The Baldwin County Planning and Zoning Commission met on September 9, 2024, at 10:00 AM. The meeting included approval of previous minutes, several public hearings on rezoning, site plan modifications, subdivision approvals, and variances. - By the Bay 2 (PUD 24-09): RV park on 6 acres. Staff recommended approval with conditions. Commissioner requested dumpster moved to front; applicant agreed. Approved.
- Avery Cove (SPP 24-13): Subdivision of 121 lots on 40 acres. Staff recommended approval with conditions including revised traffic study. Opponents raised drainage concerns. Commissioner noted that in unzoned areas, the commission must approve if regulations are met. Approved.
- Abbey Oaks (SPP 24-14): Subdivision of 81 lots near Spanish Fort. Traffic study, drainage, and wetland permits were addressed. Residents strongly opposed due to traffic and school zone congestion. A motion to table failed on a roll call vote (3-4). Subsequently, a motion to approve with staff conditions passed over opposition.
- Subdivision Regulation Amendments: Staff presented proposed amendments to be considered by the County Commission on October 1, 2024. Commissioner Seibert expressed disappointment that the commission had no opportunity for formal input. Staff responded that the process followed guidelines and incorporated previous comments.

Good evening. I want to call to order our September 5th Balma County Planning and Zoning Commission meeting. At this time, you'll stand with me. We'll have a prayer and a pledge of allegiance. Father, we're thankful to you for this day. We're thankful to you for this county that we live in. It's a great place to live. We're thankful for the many that make it that way for our elected officials who work to make it that way for all of the staff that's here tonight that uh has made this meeting possible with their hard work. Our first responders, uh, so many father, we're just thankful for we do live in a great place. Thank you, Father, for the opportunity we have to conduct this business tonight. Uh bless us with wisdom uh that we conduct ourselves in a way that we should, and we pray all this in the name of Jesus. Amen. I pledge allegiance to the flag of the United States of America and to the Republic for which it stands. One nation under God, indivisible with liberty and justice for all. Good afternoon, Chairman and Commissioners. Uh, we'll quickly go through our uh public hearing guidelines. We have several public hearings on the agenda for you all tonight. Uh so for those in the audience, uh, public comments should only be made during the public hearing portion of the meeting. Uh, when you come up to the podium, please state your name and address into the microphone for the record. Uh comments should be directed to the chairman of the planning commission, and he can uh uh address them or commit them to the appropriate person. Uh comments should be focused on the application that is being presented at that time, and comments from individuals should be limited to three minutes. Uh and if you're speaking on behalf of a group, you can extend that to five minutes. So there's a couple of rezonings uh tonight. Uh you'll see this in your staff reports. Just a reminder of the criteria that the zoning ordinance says uh we have to review rezoning requests by number one, is it could put uh compatible with the development pattern? Uh number two, is it a change in conditions from since originally zoned? Number three, does it uh conform to the master plan? Number four, does it conflict with public improvements? Number five, uh, is there any adverse traffic uh affects the traffic? And I always like to clarify on this piece that means the overall transportation network. There's always situations where you have to have localized traffic improvements, but this is more on the rezoning stage, more about what's going on in the transportation network in that that area.
