- An adjacent property owner raised concerns about an existing public access easement recorded approximately five years ago on a flag-shaped lot to the south. The owner wanted to adjust that easement.
- Scott McDonald, Director of Development Services, explained that staff learned of the issue just minutes before the meeting. After a brief phone discussion with the applicant and the adjacent owner, both parties agreed to proceed with the plat as submitted. The easement adjustment would be resolved later, ultimately removing the old easement and straightening access, which McDonald described as a "win-win" that would benefit both properties and simplify the plat.
- The chair clarified that the accuracy of the plat would not change. The commission then voted unanimously to approve the final plat.

I am Chair Brian McCallan and I call this meeting to order at 2 37 p.m. and announce that a quorum is present. Before we begin working through today's agenda, I would like to remind all applicant all applicants and interested parties that cases considered by this commission today will also be considered by the city council. City Council agendas are posted at City Hall at least three business days prior to meetings. City Council agendas can also be found on the City of Weatherford website at WW.weatherford TX.gov slash meetings. Okay, we will start with item 2A, approval of the minutes. This is to consider approval of the minutes of the planning and zoning commission meeting held October 8th, 2025. And the motion to approve passes unanimously. Moving on to item three. Actually, we're we're going to uh have a brief recess. Uh and so we're gonna pause this meeting right now and uh we'll come back online shortly. And with that, staff recommends approval of the final plot subject to all requirements of the subdivision ordinance. And I'm here if you have any questions. Um yeah, it may be good. Um Monica, could you would you mind give us a brief summary of of some of the discussion that was taking place on this item a few moments ago? Um in regards to the easement, I'm sorry. Yes, that's correct. So or whatever it was. There was a lot of action beforehand. And with respect to the anonymity, we don't need to know who or what was requested, just what was the general conversation? Yeah, so the there's a property to the south adjacent to this property as you see on the screen that has an access easement that was reported about five years ago. Um they're required to show it on this plat, and the and that property owner is now wanting to adjust that access easement, which is that conversation today. Okay. And just for clarity, um, it is it's that flag-shaped lot to the to the south. I think I guess that's the south of the lot that's being platted. Okay, okay. And and so we may um ask city attorney on this. Do we have any obligation as far as that's concerned? I mean, we um, you know, this all seems to be in order from our perspective. Uh, and you know, I think we would move forward with a vote. Is there anything else we need to consider in that regard? No, I think you're good to go, but um, if do you have anything you want to add to we were just explaining to the board kind of the issue that was raised. Uh Scott McDonald, director of development services. Yeah, ultimately we had an adjacent property owner that came in, had some questions about changing the public access easement, which was dedicated years ago. Um with a brief phone call with the the applicant and the adjacent property owner, this plat will be approved as is they can work through the details ultimately update the ingress egress public access easement to remove that and then straighten out that easement will be better for both parties, and I think it'll be a win-win. That way we're not holding up the applicant going through the process and we have it documented as such. Great. And yeah, so both parties will be able to proceed in the future and just have to take some steps to resolve this issue. Yes. And the accuracy of the plat doesn't change. I mean that's still. No, nothing, nothing on the plant will change other than that public access easement that was dedicated years ago and the curvature within it. But because we're getting dedicated right-of-way, this will clean that up and remove what that is. So it'll benefit the plat that's being provided today. They'll end up with unencumbered real estate, and it'll simplify our the the request of the adjacent property owner to straighten that out. Cool. Thank you. It's a win-win. And let me say apologize to the board. This this was just brought to staff's attention literally, like three minutes before the meeting started, and so there was no opportunity to have worked through or address this before just a couple of minutes ago.
