0:17

Good evening.

0:18

Wow, this one works good.

0:19

Um, welcome to the City of Bullhead City's uh regular planning and zoning commission meeting.

0:25

Today is Thursday, August 3rd, 2023.

0:29

Can we have a roll call, please?

0:32

All commission members are present.

0:34

Thank you.

0:34

And if you would all join me and rise for the Pledge of Allegiance.

0:46

And to republic for which it stands.

0:50

Underground with the justice for all.

0:57

Okay, now is the time for the call to the public.

1:00

So if anybody has anything they would like to comment on that is not on the agenda, now is your chance.

1:07

You have three minutes unless you are representing a group of individuals with you, and then you get five minutes.

1:14

Seeing nobody rise, we'll close the call to the public.

1:21

I didn't do it.

1:25

Blame me on my first day.

1:28

Okay.

1:29

Um first on our agenda is approval of minutes from our previous meeting.

1:35

I make a motion to approve our July 6th minutes from our regular meeting.

1:41

I second that.

1:42

So we have a motion to approve the minutes from the July 6th meeting as read.

1:48

A second and a second.

1:49

All in favor.

1:52

All right.

1:56

We need um Commissioner Genovies.

2:02

Did you push your button?

2:03

We need everybody to push their buttons tonight, please.

2:08

Yes, the why.

2:09

Yes.

2:11

Seven in favor of the motion.

2:13

Motion carries.

2:16

Okay.

2:17

Hearings for items and action items.

2:19

Good thing I brought glasses.

2:21

Um I actually the the number two on your in your book is the annual review of the planning and zoning commission bylaws according to section 302.

2:33

I brought this up last month, so I guess I'll start.

2:38

Excuse me.

2:40

We have in section 105B and Section 206 both mention removal of members.

2:51

However, they both also state that the commission has to vote to remove a member.

2:57

The only reason I'm bringing this up is when I first joined this commission, we had two can uh member uh excuse me, commissioners that never showed up, and it was very frustrating.

3:07

And um I would just I would kind of like to make it so that if they miss whatever number it currently reads three missed meetings in a 12-month period.

3:19

I think it should be two missed meetings, but that they're automatically removed that we are not forced to vote to kick them off.

3:27

That's just my opinion.

3:29

I don't know what you all think.

3:33

Would this be removed because of absences with reason or just no an excuse?

3:40

No show, no call, no show.

3:42

Yeah, no call, no shows, an excused.

3:44

I mean I've missed one meeting since I've been on this committee, um, but I gave Johnny three months notice for it.

3:50

So it was for my grandson's surgery, so um, I don't know.

3:56

I it's it's it's up to you all right now.

3:58

It reads that we have to vote somebody off if they just don't show up, and I just think it ought to be automatic.

4:09

I I can I can uh provide a little bit of uh uh guidance on that.

4:14

Um the council might entertain uh an automatic referral to them, but any uh appointee is subject to city council remover, so no one would ultimately be removed until council voted it.

4:29

If you wanted it to be an automatic referral to them, that they might entertain that amendment uh to it, but um they might want to have a consistency with the other bylaws, which there's several sets, and so if they choose to do that, they probably do that on all of them.

4:47

But that's just my input as far as the effect.

4:50

Okay, well, and and that that works for me.

4:52

I just I think it's difficult for the seven seven of us to point out one person and say, you know, you're you're failing and you're gone.

5:01

If it's obvious and it's on, you know, then it's automatically going back to council.

5:06

Then people are expected to do the job that they volunteered to do.

Bullhead City Planning & Zoning Commission Meeting - August 3, 2023

The Bullhead City Planning and Zoning Commission met on August 3, 2023, at 1:30 PM. All seven commissioners were present. The meeting included approval of minutes, discussion of commission bylaws, three zoning and general plan amendment requests for two separate parcels, and a code amendment for accessory structures in multifamily districts. All items except one code amendment vote were approved unanimously.

Consent Calendar

  • Approval of July 6, 2023 Meeting Minutes: A motion to approve the minutes as read was made and seconded. The commission voted 7-0 in favor, and the motion carried.

Discussion Items

  • Annual Review of Planning & Zoning Commission Bylaws: A commissioner proposed amending Section 105B and Section 206 to automatically remove members who miss two (rather than three) meetings in a 12-month period without excuse, eliminating the requirement for a commission vote. Staff noted that any removal would still require City Council action. After discussion, the chair concluded there was no consensus, and the item was tabled without a vote.

  • Zoning Map Change Z18-006 (Second Time Extension): Request to extend by four years the stipulation deadline for a 52.46-acre parcel (the Laughlin parcel) west of Highway 95 north of 7th Street. Originally approved in 2019 for mixed-use commercial and multifamily, the applicant (Don Anderson, Anderson Nelson) cited pandemic, supply chain, and interest rate delays, stating that 80% plans and a ADOT-approved traffic signal were completed. Commissioner Mel stated a general opposition to four-year extensions after the first extension but noted this was only the second request. Public hearing had no speakers. Motion to approve passed 7-0.

  • Minor General Plan Amendment P23-001 (2525 Rio Rancho Boulevard): Request to change the land use designation from medium-density residential to light industrial for a portion of an 80.49-acre parcel. This was the first step toward rezoning for sand and gravel mining. Applicant Dan Ayler explained the parcel is a FEMA floodway, and no processing would occur on site. Public comment: Scott Merrill (resident of Desert Glen) expressed concerns about noise, buffers, and 24-hour operations, but said he was not opposing the change. Staff noted specifics would be addressed at the conditional use permit (CUP) stage. Motion to approve passed 7-0.

  • Zoning Map Change Z23-007 (Same Parcel): Request to rezone the same 80.49-acre parcel from PL (Public Land) to M1 (Light Industrial). Applicant Michael Stone (S&S Concrete) stated the mining would support ongoing demand and create 2–5 new jobs. Public hearing: no speakers. Motion to approve passed 7-0.

  • Minor General Plan Amendment P23-002 (1805 Bullhead Parkway): Request to change land use from medium-density residential to light industrial for a 78.49-acre parcel. Similar to prior item, this parcel is adjacent to existing CMEX mining operations. Applicant Dan Ayler noted the property has been used for mining since the 1970s. Public hearing: Dan Ayler spoke briefly; no other speakers. Motion to approve passed 7-0.

  • Zoning Map Change Z23-008 (Same Parcel): Request to rezone the same 78.49-acre parcel from PL to M1. Discussion focused on truck access, separation of operations (Pass Canyon Wash vs. Silver Creek), and that no processing would occur on this site. Commission clarified the two parcels are not contiguous and operations are separate. Motion to approve passed 7-0.

  • Code Amendment – Accessory Uses, Buildings, and Structures (Title 17, Chapter 17.06.140): Request to add the phrase “in the R2MF multifamily district” to apply the same standard as single-family districts, limiting accessory structures to 50% of primary living space. Staff explained this prevents overbuilding on multifamily lots (e.g., tiny house with huge garage). Public hearing: no speakers. Motion to approve passed 6-1 (Commissioner Steve opposed).

Key Outcomes

  • Approved: Minutes (7-0); Z18-006 time extension (7-0); P23-001 general plan amendment (7-0); Z23-007 zoning change (7-0); P23-002 general plan amendment (7-0); Z23-008 zoning change (7-0); Code amendment (6-1).
  • No Action: Bylaws amendment discussion – tabled due to lack of consensus.
  • Next Steps: For the two parcels at 2525 Rio Rancho and 1805 Bullhead Parkway, applicants will return for conditional use permits for mining operations, where specific conditions (noise, buffers, hours) will be addressed.
