Speaker 1

5:23

Good morning.

5:24

Welcome to the May 14, 2026 uh meeting of the Charles County Board.

5:29

Ms.

5:29

Weshler, the first agenda item, please.

Speaker 2

5:31

Our first agenda item is BP Waldorf LLC trading as Boston Gourmet Pizza 10440 O'Donnell Place, Waldorf, Maryland.

5:40

They're requesting two things: permission to operate for a period not to exceed 30 days under the current license and permission to be closed for more than 10 consecutive days.

5:51

Ms.

5:51

Sue Greer is here representing them.

Speaker 3

5:56

If it's okay, because I feel I think you all know

Speaker 4

5:58

I'm so short that I disappear behind the

Speaker 3

6:01

screen.

6:02

So Sue Greer on behalf of the Creek Sports Bar LLC, and as Ms.

6:08

Weschler indicated, we're here requesting two things to operate under the license, the existing license of uh BP Waldorf LLC trading as Boston's Gourmet Pizza, and to be closed for more than 10 days.

6:21

And first, I really want to thank you all for putting me first on your agenda.

6:25

I'm between meetings, so I did put my sneakers on and run over here and uh appreciate the consideration.

6:33

So what is happening with um Boston's, as you know from our correspondence, is that that establishment, the request to be closed for 10 days, is because renovations will be done within the establishment to physically create a physical separation between physical space of the Creek Sports Bar and restaurant and a new restaurant that will be coming in, a brick and mortar restaurant known as Flavor Hive Restaurant.

7:01

And meanwhile, I just want to let the board know that the individual that will be managing the Creek Sports Bar and Restaurant is the same manager that was employed by Boston.

7:14

So this is a great opportunity for her.

7:16

She has great experience with the establishment, very excited, as well as the liquor license, the resident liquor license holder, uh Courtney Goldsmith will also still be the same resident agent for that.

7:28

On the flavor hive, which will be physically separated, you will not be able to get from the creek to the flavor hive without going outside because I know that that was a concern legitimately raised by the county attorney's office, and we wanted to make sure that we had addressed that.

7:58

Um bartenders and other employees employed while we go through this process and hopefully look forward to bringing two great establishments to this county.

Unassigned speaker

8:11

So

Speaker 3

8:11

there you go.

8:13

And I think this board, I want to commend you, you've always found a way to work with businesses, and we're asking for that consideration today.

Speaker 1

8:22

Um is there my questions to the any questions from the board?

8:26

Ms.

8:27

Jones.

Speaker 5

8:33

I I

Speaker 4

8:36

have some questions.

8:40

And I think that um our county attorney I I'm not sure that the timing is correct on this.

8:50

This is not questions for you.

8:51

This is quite

Unassigned speaker

8:58

when

Speaker 4

8:58

did Boston's cease their business operations?

9:02

The one that holds the liquor license.

9:04

When did they when did they stop?

Speaker 6

9:05

I have no information about that.

9:07

Uh Ms.

9:08

Jones, but um,

Speaker 4

9:10

Miss Weshler, you probably do.

9:12

Do you

Unassigned speaker

9:12

know I

Speaker 2

9:15

I don't know.

9:16

Um I know that Miss Greer submitted an application for the transfer a while ago.

Unassigned speaker

9:24

Ms.

Speaker 4

9:24

Greer, do you know when you submitted the transfer?

Speaker 3

9:26

Well, I I can go back because the rule exists within your rules just for this correct.

Unassigned speaker

9:31

So on April 7th, we requested because we had gotten notice from frankly franchise at Boston's that things had to accelerate.

Speaker 3

9:39

We had a quicker date that they thought, as as you know, when you're doing a sale of a business, things are fluid.

Unassigned speaker

9:45

And when we receive that notice, we submitted on April 7th a request to the board through the clerk and the county attorney's office to operate under that license with an anticipated closing date or transfer date, should I say sale date of the property on which Boston sits of uh May 24th?

Speaker 3

10:11

Actually, I apologize.

10:13

I apologize.

10:14

I just said May 24th, and May 24th hasn't happened.

10:16

It was we were anticipating closing on April, and I think that's in my letter of the request that you have in front of you that we had anticipated closing on April 24th, correct?

Speaker 4

10:31

So you submitted a letter to the clerk to our clerk to say we'd like to we'd like to continue operating under Boston's liquor license for 30 days as allowed by the rules.

10:47

Correct.

10:48

And that was April 7.

10:51

And that's all it requires is a letter.

10:54

There's no approval or

Speaker 3

10:56

no, and there is the the your rule, let me just be very clear.

Charles County Board Meeting: Liquor License Dispute and Approvals (May 14, 2026)

The Charles County Board of License Commissioners met on May 14, 2026, to address a contentious request from the Creek Sports Bar, several temporary alcohol beverage licenses, and a standard license transfer. A significant portion of the meeting focused on a business that operated under a liquor license without explicit board approval, leading to a legal consultation and a compromise.

BP Waldorf LLC / Creek Sports Bar (Contentious Discussion)

Attorney Sue Greer, representing the Creek Sports Bar LLC, requested permission to operate for 30 days under Boston Gourmet Pizza's existing license and to close for renovations to separate the bar from a new restaurant (Flavor Hive).

  • Appellants' Position (Sue Greer): Argued that the business acted in good faith, following what they believed was an approved process. A miscommunication with the county attorney's office occurred. Ms. Greer asked the board to consider the substance of the rules over technicalities and acknowledged the need to fully comply.
  • Board Positions: Commissioner Jones expressed significant displeasure, stating, "everybody has to follow the same rules so that the playing field is even." The Alcohol Enforcement Officer (Mr. Potter) characterized the unlicensed sale of alcohol as a serious criminal matter. Ms. Bronner questioned the lack of written confirmation authorizing sales.
  • Resolution: The board entered a closed session for legal advice under the General Provisions Article. Upon returning, three motions were passed:
    1. Approved the closure of the business for more than 10 consecutive days for renovations.
    2. Extended the validity of the Boston's license until June 11th to facilitate the transfer.
    3. Denied the request to operate under the current license for any purpose other than applying for the transfer, effectively preventing the sale of alcohol until a new license is formally approved.

One-Day Temporary Alcohol Beverage Licenses

American Legion Post 82 (Joe Williams Memorial Golf Tournament): Approved. The event is scheduled for June 26, 2026, from 7:30 AM to 3:00 PM at the White Plains Golf Course with approximately 144 attendees. St. Charles Running Festival (Celtic Star Inc.): Rescheduled to a future meeting as the representative, Damon Smalls, was not present. Island Roots Foundation (Trio Fest): Approved. The wine, beer, and food festival will take place on August 1, 2026, from 11:00 AM to 8:00 PM at the Charles County Fairgrounds with an expected 1,000 attendees. Security and alcohol management plans were discussed. Maryland Senators Baseball & Softball (Golf Fundraiser): Approved. The event will be held on June 5, 2026, from 7:00 AM to 4:00 PM at the White Plains Golf Course with approximately 120 attendees. Indian Head Volunteer Fire Department & Rescue Squad (Golf Fundraiser): Approved. The event is scheduled for May 15, 2026, from 7:30 AM to 5:00 PM at the White Plains Golf Course with approximately 150 attendees.

License Transfer Application

Grinders Spirits LLC (Ratosh Rasosh and Rusty Grinder): The board approved the transfer of the Class D beer, wine, and liquor license from Rusty Grinder to Ratosh Rasosh. The approval is contingent on the successful completion of the Use & Occupancy permit, Health Department permit, and the resolution of a Comptroller's hold. Attorney John Quinn represented the applicants. Mr. Rasosh expressed confidence in running the store despite limited management experience.

Consent Calendar

  • The board approved the meeting minutes for April 9, 2026, and April 29, 2026.
  • The April 2026 monthly inspection report, presented by Mary Jane Couples, was received without questions.
