5:20

It's 1810 Monteg Lane.

5:25

The variance to a legacy city code 18 204 Urban Mixed Use Setback Requirements and Section 18 308 to allow an in-ground swimming pool within the required setback.

5:38

Catherine, you're thank you, Chairman, members of the board.

5:44

Yes, the case before you today is a request for variance setback requirements for a swimming pool in the urban mixed use legacy district.

5:52

The subject property is part of airly at Wrightsville Sound subdivision, which was rezoned from R 15 to a conditional urban mixed use district in 2017 to facilitate the development of a higher density residential neighborhood.

6:05

The property across Airly Road, commonly known as Airley Gardens, is zoned R20 legacy district.

6:12

The subject property contains a single family dwelling that was constructed earlier this year.

6:17

Upon inspection of the property for the zoning final in September, the city's uh inspector determined that a swimming pool was under construction without the required permits.

6:26

Since this property is located in a mixed use district rather than a typical residential zoning district, the setbacks for swimming pools are based on those district requirements or five feet in this instance.

6:37

All portions of the swimming pool, including attached decking and equipment, must be located outside of the required setback.

6:44

This photo of the subject property looking north shows the portion of the pool coping that extends into the required setback on the north side property line, approximately one and a half feet.

6:53

And you can see the pool equipment, which is fully located within the required setbacks, and a required five foot non-municipal easement along the east property line.

7:02

On or about October 6th, 2025, the applicant submitted a request for a variance to allow an encroachment into the required setbacks for a swimming pool in the urban mixed use legacy district.

7:13

I'd like to submit the case summary and all attachments into the record, and I'm happy to answer any questions you may have of city staff.

7:19

Is a uh permit always required for a pool?

7:23

Yes, sir.

7:24

Thank you.

7:24

Any anybody else have questions?

7:27

Catherine.

7:28

All right, thank you.

7:29

Thank you.

7:30

All right, we ask if the applicant would like to speak.

7:35

Thank you.

7:36

Good afternoon.

7:37

My name's Amy Schaefer.

7:38

I'm here on behalf of the applicant.

7:41

I have a brief presentation.

7:43

Uh we want to thank Ms.

7:44

Thurston.

7:45

Um, as you can see from the packet, the original citation was actually stating that there was a 10-foot requirement for the setback.

7:54

That's the current code for residential zoning, but this is zoned UMX.

8:00

So Ms.

8:00

Thurston was able to clear that up before we brought this uh variance forward.

8:07

As you can see, um, the landscaping is in, the pool is in, the house is constructed.

8:13

Um the property owners had been working on the pool and the house for quite some time.

8:19

Various people had come out, they had gotten permits for everything else, um, and just simply did not realize that you had to have a separate permit for the pool until the zoning inspector came out and let them know that at that time.

8:34

Um I I have some background, but Miss Thurston covered all of that.

8:38

At that time, um, it was discovered that the pool was not set back appropriately for the five-foot setbacks.

Wilmington Board of Adjustment Meeting - November 20, 2025

The Board of Adjustment of the City of Wilmington held a quasi-judicial public hearing at 1:03 p.m. on Thursday, November 20, 2025, in City Council Chambers at the Skyline Center. The board considered three variance requests. All votes were unanimous (5-0).

Consent Calendar

  • Approval of Minutes (October 16, 2025): A motion to approve the minutes carried 5-0.

Discussion Items

  • 100 River Rock Way (BADV-8-1125): Variance to Legacy City Code Section 18-556 vision clearance standards for an existing wall adjacent to a proposed driveway. The applicant requested a continuance to the December 18, 2025 meeting. A motion to continue carried 5-0.

  • 1810 Montage Lane (BADV-9-1125): Variance to Legacy City Code Sections 18-204 and 18-308 to allow an in-ground swimming pool within the required rear setback (1.5-foot encroachment). Staff presented that the pool was constructed without permits on a lot zoned Urban Mixed Use (UMX), which requires a 5-foot setback. Applicant representative Amy Schaefer argued unnecessary hardship due to the lot's unique physical constraints (narrow, shallow lot under UMX zoning) and confusion about applicable setbacks. The board discussed contractor negligence and the frequency of unpermitted pool construction. A motion to approve the variance with the condition that pool equipment be moved to comply with setbacks and that the variance does not override non-municipal easement restrictions carried 5-0.

  • 3436 River Road (BADV-10-1125): Variance to Section 18-494(C.1-A) requesting relief from installing 185 linear feet of required sidewalk along the property's River Road frontage. Staff reported the property is used by Cape Fear Public Utility Authority (CFPUA) for wastewater treatment. The applicant (Robin Austin, McKim and Creed) stated that 1,315 linear feet (88% of frontage) would be installed, but the remaining 185 feet should be waived due to steep slopes (24% cross slope), drainage issues, existing utility piping, and lack of pedestrian connectivity in the industrial area. Staff recommended a fee-in-lieu at $35/linear foot ($6,475). Board member Patrick Moore noted that no sidewalks exist nearby (nearest is half a mile north). A motion to approve the variance with the condition that the applicant pay a fee-in-lieu for the uninstalled portion carried 5-0.

Key Outcomes

  • Approved minutes of October 16, 2025 (5-0).
  • Continued item 100 River Rock Way to December 18, 2025 (5-0).
  • Approved variance for 1810 Montage Lane with conditions (5-0).
  • Approved variance for 3436 River Road with fee-in-lieu condition (5-0).
  • The meeting adjourned at approximately 1:31 p.m.
