To grant a variance requires a concurrent vote of four-fifths of the members of the board to reverse or modify determination of an administrative official requires a simple majority.

The subject property is zoned multiple dwelling 17 residential district, and the existing residential structure is shown on the screen in front of you towards the front of the lot.

The applicant has proposed to subdivide the existing parcel into two lots with a 20-foot wide private access easement into the rear lot that would come off of Wrightsville Avenue.

There's currently a 10-foot public alley to the rear of the lot that does not provide dedicated access for any of the existing or proposed lots.

The applicant has proposed to construct a single dwelling structure on the rear of the lot, which would be on lot 35B as shown in your attachment three, and also shown on the screen in front of you.

Um my experience on a board of adjustment.

I'm aware of the challenges of the variance process and the bur and the the uh the challenge of showing hardship, not of our undoing, and so we're prepared to do that today.

Um Ms.

Hughes is not a developer, she is a single mother who has already invested heavily in the property, extensively renovating the house on the uh on lot uh.

Um, and her goal on the project is to continue with this commitment um while providing a housing solution for her family.

Um, in planning this project, there were a number of directions to take, and on examination of the site plan, some of those may be evident, but we're here to answer questions about that.

Um, we chose a design solution that takes into account the spirit of the LDC and that is that is not contrary to the public interest to quote the ordinance.

Um so we feel there are two key considerations of this variance request.

The first one is the existence of the 10-foot alley to the rear.

Um this is a city-owned property that's non-functional as was stated previously.

It doesn't circulate, it's overgrown, it does not doesn't appear to serve any drainage or storm water functions, and it frankly should probably be closed for tax-based reasons.

Um the variance application requests that we be allowed to measure our rear yard setback from the center line of that of that alley, that 10-foot alley.

And if that is allowed, our variance requests ask for a four-foot-three reduction in the 15-foot setback in the rear.

Um, that reduction would be from 15 to 10 foot nine.

If the board or if this proceeding does not allow us to measure from the center line of the alley, then our variance request is five feet greater.

It's uh a nine foot three reduction in the rear yard setback from 15 feet to five foot nine.

The second, I think the second relevant matter on this is the preservation of an extremely healthy and large tree, which you see um on your site plan.
