues just so we can know what's going on.

And I know that uh you've said that maybe there's a restaurant there, and and maybe you'd be re be able to restrict that to its only restaurants or something, but I know just a broad commercial broad brush allows for a lot of things that maybe at the neighborhoods don't want.

And so are there some things that you might pull out of there, or would you agree to maybe some break requirements more than what the city does?

Item number 10 is a extension of a preliminary plat request uh for a subdivision called Fraser's edition.

Uh, this is a subdivision plat on uh almost 16 acres located at the northeast corner of West 51st Street South and the Gil Creese Expressway.

Uh the original preliminary plat for this was approved back in 2024, but there has been some ongoing issues with the property owner and with the Oklahoma Turnpike Authority and determining who manages access to the frontage road that is owned by OTA in front of this property, which has caused several delays in them being able to get their final plat recorded.

Um they've made a lot of progress on the required infrastructure and other things required to serve the subdivision, but as we continue to work through the issues with access, um, we're supportive of them getting another year extension on their preliminary plat, and so we recommend an approval of that one-year extension.

There were a few lots proposed as part of the subdivision.

This one is for Maybell Villas 2, which is located south of the southeast corner of West 81st Street, South and South Maybell Avenue.

Uh as the name indicates, this was phase two of a Maybell Villas development occurring there along Elwood.

There were some delays experienced in phase one that waterfalled into issues with phase two getting completed.

They are also continuing to make progress on all the required infrastructure as it relates to that subdivision, but they were running up against their expiration date of their preliminary plat.

So they have asked for an extension of that as well.

Um we have no objections from either TAC or otherwise to the extension, and so we recommended approval of the one year time frame.

Yeah, Sarah means so this looks like residential, it looks like roughly 60 units that.

So this is actually it's a little deceptive if you're looking at the plat in your packet because the real subdivided lots on the south side are Maybellville is one, which is already completed.

This is the area north of that, which actually contains eight lots-ish, I think.

Those really big lots.

Yeah, the very large lots um that are done in conjunction with the first phase of Maybell Villas.

Um, but you can see that the street for Maybell Villas, the first phase was constructed along that northern property line, and I think that there were some delays in getting all of that worked out.

So that's what's led to this project getting pushed back a little bit.

But so phase two is platted as we're looking at it, those eight yards lots.

Hi, good afternoon. Not much today. Um we had um a case on the west side. It was a landscaping business that was approved at City Council for CG. It was at 49 West 49th in Tacoma. Uh we had another case that Plan Commission recommended approval of that was withdrawn by the applicant before city council. This was one out east on Admiral Place and 177th East Avenue. The request was to IL, and um, so the applicant withdrew. May come back at some future date. And that's really all I have. Thank you. Any questions about any questions for Susan? Thank you. Commissioner will first hear from the staff for an explanation of the application, physical facts of the property under application and the surrounding property, followed by a presentation of the staff's recommendation. Commission will then hear for the applicant's presentation not to exceed 15 minutes. Next, the commission will hear for any interest party or protestants. A time limit per speaker may be imposed. Those wishing to speak must use the sign in over to my left by the door. For the record, please state your name and address if you choose to speak. Finally, the commission will hear the applicant's rebuttal if any, not to exceed 10 minutes. During the hearing, the commission may ask questions of staff, the applicant, or interested parties in the room are representing the city legal department and development services department and the Tulsa Plenty Office staff.
