The Virginia Beach Planning Commission held a public hearing on July 9, 2026, to consider a range of land use applications, including short-term rental regulations, mixed-use developments, and conditional use permits. The meeting included a formal session following an informal discussion. The commission deferred several items, approved a consent agenda of nine items, and voted on 11 regular agenda items, with most receiving approval. Key themes included addressing housing needs, balancing development with community concerns, and refining zoning ordinances.
Good morning, everyone. Thank you. Good morning. Good morning. And thank you, Planning Commissioners and City Staff for your participation today. My name is John Carlson. I'm the chair of the Genia Beach Planning Commission. Welcome to the July 8th informal session of the Gene Beach Planning Commission. Call this meeting to hold. For today's meeting. Just two quick things before we jump into the agenda. One, Chair Costan is going to make an announcement at the start of formal, but just for awareness, the closed captioning system is not working in council chambers. So there will be an announcement for the public if anyone needs some sort of combination for that. The other quick thing, just for awareness upcoming on your August agenda, we will have the text amendment proposal for data center. So that is forthcoming. And that's all I have. Sure. Good morning, um, Hannah Sabo Zodia Administrator. I am here to talking about the first two items, items one and two are both relating to the city's ordering zoning ordinance pertaining to short-term rentals. Um the planning commission was briefed on these during the last meeting. Um the items one and two both are looking at a change to the overlay within the oceanfront resort district, the specific overlay being the short-term rental overlay. Um, during the April 21st, 2026 meeting, City Council referred a resolution that was sponsored by Vice Mayor Wilson and then Council members Remick Shulman and Henley directing the planning commission to review review a revision to the oceanfront resort STR overlay district. And that was due to the proliferation of STRs at the ocean front and then the detrimental impact to the neighborhood from parking and then loss of housing stock. Uh the overlay boundary is proposed to be reduced in area. And at yesterday's city council meeting, they did approve an extension for 60 days for that resolution. So just to be aware of that for this planning commission, you don't have that um deadline of today any any longer. Um within the existing overlay, there's a hundred there's 331 permitted STRs, and the proposed overlay um would contain 281 STRs that are currently permitted. And uh so those existing STRs that are outside of the newly proposed overlay, but within the existing overlay, would be considered grandfathered, and they would be allowed to continue to operate so long as they don't stop operation for a period of two years or longer. Um we have done a lot of outreach uh for this update. We have gone to the old beach design review committee, the Bayfront Advisory Commission, uh the Resort Advisory Commission's Transportation Parking Pedestrian Committee, and the Resort Advisory Commission's Planning Design Review Committee. The Hampton Roads Realtors Association was also briefed. Um we of course briefed this group at the last meeting, and letters were sent out to all of the um properties within the boundary that would be affected. Um through that outreach, we've gotten a lot of neutral feedback, just like questions about what would happen uh to those existing short-term rentals. Um we explained the grant bothered process, and uh we did get two letters in opposition that were included in the supplements, uh, the last supplement that went out. We've received about 17 calls. Um again, those were mostly asking questions, and and then I would say generally neutral um on the change. Um, if there are any questions on that item. And so I'll just oh, sorry, go ahead. Well, I'm not sure I have a specific question. What I'm really wanting to say is this what's in front of everybody today, is an alternate map. Had work with my councilman with regards to public input, and it was looked at to be to be too great a reduction in the vibe area. So, unlike the previous map, this now extends permitted STRs up to 18th Street before it's been pulled back. Um so this is an alternate map that's in front of you from the one that was here a month or two before. I think because of that, we probably want to take the time we've been given and not vote on it now, so you all have a chance to see it and and talk about it. However, I will say that the time we gave this has given a lot of people the opportunity to ask questions, find out what's it's going to mean to them. I I will say this, so it doesn't really come out clearly in the regs. Abandonment you know of a non-conforming use, which is what it would be, uh is an enforcement issue. It becomes very difficult at times to understand abandonment, uh, particularly for an STR. So the likelihood of abandonment, I'm not sure is that great. However, what it does do, and I'm not sure everybody understands this within the district.
