So we have three.

2:35

Um at this point in the meeting, I'd like to open up for public comment.

2:39

Uh, if there's anybody from the public that would like to speak uh to the planning and zoning commission on matters other than what's in front of us uh this evening, now is your opportunity to do so.

2:54

And seeing no hands raised or people walking forward, uh we can uh move on to hearings.

3:02

Uh can I entertain a motion to open the public hearings, please?

3:06

So moved.

3:07

Thank you, Commissioner Charbonneau.

3:08

Thank you, Commissioner Seven.

3:10

Um Danny, at this point, do you have uh uh uh staff report for the first item, the text amendment for EV charging.

3:19

Uh yeah, uh real quick.

3:21

So um this item came up at our at our last meeting.

3:24

Um I did ask for the commission to continue the public hearing um to add a an additional note, but uh this amendment was introduced because the uh fire chief uh would like us to add uh requirement that all electronical vehicle charging stations should have a clearly marked emergency shutoff uh added to the equipment uh for safety reasons.

3:48

Um that the fire marshal uh or building officials should inspect uh those stations before any zoning reviews are finalized.

3:57

Um last meeting I asked for us to continue because I wanted to add an additional note that had come up uh for a different reason.

4:05

Um just clarifying that EV charging stations uh and equipment should be required to meet the same zoning setbacks that apply to accessory structures like sheds, uh pavilions, that type of thing.

4:17

So they should be set back, you know, at least six feet from the side property lines, um, shouldn't be out in your front yard, um, things like that.

4:27

Um so um so yeah, that's that's generally about it.

4:31

Um would ask for a uh well, I'd be glad to take any questions and then ask for a vote to recommend approval or denial.

4:42

So Danny, I have uh I have a question on the language in uh number seven.

Summary of Proceedings

Crestwood Planning and Zoning Commission Meeting - December 5, 2024

Note: The agenda indicates December 4, 2024, but the provided instruction specifies December 5, 2024. This summary uses the instructed date.

The Crestwood Planning and Zoning Commission met on December 5, 2024, at 6:00 PM in the Aldermanic Chambers. The commission addressed a text amendment for EV charging, a conditional use permit for a Dunkin' restaurant, a major site plan review for the same Dunkin' location, and a deadline extension for Sam's Club gas station. All items were approved or continued as detailed below.

Consent Calendar

  • Approval of Minutes (November 6, 2024): The minutes were approved unanimously by voice vote (motion by Commissioner Charbonneau, second by Commissioner Seven).

Public Comments & Testimony

  • No members of the public spoke.

Discussion Items

Text Amendment – EV Charging (Item 5a)

  • Staff Report: Danny presented an amendment requiring emergency shutoff switches for electric vehicle charging stations, as requested by the Fire Chief. The amendment also clarifies that EV stations must meet the same setback requirements as accessory structures (e.g., sheds) and cannot be placed in front yards.
  • Commissioner Discussion: Concerns were raised about the language in section 7, specifically the word "inspected" vs. "reviewed and approved." A commissioner suggested changing "inspected" to "reviewed and approved" and moving the timing before zoning reviews. Additionally, a potential loophole was noted in the definition of "electric vehicle" (requiring licensing/registration) – a vehicle without plates might not qualify. A motion was made to continue the item to a future meeting to allow staff to revise the language. The motion passed unanimously by voice vote.

Conditional Use Permit – Dunkin' at 9600 Watson Rd (Item 5b)

  • Staff Report: Danny explained that Watson STL Donuts Inc. seeks a CUP to operate a Dunkin' restaurant with a drive-thru in the C1 district. The site previously housed Imo's Pizza. The proposal includes a small interior seating area (8 seats) and a drive-thru with a minimum of five stacking spaces (the plan shows 7-10). The comprehensive plan supports this use. The staff recommended approval with standard conditions.
  • Applicant: Michael Crouch (1820 Sunset Ridge, Festus, MO) stated they operate 14 locations in Missouri. Hours: 5 AM to 8 PM. Peak volume: ~400 transactions per day, 70% before 11 AM. He addressed traffic concerns, noting the drive-thru time of 150 seconds.
  • Commissioner Questions: Concerns focused on traffic ingress/egress, especially from Old Sappington Road. Commissioners discussed potential left-turn restrictions at the northernmost exit and the need for directional signage. The applicant expressed flexibility.
  • Vote: Motion to approve the CUP. Roll call: Commissioner Zipple (yes), Commissioner Klosterman (yes), Commissioner Charbonneau (yes), Commissioner Sutton (yes). Unanimous (4-0). The recommendation will be forwarded to the Board of Aldermen.

Major Site Plan Review – Dunkin' (Item 6a)

  • Staff Report: Danny reviewed the site plan details: 12 parking spaces (exceeding the required 7), drive-thru stacking, and building renovations. The existing concrete block (CMU) on the front elevation is an unacceptable material per Watson Road overlay guidelines. Staff recommended replacing windows with less reflective glass, providing a landscape plan, and addressing asphalt conditions.
  • Applicant: Mr. Crouch indicated flexibility on colors, dumpster enclosure, and other conditions. He preferred earth tones.
  • Commissioner Discussion: Extensive discussion on conditions:
    • Proper dumpster enclosure per code.
    • Restricting left turns from the northernmost exit onto Old Sappington Road.
    • Redesigning the east side islands and sidewalk to facilitate traffic flow.
    • Adding pedestrian striping from parking to the front door.
    • Replacing windows with more transparent glass.
    • Providing a landscape plan meeting city code.
    • On CMU cladding: The commission decided to require repainting with a complementary color rather than full recladding.
    • A proposal to add a lawn area in front was discussed but not adopted; the landscape plan will cover existing beds.
  • Vote: Motion to approve the major site plan with the above conditions. Roll call: all four commissioners voted yes. Unanimous.

Deadline Extension – Sam's Club Gas Station (Item 6b)

  • Staff Report: Danny noted that the commission had previously approved a CUP and site plan for a gas station expansion at 10248 Big Bend Blvd. Deadlines were extended in August; now the applicant requests further extension to obtain building permits by May 1, 2025, and begin construction by July 6, 2025, due to bidding and design delays.
  • Commissioner Discussion: No objections.
  • Vote: Motion to approve the extension. Roll call: all four yes. Unanimous.

Key Outcomes

  • Text Amendment – EV Charging: Continued to a future meeting for language revision.
  • CUP – Dunkin': Approved (4-0) with standard conditions. Final decision by Board of Aldermen (tentatively December 10, 2024).
  • Major Site Plan – Dunkin': Approved (4-0) with specific conditions (dumpster enclosure, left-turn restriction, island/sidewalk redesign, pedestrian striping, window replacement, repainting of CMU, and landscape plan).
  • Deadline Extension – Sam's Club: Approved (4-0) extending building permit deadline to May 1, 2025, and construction start to July 6, 2025.
  • Aldermanic Report: Alderman Kennedy noted the board approved the previous CUP recommendation and passed restrictions on short-term rentals of residential pools. He also announced the Santa Car Cruise on Saturday, December 7, from 2:00-3:30 PM.
