1:14Approval of the joint board of adjustment meetings.

2:00We will now convene as a joint board of adjustment.
2:03The joint board of adjustment is a five-member board which has the power to hear requests for variances.
2:08Conditional uses and appeals from ministerial decisions of zoning officers.
2:12The concurring vote of two-thirds of the full board membership of the board.
2:16Four votes is necessary for approval of a variance or an appeal of the zoning officer.
2:21The concurring vote of a simple majority of those board members present in voting is necessary for approval of a conditional use permit.
2:30In accordance with Robert's rules of order, we require a motion to approve a request before before the request can be debated.
2:36As a matter of policy, all motions are made into positive.
2:43Shall authorize variances from the zoning requirements for special conditions existing on the land will can will result in an unnecessary hardship for the applicant.
2:52Financial disadvantage to the property owner shall not constitute proof of an unnecessary hardship.
3:01Moving on, agenda item 2025, JJCU 001.
3:07Jessica Andron Andronovitz has made an application 2025 JJCU 001 to the Brookings County Joint Board of Adjustment for a Conditional Use.
3:18Joint Zoning Ordinance for Brookings County and City of Brookings Article 3 District Regulations Chapter 3.04 A Agricultural Lands District Section 3.04.

5:00Her business plan is included as a separate attachment and includes the following.
5:13The applicant has kept up the property, controlled the weeds and replaced fences and added new fences for additional turnout areas since she has taken over the property.
5:22Vehicle and trailer parking on the lot is available for the borders.
5:26The applicant was approved for a conditional use 2022 CU 014 on October 4th, 2022 for a maximum of 30 horses, and that was valid for three years and will expire on October 4th, 2025.
5:39She continues to manage and operates the facility as it had been run in the past and like to continue the business into the future with a maximum of 50 horses.
5:48This is a formal just a brief history.
5:51I'll just kind of glance highlight some of that.
5:54Um it's a former Neil Sebring property, and the facility was approved for a horse stable back in 1997 with a conditional use and special exception and at that time.
6:05Since that time, it's um always been a horse arena up until now, up until continued to this time from 16 2003, 2016, 18, and 19 and 22 with different operators operating the facility.
6:40Objections to the request.
6:41Public notices are published in the Vulgar Tribune on August 21st and 28th, 2025.
6:47Letters were sent to the adjoining landowners, the Aurora Township Chairman and Clerk, and the Brookings Community Development Office.
6:55Here is the applicant's conditional use application.

7:08This is 25th Avenue driveway coming in.
7:11These are the additional pastures or uh fencing she has uh installed to have more lots for the pasture horses out there compared to what I was when she started.
7:23These extra a little more useful for her and for the borders of their horse parking lot over here where the trailers are parked.
7:31This is the barn and stables right here.
7:33This is the outside exercise, the arena area.
7:39This is her business plan.
7:45Stated it's on 24 acres out there.
7:48It can be listed under Bayview Farms.
7:52Her maintenance plan, her border requirements, emergency contact and information.

9:09This is the manure storage area right there, which is hauled out once a month for that.

9:20This is looking towards the west where she made the made some more lots, made an alleyway down here and two pens on the north and two pens on the south.
9:28This is just looking from the driveway towards the north pens that she made, all kept up and mowed around there.
9:34Um, it's looking towards the north and dividing the dividing fence between the two lots.
9:40So the applicant is not able to be here this evening as she had a previous commitment appointment with a veterinarian on her facility.
9:47Um did receive one comment.
9:50I'll read that now from adjoining landowner Mike Barkley.
9:54He wanted to note that Miss Adronowitz operation on the property has never looked better, and she has done a wonderful job.
10:00He has no issues with her conditional use request.
10:05If there is questions that do arise, we can contact Miss Adronowitz by phone for her answers if there's any question that the board may have.

11:01Uh no, as you mentioned in your report, we've reviewed the application and have no objections, no comment beyond your staff report.
11:11An application for conditional use for it have them filed on the with the joint board acting as a board of adjustment, a copy of the application being attached here to such application being made by Jessica Adronowitz regarding their filing real property.
11:26Lot M2 of Warrior Commercial Part Edition and Lot M2 of Warrior Commercial Park 2nd Edition to include vacated portion of the street included in the southwest one fourth of section 18 Township 110 North Range 49 West Aurora Township, located at 1900 25th Avenue, Brookings, South Dakota.
11:43After due notice, a public hearing have them been held on the application on the second day of September 2025.
11:50Number one, the joint board hereby finding that it is empowered to grant such a conditional use under the following sections of the joint zoning ordinance for the Brookings County and the City of Brookings.
11:59Article 3, District Regulations, Chapter 3.04 A Agricultural Land District, Section 3.0402, conditional use permit number 24, stables.
12:10And further finding the granting of the conditional use not will not adversely affect the public interest.
12:15Number two, the joint board further finds and certifies that the following specific specific rules governing the conditional use requests have been complied with.
12:23Emergency file and safety plan to be on file.
12:26Number three, the joint board further finds that satisfactory provisions and arrangements have been made concerning the following were applicable.
12:33A entrance and exit to the property and proposed structure therein with particular reference to automotive and pedestrian safety, convenience, traffic flow, and control, and access a case of fire or catastrophe.
12:45Entrance and exit to the property will use existing driveway on 25th Avenue.
12:52B off-street parking loading areas were required with particular attention to the items and A above with economic noise, glare, or other effects of the conditional use on adjoining properties and properties generally in generally in the district.
13:05No on-street parking, use on-site parking.
13:10Utilities and refuge and service areas with reference to locations, availability and compatibility.
13:16Dumpster service for garbage and refuge disposal.
13:21D, screening and buffering with reference to type, dimensions, and character.
13:28E signs of any and proposed exterior lighting with reference to glare, traffic safety, economic effect, and compatibility and harmony with properties in the district.
13:3732 square foot sign allowed and any required safety signs.
13:41F required yards and other open spaces.
13:44Spraying of all noxious and other weeds before they go to seed, monitoring weed growth and weed control by spraying, mowing, or tilling by permit holder or designated spray professional sprayer service.
13:56Weed controls pursuant to South Dakota Codewide Law 38-22.
14:02General compatibility with adjacent properties and other properties in the district.
14:06Comprehensive plan is met for the agricultural district.
14:10H roads providing access to the property are adequate to meet the transfer transportation demands of the proposed conditional use.
14:18The Board of Adjustment may require the applicant to enter into a written contract with any affected township or other governmental unit regarding the upgrading and continued maintenance of any roads used through conditional use as required as requested prior to the issuance of a conditional use.
14:3425th Avenue meets the transportation demands of the conditional use.
14:39I need required notifications to law enforcement or fire department.
14:43Notifications to Brookings County 911 and Brookings County Emergency Management of any hazardous materials or chemical spills.
14:51Any safety inspections.
14:52Any inspections required for building permits.
15:00The joint board further determines on the conditions as conditional use permit upon the following additional special conditions or safeguards.
15:04A best management practices to be used for.
15:07Number one, manure disposal storage area.
15:10Two, insect control.
15:12Three, grassland management.
15:15B maximum number of horses is 50 boarded horses at any one time.
15:22Any deceased animals to be to be disposed of within 24 hours.
15:27D host clinics or schooling shows with a maximum number of 20 attendees per event.
15:35The joint board of adjustment needs a majority approval of the members.
15:39Well, that should be no, it is majority.
15:42Of the members present to grant a above petitionary conditional use permit for the above described or property as follows.
15:48Conditional use number 24 stable for horses.
16:14If approved, the Brookings County Zoning Director is authorized to issue any required building permits for the construction consistent with the requirements of this conditional use.
16:27Date of the second day of September 2025.
16:35Are there any additions or corrections to the findings of facts?

16:44No, this is until she decides to cease operations or sell the property, she does not have to come back in three, five, ten years to renew it.
16:58Chair, I find that this application meets the requirements of the zoning ordinance as long as the findings of facts are allowed are followed.
