0:40

There we go.

0:41

Good morning, Your Honor.

0:42

Uh Daniel P.

0:43

Lewis on behalf of the City of Venice.

0:45

This one will actually be pretty quick today.

0:47

I've had an opportunity to recap you on this one.

0:49

This is there's this case is currently in probate because the title, the property owner is deceased, as I believe 11 years ago.

1:03

Since this is they are doing a summary administration of the estate based on based on the when based on the fact that the uh owner this again passed away 11 years ago.

1:15

So unfortunately, while again, as we just discussed last time, there's no personal representative being will be named.

1:21

However, they did file an amended petition to declare the property homestead to take it out to the probate, take it out of probate.

1:35

Um and that's he's expressed to me that order would actually work be work as a deed that would trans that would legally transfer the property to all the heirs, including Mr.

1:45

Neary, who's here today.

1:47

Um unfortunately, we're that puts us in the same boat as we are we were in last month, so we are going to request a continuance uh on this matter just to resolve that for 90 days just because at that point that gives them that gives them extra leeway time because if we did a 30-day one, they probably wouldn't have time to actually get the permits issued or anything if the you know ultimately even if the judge signs it within the within the next month.

2:12

So it's it gives it more leeway, it gives them more leeway to like actually get the order in, get the permits, and finish the work.

2:19

Okay.

2:22

Um Mr.

2:23

Neary, is there anything you wish to say?

2:26

Um, sir, I spoke with the contractor contractor, and then probably I am handled on the property.

2:36

Excellent.

2:37

Okay.

2:38

All right, so when is the that would then take us to March, April, May?

2:42

What's the date of the May hearing, Amanda?

2:46

That is May 6th.

2:47

Okay.

2:48

Okay.

2:49

So then based upon the request by the city to continue this for a three-month period, we will uh schedule this for the May 6th, 2026 Code Enforcement Special Magistrate hearing.

3:02

Um I believe that concludes everything we have for today.

3:06

As of right now, the only thing the um next the next special magistrate hearing is scheduled for March 4th at 2026 at 10 a.m.

3:15

Otherwise, that's it.

3:16

Summary of Proceedings

Special Magistrate Code Enforcement Hearing - February 4, 2026

The Special Magistrate convened on February 4, 2026 at 10:00 AM in the Council Chambers to hear a single code enforcement case, CEBD24-005 involving property once owned by Mildred H. Neary. The city requested and was granted a 90-day continuance due to ongoing probate proceedings and the need to finalize a homestead declaration to transfer the property to heirs.

Old Business: CEBD24-005 – Mildred H. Neary

  • City Attorney Daniel P. Lewis presented the case, noting the property owner died 11 years ago and the estate is in probate under summary administration. An amended petition to declare the property homestead has been filed; if approved, the order would effectively deed the property to all heirs, including Mr. Neary who was present.
  • Mr. Neary briefly stated he had spoken with a contractor and was handling the property.
  • The city requested a 90-day continuance (instead of 30 days) to allow the court order to be issued, permits to be obtained, and work to be completed.

Key Outcomes

  • The Special Magistrate granted a continuance until May 6, 2026 for the next code enforcement hearing. No other actions were taken.
  • The meeting adjourned shortly after the continuance was granted.
