Alameda Planning Board Meeting - December 16, 2021
The Alameda Planning Board met on December 16, 2021, to consider several major items, including amendments to the Bay Port Alameda Landing Master Plan, a new state law (SB9) allowing increased housing density in R1 zones, and objective design standards for SB9 projects. The board also approved the 2022 meeting schedule and heard public comments on each item. Key outcomes included a recommendation to the city council on the SB9 ordinance, adoption of design standards, and a decision to give more time for exploring commercial use at Alameda Landing rather than converting to residential.
Consent Calendar
- Unanimously approved the Planning Board regular meeting schedule for 2022.
Public Comments & Testimony
- Item 7C (Alameda Landing Master Plan):
- Betsy Mappison (resident) expressed support for keeping commercial/community space to activate the waterfront.
- Jay Garfinkel questioned project details and the process, saying it appeared rushed.
- Shella (Bay 37 resident) strongly favored converting the lot to residential due to safety concerns and break-in attempts.
- Zach Bowling favored mixed-use commercial and residential.
- Amy Wooldridge (Parks Director) envisioned the space as a community amenity, e.g., a library/recreation center with a small cafe.
- Item 7A (SB9 Ordinance):
- Zach Bowling (SB9 advocate) supported the ordinance but recommended a 1200 sq ft cap or size matching existing units.
- Jay Garfinkle urged adoption of an urgency ordinance to avoid applications under state law before local rules take effect.
- Christopher Buckley (Alameda Architectural Preservation Society) recommended limiting the ordinance to SB9 requirements only and not making unrelated zoning changes.
- Margaret Hall supported the preservation society's recommendations and called for a more deliberate process.
- Henk Hernandez (ADU builder) asked about converting existing ADUs into lot splits.
- Item 7B (Objective Design Standards):
- Zach Bowling supported the standards as written, noting they align with off-the-shelf manufactured home options.
- Christopher Buckley recommended refinements, including clarifying applicability, adding context consideration, and fixing alignment language.
- Betsy Matteson endorsed the preservation society's comments and suggested adding diagrams.
Discussion Items
- Item 7C – Bay Port Alameda Landing Master Plan: The board debated whether to require commercial space (as currently mandated) or allow residential units (three single-family or five townhomes). Staff recommended keeping the commercial requirement due to its potential to serve the park and future water taxi. The developer argued that retail would struggle and proposed moderate-income housing as an alternative. Board members split: some emphasized the community benefit of commercial, while others cited housing needs and vacancy rates in nearby centers. A motion by Board Member Teague to strike the mid-term design review deadline but retain the ultimate requirement to build commercial before the 330th residential permit passed unanimously, allowing more time for feasible commercial or community uses.
- Item 7A – SB9 Ordinance (R1 Zoning Amendments): The board examined a draft ordinance to implement Senate Bill 9, which allows up to four units on R1 lots via ministerial approval. Discussion focused on unit size limits (staff proposed 1200 sq ft; some board members favored 1600 sq ft), the inclusion of accessory dwelling units (ADUs) after a lot split, and whether to clean up unrelated permitted uses. The board also debated requiring vehicular access for split lots and retaining the word "alteration" in tenant displacement protections. After extensive deliberation, a motion by Board Member Teague passed 6-1, recommending the city council adopt the ordinance with amendments: use the city's existing ADU ordinance, allow units up to 1600 sq ft, restore "alteration" language, and defer unrelated use changes. The motion also directed staff to clarify that split lots are for residential uses only.
- Item 7B – Objective Design Standards for SB9: Staff presented objective design standards for SB9 projects, covering architecture, materials, additions, and parking. The board discussed applicability (only to SB9, not all single-family homes) and requested refinements such as diagrams and clearer alignment language. A motion by Board Member Curtis to approve the standards with the removal of the third bullet point (which would have broadened applicability) passed 6-1.
Key Outcomes
- Item 7C: The board voted unanimously to recommend that city council not amend the master plan, but to modify the condition of approval to give the developer more time (until February 2022) to submit design review for the commercial space, while keeping the ultimate requirement to build commercial before the 330th residential building permit.
- Item 7A: The board voted 6-1 to recommend that city council adopt the SB9 ordinance with specified amendments, including allowing up to 1600 sq ft units, keeping the existing ADU ordinance, restoring "alteration" protections, and deferring unrelated use changes. The ordinance is slated for council consideration on January 4, 2022.
- Item 7B: The board voted 6-1 to adopt the objective design standards for SB9 projects, with the third bullet on applicability removed. The standards take effect January 1, 2022, and staff will continue refining them based on public and board feedback.
