Um approval of PT 002741-2026, a conditional final plat for the Grove Phase 1, 33.66 acres, uh 105 lots, uh zoned A1 to RS3 via BAZ 001459 2024.

This property is located south of Jasper Street and west of 23rd Street, um, also known as 193rd East Avenue or County Line Road.

Um the original um early phases of this uh the preliminary plat included all three phases of this development.

Um right now tonight we're only looking at phase one during this excuse me city council meeting of September 17th, 2024 for the rezoning of this property.

It was noted that a traffic impact analysis would be performed for this development.

Uh staff has received the results of the traffic impact analysis in conjunction with this conditional final plat, um and it is included as an attachment uh to the staff report.

Uh the conclusion of the study showed that uh traffic would remain acceptable during phases one and two uh but would not be acceptable or would operate below acceptable levels at during phase three.

Um the community development director is working with the assistant city manager and the streets director um to review the proposed um mitigation options and will determine what is the best option to alleviate that.

Uh we don't expect that phase three will be coming forward till around the year 2030.

Um so we're comfortable with going forward with phase one at this time.

Uh according to FEMA maps, uh there is uh no 100 year floodplain within phase one, it's uh further west at a later phase.

This conditional final plat was reviewed by the technical advisory committee on July 14th.

Yes, this is a public hearing consideration and possible action regarding PUD-002918-2026, planned unit development, a major amendment to PUD 111, 7 Brew Kenosha on 0.70 acres, Commercial General, located north of West, uh excuse me, located north of West Kenosha Street, also known as 71st Street and west of South Aspen Avenue, also known as 14 uh 145th East Avenue.

PUD-002918-2026 is a requested PUD major amendment to PUD 111 of the Sonic PUD.

PUD 111 was approved by the Broken Arrow City Council on March 16th, 1998.

PUD 111 was created as part of the development of the former Sonic restaurant uh location at the subject property.

The sonic location closed in recent years, and the structure and property are currently unused and vacant.

During pre-development discussions, the developer was made aware of the existing PUD.

After reviewing the existing PUD, the applicant identified parking as the only requirements that would conflict with the proposed site plan development.

Thus the applicant has come forward with an application to amend PUD 111.

The request would modify parking standards from the required seven employee parking spaces and 31 customer parking spaces to require solely the seven employee parking spaces.

Seven Brew, a quick server uh beverage facility, operates solely as a drive-thru business with no indoor or outdoor seating.

Based upon the location of the property and the surrounding land uses, staff recommend PUD-002918-2026 be recommended for approval to the Broken Arrow City Council.

I I had a quite a question just for staff, and it was just uh very similar to the issue we had recently reminded me a lot about it.

So I just wanted to ask about you know what what type of study or consideration was done as far as stacking goes.

Um we talked a lot recently about another one that might be could be spilling into the street and that type of thing.

So just kind of wonder what that conversation was like and the sense of comfort to ensure that it's not spilling out into the street into neighbor's neighboring properties.

For sure, yeah.

Um a lot of it kind of especially with the stacking spaces.

Um, I mean, we at the ordinance only really requires um the minimum of the four stacking spaces.

Um and I'll have to I don't recall exactly, but um I think with this seven brew and a lot of other drive-throughs now they have you know two windows or um or sorry the two boards um to order.

Um and I can't remember how our ordinance treats that if it's now you need four because you have or sorry, now you need eight stacking spaces because you have two um menu boards, or if it's four for the two menu boards alone.

Um I don't remember off the top of my head what that um number looks like.

Um but on the um conceptual site plan for this um project, you know, you can see they have a pretty good amount of you know stacking spaces.

Um and really in terms of you know, kind of the study and discussion on you know whether that could overflow into Kenosha, um we haven't had one.

Um I'll be honest in that regards.

Um, but I think a lot of times we rely, you know, on the developers and property owners to you know kind of be their um kind of look ahead on their own and for those issues um because you know, of course, the future um you know business, you know, seven brew, if they're having issues with people out in the street, um, or going into the um that drive is actually um there's a little bit of a mutual access easement on the front, um, and then I think there's an O'Reilly's or an advanced auto parts right there.

Okay, and so um so if say if it was an issue where you know cars are you know stacking into the advanced um auto parts um business, um you know, then that would be um an issue with code enforcement and of course working with um you know that department to you know make sure that's not um you know affecting those other businesses.

And also uh just with this the amended PUD, uh remind me again like if would things change if there was a different tenant in the future, say there's someone else who who's in in control, do they have to go back to like the city standards or did they get to have their uh lesson amount of parking requirement too?

Yeah, the um the PUD would stick with the property and the and the structure, and so if Seven Brew for some reason, you know, moved on and um wasn't at that location anymore and another business came in.

Um I think we'll one of the difficulties would be in the the way the seven brew um how their developments are built, they're kind of special made almost for that type of business.

Yeah, it'd be hard for I think for like a chicken business to come in and set up in there or something.

Um so I think that will kind of be one thing if anything, if in the future, you know they're not there and someone else was looking at it, they might see that.

Um Seven Brew is able to uh pump through customers in less than two minutes each.

Uh so the the question about the stacking is is not too much of a concern as far as Seven Brew, uh the way they run their business.

As you saw too, there was a stacking of 21 before you even reached the max.

Um we're look as he said, we're looking to specifically reduce the amount of required parking in that um because Seven Brew doesn't have the inside seating, doesn't have outside seating, customers aren't meant or designed to park there and go in and get coffee or sit down and stay.

It's specifically designed to stay in your car uh and drive through, as I'm sure some of you guys have experienced in other seven brews.

Uh so that's what this request for is to just minimize the amount of parking so that we can fit the development on the the property itself.

PUD 002951-2026 is a request for a planned unit development permit for a municipal salt dome as an accessory use to the public right-of-way.

The city owned property is zoned agricultural and is located one half miles south of Kenosha Street, east of 23rd Street, at the northeast corner of 23rd and College Street.

The city acquired the property in 2019 when it was 2.19 acres, and after allocating some of that area for the bridge embankment to widen the 23rd Street Bridge over Highway 51 and allowing for some drainage on the site.

It left the site at 1.09 acres.

With the irregular shape and limited access to the site, made it difficult to try to meet different dimensional requirements.

Also, the nature and use of the salt dome does not lend itself to meeting the aesthetic requirements of the highway overlay district, as it includes concrete base with an arched metal truss structure covered with vinyl fabric.

The applicant is planning for the vinyl fabric to be green in color to blend better with the environment.

It is strictly a municipal facility intended to address roadway safety during icing conditions and only will only be used a limited number of days per year, depending on when the winter storms occur.

Fencing is proposed to be chain link or similar non-opaque material due to the site constraints after accounting for this uh salt dome.

I'm sorry, I have a typo in there, and needing to include a dry pond on the site.

The PUD also requests that no landscaping be required.

There's also an existing billboard at the billboard easement near the southeast corner of the site that limits access to the site.

Um properties around it are zoned mostly industrial.

Um to the north and east are level three.

To the south and west are level six.

Um and so the deviations that are requested with this PUD are to not have any frontage requirements or setback requirements.

The building height uh would be per the zoning ordinance.

Um the use as the minor utility facility isn't allowed use in the agricultural district.

Um they're requesting no parking requirements, uh, the chain link fence, um, that the landscaping requirements not uh be required, um, and that the aesthetic requirements uh regarding the highway overlay district not be required.

So according to section six-three-four point three of the zoning ordinance, uh, one of five purposes are to be met in order to approve a PUD and then staff's opinion.

Um this request satisfies items two and five of that section, and that the site is atypical and that it is small and has an irregular shape with limited access.

Locating the salt dome to a more central location in the city will provide a public benefit, and that salt trucks will be able to service roadways in a timelier manner.

Um, and then number five, the use of the site as a salt dome is an accessory use to the right-of-way and will aid in providing safe travel on rights of way during icing conditions and will support the city's overall infrastructure.

There is no floodplain on the property, and water and sanitary service are available from the city.

So, based on the comprehensive plan, the location of the property, and the surrounding land uses, staff recommends that PUD 002951-2026 be approved.

But yes, because of the limitations of the site, and we're trying to enclose the salt.

I don't know if any of you have driven, you know, the property, the city property behind Rema had a salt barn there for a while, and over time had been damaged.

There was a big hole in it for a while.

And so, in order to keep that type of material covered for the uses, a lot of times our streets and stormwater department.

I don't know if you guys have prepared for Christmas yet, but they have prepared for bad weather.

They've already ordered the salt for this upcoming winter season to make sure that we are adequate adequately supplied and not you know surprised.

So, because of that, we have to acquire a lot of materials such as this, and they're utilizing a new system.

I don't know if you guys heard about the brine, the salt tanks that mix salt and water, and then it goes into the specialty equipment trucks that then pre-treat the roads and continue to treat during weather events.

So that is the request for the project.

There's no gonna be no operation, like no um uh employees sited at this site, there's nothing like that there.

Yeah, so you so you don't want it in three different places?

You uh would rather have it centralized in one place?

Is that easier or as it relates to being in different parts of the city?

Is there no advantage to being over here and over here and over here versus all in one place?

So the thought for behind that is that they can order a larger amount here and it can be better controlled here.

Um we have currently there is salt up north at the public safety training complex with that police and fire share.

Um, the streets of stormwater has done a small pile over there as well.

Um, and then there's some down south.

So they're looking at majority of it at this location in the central portion, also to be closer to access to the highway, both the turnpike and um the highway 51 corridor um and things like that.

Okay, so um kind of the leaching aspect of it right now.

The salt is on like an older pavement area, and then there's tarps over it, um, and so it's not enclosed, so wind and things like that weather can affect it.

So kind of utilizing that this unique shape for a singular purpose.

Yeah, and there's one just over by the where the creek turnpike and 51 highway out there on the east side by bronze and all that stuff.

Is a request to change the zoning designation on 38.39 acres from agricultural to commercial general for a commercial development.

Commercial general zoning is allowed in level six.

And the property is located at the northwest corner of Tucson Street or 121st Street and Aspen Avenue, also known as 145th East Avenue.

In their meeting of April 19th, 2016, the City Council approved a rezoning of this site from agricultural to commercial heavy, subject to the property being platted.

This property was never platted, and under the previous zoning ordinance, plating was required before a zone change could take effect.

Therefore, the ordinance has not been prepared and the CH zoning was never codified.

In their meeting of October 23rd, 2025, the planning commission approved a lot split to split a 0.69 acre uh lot from this overall site.

Um and this current request includes both that lot and the overall area.

Transportation plan for the Broken Arrow next comprehensive plan identifies a future frontage road along the south side of the creek turnpike in the vicinity of this property.

Um other properties to the west of this site have either dedicated 80 feet of right-of-way or will be dedicating additional right-of-way for the frontage road as part of their platting process.

This project will also be required to dedicate the right-of-way for the frontage road.

Uh the initial preliminary plat that staff is reviewing shows an 80-foot right-of-way.

Um as we work through the plat, it will have to be adjusted some so that it aligns with the 80-foot right-of-way and the property to the west.

It's just a slight jog, um, but it's something we can do.

To the east is commercial zoning and is under construction for the Hackberry Marketplace with um Home Depot Hobby Lobby and other businesses.

To the south across Tucson Street is single family residential and some vacant land beyond that.

To the west has multifamily residential development and some floodplain.

According to FEMA maps, a portion of the west side of the property is located within the 100-year floodplain.

Uh no development is proposed in that part of the site.

Water and sanitary sewer are available from the city of Broken Arrow.

And so based on the comprehensive plan, the location of the property, and the surrounding land uses, staff recommends that BAZ 002954-2026 be approved.

Um approval of PT 002741-2026, a conditional final plat for the Grove Phase 1, 33.66 acres, uh 105 lots, uh zoned A1 to RS3 via BAZ 001459 2024. This property is located south of Jasper Street and west of 23rd Street, um, also known as 193rd East Avenue or County Line Road. Um the original um early phases of this uh the preliminary plat included all three phases of this development. Um right now tonight we're only looking at phase one during this excuse me city council meeting of September 17th, 2024 for the rezoning of this property. It was noted that a traffic impact analysis would be performed for this development. Uh staff has received the results of the traffic impact analysis in conjunction with this conditional final plat, um and it is included as an attachment uh to the staff report. Uh the conclusion of the study showed that uh traffic would remain acceptable during phases one and two uh but would not be acceptable or would operate below acceptable levels at during phase three. Um the community development director is working with the assistant city manager and the streets director um to review the proposed um mitigation options and will determine what is the best option to alleviate that. Uh we don't expect that phase three will be coming forward till around the year 2030. Um so we're comfortable with going forward with phase one at this time. Uh according to FEMA maps, uh there is uh no 100 year floodplain within phase one, it's uh further west at a later phase. This conditional final plat was reviewed by the technical advisory committee on July 14th. Uh staff and the TAC committee uh recommend approval of the conditional final plat for the groves subject to the comments attached with the staff report. Um and so staff uh is available to answer any questions. Thank you very much.
