Case 2648, Little Fawn Lane Private Driveway and Stream.

0:25

Case number 2621.

0:28

Golick multifamily development.

0:30

It's on remand from the zoning board of appeals.

0:35

Case number 2649, 5369, 269, Main Street contract zoning application for parking and case number 2630, the Brunswick perimeter trail phase one.

0:53

Um and we'll be opening that up and then tabling it.

1:04

Rob Burgess, uh Planning Board Vice Chair next to Rob.

1:08

Steve Walker next to Steve, Chris Baldwin.

1:12

Um Laura Hatmaker is uh on Zoom, and Alison Harris is on Zoom.

1:19

And on my near left, Julie Erdman, director of planning and development, next to Julie.

1:26

Matt James, our land use planner, and I'm Bill Dana.

1:30

Um Matt, would you start us off?

1:35

First up we have case number 2648, Little Fawn Lane Private Driveway and Stream Crossing.

1:42

The planning board will review and act upon a major development review sketch plan application submitted by Site Lines PA on behalf of the property owners, Robert Muller and Judith Portermuller for a new private driveway to serve a residential lot.

1:57

The subject property is located on Little Fawn Lane, map 742, and within the rural farm and forest zoning district and the shoreline protection overlay and shoreland protection overlay stream protection subdistricts.

2:11

Thanks.

2:12

Uh before I come to you, Joe, I uh I'd like the staff has reviewed the application and determined that it's complete.

2:19

I'd like a motion that the staff review committee uh that the planning board concurs with staff's conclusion that the basic sketch plan major development review application materials have been submitted and that the application is uh complete such that the committee, the board may proceed with substantive review of the application and identification of any further information required from the applicant.

2:46

Do I have a motion to that effect?

2:47

Motion by Steve, second by Chris.

2:50

All those in favor.

2:53

I see Laura and Alison.

2:56

Do I have your hands?

2:58

Okay, that's unanimous of the board members present.

3:02

Thank you.

3:04

All right.

3:05

All right.

3:06

Joe.

3:07

Thank you.

3:08

Uh my name's uh Joe Martin.

3:10

I'm here on behalf of the applicant.

3:12

Um just go through the first one.

3:16

Um so the the applicant, as Matt noted, is Robert Mueller and Judith Portermuller.

3:21

Um Robert Mueller should be on Zoom, and he uh will have a short uh presentation after I finish mine uh tonight here as well.

3:29

He's wants to provide some comments on the project as a whole.

3:32

Um so site lines um is the engineer and surveyor record for the project.

3:37

Um so the project was a piece that was the the properties was a piece that was carved out of a subdivision that was approved by the board a number of years ago, Douglas Ridge subdivision.

3:48

Um we were also the the surveyor and engineer record for that project.

3:52

Um so um one of the things that uh we had to do for this uh project is update the wetland delineate delineation that was done a number of years ago.

4:02

Um that was um the the wetlands didn't change the the stream um limits of the stream did change slightly from the previous delineation, but um all that's been updated for this application.

4:16

Uh the review process, um so we initially submitted this to staff review as a sketch final approval.

4:21

I was kind of one uh based on the comments we received at staff review.

4:25

We've decided to separate this and do a sketch review, and then we'll come back uh for a final review review at a future planning board meeting.

4:32

Um we have submitted to the Army Corps of Engineers for a permit for the wetland impacts of stream crossing.

4:38

Uh meeting with the project manager for the Army Corps next week to uh address some comments uh she has and then hopefully that permit will get wrapped up.

4:47

Um we have submitted and received uh the um NRPA perm by rule from the DP uh for the wetland crossing and uh well sorry, wetland impacts of stream crossing, um, and that should be um in your packet as well.

5:02

So this is an aerial of the project area.

5:06

Uh so hacker road kind of cuts east to west on the screen.

5:10

Uh Rose Douglas Lane is a private road, and that's part of that uh previous subdivision that was approved.

5:16

Um you can see the majority of the house lots within that subdivision have been developed at this point.

5:21

Uh but there is one piece of land over here that was left as retained by owner.

5:27

It was a little over five acres, and it was retained by the original owner for a future house slot, which they're now looking to move forward with uh constructing a house on at this point.

5:39

Um the summary of the project.

5:41

So again, the the uh side area is a little over five acres.

5:45

Uh it's in the RF zoning district, as I noted before, it's retained by owner.

5:49

Um so the the project itself is just the construction of a private driveway that is required to cross over a stream to get to the buildable portion of the property.

5:59

Um the reason that's coming to you for review is because um the project results in more than a hundred cubic yards of earth moving within the SBO SP overlay district, um, and because of that, that requires a uh site plan approval uh from the planning board.

Summary of Proceedings

Brunswick Planning Board Meeting - September 22, 2026

The Brunswick Planning Board met on September 22, 2026, to review and act on four development cases: a residential driveway and stream crossing sketch plan, a remanded multifamily housing project, a contract zoning application for parking reduction, and a multi-use trail. The meeting included board deliberations, public testimony, and votes.

Case 2648: Little Fawn Lane Private Driveway and Stream Crossing (Sketch Plan)

Presentation: Joe Martin of Sight Lines PA, representing property owners Robert Muller and Judith Portermuller, presented a proposal for a new private driveway and pipe-arch culvert crossing a minor tributary stream to access a five-acre residential lot in the Rural Farm and Forest district with Shoreland Protection overlay. The project required a major development review due to over 100 cubic yards of earth moving within the overlay district. Staff review had separated the original sketch-final submission into sketch and final phases. The applicant had submitted to the Army Corps of Engineers for a permit and obtained an NRPA permit by rule. Board Discussion: Members discussed:

  • Driveway grade (13% down, 12.5% up) and concerns from fire department and town engineer about steepness.
  • Culvert type: applicant proposed an embedded pipe-arch culvert; environmental planner and board members (Laura, Steve) preferred a bridge or open-bottom arch to reduce stream fragmentation and erosion.
  • Wetland and stream impacts: 4,000 square feet of wetland fill; stream width (average 4.5–5 feet, maximum ~5.25 feet).
  • Erosion control: need for turf reinforcement mat and better sediment barrier placement.
  • Financial capacity: initial cost estimate of $20,000 was deemed unrealistic; board requested a detailed engineer’s estimate.
  • Alternatives: T-walls (head walls) suggested to shorten crossing and reduce slopes. Public Comment: None. Vote: The board initially split 3-3 on approving the sketch plan. After discussion, a motion was made and seconded to approve the sketch plan with the stipulation that the road grade not exceed 10% (as referenced in staff review). The motion passed unanimously.

Case 2621: Golick Multifamily Development (Remand from Zoning Board of Appeals)

Background: The project at 23 Thomas Point Road (14 units affordable housing) was remanded by the ZBA on August 11, 2026, for insufficient findings. Staff requested the remand. The board reviewed amended findings and an additional Cook’s Corner Design Standards analysis. Board Discussion: Members praised staff for detailed findings, noting that some Cook’s Corner standards were deemed inapplicable or impossible to meet due to code conflicts, and that the project meets others to the extent possible. Staff added a condition requiring a revised landscaping plan with plant sizes meeting design standards. Public Comment: Three speakers:

  • Jennifer Johnson (abutter, 21 Thomas Point Road): questioned the application of Cook’s Corner standards, requested clarity on waivers and plan control documents, and expressed concerns about parking (14 units with 10 spaces – but later clarified 14 spaces).
  • Dora Stewart (25 Thomas Point Road): expressed concern about density compared to her lot; said she did not receive notice.
  • Jennifer Navarro (appellant, 90 Thomas Point Road): argued that the remand task was not met, cited internal contradictions in findings (e.g., density stated as 18 units then 19.13), issues with landscaping, financial capacity, and noticing. She requested specific findings and threatened legal action. Vote: Motion to approve a waiver for tree removal plan (unanimous). Motion to approve the project with conditions (unanimous). Conditions included: original case 2354 conditions remain in effect; applicant to provide evidence of funding prior to building permit; revised landscaping plan with Cook’s Corner-compliant plant sizes.

Case 2649: 53-69 Main Street Contract Zoning Application

Presentation: Ryan Barnes of LJB Inc. presented a request to reduce off-street parking from 87 spaces to 41 spaces for a mixed-use redevelopment (34 residential units, 8 commercial spaces) at the corner of Mason and Main Street. The site is contaminated (former gas station). The contract zone would allow the reduction; the project includes a parking garage with capacity for lifts to reach 74 spaces. Ryan highlighted:

  • Environmental benefit: remediation of contaminated soil (~10,000 cubic yards, 700 truck trips).
  • Economic benefit: annual tax revenue increase from ~$23,000 to ~$337,000–$472,000.
  • Consistency with Comprehensive Plan, Climate Action Plan, and past parking studies (2001, 2025) showing adequate downtown parking.
  • Intent to incorporate streetscape improvements and assist with Chimney Swift habitat. Board Discussion: Members asked about administrative adjustment (not possible for such a large reduction), lift costs ($15,000 each), contamination management, and parking allocation for condos. Board expressed strong support. Public Comment: None. Vote: Unanimous motion to recommend the contract zone to the Town Council, finding it consistent with the comprehensive plan, consistent with allowed uses, and subject to sufficient conditions.

Case 2630: Brunswick Perimeter Trail Phase One

Update: Staff noted that noticing requirements for the public hearing were met but the information needed for board review was not yet ready. The board voted unanimously to table the item to the next meeting on October 13, 2026.

Key Outcomes

  • Case 2648: Sketch plan approved with stipulation that road grade not exceed 10%.
  • Case 2621: Project approved with three conditions (uphold prior conditions, provide funding evidence, submit revised landscaping plan).
  • Case 2649: Unanimous recommendation to Town Council for contract zone approval.
  • Case 2630: Tabled to October 13, 2026.
