New Business – 302 Summer Rest Road (BADV‑3‑825): Variance to allow a bulkhead extension in the R‑20 (Legacy) district. Zoning Administrator Kathryn Thurston presented staff’s case summary, noting the site is a vacant lot with existing riprap revetment and a gazebo installed prior to annexation. The 75‑foot conservation resource setback for coastal wetlands applies. The applicant, Stephen Beacham, represented by Jason Dail (coastal permitting specialist), proposed replacing the deteriorated riprap with a vertical vinyl bulkhead placed landward of the existing revetment, within the 37.5‑foot non‑encroachment area. The applicant stated that the project has a CAMA permit expiring November 9, 2025, and that the bulkhead would be installed entirely within the property boundaries. The northern neighbor (Robert Gibbons) submitted an email indicating he had no issue with the bulkhead in principle, provided the height matched his existing wall. The applicant confirmed he would coordinate with both neighbors and that the bulkhead would include a wing wall to manage runoff. Board members discussed the permissibility of the encroachment, the existing hardened shoreline, and the site‑specific nature of the variance. City staff noted that the city now allows limited encroachment up to half the buffer on a case‑by‑case basis.

All right. We're gonna go to go ahead and call to order the City of Wilmington's Board of Adjustments meeting for Thursday, August 14th, 2025. It is one o'clock. Um before we get started, uh I'm going to read the Board of Adjustment introduction. Hearings before the Board of Adjustments are quasi-judicial in nature. Decisions for the board are based on the record of these proceedings. To grant a variance requires a concurrent vote of four-fifths of the members of the board. To reverse or modify the determination of an administrative official requires a simple majority. Evidence submitted to the board for review becomes part of the record. Appeals for the board's decisions are to Superior Court on based on the record. Appeals must be filed within 30 days of the date of filing of the board's order in the planning division. A hearing before the board is conducted in accordance with the rules of procedure. Those who want to testify in a case are sworn as witnesses. The chairperson recognizes those who want to testify or their attorneys for presentation of evidence during the hearing to ensure that all testimonies properly recorded.
