- CEMI26-0018 John and Nancy Eiseman: The respondent was cited for watering at 7:00 AM on May 12, 2026, in violation of water restrictions. Mr. Eiseman argued he was out of the country from May 2-17 and did not receive adequate notice. The magistrate dismissed the citation solely because Mr. Eiseman was not in town during the violation, and ordered the $25 appeal fee refunded.
- CEMI26-0023 Samuel George Joynson and Anna McLean: The respondent was cited for watering at 6:35 AM on May 15, 2026. He argued lack of notice and that his irrigation system was partially micro-irrigation (damaged by a hit-and-run). The magistrate found the respondent violated Section 74-48, citing that the notice provided was adequate and distinguishing this case from Eiseman's because Joynson was in town. The respondent forfeited the $25 appeal fee and was assessed a civil penalty of $150 plus recording fees, due within 10 days.

Ready. All right, good morning, everyone. We'll call the July 1st, 2026 special magistrates hearing to order. Uh the first item is case number CEBD 2400524. Mildred H. Neary. And Your Honor, uh, based on this one, uh, we are actually going to dismiss this one or request a dismissal on this one because we got we got permits. Okay. Is that that's correct, right? For the record, uh Jim Davis, supervisor, community research officers. Um they they did receive the permit, they've been issued, and the work has begun. Good. Good. All right, thank you. All right, based on the sworn testimony and evidence presented. I find that respondent is compliant with the administrative order entered on October 8th, 2025. Respondent has put on notice that future violations of chapter 88 building regulations section 3.2 responsibilities for residential properties, including structures, vacant buildings, um, uh, and vacant or in unimproved lots of the city code of ordinances will cause the respondent to be deemed a repeat violator and subject to a fine of up to 500 per day for each new violation beginning on the day the violation occurred. All right, then we'll turn to new business. Uh case number CEZN 25-00088, Justin Junda. Is the city ready to proceed? Yes, Your Honor, and uh we also Mr. Boone Jackson Boot is here as well for the respondent in this case. Um through discussions with the between the city and Mr. Boone on behalf of Mr. Jundu, the with the parties have come to an agreement on this matter. We're going to agree to continue uh this case to our September docket. However, um Mr. Junta is going for a variance hearing this coming Tuesday, and we want to put it on the record that um if the variance is granted, um the respondent will move the fence in question to uh back behind the ECL or do me more accurate what's detailed in his plans um within 15 days of receiving the variance. If he does not receive the variance, then within 15 days he'll remove the unpermitted uh parts of the fence. Okay. On Tuesday, April 7th, uh 2026, I was contacted by the City of Venice stormwater engineer Steve Barns.
