We appreciative of our elected officials, our first responders, so many that uh work hard to make it that way.

0:38

We thank you for our staff that has worked hard for this meeting tonight to put it together.

0:42

And uh now, Father, we just ask that what we do here is show respect to each other, and Father, we honor you and how we conduct ourselves.

0:51

Thank you so much for all that you do for us, and we pray all this in the name of Jesus, amen.

At this time, we'll uh have the approval of our minutes of our uh April 4th work session and the regular meeting.

1:58

Hopefully, everybody's had a chance to look at that.

2:00

Made any comments to staff.

2:02

If no corrections, I'll entertain a motion to approve those.

2:06

Oh no, Mr.

2:08

Davis?

2:09

Thought I heard all right.

2:11

Mr.

2:11

Davis made a motion to approve those.

2:13

Do I have a second?

2:14

Second.

2:14

All right, Mr.

2:15

Booser, second the motion.

2:16

All in favor say aye.

2:18

Aye.

2:18

Any opposed?

2:20

All right.

2:20

Our minutes are approved.

2:24

All right.

2:26

Mr.

2:28

You want me to afternoon, Commission.

2:42

Uh, just real quickly, uh, we'll go through our public hearing guidelines uh, like we did um last month.

2:51

One second.

2:55

So uh we have several items on public hearing tonight, just a quick guidelines of how we operate our public hearings.

3:01

Um the public comments should be made uh only during the public hearing portion of the meeting.

3:07

Uh when you approach the the podium uh to the microphone, please state your name and address, uh address all your comments to the chairman of the planning commission.

3:18

Um comments should be focused towards whatever application is being presented at the time.

3:23

Um, and then the comments from individuals should be limited to three minutes.

3:26

And if there's a someone speaking on behalf of a group, that it can be extended to five minutes.

3:31

Um we do have a couple rezoning cases tonight.

3:35

Uh so just quickly remind everyone that the when that when considering a rezoning case, the commission has 10 criteria from the zoning ordinance that they must uh review the the rezoning request by.

3:48

I won't read all 10 of them again because you'll see this through a lot of the staff reports and presentations tonight, but um no future development plans or anything can be considered during the rezoning case, only the the 10 criteria that are spelled out in the the uh sub zoning ordinance.

4:06

Uh when when it comes time for subdivision uh cases, you know, those are a lot more cut and dry.

4:12

They are either meet the regulations or they don't, and that's what the the commission can consider.

4:17

Uh and that'll be covered in during the the planning the staff reports.

4:21

So with that, um we can proceed on Mr.

4:25

Chairman.

4:25

Okay.

4:26

Thank you, sir.

4:29

All right.

4:30

Summary of Proceedings

Baldwin County Planning and Zoning Commission Meeting - May 3, 2024

The Baldwin County Planning and Zoning Commission held a regular meeting on May 3, 2024, at 10:00 AM. The meeting included approval of consent agenda items, a highway construction setback appeal, two rezoning cases, several subdivision and planned unit development requests, and a variance request. The commission denied one rezoning request (Glass property), recommended approval of another (Craig property), denied a setback appeal, approved multiple subdivisions, tabled an RV park request, and denied a wetland buffer variance.

Consent Calendar

  • Approved minutes of the April 4 work session and regular meeting.
  • Approved CSP 24-14 (Northcut Dental) and PER 24-19 (Savannah States phase one extension request) unanimously.

Public Comments & Testimony

  • Multiple speakers opposed the Glass property rezoning, citing traffic safety concerns on narrow single-lane roads, school bus access, and emergency vehicle access. Speakers included neighbors Carla Mitchell and Jewel Lars Lawson, who described dangerous conditions and the need to preserve the residential community.
  • Charmaine Glass, the applicant and a disabled veteran, spoke in favor, stating her home-based business would not generate heavy traffic, that she would preserve mature oak trees, and that the rezoning would allow her to move operations out of her house.
  • Dean Horick spoke in opposition to the Acorn Property Subdivision, representing his father's adjacent airport. He cited FAA regulations (49 USC 47107) requiring compatible land uses and warned of liability and safety risks from residential development near the runway.

Discussion Items

  • Highway Construction Setback Appeal (Case: Mitchell): Applicant Timothy Mons requested an appeal to build a pole barn over existing lifts at his auto repair shop. The concrete slab and lifts encroach 14 feet into the 75-foot setback. Staff recommended denial due to ongoing issues with cars in the right-of-way. The commission denied the appeal, allowing the lifts to remain (as they are bolted and removable) but denying the permanent structure.
  • Rezoning Z24-11 (Glass Property): Request to rezone 0.33 acres from RSF2 to B1 for an office. Staff recommended denial due to incompatibility with surrounding residential development, single-lane roads, and opposition from the City of Daphne. The commission voted to recommend denial to the County Commission (one no vote heard).
  • Rezoning Z24-12 (Craig Property): Request to rezone 1.95 acres from BCZ to RSF1 for a two-lot subdivision. Staff recommended approval. Approved unanimously.
  • PUD 24-03 and CSP 2403 (Ross Adams): Multi-unit commercial development and outdoor RV/boat storage. Staff recommended approval. Approved unanimously.
  • PUD 24-05 (Michael Sorrell's RV Park): Request for a 49-site RV park. Staff recommended denial due to lack of capacity information from Baldwin County Sewer and no fire flow test. The applicant requested a table to explore septic option. Commission tabled the case to June 2024 meeting.
  • PUD 24-06 (Red Hill Road Mobile Home Park): Final site plan for a 17-site manufactured home park (existing 5 homes). Staff recommended approval with waiver of sidewalks, curb, and gutter. Discussion on parking dimensions and road proximity. Commission approved with waiver (roll call: 5-2, with Mr. Davis and Mr. Boer voting no).
  • SPP 24-05 (Acorn Property Subdivision): Preliminary plat for a 4-lot subdivision. Staff recommended approval. Commission approved.
  • SPP 24-06 (Belfare Subdivision): Preliminary plat for a 79-lot subdivision. Staff recommended approval with conditions including coordination with the Highway Department on County Road 64 improvements. Commission approved.
  • SV 24-05 (Cypress Landing Variance): Request to allow a private road to encroach on the required 30-foot wetland building setback. Staff recommended approval citing topographic hardship due to wetlands. Commission denied the variance (motion to deny carried).

Key Outcomes

  • Denied: Highway Construction Setback Appeal (Mitchell) - denied; lifts may remain but no pole barn.
  • Recommended Denial: Rezoning Z24-11 (Glass property) - forwarded to County Commission with recommendation to deny.
  • Recommended Approval: Rezoning Z24-12 (Craig property) - forwarded to County Commission.
  • Approved: PUD 24-03 and CSP 2403 (Ross Adams) - approved.
  • Tabled: PUD 24-05 (Michael Sorrell's RV Park) - tabled to June 2024 meeting.
  • Approved with Waiver: PUD 24-06 (Red Hill Road Mobile Home Park) - approved with waiver of sidewalk, curb, and gutter; roll call 5-2.
  • Approved: SPP 24-05 (Acorn Property Subdivision) - approved.
  • Approved with Conditions: SPP 24-06 (Belfare Subdivision) - approved.
  • Denied: SV 24-05 (Cypress Landing variance) - denied.
