See everybody and we're right in December.

0:04

Is there a motion we approve the minutes?

0:05

So mock.

0:07

Motion second.

0:08

All in favor say aye.

0:09

Any opposed?

0:10

Minutes approved.

0:11

All right.

0:12

Virgil.

0:18

Unfortunately, somebody not paying attention to what he was doing.

0:22

Have seven on the menu for y'all to get seven.

0:25

First one is 2711 24th Street.

0:28

This one was uh postponed or put on the burners for uh 30 days, I believe it was, but the owner has decided just to quit fighting this one and let this one go.

0:40

So we will be voting this one to be condemned tonight.

0:43

Well they put it into it, hasn't it?

0:46

This one here now.

0:47

Oh, they have is that the one that was the this one that was the air property?

0:50

Yeah, this is one of the one of the ones that's an air property.

0:53

Yeah, somebody wanted to keep it, somebody wanted to they were they were debating it, but they they knew that it was a lost cause.

0:59

So they they said they couldn't fight it anymore, just let it go.

1:03

So there will be nobody here for this one.

1:05

Okay, and we will be voting just uh go ahead and demolish this one.

1:10

Yes, no, my last one.

1:12

So the next one is 3113 Riggs Road.

1:17

This one here is another multiple air property.

1:21

Uh the gentleman sent his brother up here last time, and he really didn't understand what he was up here fighting for, but the man you can see has at least boarded up the property.

1:34

He cut the tree off of the roof.

1:38

That's about all he's done so far.

1:40

He has pulled a permit.

1:41

Um he has pulled a permit.

1:45

There has been no other repairs made to date.

1:48

This guy lives in Texas.

1:50

Why does that look why those windows?

1:52

Why does that look better than that?

1:54

Are those dates right?

1:56

Yes.

1:57

Well, because you well, you can you can't see you can't see the rotted wood because of the tree.

2:01

Okay.

2:02

In the top one, and I'm saying those windows don't look bad.

2:05

Oh, yeah, but they it the front windows were busted out, and we we make them secure the house if they're gonna let it sit there for any length of time so squatters don't get in.

2:13

And you said the owner of this property lives in Texas.

2:16

Lives in Texas.

2:17

Well, they'd be here today.

2:18

No, he's not gonna be here today.

2:19

He wanted to do a zoom call, but we don't do zoom calls anymore.

2:22

He did uh submit a an email um saying what he was going to do, what he wanted to do.

2:30

I will tell you this, he tried to get a grant, and I told him when he tried to get it, he wasn't gonna be able to, and he wasn't because of the there's no clear title.

2:39

He does want to make the um repairs.

2:43

He's asking for 90 days.

2:45

I I don't see enough improvement in my opinion to to grant it.

2:50

Uh so I'm gonna I'm gonna leave this one with y'all on that.

2:53

Uh mine is still to condemn on this one.

3:01

But he doesn't have a clear file.

3:03

No, sir.

3:04

No, sir.

3:05

There's like eight different uh airs, some of them have died, so then it's gonna even go further down.

3:12

We don't know how many airs possibly could be involved in this one.

3:17

We just need to take it off our plate.

3:19

I I in my opinion, yes.

3:21

Uh there will be somebody here to speak on behalf of the property, but it will not be the only the the person trying to save the house.

3:30

All right.

3:32

The next one is 3153 Riggs Road right down the street.

3:35

Uh same thing, it was tabled uh on August 12th.

3:40

She has done nothing since we tabled this one.

3:44

I have not heard from her.

3:45

I tried to reach out to her this morning.

3:47

Voicemail was full, uh, so I texted her and let her know about the um hearing tonight.

3:53

Uh she has received her mailings, so but uh the last we talked the way she talked, I don't think she's gonna try to.

4:04

I mean she hasn't done anything that y'all ask her to do in the 30 days that you gave her.

4:08

So that's another one that I would just say go ahead and vote this one to condemn if they want to appeal, then they have that right.

4:19

All right.

4:20

Well that's all the old ones.

4:21

Now we've got some new ones.

4:24

2317 Jack Warner Parkway.

4:27

This one is the slab.

4:28

This is the old Jerry's Cleaners building.

4:30

Uh this is what it looks like today.

4:33

Uh the slab is still there.

4:35

When they tore the building down, for some reason, he left the slab there.

4:39

Uh this is Marcus Minges, he owns the property.

4:44

He said he had some use he wanted to use for it, but it's my understanding he has never presented it to the city.

4:50

So this one here just needs to come up.

4:55

So what yeah, what are we?

4:57

The slab.

4:58

Condemning the slab.

4:59

Pull the slab up.

5:00

Yes, sir.

5:01

Mr.

5:02

Benches will be here.

5:03

I don't know what he's gonna argue, but he will be.

5:06

Like we did after the tornadoes and so many every place.

5:08

Exactly.

5:09

So we typically I'm I'm not familiar with this word.

5:11

Why do we care if there's a slab there?

5:14

When when a house is when a property is demolished, they're supposed to remove everything and take it back to natural ground.

5:19

When he demolished this building, he did not.

5:22

And so but then you've seen the previous pictures, it becomes a place for him to use a storage lot, and that's not what it's designed for.

5:31

It's not a it's not an approved uh use for the property or anything like that.

5:36

The slab is supposed to come out, take it back to natural ground, then you can just maintain the grass.

5:43

Because even in the condition it's in now, you can see it's it's filthy.

5:47

It's it's an eyesore.

5:51

Nobody around there, I mean, it's gonna bring down the property values, and that's the whole issue with with this property.

5:56

This this started back when we were working on Jack Warner Parkway there, and I gave him he couldn't get trucks in and out of there because of the work that was going on there.

6:06

So what that was a year and a half project.

6:08

So he and then it's been sitting here like this uh for the last I I believe a year in the same condition.

6:17

The only thing he's done is got most of the stuff off.

6:21

Uh but he will be here to represent this property and the one right next to it that's up next.

6:26

About how long would it take a reasonable person to clean that off if they wanted it and not?

6:31

You mean to get rid of the slab?

6:33

Yeah, three days.

6:38

Literally three days, so he's the owner of the next property as well.

6:43

23 27, Jack Warner Parkway.

6:47

This is the old house's garage.

6:50

You can see multiple busted out windows, uh still trash, overgrown debris, all of these windows the the holes in the roof, the doors, it's open to the public.

7:02

He has uh you'll see here in a minute.

7:05

That's that was uh Friday when I was out there.

7:09

Those that's the way it's still in as of last Friday.

7:14

So people could go in there and light fire warm up and wanting to.

7:20

Yeah, there's there's ways to get in that building.

7:21

Plus, you see he's still storing stuff on the property even after being told by code enforcement to remove all trash, debris, and everything else.

7:31

I don't have a problem with him saving this building.

7:34

The building still is is savable if he's got a legitimate plan to do so, but he hasn't done what needs to be done to keep it there.

7:45

So I'll let him present his case for the building, and y'all can make your decision on that one.

7:50

Uh it's been here for a while.

7:52

My my recommendation, of course, is to demolish it.

7:55

If he keeps the building there, I mean it's not the building is not condemned.

8:02

Is that correct?

8:03

If he if he makes the repairs, makes it repairs.

8:06

The building is not condemned.

8:08

Right.

8:08

If the building is not condemned, and you can store stuff in there.

8:15

Yeah, he can use he could use it as a inside the building.

8:18

He can't store on the lot.

8:20

He can't just leave the junk outside.

8:22

He's got to maintain the property, fix the windows, fix all the doors so it's secured from the public, and then it could be used as storage because there's a lot of stuff inside the building.

8:33

There is a lot of stuff.

8:38

That's that's the that's how I like to give you because there's a lot of stuff in the building.

8:42

That's another word that begins with the S you might only use this.

8:48

And then this is the last one, 3620, 23rd Street.

8:52

This is a burn house.

8:54

Overall, um boy, my mind swept blank.

8:59

Anyway, this is on the west side as well.

9:02

The owners will be here to represent this house.

9:04

They have pulled the permit.

9:06

She said they've started doing some work inside.

9:09

Uh I haven't I can't get inside to see to prove if there's any work, but but there's been no repairs to the outside of this building yet.

9:19

She will be here to represent this house.

9:23

Where is that again?

9:24

I'm sorry.

9:25

That is over off of um uh it's on 23rd Street and on the west side, 3620.

9:32

This is the first time we've seen this one.

9:34

Yes, this is the first time we've seen this one.

9:36

Yeah.

9:37

So I mean, I wouldn't if she's if she gives you a legitimate plan of action, which like I said, she has pulled a permit, and on the permit, she has the right scope of work to make the repairs.

9:47

They just haven't started yet.

9:49

How long is that is she before the permit?

9:51

Uh within well, it was after I posted it for condemnation.

9:56

She she did pull the permit with all the speculations.

10:00

I mean the specifications of what needed to be repaired are on the scope of work.

10:05

She said, like I said, she says she started removing some of the walls inside the damaged walls.

10:10

I don't know.

10:11

I haven't seen that part.

10:16

I wouldn't have a problem with giving her 90 days to see what kind of progress they make on this one.

10:25

And that should be all I've got.

10:28

Oh no, no, wait a minute.

10:29

I'm sorry.

10:30

I forgot.

10:30

I do have one more.

10:32

4700 McFarland Boulevard East.

10:35

The old motel six.

10:37

Oh, yeah.

10:42

Okay, so this one here, though.

10:46

The owner had made a lot of the repairs to the front side of the building.

10:51

And then it just sat there for months upon months.

10:55

And then all the repairs that he made got busted back out.

10:58

Vagrants and squatters took it over again.

11:02

He has secured up everything.

11:04

He is back out there working on it actively.

11:07

As of Friday, he has a crew out there.

11:10

Actually, there's two crews out there working, finishing up the back balconies on it.

11:15

So he is making some repairs.

11:18

The owner will be here tonight to represent.

11:20

Does he have a plan that you know of to put it back up?

11:24

Yeah, he's he's fixing, he's trying to fix it back up to put it back in as a motel.

11:31

The original somewhere down the line there was some cross signals between our previous um director uh saying that there was a possibility that he could um partially open up this thing, but there was no way to keep it safe by doing that.

11:48

So that's kind of how we got to this position.

11:51

But you can see that he is making repairs.

11:54

Uh I was told that there is supposed security out there 24-7 now.

12:02

And it's our recommendation to give them 90 more days to see if they can move forward with the current repairs that they're falling.

12:11

The old motel six.

12:18

I don't speak of many properties, council.

12:20

This property, my 20 years of law enforcement has been a constant problem for 20 years.

12:25

It keeps going back and forth.

12:27

We're gonna fix it, it becomes full of homeless, people breaking in, it's a non-stop as far as a public safety aspect of it.

12:33

I believe this property needs to come down.

12:35

So I agree.

12:36

I agree with that too.

12:38

I will add counsel um that Mr.

12:40

Park, Mr.

12:41

Cam Parsons represents the property owner in this one.

12:43

He reached out to my office on Friday.

12:45

He is having some um he has some medical appointments in Birmingham and cannot be here tonight.

12:52

He asked that we that we table it for a month for him to be here.

12:56

I reached out to Mr.

12:57

Lanier.

12:57

Mr.

12:57

Lanier, I think understood and and certainly wants to move forward with this, but but from what we talked yesterday, didn't have an issue with with giving them time to let Cam be here.

13:09

It's not gonna change my mind.

13:10

I don't want to definitely want to give it 90 days, so I just say might just the tape.

13:14

30 days 30 days and 30 days, I believe he will either show the progress that y'all need to see, or or he's gonna show you this time again.

13:23

It ain't no progress.

13:24

He can show me he could, you know, like it's coming down.

13:27

I mean, a thousand.

13:31

Yeah, it's on the ground before I would have been comedy.

13:38

Cam chair.

13:39

Now the the owner will be here tonight to represent.

13:42

I know Cam's not gonna be here, but the owner or the person that's doing the work to it, he will be here to represent.

13:48

So that is more comedy if Cam.

13:56

They're probably gonna put Christmas lights all over because I doubt it.

14:01

It's awful, needs to come down.

14:02

Oh yeah.

14:03

Any other questions for me on this one?

14:06

That's seven tonight, huh?

14:08

Yes, sir.

14:08

I I kind of made a mistake when uh we we definitely wanted this one on here, and I accidentally put three others along with it.

14:16

So uh I apologize for for the error on the city.

14:19

Oh, that's why we get it.

14:20

That will not have to be.

14:24

All right, thank you, Virgil.

14:26

Okay, Zach.

14:31

I have a rezoning for you guys.

14:33

This is at um 2100 and 2102 Fifth Avenue East.

14:37

They're rezoning from SFR 1 to MR1.

14:42

And this is in Council District 2.

14:45

Um, so the location of the property.

14:46

So this is kind of in the Forest Lake area behind Midtown Village, close to Snow Hinton Park, um, just north of Hard Road, Hargrove Road.

14:56

Uh currently zoned SFR1, and then this is what it looks like today.

15:01

So there are some apartments around the area, um, and then some homes as well along 21st Street East, and then two homes on the property today.

15:11

Um they're requesting to rezone just to really increase the density on this lot.

15:18

Um so again, here's what it looks like today, and this is what they're proposing.

15:24

Um so five homes with some parking access off of 21st Street East.

15:31

These are some renderings of what that might look what those might look like.

15:37

Uh and so framework identifies this as traditional neighborhood edge, and so this zoning request does conform to the uh framework plan and it does the use also conforms to the framework plan, um, as you can see here.

15:51

However, um at Planning and Zoning Commission, they voted not to not to recommend this rezoning request by vote of five to three.

15:59

Um and you can see those yes and no votes there.

16:03

So is the yes not to or the yes to?

16:08

Sorry, I switched those or no is to approve.

16:11

Like the I guess the standing motion is to approve, and they said no.

16:18

Motion to approve, they voted no.

16:20

So five people voted no, three people voted yes to approve.

16:23

What was the debate or no button?

16:26

So I think Miss Howard can speak a little bit more on this because this is Mr.

16:29

Centel when we met with after the uh so um there was some discussion from one of the residents in the area, not really an opposition of it, but it just made me want to go back and speak with the developer again.

16:45

I did have some questions about things that become typical issues in the area such as pulling a garbage cars to the streets.

16:51

Yeah, what did we say about that?

16:53

Yeah, so are they doing a dumpster?

16:54

Are they doing individual garbage cars?

16:56

They're gonna do garbage carts, I believe, but they're they're essentially creating an HOA, which is kind of what you were uh pushing for to kind of regulate all of those items.

17:06

So I asked them for a stronger HOA, and um there like I said, there wasn't really opposition from the community, but just concerns that I needed to deal with again.

17:16

Who is right in the developer?

17:17

Yeah, it is, huh?

17:18

Who is the developer?

17:20

Um it wasn't anyone who I was uh familiar with, JL Pate construction.

17:26

I'm not sure.

17:26

I don't think I've heard of them before.

17:29

Oh, that's pretty much dead.

17:31

I don't see how they can happen H that would be effective to me.

17:36

They worked on it.

17:38

They they worked on it, they worked on it.

17:40

They went back to it and worked on it.

17:42

And so I'm the Little.

17:44

I'm I'm good.

17:45

So today I'm in favor of a movement forward.

17:47

Yeah, it's gonna be on the street.

17:48

Yes, yes.

17:50

Where is it?

17:50

I mean, is it about that one street that runs right behind it?

17:56

Right, yes, sir.

17:56

Yeah, you know that roundabout is right near there.

18:00

Coming from Jason's Daily, right?

18:01

Yes, sir.

18:03

So they they work really hard.

18:04

Central worked really hard to try to make this be an absolute upgrade for it.

18:10

Okay.

18:12

And then I have an annexation request for you guys.

18:14

This is Dominion Investment Properties, and I see about 40, 41 acres south of Akkadian Place.

18:20

So Mr.

18:21

Crow is familiar with this one.

18:23

Um, so this is south of Acadian Place in between Black Warrior um and River Bluff Drive.

18:30

Large, pretty large piece of property here.

18:32

Um they are requesting to rezone for city infrastructure for proposed resent residential development, which will have 23 residential lots that you can see here.

18:41

So they're accessing off of that existing stub street in River Bluff Drive.

18:46

Uh they met pretty substantially with the property owners and really worked on this plan to get it to a place where everyone was comfortable.

18:54

Um, because initially they had continued the request, met with them, and then a lot of the opposition ended up coming in in support.

19:04

Um, and so then it ended up being unanimously recommended for approval.

19:09

And they're just gonna stay SFR one but annex into the city.

19:14

Okay.

19:15

You good Norman?

19:17

Yes, promotion.

19:19

They work through a lot of issues.

19:21

That's all I got.

19:24

I don't have any commons.

19:26

We do have uh a few items for direct set.

19:29

Okay.

19:30

All righty, Brandy.

19:34

All right.

19:35

So I've got one to go over with you guys today.

19:37

Um, the police and fire pension board, there is a council appointee who's no longer a resident of the state of Alabama.

19:43

So you guys will need to find a new appointee for the police and power police and fire pension board.

19:48

Oh you want to advertise it or have we do that?

19:51

Yeah, we can advertise on there.

19:54

So there is already a retiree position for that particular board that is filled.

20:00

So this one is you couldn't put a retiree on the other spot.

20:02

No.

20:03

No, no, no.

20:03

So this is a good thing.

20:04

I'm gonna get asked about that.

20:05

So I just retiree position is already filled.

20:08

Okay, so the one we advertise for two weeks.

20:11

Sure.

20:11

Okay.

20:12

Scott or Calling How long do we anticipate?

20:16

Does that board continue in existence?

20:20

So after we fold into RSO.

20:22

Yes, the board will continue to act as long as they would like until they take action to either dissolve themselves or make themselves inactive.

20:32

What would they have to do?

20:34

They will have to take a vote as part of the RSA conversion process.

20:38

Theoretically, they could not they could vote not to dissolve, but all they would be asset list, and I can't imagine there being reasonable.

20:45

Well, there are sorry, there are final votes that will need to happen.

20:49

But there will the board will probably exist for about a year afterwards.

20:52

You'll have to have a final audit.

20:53

You'll have to have a file like uh you know filing of all tax forms and all of that kind of thing.

20:57

So it might continue on past that, but that will so whoever comes out, whoever's picked, it'll be there a year and a half most potentially.

21:11

Do we have to fix the one?

21:13

Do we need to replace this first?

21:15

I am not aware of there being any um quorum issues if you guys chose not to appoint someone.

21:22

Um would just say anybody's not bothering it.

21:26

So it will not bother.

21:28

I don't see any point.

21:29

And I asked.

21:30

I will say that the board's attorney uh inquired about it yesterday at the board meeting.

21:37

I don't I don't see I could be way off base.

21:40

I don't see that there's anything to do except vote.

21:46

Turn off the lights.

21:48

That's you know, what are we all thinking?

21:50

I don't care.

21:52

I really don't either, but I think we got an opening, just do what we've always done.

21:57

Okay.

This one was uh postponed or put on the burners for uh 30 days, I believe it was, but the owner has decided just to quit fighting this one and let this one go. So we will be voting this one to be condemned tonight. Well they put it into it, hasn't it? This one here now. Oh, they have is that the one that was the this one that was the air property? Yeah, this is one of the one of the ones that's an air property. Yeah, somebody wanted to keep it, somebody wanted to they were they were debating it, but they they knew that it was a lost cause. So they they said they couldn't fight it anymore, just let it go. So there will be nobody here for this one. Okay, and we will be voting just uh go ahead and demolish this one. Yes, no, my last one. So the next one is 3113 Riggs Road. This one here is another multiple air property. Uh the gentleman sent his brother up here last time, and he really didn't understand what he was up here fighting for, but the man you can see has at least boarded up the property. He cut the tree off of the roof. That's about all he's done so far. He has pulled a permit. Um he has pulled a permit. There has been no other repairs made to date. This guy lives in Texas. Why does that look why those windows? Why does that look better than that? Are those dates right? Yes. Well, because you well, you can you can't see you can't see the rotted wood because of the tree. Okay. In the top one, and I'm saying those windows don't look bad. Oh, yeah, but they it the front windows were busted out, and we we make them secure the house if they're gonna let it sit there for any length of time so squatters don't get in. And you said the owner of this property lives in Texas. Lives in Texas. Well, they'd be here today. No, he's not gonna be here today. He wanted to do a zoom call, but we don't do zoom calls anymore. He did uh submit a an email um saying what he was going to do, what he wanted to do. I will tell you this, he tried to get a grant, and I told him when he tried to get it, he wasn't gonna be able to, and he wasn't because of the there's no clear title. He does want to make the um repairs. He's asking for 90 days. I I don't see enough improvement in my opinion to to grant it.
