Summary of Proceedings

Baldwin County Commission Meeting – October 20, 2026

The Baldwin County Commission convened on October 20, 2026, at the Fairhope Satellite Courthouse with Commissioners James E. Ball, Matthew P. McKenzie, Billie Jo Underwood, and Charles F. Gruber present. The meeting included a pre‑meeting work session and a regular session covering consent items, a retiree recognition, a waste sighting board meeting to assist Escambia County with hurricane debris, and multiple public hearings on rezoning cases.

Consent Calendar

  • The Commission approved the consent agenda as modified during the work session. Notable items included:
    • Monetary donation of $30,000 from Fly High Goose Foundation for a walking trail at Live Oak Landing Park.
    • Multi‑year $10,000 sponsorship from Rayonier for the Bicentennial Park Christmas light show.
    • Ratification of interim payments totaling $5,624,119.73 (88 invoices) and payment of bills totaling $15,833,524.25 (388 invoices).
    • Approval of competitive bids for gasoline/diesel, portable toilets, a new District Attorney building, roof replacements, bituminous materials, and other projects.
    • Resolution declaring termination of the State of Local Emergency for Hurricane Isaias.
    • Taxpayer waiver of penalties (FE1), added to consent.
    • Personnel actions, vehicle transfers, budget amendments, and other routine items.

Public Comments & Testimony

  • During the work session, no members of the public registered to speak.
  • During public hearings:
    • Cooper’s Lake Rezoning (Z26‑37): Residents spoke against the rezoning from RA to RSFE, citing preservation of rural character, flooding concerns, and a petition of 1,200 signatures. The applicant’s agent supported the request. An attorney for a joint owner argued that the applicant does not hold clear title.
    • Alstons Rental / Highway 98 RV Park (Z26‑25 and PRD26‑02): One neighbor spoke in favor, describing the project as a visual improvement and an affordable housing option. No other public speakers.
    • Gulf Coast Farm (Z26‑35): The applicant presented a concept plan for an “agrihood” with 83 lots on 118 acres. No opposition was voiced.
    • Maye Property (Z26‑36): No public speakers.

Discussion Items

  • Retiree Recognition: Gina Jones was honored for 25 years of service, with special mention of her work with animal control.
  • Waste Sighting Board (FK1): The commission recessed to convene as the Waste Sighting Board to consider a request from Escambia County, Florida, to dispose of up to 500,000 cubic yards of construction and demolition debris from Hurricane Isaias. Environmental Manager Terry Graham explained the debris is non‑hazardous and would not significantly affect local landfill capacity (Magnolia Landfill has about 80 years of C&D space). The board approved Resolution 2027‑24 by a 3‑1 vote; the regular commission later ratified it.
  • Executive Session: The commission held an executive session during the work session to discuss pending litigation.
  • Work Session Items: Staff reported that the 2026 Multi‑Jurisdictional Hazard Mitigation Plan, prepared by Anna Marie O’Brien, was approved by FEMA. Commissioners also addressed a confusion over administrative leave for hurricane preparation, which was resolved by clarifying the policy.

Key Outcomes

  • Minutes: Approved minutes of the October 6 regular meeting, October 7 emergency special meeting, and July 14 Road and Bridge meeting.
  • Consent Agenda: Adopted as modified.
  • GA1 (Resolution 2027‑025): Adopted to amend the minutes of the August 4, 2020 meeting (Commissioner McKenzie recused).
  • EO1 (Road Vacation): Unanimously approved the vacation of a portion of former River Road.
  • ES1 (Cooper’s Lake Rezoning): Motion to approve the rezoning from RA to RSFE passed 3‑1.
  • ES2 (Alstons Rental Rezoning): Denied.
  • PRD26‑02 (Highway 98 RV Park): Denied.
  • ES4 (Gulf Coast Farm Rezoning): Approved.
  • ES5 (Maye Property Rezoning): Approved.
  • FK1 (Debris Disposal): Approved by the Waste Sighting Board and ratified by the Commission.
