1:20

Then I need a motion to approve the minutes from the August 10, 2026.

1:50

They'll give us some background information and those kinds of things.

1:53

If you have any questions for the city, you will have an opportunity to ask those questions.

1:57

We as the board will also have an opportunity to ask them any questions that we would have.

2:02

Then you will have an opportunity to come up to the microphone and provide us with any additional information that you would like for us to consider as it relates to your appeal.

2:10

Just ask, and I'll try to remind you when you come up to the microphone, please state your name in full and your current residential address for the record.

2:28

Unassigned speaker

2:31

It

Speaker 1

2:31

kind of ends up being a little bit of a dialogue back and forth between everyone until we can get all the information that we need to make our decision.

2:38

Then we will close down the testimony or talking portion of it, and we will deliberate an open forum.

2:44

You'll be able to hear our conversation, and then we will deliver a decision to you before you leave today.

Speaker 3

3:23

All right, we have one item this evening.

Unassigned speaker

3:33

So

Speaker 3

3:33

this is on the southeast side of the city, right by Minooka Park.

3:39

And here is their neighborhood.

4:04

As you can see in the diagram on the left, that's taken from our zoning code.

4:09

Um the light blue shading is a um not permitted location for accessory structures.

4:16

So normally the applicant would need to locate in the hatched uh white and gray portion.

4:22

Um, in this illustration, their house is their house's position would

Unassigned speaker

4:27

be

Speaker 3

4:27

um the right side house because it is a corner lot.

4:32

So normally the permitted locations for their shed would be in the rear yard or in the interior side yard.

4:40

And the applicant, um, this is the proposed uh rendering of the shed.

4:44

It would um be constructed to match the cladding and color of the uh principal building on the parcel.

Unassigned speaker

4:55

And this is the location roughly in their yard where they would like to locate the shed.

Speaker 3

5:05

The applicant's um argument for locating the shed in the street side yard um is related to the grading of their property.

5:12

Here you can see from our city GIS map, the topography lines in the rear yard and in the interior side yard, you can see that there's a steeper grade change, and the applicant said that they would need to construct um some sort of retaining wall or make changes to the natural topography of their yard, and that would result in other issues related to draining.

5:37

Um that they would instead like to locate their shed in a flatter portion of their yard in the street side yard.

5:47

Here's an image of the rear yard.

5:50

You can see back from their patio, there is quite uh a grade change down to the back of their parcel.

Unassigned speaker

6:00

Um

Speaker 3

6:00

in here in their interior side yard, not only is there a grade change, there's also a large mature tree where they might otherwise locate the shed.

Unassigned speaker

6:12

Um

Waukesha Board of Zoning Appeals Grants Dimensional Variance for 1730 Hunter Road Shed on October 12, 2026

The City of Waukesha Board of Zoning Appeals met on Monday, October 12, 2026, in Council Chambers at Waukesha City Hall, 201 Delafield Street, Waukesha, WI 53188. The agenda listed the meeting for 4:00 PM. Board members present were Tim Nickage, Christy D'Angelo, Eric Dunst, and Kevin Riley. The board approved prior minutes, heard one appeal, and unanimously granted Christopher Strike a dimensional variance to construct a shed at 1730 Hunter Road. The agenda attachment for the zoning denial letter is labeled 1720 Hunter Road, a discrepancy with the 1730 Hunter Road address used in the appeal, staff presentation, and applicant's testimony.

Consent Calendar

  • ID#26-04349: The board approved the August 10, 2026 meeting minutes. Tim Nickage moved approval, Eric Dunst seconded, and the motion passed by unanimous voice vote.

Discussion Items

  • No public comment was made from anyone not related to the pending appeal.
  • City staff presented the sole new business item, ID#26-04348. The property is a corner lot near Minooka Park. The applicable code, Section 22.03(6)(A)(4), requires a street side accessory building's minimum setback to be aligned with the street side elevation of the principal building. Staff showed that the rear yard and interior side yard have steep grade changes; the interior side yard also contains a large mature tree. The requested street side yard location is flatter and would be screened from Hunter Road and Guthrie Road by an approximately 28-foot-wide terraced landscaping easement held by a neighborhood/homeowners association. Staff stated the street side setback was the only code requirement at issue.
  • Christopher Strike, the applicant and owner of 1730 Hunter Road, testified that he currently has no shed, his garage is full, and he had been in discussion with the homeowners association but needed city approval before returning to the HOA. He said the proposed location is at a similar grade to the house and that he could pour a concrete slab if needed. He also stated he understood that, as the property owner, he is responsible for maintaining the terrace area.
  • Board members discussed consistency with an earlier similar case. Some members initially said the applicant had other permissible locations and expressed concern about setting precedent. Others found this case distinguishable because of the steep grades, the mature tree, the HOA landscaping berm acting as a buffer, and the value of HOA review. Members also noted that placing the shed in other allowed spots would be more difficult and expensive due to grade changes. The board concluded that the corner-lot conditions were unusual and that the requested location was reasonable.

Key Outcomes

  • The board unanimously affirmed all four required findings for a dimensional variance:
    1. Exceptional or extraordinary circumstances apply to the property that do not apply generally to other properties in the same zoning district.
    2. The variance is necessary for the preservation and enjoyment of substantial property rights possessed by other properties in the same zoning district and vicinity.
    3. The variance is not requested solely for economic gain or loss, and self-imposed hardship was not considered a ground for granting it.
    4. The variance will not substantially harm adjacent property and will not materially impair the purpose and intent of the zoning code or the public interest.
  • After the findings, a board member moved to grant the appeal and variance for 1730 Hunter Road; the motion was seconded and passed unanimously by voice vote.
  • The applicant was told he could take the decision to his homeowners association for the next step. City staff said a confirmation letter would be sent in the coming days.
  • A motion to adjourn was made, seconded by Eric Dunst, and the meeting ended.
