Summary of Proceedings

Crestwood Planning and Zoning Commission Meeting – November 7, 2024

The Crestwood Planning and Zoning Commission held a regular meeting on November 7, 2024, at 6:00 PM in the Aldermanic Chambers. Note: The published agenda listed the meeting as Wednesday, November 6, 2024, but the summary date is provided as November 7, 2024. The commission considered four public hearing items (two conditional use permits, two text amendments), heard public comment on a new business, and discussed potential changes to residential fence regulations. All votes were unanimous among the four voting commissioners present.

Consent Calendar

  • Approval of Minutes: The minutes from the October 2, 2024 Planning & Zoning Commission meeting were approved unanimously by voice vote.

Public Comments & Testimony

  • Michael Crouch (representing a new Dunkin’ Donuts franchise) spoke during public comment about plans to open a drive-through restaurant at the former Emo’s Pizza location on Watson Road. He stated the company would completely remodel the existing building, take possession on December 1, 2024, and aim for a second-quarter 2025 opening. This would be the 14th Missouri location. Commissioners expressed enthusiasm and noted the site’s history.

Discussion Items

  • CUP-9-24 – Turkish American Intercultural Education Foundation (9201 Watson Rd): Staff presented a request for a conditional use permit for an assembly-limited use (cultural/community center) in a vacant 31,000-square-foot office building. The applicant, attorney Ed Grizzedeck, explained the foundation would relocate from Lemay, serving about 100 families with evening and weekend activities (20–50 typical attendees, up to 175 for rare events). No alcohol or smoking; minimal traffic impact due to off-peak hours and right-turn-only access. Staff recommended approval with conditions A–J plus property maintenance code compliance. The commission voted unanimously (4-0) to approve.
  • CUP-10-24 – Lighthouse Christian Fellowship (9147 Watson Rd): A similar request for a religious assembly use in a vacant 5,000-square-foot building, with a congregation of 15–40 for evening/weekend Bible study. Applicant Robert Wells noted minimal interior changes (removing a non-load-bearing wall) and a lease arrangement. Staff recommended approval with conditions A–J plus property maintenance code. The commission voted unanimously (4-0) to approve.
  • Text Amendment – EV Charging: Staff proposed adding a code requirement for a clearly identified emergency disconnect switch at each EV charging station (per fire marshal). Discussion also raised possible setback requirements for residential EV stations. The commission voted unanimously to continue the public hearing to the December 2024 meeting to allow further study and possible additional amendments.
  • Text Amendment – Home Based Businesses: Staff proposed expanding the definition of short-term rentals to include rental of accessory structures, swimming pools, trampolines, and similar amenities (effectively prohibiting such rentals in residential districts), and aligning the home-based business definition with state law to exclude businesses primarily conducted in yards. No public comment. The commission voted unanimously (4-0) to recommend approval.
  • Discussion: Residential Fences: Staff presented options for defining when a fence repair triggers full code compliance (e.g., threshold of one-third of total fence length replaced within a year, based on examples from Kirkwood, University City, and Webster Groves). Staff also raised concerns about six-foot privacy fences on corner lots creating visibility hazards for neighbors backing out of driveways. Public comment: Stephen Crawford (8914 Mandalane) described five near-miss incidents with pedestrians due to a neighbor’s six-foot privacy fence located 15 feet from his driveway, urging a site-triangle requirement. Commissioners generally favored a one-third repair threshold per year and using the established site-triangle standard to restrict privacy fences near driveways on corner lots. No formal vote was taken; staff will draft a formal code amendment for a future meeting.

Key Outcomes

  • CUP-9-24 (Turkish American Intercultural Education Foundation): Approved unanimously (4-0).
  • CUP-10-24 (Lighthouse Christian Fellowship): Approved unanimously (4-0).
  • EV Charging Text Amendment: Public hearing continued to December 2024 meeting.
  • Home Based Business Text Amendment: Recommended for approval by unanimous vote (4-0).
  • Residential Fences: Staff directed to prepare a code amendment incorporating a one-third repair threshold and site-triangle restrictions for corner lot fences, to be presented at a future meeting.
  • Both approved CUP items will be forwarded to the Board of Aldermen for final action (scheduled for later in November 2024).
