All right, number seven is public hearings, appeals, presentations, recognitions, and awards.

Item A is update on the 2026 general obligation bond package.

Mayor Council, good evening.

Uh just quickly, I wanted to mention that the public education phase of the 2026 bond package began about two weeks ago.

And we have had various meetings with HOAs and a number of other organizations.

And we've been out pretty much uh a couple of nights a week uh since since about two and a half weeks ago uh talking to HOAs, also Matt Hendron has been to all the coaches meetings for baseball.

And he's probably spoken to a couple of hundred uh coaches, parents, and members of their organization actually just talking about about the the various projects within the proposition.

And I want to share with counsel is that the uh the actual I would say the bulk of the initiative on public education, it begins this week and runs through April 7th, and I was wanted to share with council, and I'll be talking about these each week.

Is as a part of the public education, we're planning on uh showing approximately 30 videos, and these videos are of the various projects in the propositions so the folks can learn more about the improvements or the initiatives are being planned.

Uh there is going to be the four public meetings that we're gonna have, three in March and one in April uh throughout the community, like we did back in in August and in September when the public forum.

This time it will be to show the projects that the council chose for each of the propositions, and then the user groups, sports organizations, staff, and council will be there to answer questions of the folks that attend, and they were very well attended, and I fully anticipate that we're gonna have great attendance at those four meetings as well.

And I fully anticipate that we're gonna have great attendance at those four meetings as well.

Also, there is going to be a number of public presentations to civic organizations and community groups.

Uh there was one last Friday, uh, for example, with Civitans.

We had a couple members of council that attended, then we have a couple of that are attending uh another uh civic organization that meets in the evening.

Uh there'll be uh a number of social media posts about the propositions and about the specifically of the projects.

Uh we will be attending the Tulsa and Wagner County Commissioners meetings and give uh uh presentations to uh the commissioners at each meeting.

Obviously, they represent each uh especially Tulsa County and Wagner County.

There's members of the the commission that represent our areas, so we're gonna make sure they have a packet of information.

Uh two weeks ago, we sent out a package of information on the propositions and the projects to all of our state legislators.

So each one that represents broken arrow has a copy of that packet in case they have any questions that they can answer those questions their constituencies.

We're also going to be attending the broken air and union public school board meetings next early next month.

Aaron has coordinated those, and so we'll be going and making presentations, and then all this is gonna culminate with the distribution of what I'm calling the bond book to all the households in the community, sometimes starting around the 15th or 16th of March.

And this will be a document very similar to the one sheets that council has seen.

It will have it will have some pictures and be a little bit a little bit more uh information about the propositions.

And so uh we have put together this this phased approach to provide the education.

In addition to this, we have all the sports organization, the community groups, the Tulsa City County Library has uh two public forums in March, which council members are to know about or and are invited to attend.

And so everyone is out there actually working on providing that public information.

So when uh broken air voters go to the polls on April 7th, they will have all the information they need to be able to make uh decisions on eight propositions.

Uh everyone's been told that it's not one vote, uh yes or no.

You've got to vote eight times, and it'll actually be a video that talks about you know flip the ballot because back in 2018 there were two on the on the back side, and several people mentioned to the mayor back then is that hey, we didn't know there was a uh actually two propositions, so we had to do a quick video to remind people to flip the to flip the ballot.

So we're gonna be doing something similar there.

But it's all about making sure folks have good information and finally uh Build a Better Broken Arrow is actually working on uh putting out uh information regarding the bond package.

And so uh the last thing I wanted to say was we did get an endorsement from the uh the history museum.

Uh last week I went attended their meeting and they voted unanimously support the uh the the uh the package of eight propositions and I gave a presentation to them and they were very happy with everything in there, and so as we go to to these organizations, we'll be asking them for a letter of support or a statement to something to show their support for the council's initiative to uh actually just want to once again reinforce the fact that this package is made up of projects and initiatives that were driven by the voters, actually the citizens community with surveys, uh public attendance, HOA meetings, conversations, and our partners.

And so that's really my update now is just to give you an idea of what's about to become over the next or really over the next six to seven weeks.

Lots of meetings, lots of words.

Um item eight is citizens' opportunity to address the council on general topic uh topics related to city business or services.

I'm just trying to get information.

Before I even get started, I want to preface this.

It is again it is for life ride.

Um, I'm not against the program, not against it at all.

So um, with that being said, I'll go ahead and get started, and I will try to speed it up as fast as I can.

So good evening, mayor, um, city council and city manager.

I appreciate you guys having me today.

Um, this is the second time I've addressed this issue publicly.

At a prior meeting, I raised concerns under Article 2, Section 37 of Oklahoma Constitution.

When no corrective action was taken, I requested a review from the city attorney.

Um which I took no further action at that time.

I just let the time run out.

Um the city responded that Life Ride is a service or fee, not a tax, that the city is not a health care provider, and that the ambulance service is a public utility under Oklahoma law.

Again, tonight I'm not here to debate that position.

I'm simply asking clarification on how this program and similar charges are imposed and enforced.

And if I if you don't mind, anybody can answer these questions.

I don't mind at all.

Um, there's actually about 20 of them.

So is the city's official position that life ride is a service or fee, not a tax, correct?

We actually aren't.

We we just have to listen to you on this item since it's not an agenda item.

So we'll have to get back with you on answers.

Was that um the city has cited the attorney general opinions, including a statement from the former journey attorney general drew Emerson in support of that position.

Um, that is what I have here too.

The next would be um life ride by the city as an emergency is described by the city as an emergency medical service program.

Statements according to yours.

According to the city's fact, a monthly fee is charged to all utility customers to help pay for this service.

It should be on that.

I'm looking for a broken arrow life ride fact sheet.

It's on your city page.

I'm just trying to get um public clarification on them.

That fee is charged whether it's not whether or not a resident ever uses the ambulance or EMS service.

The city states that life ride only provides a benefit if emergency ambulance services are actually used.

Residents who use who never use EMS receive no direct life ride benefit.

Life ride is not metered or measured per household.

There is no individualized life ride service unless EMS is actually dispatched.

Residents cannot opt out of Life Ride, the life ride charge.

My concern is enforcement, not labels.

I'm almost finished.

Life ride is billed through the city's utility program.

If a resident refuses to pay life ride portion of the utility bill, the account can sit is considered past due.

A pass due utility account can result in water services being disconnected.

Water is an essential service.

9A, consideration discussion and possible approval to retain design workshop as consultants for the downtown master plan.

Good evening, Madam Mayor, Mr.

Vice Mayor, members of council, city manager, Mrs.

Spurgeon, I'm community development director, Rocky Hinkle.

Uh, tonight before you is an exciting topic.

Uh, we're looking at hiring a consultant to re envision what the downtown could look like.

Um so, in accordance with the city's comprehensive plan, the community development department is launching the master plan process for downtown broken arrow.

This initiative builds upon the foundation of the inaugural 2005 downtown plan, which successfully created the Rose District.

This new plan will serve as a strategic roadmap for the next chapter of downtown growth and revitalization.

The new downtown master plan will encompass a study area of over two square miles long from Elm to Lynn Lane and from 71st or Kenosha to 91st and Washington Street, and even further down south along 1st Street from uh Washington Street down to New Orleans.

Uh the city received 12 professional proposals after interviewing five finalists.

The selection committee recommended design workshop, who was also supported by Kimlian Horn and ADG as part of their team based on their specialized expertise in urban design and infrastructure.

The planning process is estimated to take 12 months with the projected start date in March 2026.

To ensure the vision aligns with the community needs, the city council appointed a citizens advisory as advisory committee to provide oversight alongside city staff and the consulting team.

The total professional service cost for the master plan is not expected to exceed 185,000.

The funding source for this initiative is in the sales tax capital improvement fund in fiscal year 2026.

The allotted budget was 150 150,000.

As part of this request, there is a budget amendment number 23 and a qu and a request for additional 35,000 dollars to fill the funding gap.

Staff recommends that you approve professional service agreement and budget amendment number 23 for the downtown master plan between the city of Broken Arrow and design workshop and authorized execution for the professional services agreement and budget amendment number 23.

I just think there's a lot of potential here for uh good things to come out of this um this proposal.

And I know the folks that I've talked to about the uh citizens advisory committee, they're excited they're ready to go.

So just a little timeline for you.

No, that's weird.

City manager.

I do.

I'm gonna I'm gonna mention this now.

It's a utility matter, but obviously I want to make sure that those that are watching the meeting actually see this.

Is that um it's regarding a water line break that took place on Houston Street Monday afternoon around 3 p.m.

Kinetic Boar crews significantly damaged a transmission water main on Houston between County Line Road and Highway 51?

This line feeds the subdivision to the north, which is Oak Creek estates impacting the entire subdivision.

Approximately two in our own homes to be exact.

City crews have been working on this since the impact, but this is a unique size and orientation has limited the repairs.

Uh crews were able to dig out additional lines today and locate fittings for repairs and are currently working on it.

Water for the subdivision is expected to be on this evening around seven or eight o'clock.

So really there was without water, some portions of yesterday.

Um notifications were sent out to residents yesterday.

Uh network outages this afternoon impacted some of the updates, but I just want the council members to know is that our folks have been working on this.

Obviously, sometimes water main breaks take longer than expected, but I do believe we've kept all the residents affected uh aware of what's going on.

And based on Tim's latest update, we should be we should everybody back on uh this evening.

So was that was it spotted uh beforehand?

Did they know where it was at?

I'd I'd like to ask Tim to come forward and address that question because we do have concerns about additional uh you know, basically interruptions of service, which he's trying to address.

Him and Kenny updated me this afternoon about this.

Good evening, Mayor, Vice Mayor, City Manager, City Council Timothy Robbins, Utilities Director.

Um, yes, sir.

They uh R U Tele locate crews uh were uh out there to locate our water line in advance of their work uh accordingly with their their utility dig tickets.

They did locate their boring rig on top of our line.

We so we had active locates, and they they did hit their line as they were installing.

They were installing their their utility quite low, quite closely to ours.

Uh we're gonna follow up with the engineering and construction department and the utility right-of-way coordinator to verify their um locates, their approved plans and compare those back to what we saw in the field.

So we'll be tracking everything and and billing the uh impacts accordingly.

So did Connecticut reach out to us or did our citizens reach out to us to tell us they had no water.

I believe they actually called it in uh as they they hit it, uh, and then subsequent to that, several citizens did call in and locate.

We had crews out on site quite quickly.

Um it was just uh one of those perfect storms of finding the right parts to repair it.

We ended up having to dig out almost 50 to 60 feet of line to get it properly repaired.

And so then you said kinetic will then reimburse us for us fixing the water.

We will send them the invoices, yes, ma'am.

Um I'm excited to let the council members know that the FOP has ratified uh the contract that we have reached, and so at the next council meeting, uh Kelly Cox will be presenting on my behalf the uh recommendations for a two-year agreement with the FOP.

So I'd like to thank the leadership uh for presenting that vote and the cooperation we had.

Uh, sometimes completing the contract takes a little bit longer than other times, uh but I'm very happy with the with the negotiations on both sides, and I look forward to presenting that to the council you know at the next meeting.

Secondly, is that there was a lot of work put in to this downtown advisory update, and I'm glad uh councillor green mentioned the excitement amongst the citizens committee.

And I know there's two council members plus planning commissioners, and this is going to be a good year of discussion about the vision of the I would say the next vision on how we can continue to make the Rose District, albeit the current what we know is the downtown or other areas on Main Street, continue to make it a viable place for our residents and and uh patrons coming into the community.

And then finally, I appreciate Mr.

Hayes coming this evening, and if he has list of questions, he can get those to the city council.

Uh I answered some questions that Mr.

Hayes had recently, and I'd be glad to get those questions and once we have answers, share those with council and then make sure Mr.

Hayes receives responses.

We did a work study on that.

Is that something that's on the website?

For the life ride questions, we did a work study on that.

There's frequent there is a section on there that he was referring to.

Well, I know we did a we did a a council session.

We did a work session, we did several discussions about it then and the discuss it during the budget process.

We've had the fee in place approximately three years.
