Public Comments & Testimony
- Mayor Maddox: Expressed deep sadness and personal tribute to Brian Harden (a friend and businessman) following his sudden passing. The Mayor noted Harden's significant, anonymous financial support for the "First Tee" program and his role on the Paraboard. Several council members echoed sentiments of shock and acknowledged Harden's 30+ year support of talent search programs.
- Council Member: Inquired about the potential for future subdivision of the Grammar property to "clean up" annexation lines, noting the current "zigzag" border. The Mayor acknowledged the need for cleaner lines but noted the current request is not against code.
Discussion Items
-
Property Maintenance (3113 & 3153 Riggs/Ridge Road): Virgil presented reports on two properties with long-standing condemnation issues (approx. 5 years).
- 3113 Riggs Road: Owner has begun minor repairs (boarded windows) but lacks permits. Virgil recommended a 90-day deadline to obtain permits and start major work (roof, siding, windows, electrical). Council members discussed shortening this to 30 days, citing concerns about owners "dragging it out" with minimal work. Council agreed to a tighter deadline (approx. 30 days) to ensure serious intent.
- 3153 Ridge Road: Original owner deceased; widow has not made major repairs despite condemnation proceedings. Virgil recommended moving forward with condemnation. Council noted the extensive cost of repairs (likely full rewire and code compliance) and the property's open nature to the public.
-
Zoning & Annexation (Grant McCabe):
- Context: A small property (14310 Santorini St) outside city limits is being annexed and rezoned from SFR1 to LR (Low-Richard Residential? Note: Transcript ambiguity on expansion, likely Low Residential or specific multi-family code) to match the adjacent property inside city limits. This involves land exchange to fix property lines and allow construction.
- Discussion: Council clarified that the rezoning aligns with existing surrounding zoning (LR) and that the annexation is necessary due to the property's location relative to city limits.
- Gas Station Annexation: Confirmed annexation into city limits for a rezoned gas station, recommended unanimously by planning.
-
Annexation (Jonathan Grammar):
- Request: Approximately one acre on Nickel Park Road, including a "zigzag strip" and a house. The owner seeks annexation to ensure city school attendance for his children.
- Background: Planning Commission previously denied this by a 5-2 vote in October due to concerns over setting a precedent for selective annexation (annexing only strips rather than full lots) and potential commercial避税 (tax avoidance) implications.
- Council Deliberation: Council discussed the unique nature of the request (school district boundary). Council members expressed that while selective annexation is generally "not best practice," this specific instance appears unique. The Mayor noted no adverse comments were received, and the family owns the surrounding property. Council voted to approve, with a caveat that future subdivision might be required to "clean up" the property lines.
-
Administrative Updates: Council reviewed numerous budget amendments (FY 2026), code amendments (Section 1942), and public works contracts. Council also noted the upcoming unveiling of the Marshall 4 statues and the observance of Veterans Day.
Key Outcomes
- Unanimous Approval: Minutes approved.
- Conditional Approval (Property 3113 Riggs Road): Owner granted a tightened deadline (Council suggested 30 days, initially recommended 90) to pull permits and begin major repairs on condemned property; failure to comply may lead to further condemnation action.
- Approval (Property 3153 Ridge Road): Council agreed to move forward with condemnation proceedings for the property occupied by the widow of the former owner, citing lack of major repairs and severe condition.
- Granted: Annexation request for Grant McCabe's property (rezone SFR1 to LR) to align property lines and match adjacent zoning.
- Granted: Annexation request for Jonathan Grammar (Nickel Park Road) to include the house and a strip of land for school district purposes, despite previous Planning Commission denial due to precedent concerns.
- Scheduled: Adoption of Zoning Amendment No. 23 for December 9, 2025.
- Executive Session: Council moved into executive session to discuss pending litigation, security plans, and preliminary negotiations in commerce.
- Note: Councilmen noted the unexpected passing of Brian Harden and his legacy of support for local youth programs.
Meeting Transcript
Good gracious. Is there a motion that we approve the minutes? Some of them. Second. Motion second. All favor say aye. I minutes approved. Okay, Virgil. You're up first. So we got two for y'all this evening. First one's 30 uh 3113 Riggs Road. The owner has started making some minor exterior repairs. He does have the windows boarded up and secured. He has not pulled a permit yet to start work, but they will be here to represent the property. He says he wants to save it. How long is it? What's their recommendation? I told him I would recommend to give him 90 days to get a permit pulled and get started making the proper repairs for it. If they do that, I mean I have no problem with them fixing it. It's either fix it or get it tore down one of the other things. We've been dealing with this one for quite a while. That was my question. Is this not the first time this is when it's coming up? For condemnation, yes. It's been in our property maintenance proceedings for about five years. So they would they would do a little bit of work, get it out, it would go back in. So that's that looks like there's gonna be a whole lot of work to that roof. It's gonna need a new roof, new siding, all new windows, uh, new electrical panel. It's gonna be an undertaking. They there someone will be here tonight to represent this property. And you say it's been in for five years. Yes, sir. In the property maintenance. That's a huge expense. I don't like to see people dragging out. We're doing just enough to get by. Repair in a rental house. Virgil, I mean, would you all be against only doing 30 days? I have no problem with only doing 30 days. I don't know. I would much rather see it. That's serious, right? Give them a give them a uh tighter deadline. Yeah, uh to at least get the permit pulled, get started on some major repairs. I'm okay with 30. I don't I'm not real sure. It's been in that long, I'm not real sure, but okay. We'll know whether it's serious or not. All right. The next one's right down the street, 3153 Ridge Road.
