0:57

We have a couple of items on for today.

1:00

Um, and our first item uh will not be the uh committee report.

1:07

We're saving that for a second because we're figuring we're gonna have a nice long discussion on that.

1:10

Okay, but you guys are already at the table, so please feel free to stay.

1:14

Our first item on for discussion today.

1:17

Oh, I gotta take a 10 phone.

1:20

All right.

1:21

Can I can I see your pen again?

1:23

Thank you.

1:24

All right, so let's uh first let's take attendance first.

1:38

Here

Unassigned speaker

1:39

uh

Speaker 2

1:39

Minority Leader Cunzio, Legislator Barr.

1:43

1:47

1:51

and uh Chairman Gosh here.

1:54

Okay.

1:54

So everybody is here.

1:59

So now I believe we can start the agenda and take up the item.

2:04

Our first item on the agenda, which as I think most of the people sitting at this table already uh said in the floor earlier, is uh public hearing and a local law regarding the dissolution of the Westchester County Deferred Compensation Board.

2:21

We're taking this up again only because this matter was referred both to the uh budget committee as well as the legislation committee.

2:29

So here to just walk us through this again briefly uh is uh Justin Aiden from the county attorney's office agreed.

Speaker 6

2:39

Um thank you.

2:40

So uh as was discussed at the BA this morning, this law would repeal chapter five forty-three, which establishes the county's department compensation board.

2:50

As you will know, last year the board authorized the county to go to the New York State deferred compensation plan.

2:58

Um prior to that we had been running our own through various third-party administrators and how was our last one.

3:05

Um basically all the functions of the deferred compensation board um has been doing for the county, the new York State deferred compensation board does now.

3:16

So there really aren't any functions left for the county deferred comp board to do.

3:21

We had our last quarterly meeting, we had the state reps come down, we talked about the transition that occurred last year, how everything's been going, it's been very smooth, uh people have been very satisfied.

3:33

That's the feedback.

3:34

State gotten the finance department has gotten so um the deferred compensation board voted to recommend dissolution.

3:44

Umanimous among those who voted uh point of clarification.

3:51

Uh Mr.

3:52

Casciato, because he knew this was going to be coming to the full board legislators.

3:56

So he decided the same before.

3:59

Um but it was the recommendation of the deferred comp board to dissolve, and that's what this would do.

Speaker 2

4:08

Thank you for that uh explanation.

4:10

I know this was discussed previously, but are there any questions?

4:14

Uh oh, before I continue, let me just note we're we're also joined today by uh several legislators, uh non-members of the first

Unassigned speaker

4:24

uh

Speaker 2

4:24

legislator Eric Pierce, um, our minority, our majority with name Williams.

4:32

Our uh chair of uh uh board vice chair.

4:35

Oh, wait, you're on the year.

Speaker 7

4:39

And

Speaker 2

4:39

do we have anybody on I think uh that's everybody so thank you for uh joining us today.

4:50

Um so just to continue, uh as Mr.

4:54

stated, uh this is moving from the county to the state.

Unassigned speaker

5:00

stated uh this is moving from the county to the state um presumably to streamline the process and uh just facilitate things uh I see uh legislator U has a question.

Speaker 2

5:09

Mr.

5:10

Uli.

Speaker 1

5:11

Yes, thank you so much.

5:12

Uh curious if we as Westchester County will get representation on the state board that oversees the deferred con plan since I'm guessing we're a substantial part of the plan.

Westchester County Board of Legislators Legislation Committee Meeting – October 5, 2026

The Legislation Committee of the Westchester County Board of Legislators convened on Monday, October 5, 2026, at 1:16 PM (agenda time 1:00 PM) with Chair Smith presiding. All nine committee members were present, including Legislators Puja and Ulaj participating remotely. The meeting covered two major discussion items—dissolution of the Deferred Compensation Board and the Charter Revision Commission Report—followed by the approval of several routine receive-and-file items. The meeting adjourned at 2:34 PM.

Consent Calendar

  • Minutes Approval (September 22, 2026): The minutes from both the 10:00 AM and 1:00 PM meetings of September 22, 2026, were approved unanimously (7-0, with Legislators Puja and Ulaj recorded as away for both votes).
  • Receive & File Items (approved unanimously, 7-0, with Puja and Ulaj away):
    • 2026-267 (Memo of Legislation to improve cell phone coverage on county property)
    • 2026-428 (Memo to prohibit replacing county employees with AI)
    • 2026-429 (Memo to establish a Down Payment Assistance Program for first-time homebuyers)
    • 2026-430 (Memo to amend Chapter 542 for e-bike/e-mobility charging safety)
    • 2026-469 (Charter Revision Commission Final Report – received and filed)
  • Item Continued (no vote): 2026-308 (Memo to establish a Westchester County Office of Fatherhood and Family Engagement Advisory Council) was continued at the request of a member for further committee discussion.

Discussion Items

  1. Dissolution of the Westchester County Deferred Compensation Board (2026-486 and 2026-487)

    • Justin Adin, Assistant Chief Deputy County Attorney, presented the proposed public hearing and local law to repeal Chapter 543 of the County Laws, dissolving the Deferred Compensation Board. He explained that the county had transitioned to the New York State Deferred Compensation Plan in 2024, and the county board’s functions are now fulfilled by the state board. The county board had unanimously voted to recommend dissolution. Legislator Ulaj asked whether Westchester would gain representation on the state’s three-member board; Adin clarified that the state board is appointed by the governor, Senate majority leader, and Assembly speaker, and the county can communicate through state delegation channels. The committee voted unanimously (9-0) to sign both items and refer them to the full Board of Legislators.
  2. Discussion on the Charter Revision Commission Report

    • Chair Lyndon Williams and Counsel Mondaire Jones (Friedman Kaplan) presented the report, summarizing the work of the 21-member commission over 16 months. The commission received over 100 submissions, approved 74 recommendations, and categorized others as “not approved” or “approved for further research.” Key themes included:
      • Procurement and Contracting: Multiple departments (County Attorney, Environmental Facilities, Community College, Public Works) requested reforms to speed up approvals, eliminate outdated pre-qualification boards, and align with state law changes. Williams noted that these process improvements would have immediate operational impact.
      • Ex Officio Voting: Several requests addressed ambiguity over whether ex officio board members (e.g., on the Planning Board or Airport Advisory Board) have voting rights. The commission recommended clarifying that such members are voting members, citing quorum issues.
      • Elimination of Defunct Boards: The commission approved removing references to non-functional bodies such as the Consumer Policy Board and the County Records Commission.
      • Community College Alignment: Recommendations clarified that Westchester Community College is not a county department but a sponsored institution, and allowed it to adopt its own procurement policy consistent with county and state rules—three changes in total.
      • County Attorney Recommendations: A priority area, including updates to purchasing and bidding procedures to comply with changes in General Municipal Law.
    • Jones highlighted a significant concern: the county’s acts and local laws are not publicly accessible online in a codified format, which he called “appalling from a due process standpoint.” He urged the board to prioritize updating the county website to include all legislation, noting that practitioners cannot easily access current law.
    • Williams and Jones noted that most recommendations require only legislative action; a few that would affect elected offices require a mandatory referendum. The chair asked that the board act on at least some recommendations within the statutory six-month consideration window to honor the work of the volunteer commission.
    • Legislators expressed appreciation for the report and indicated they would begin prioritizing items for implementation.

Key Outcomes

  • Deferred Compensation Board Dissolution: Items 2026-486 (public hearing resolution) and 2026-487 (local law) were approved by committee (9-0) and referred to the full Board of Legislators for consideration.
  • Charter Revision Commission Report: The report (2026-469) was received, filed, and approved by the committee (7-0). No formal vote on individual recommendations was taken at this meeting; the board will consider them in future legislative sessions.
  • Next Steps: The committee will continue discussion on the Charter Revision Commission recommendations, with an emphasis on procurement reforms and website accessibility. The continued item (fatherhood office memo) will be taken up separately. All other receive-and-file items are now filed for potential future legislative action.
