Baldwin County Planning and Zoning Commission Meeting

The Baldwin County Planning and Zoning Commission convened on December 10, 2024, at 10:00 AM. The meeting included approval of minutes, a consent agenda, and public hearings on three major items. The commission took votes on rezoning and planned residential development (PRD) requests, making recommendations to the county commission.

Consent Calendar

  • PER 24-42 (Faro Falls Phase 8 and 9 extension), PER 24-46 (Glass Road RV Park extension), SFP 24-18 (Two Lakes Phase 1), CSP 2431 (Vertical Bridge cell tower), SC24-55 (Resubdivision of Lot 1, T&K Subdivision), SDP 24-29 (Madeline's Way), and SPP 24-30 (Resubdivision of Parcel B, Point Clear Tennis Club). These items were approved unanimously with no public opposition.

Public Comments & Testimony

  • Phillipsville Noll Subdivision (SC24-53): Several residents spoke in opposition, citing concerns about traffic, property values, and potential for mobile homes. Charles Stewart, Arthur James, TJ Thompson, and Marshall Lannham voiced their worries. The applicant representative did not speak. The commission approved the subdivision unanimously.
  • Randall Property Rezoning (Z24-47): The applicant, Joseph Thatford, spoke in favor, noting no immediate development plans. Ben Gould, Gary Little (representing Verandas POA), AC none, and Peggy Wilson spoke in opposition, citing traffic, rural character, and previous denial. The commission voted 4-2 to recommend approval.
  • Bear Creek PRD & Rezoning (Z24-49 and PRD 24-07): Dwayne Smith represented the applicant. Opponents including Debbie Hale, Tyler Miller, and Allie Dole raised issues of school overcrowding, infrastructure, traffic safety, and flooding. The commission voted 4-2 to recommend denial of both the rezoning and the PRD.

Discussion Items

  • Phillipsville Noll Subdivision: Staff presented conditions for wetland delineation and easement labeling. The commission discussed limitations on further subdivision and the number of dwellings per parcel. The motion to approve passed unanimously.
  • Randall Property Rezoning: Staff noted the property is near a major node and compatible with adjacent zoning. Commissioners debated traffic and character, but approved recommendation to county commission.
  • Bear Creek PRD & Rezoning: Extensive discussion focused on lot sizes, parking, and the PRD as a means to circumvent standard lot widths. Commissioners expressed frustration with the lack of enforcement mechanisms for covenants and the cumulative impact of multiple developments in the Alberta area. The motion to deny the rezoning was made by Mr. Mullock and seconded by Mr. Seibert, carrying 4-2. The PRD denial was moved by Mr. Mullock, seconded by Ms. Burnett, and also passed.

Key Outcomes

  • Approved consent agenda and Phillipsville subdivision unanimously.
  • Recommended approval of Randall rezoning (4-2) to county commission.
  • Recommended denial of Bear Creek rezoning (4-2) and PRD (voice vote) to county commission.
  • Next regular meeting scheduled for January 9, 2025.
  • Chair addressed criticism from a county commissioner and offered to step down; election of officers will occur at the January meeting.
