I'm

Speaker 2

1:12

Vivian Tagenon, associate planner with the City of Benesha's Development Services Department.

1:17

The item before you this morning again is the 1112 East Sixth Street parcel map for a proposed lot split at this location.

1:25

This item again was continued from the zoning administrator hearing of April 7th, 2026.

1:31

This project is categorically exempt from the California Environmental Quality Act or CEQA pursuant to Section 15301, existing facilities, and 15315 minor land divisions, which apply to projects involving minor alterations of land with negligible or no expansion of use, and the division of property zoned for residential use into four or fewer parcels when the division is in conformance with the general plan and zoning respectively.

2:02

The proposed parcel map would authorize a lot split and would not result in an expansion of existing structures or a significant alteration to the use.

2:13

The project is located in the southeastern part of the city at 1112 East 6th Street.

2:19

The zoning is medium density residential or RM.

2:23

The property is not located within a historic district of the city, and the structures on the property are non-historic structures.

Unassigned speaker

2:32

The

Speaker 2

2:32

general plan designation for the property is high density residential.

2:38

The applicant requests a parcel map to subdivide an existing 0.57-acre parcel into two separate parcels, parcel A and parcel B on the informational exhibit, which I will show in the next slide in a moment.

2:52

Proposed parcel A contains approximately 0.262 acres with an existing eight-unit residential apartment building addressed as 1112 East 6th Street, whereas proposed parcel B contains 0.313 approximately acres, uh, with two existing four-unit residential apartment buildings addressed as 607 through 623 East K Street.

3:18

No development or change in use is being proposed for either property.

3:25

Here is an image of the informational exhibit, which is also attachment one in the staff report.

3:31

The existing buildings currently operate as residential apartment units and do not meet current setback requirements relative to the existing perimeter property lines and are legally non-conforming.

3:42

Further, the property contains an existing 36-inch storm drain pipe that runs through the northern portion of the property to the southern portion of the property and empties into the drain outlet located on East K Street as shown here.

3:58

The proposed parcels are also accessed from existing individual driveways off of East K Street.

4:05

Proposed parcel B is also accessed by the public alley between East K and East L Streets.

4:12

Proposed parcel A has seven existing first floor covered parking spaces, whereas proposed parcel B has a total of 11 asphalt uncovered parking spaces, with eight of the spaces being located to the west of the two four-unit buildings and three spaces located to the north of the northernmost building on proposed parcel B site.

4:38

The existing site containing proposed parcel B has three regular parking spaces and three compact spaces.

4:45

There are numerous spaces for off-street parking on both East 6th and East Case Streets.

4:51

Each parcel also has individual utility connections for domestic water, sewer, and electrical.

Unassigned speaker

5:00

As mentioned previously, no new development grading or changes to building placement are proposed as part of this subdivision.

Speaker 2

5:06

All identified setback deficiencies are existing conditions and would not be intensified by the proposed parcel split.

5:14

Each resulting parcel maintains adequate access, utilities and site functionality, and existing stormwater infrastructure, including the city's 36-inch storm drain, is clearly identified.

Unassigned speaker

5:26

The

Speaker 2

5:27

subdivision of the parcel itself does not exacerbate zoning nonconformities nor create new impacts.

5:35

And here is an image of the proposed parcel map, which will be submitted to the city engineer for consideration and for map recordation approval in the coming weeks following today's hearing.

5:51

Pursuant to BMC section 16.32.050 point D, the parcel map shall be approved or conditionally approved if the map conforms to all the requirements of the MAP Act and is consistent with the general plan or any applicable specific plan and the provisions of this municipal code.

6:12

The project has been reviewed for compliance and consistency with applicable zoning and general plan regulations shown here.

6:19

Chapter 16.08 review of maps.

6:22

Chapter 16.32 parcel maps.

6:26

Chapter 17.24 residential districts.

6:35

Chapter 17.98, nonconforming uses and structures, as well as general plan policy 2.14.2, providing a variety of housing types affordable to a range of household incomes, including workforce housing, older adult housing, artist housing, and a mix of rental and owner occupied units.

6:57

With regard to public noticing for this project, on March 10th, 2026, a public hearing notice was posted at the project location.

7:06

On March 12, 2026, the public hearing notices were mailed to 123 property owners within 500 feet of the project site, as well as posted at City Hall.

7:18

No public comments were received as of today.

7:26

And finally, this project is categorically exempt from the from CEQA pursuant to guidelines section 15301 existing facilities, which applies to projects involving minor alterations of land with negligible or no expansion of use.

8:00

There are no environmental impacts generated by this project.

8:04

The proposed parcel map would authorize again a lot split and would not result in an expansion of existing structures or a significant alteration to land use.

8:14

And with that, this concludes my presentation for this morning.

8:18

I'd be happy to answer any questions you may have.

8:21

Benicia Zoning Administrator Hearing: Parcel Map Approval and CEQA Exemption - April 28, 2026

The Zoning Administrator convened a continuation of the April 7, 2026 public hearing at 9:30 AM to consider a parcel map application (PLN-25-15) for 1112 East Sixth Street. The applicant proposes subdividing a 0.57-acre parcel into two parcels (A and B) without any new development. No public comments were received, and the decision was deferred for a written determination within 10 days.

Discussion Items

  • 1112 East Sixth Street Parcel Map (PLN-25-15): Staff planner Vivian Tagenon presented the project. The existing property contains three apartment buildings (one eight-unit building on proposed Parcel A, two four-unit buildings on proposed Parcel B) totaling 16 residential units. The lot split would create Parcel A (0.262 acres) and Parcel B (0.313 acres). The existing structures are legally nonconforming regarding setbacks, but the split does not intensify any nonconformities. A 36-inch storm drain pipe crosses the property. Parcel A has seven covered parking spaces; Parcel B has 11 uncovered parking spaces (eight west of the buildings, three north). The project is categorically exempt from CEQA under Guidelines Sections 15301 (Existing Facilities) and 15315 (Minor Land Divisions). Public noticing was completed on March 12, 2026, with no written comments received. The applicant was present but had no additional comments.

Key Outcomes

  • The Zoning Administrator deferred the final decision, stating that pursuant to Benicia Municipal Code Section 17.104.050(B), the Development Services Director will approve, conditionally approve, or disapprove the application within 10 days of the hearing. The determination will be based on the information presented and the parcel map’s conformance with the Map Act, General Plan, and Municipal Code.
