1:01

C three is approval of the minutes of the city council's agenda.

1:07

And then we have uh several public hearings.

1:09

Item public hearing, PH one is an ordinance amending the land development code chapter 18 to allow project projecting signs in the MD 10 and MD 17 multi-dwelling residential zoning districts.

1:23

PH2 is an ordinance amending the official zoning maps of the city of Wilmington to rezone a 0.514 acre portion of a 1.26-acre parcel located at 428-430 and 432 Eastwood Road from R15 Moderate Density Single Dwelling District to O and I office and institutional district.

And

1:47

PH3 is an ordinance amending the official zoning maps of the city of Wilmington to rezone a 3.1 acre uh portion of a 6.3-acre parcel located at 5,000 Market Street from CS Commercial Services District to RB Regional Business District.

2:06

And then PH4 is an ordinance amending the land development code chapter 18 to restore group day facilities as a permitted use in various zoning districts and to reestablish and modify the definition and prescribe conditions for a group day facility.

Speaker 3

2:23

Mr.

2:23

Mayor, yes, sir.

2:24

I have a question about this item for PH4.

2:29

Um my first question would be when we go through this process to add a definition like this.

2:36

Do we take any time to look at the city maps and consider how many parcels would fall into this category?

2:48

I'm assuming that we don't draft a definition that isn't applicable everywhere.

Speaker 4

2:54

In this case, we um good morning, I'm sorry.

2:57

Um in this case, we just restored the definition that was in the previous code and then it put it back in the same districts that it was allowed in the previous case.

3:05

We didn't go back and look at all the number of parcels in those districts.

3:08

We just went back to the districts that were applicable at that time.

Speaker 3

3:12

Okay.

3:13

Um I apologize, I'm not I'm not gonna be here, I'm gonna be absent from tomorrow night's meeting, so I just wanted to say this this morning while we were all here.

3:20

Um I'm a little bit of two minds on this item.

3:24

I mean, I think it's become clear that we do need a definition, and so I certainly don't have any objections to us revisiting the old one and putting this one back in.

Unassigned speaker

3:32

But

Speaker 3

3:33

the the challenge that I have with this is that this really clearly sprang up from a group of people excuse me who were in good faith trying to do something good in our community, and in some ways are are feeling in many ways are feeling a need that the city um doesn't have too many particular other avenues to fill.

3:52

And from where I sit, that group very specifically went through um, went out in search of and tried to go through a process that was gonna be done by right.

4:04

And we had neighbors who came in who were frustrated and who were upset, and rightfully so.

4:08

I think they had very valid concerns as well.

4:11

Um, but they did have an avenue for appeal.

4:13

They could have either gone to the board of adjustment or they could have filed a case in superior court.

4:17

Those are available avenues, those are valid avenues.

4:20

They're simply not frequently used, and people are not familiar with them.

4:24

And so when we run into issues in the future where avenues exist, but people are maybe not super familiar with them and are frustrated with the process.

4:32

I don't know that the answer is always just to change the process.

4:35

Um that's not the full story in this case.

4:38

Obviously, this was previously in there, and we've identified that we probably do need a definition, but I just wanted to point out that I

Unassigned speaker

4:46

in

Speaker 3

4:46

the future I I don't want us to be writing policies to exclude people who have gone about the process in what they thought was the right way.

Unassigned speaker

4:54

Um and again, I would want to commend and suggest to people that if you can do something by right under the code, that is the correct process to follow.

Summary of Proceedings

Wilmington City Council Pre-Agenda Meeting - November 2, 2026

The Wilmington City Council met in a pre-agenda briefing on November 2, 2026, to review items scheduled for the following night's meeting. All council members were present for roll call. No formal votes were taken; the session was for discussion and preparation, covering consent agenda items, four public hearings, and a question about one public hearing item.

Consent Agenda

  • C1: Resolution authorizing the city manager to enter an agreement to purchase 48 sets of firefighting coats and pants from NAFCO of Decatur, Alabama, for $213,702.
  • C2: Resolution authorizing the city manager to enter an agreement with Dr. Yale Gold PC for professional behavioral health and wellness services for Wilmington Fire and Police Department personnel, for $600,000 over three years.
  • C3: Approval of the minutes of the city council's agenda meeting.

Public Hearings Scheduled for Tomorrow

  • PH1: Ordinance amending Land Development Code Chapter 18 to allow projecting signs in the MD 10 and MD 17 multi-dwelling residential zoning districts.
  • PH2: Ordinance amending the official zoning maps to rezone a 0.514-acre portion of a 1.26-acre parcel located at 428-430 and 432 Eastwood Road from R15 Moderate Density Single Dwelling District to O&I Office and Institutional District.
  • PH3: Ordinance amending the official zoning maps to rezone a 3.1-acre portion of a 6.3-acre parcel located at 5000 Market Street from CS Commercial Services District to RB Regional Business District.
  • PH4: Ordinance amending Land Development Code Chapter 18 to restore group day facilities as a permitted use in various zoning districts, and to reestablish and modify the definition and prescribe conditions for a group day facility.

Discussion on PH4

  • A councilmember, noting they would be absent from the next night's meeting, questioned whether city maps had been reviewed to determine how many parcels would fall under the restored group day facility definition. Staff responded that the definition had been restored from the previous code and placed in the same zoning districts as before, without a parcel count.
  • The councilmember expressed mixed views: they agreed a definition is needed and had no objection to restoring the previous one, but they were concerned that the item resulted from a group that had sought to act by right under the code. They noted neighbors had valid concerns but also had appeal avenues through the board of adjustment or superior court. They cautioned against changing processes whenever avenues are unfamiliar, and stated they did not want future policies to exclude people who followed what they believed was the correct process.
  • The councilmember affirmed that doing something by right under the code is the correct process and hoped the council would not prescribe or micromanage away from that approach.

Other Business

  • The city manager reported no additional items this morning but said staff would contact council members to determine whether they would prefer to meet after the next agenda briefing or at a 6 p.m. meeting to close the loop on the outside funding requests process.

Key Outcomes

  • No formal votes or resolutions were adopted during the pre-agenda meeting.
  • The council is scheduled to consider the listed consent agenda items and public hearings at the following night's meeting.
  • Staff will follow up with council members on scheduling a meeting to finalize the outside funding requests process.
