When

Speaker 2

5:34

the board knows they have a conflict of interest or the appearance of a conflict of interest, they recuse themselves.

5:38

They cannot possibly know who will appear from the public in any given matter, which will present a conflict of interest to them.

5:44

If anybody believes that the any commissioner has a conflict of interest in any matter, you have to announce that to us as the case is called, or the commissioner or commissioners, as the case may be, will deal with that accordingly.

5:55

If not, then the commissioners will proceed with all hearings under the assumption that there was will be no conflict of interest.

6:01

Secondly, the rules of the board provide that the chair for the purpose of administrative and judicial economy can have the board's counsel, myself, rule on the admissibility of evidence and objections if there are council president objections are made.

6:12

The board handles many cases at every hearing, and this assignment allows us to expedite the hearings.

6:16

So rather than the chairwoman turning to me and advising me advising the chairwoman, I will simply make a ruling, and my ruling will be that of the chair.

6:24

Additionally, since we have only one commissioner today, all applicants and all licensees before the board have the opportunity to ask for a postponement without any issue.

6:33

With the one commissioner, this is a rule that is different than a normal hearing where it has to be requested here.

6:39

It is a given if requested.

Unassigned speaker

6:42

With

Speaker 2

6:43

that, I'll turn it over

Yeah.

8:03

Okay.

8:03

He's um do they request an excusal?

Speaker 2

8:10

I I apologize, gentlemen.

8:12

We always knew what this is and you don't have an attorney, so we we understand, and I think this is gonna be an issue in a later case as well.

8:18

And it's a situation where I think that ultimately the argument seems very reasonable, but it's something that you'll have to make the argument at the next hearing whenever that we don't have all the licensees or parties that are requested unless they've been asked to be excused.

8:34

We postpone the case automatically.

8:36

And unfortunately we have to cite you for a cooperation charge.

8:39

I think the argument that you're concerned with regards to the person being very sick is certainly a fair argument to make, but it'll have to be made at the next hearing.

8:48

If he can't make the next hearing, or one of you also could perhaps could not make it, you'll have to ask them to be excused a few days in advance.

Summary of Proceedings

Anne Arundel County Liquor Board Hearing – October 13, 2026

The Anne Arundel County Liquor Board convened on October 13, 2026, with one commissioner present. No agenda or minutes were available for this meeting; the following summary is drawn from the transcript. Board counsel made administrative announcements, five cases were postponed (two during the session), and one license transfer was heard and approved.

Administrative Announcements

  • Board counsel noted that transcripts are maintained electronically and serve as the official record, available for review online or by appointment.
  • Counsel stated that with only one commissioner sitting, any applicant or licensee may request a postponement, and such a request will be granted.
  • Counsel reminded the public that commissioners will recuse themselves when conflicts arise; anyone who believes a conflict exists should raise it when a case is called.
  • For administrative efficiency, counsel would rule on admissibility of evidence and objections on behalf of the chair.
  • Three previously scheduled cases were announced as postponed: International Entertainment Group LLC d/b/a Catherine's; Papa's Restaurant and Sports Bar, Inc. d/b/a Papa's restaurant and sports bar; and Sharangpur Inc. d/b/a Reno's Market.

Postponements Granted

  • Affiliated On Cigar LLC d/b/a Affiliation Cigar, a Class D tavern with on-sale beer, wine, and liquor, appeared without Secretary Pernel Williams, who was reported ill. Because no excusal had been requested, the case would normally have been postponed with a cooperation charge; however, because the hearing had not started and one commissioner was sitting, the board offered and the licensees requested a postponement, which was granted without a cooperation charge.
  • TGI Fridays of Annapolis d/b/a TGI Fridays, a Class B restaurant with on/off beer, wine, and liquor at 2582 Solomon's Island Road, Annapolis, faced two violations: Rules and Regs Chapter 3, Section 3.02 (cooperation) and Section 4.16 (unauthorized conduct), based on Notice of Violation 1403 dated August 13, 2026. Required party Jennifer Rote was absent and no excusal had been requested. The board offered a postponement to avoid a cooperation citation; the licensee requested and received the postponement.
  • Dorothea Holbuleck, appearing for TGI Fridays, expressed frustration, saying she had been addressing the matter for a year and a half, felt "held hostage" as a licensee, was ready to pick up the licenses, and was being ignored by the law firm handling the transfer. Board counsel offered to obtain the law firm's information and reach out to encourage action.

License Transfer: 47875 LLC d/b/a Elbow Room

  • The applicant, 47875 LLC, owner Sivon Eversley, sought transfer of a Class H restaurant BWL license, with general entertainment restricted to two musicians and a Sunday license, from EMKO Inc. d/b/a Money's Place at 1641 Route 3 North, Crofton, Maryland.
  • Melvin J. Kadenski testified in support, stating that the license had been active for quite some time, no changes were planned, the business would be run the same way, and the prospective owners would be on the premises whenever the business was open. He described the applicants as a young couple and noted that Mr. Kaz had 20 years in the business with no problems.
  • Sherek Matthews, prospective licensee, confirmed that the business would keep the same hours, 11 a.m. to 2 a.m., that the televisions are color, and that the applicants hold no interest in other licenses.
  • The commissioner approved the transfer.

Key Outcomes

  • Affiliated On Cigar LLC d/b/a Affiliation Cigar was postponed without a cooperation charge.
  • TGI Fridays of Annapolis d/b/a TGI Fridays was postponed without a cooperation charge.
  • The transfer of the Money's Place license to 47875 LLC d/b/a Elbow Room was approved.
  • Board counsel offered to contact the law firm involved in the TGI Fridays transfer on behalf of the licensee.
