Good evening.

0:16

Welcome to our Draper City Planning Commission meeting data today, December 18th, 2025.

0:22

Thank you to the staff for getting everything ready.

0:24

This is our last meeting of the year, so you've done great all year, so kudos.

0:28

We appreciate you uh getting the reports put together and to us with plenty of time to review.

0:33

Thanks to the um volunteers up here, the commissioners that spend their time looking at those, and we also appreciate the applicants that are here tonight.

0:40

And then if anyone's listening in, we welcome the public.

0:42

So let's go ahead and get things started.

0:44

Our agenda tonight.

0:46

We have two items on there uh as posted, and there's no changes to the agenda, correct?

0:52

All right.

0:53

So let's go ahead and get things started off.

0:55

Uh we have two public hearings.

0:56

The first of which is the break subdivision plat amendment.

1:00

It's on the request of Gary Knapp representing LM Restaurant Group LC, a subdivision plat amendment located on 1.02 acres of property located at approximately 1240 south 700 east and 12258 south and 700 east.

1:16

No one is application 2025-0174-SUB.

1:21

So Nick Whitaker's our contact, so go ahead, Nick.

1:24

Thank you.

1:25

Uh so yes, this is the break subdivision plat amendment request.

1:32

Uh here's a vicinity map of the property.

1:35

That's right off of 700 east and uh uh 123rd south, more or less.

1:44

Here's an aerial map of the property.

1:47

Um this may look familiar almost exactly a year ago.

1:50

The applicant was here um requesting a zone change.

1:57

Uh here's the land use map.

1:58

It's uh neighborhood commercial and zoning is CC, which is community commercial.

2:09

So here the project summary is um the project summary is amending the Draperville plat to consolidate portions of lot seven, which is one, two, two, four, zero south, seven hundred east, and lot eight, which is one two two five eight south, seven hundred east, located on block seventeen of the Draperville Platte.

2:30

The consolidation of the subject property is to uh the subject properties is to accommodate the creation of a commercial development, and a geotechnical study was conducted at the subject property and determined to be acceptable.

2:47

So here is the Draperville Platte.

2:49

Right here are the subject properties.

2:51

This is block 17.

2:53

I'll get up closer.

2:59

So the applicant is wanting to combine portions of um lot seven and eight to create a single lot to develop that property.

3:09

This is the um uh amended plat.

3:14

Um the final version will have the uh uh structures removed from the um from the mylar.

3:28

Uh any questions or comments.

3:31

Nick, I'm not sure what we're looking at.

3:32

Can you go back the one slide, please?

3:34

Yeah.

3:36

Um I couldn't understand what this is.

3:38

What what is what's this plat of?

3:42

I apologize.

3:43

So this is lot seven and eight of the Draperville plat.

3:46

Right.

3:46

Uh combining it together into one.

3:48

Yeah.

3:49

What are these structures?

3:50

I mean, what are they showing me?

3:52

Because aren't we aren't we reviewing the plat?

3:54

Yeah, so the so uh and this is in the conditions of the report.

3:59

So um the final plat that are that will be sent in um will not have these.

4:03

This this is represents structures on the property.

4:06

Currently, currently, yeah.

4:09

Um, and they will be uh removed from the plat for the final uh version.

4:16

The structures have actually already been demolished, um, just recently demolished.

4:21

Um so we'll have the plot updated before it gets recorded.

4:25

So all we're approving tonight is the combination of the two plots.

4:28

That's the plots.

4:29

Yeah.

4:30

Okay, thanks.

4:30

That helps.

4:33

Well will the use for the pro for the property eventually come back to the planning commission for site plan.

4:40

They will be, yes, they'll be coming.

4:42

Does it seem to me like this was going to be a bar and grill if I recall?

4:46

Yeah, uh and there was a question on it as far as the distancing for that um entrance from a residential had to be 600 feet or 200 feet is the clo flies.

5:00

Uh in that that'll be addressed in the in the in the actual site plan when when we bring that to planning commission, and the applicant is working on that.

5:08

Um and staff, of course, we're working on that as well.

5:11

So assuming that would still work.

5:12

I'm assuming they've checked into that as far as the distance requirements and that well uh regarding the the plat amendment.

5:22

Um that I mean that wouldn't be in the in consideration.

5:29

I it would be am I mistaken on that, Jen?

5:33

Yeah, so the um when they come in and apply for their liquor license at that time our business license official will verify distancing standards based on state requirements.

5:46

Um that will go to the city council as a uh local consent item.

5:51

Um so the actual liquor license won't come before you.

5:55

Um there is a bar license available with the city through the business license uh standards, and for my understanding, this property does meet the distancing standards.

6:06

Okay, that's I know it's not part of this application.

6:09

I just assumed that they have checked into it, they're aware of that, and it hopefully checks out.

6:15

Okay, thanks.

6:16

Perfect.

6:17

Thanks.

6:17

Any of the questions for staff?

6:20

All right, great.

6:21

Is the applicant here?

6:22

Yeah, if you'd like to come on down, you can state your name and add anything to that presentation that you'd like.

6:28

We may have some questions for you.

6:32

Okay, I'm uh Gary Knapp with JCW Architects.

6:36

And um, yeah, we're combining these two lots, hopefully, to bring the break to this area to that.

6:43

Um just one of the boxes we're trying to check here and and get through.

6:48

So yeah, do you have any questions for me?

6:51

Any questions?

6:52

All right.

6:52

Thank you.

6:53

Thank you.

6:53

Again, uh, we'll give you we'll invite you back up if we need to after the highly contested public hearing with based on the attendance tonight.

7:01

And those listening in and for the recording, there's two seats filled in the in the audience, just so you know.

7:06

All right, so this is a public hearing.

7:07

We'll open it up for public comment.

7:09

Uh you'll have up to three minutes on the red timer.

7:11

Uh, is there anyone that would like to address this agenda item?

7:14

All right, we're seeing uh no one taking that, so we will go ahead and close the public hearing.

7:19

Commissioners, let's discuss it.

7:23

I am at I'm happy to put forward a motion and help this applicant check his box unless anyone else has discussion they would like.

7:33

Okay, let's do it.

7:34

I move that we approve the subdivision plat amendment as requested by Gary Knapp representing LM Restaurant Group LC application 2025-0174-SUB based on the following findings for approval as listed in this staff report dated December 8th, 2025.

7:56

Finding for approval being there's good cause for the amendment, and no public street or municipal utility easement will be vacated or amended.

8:05

Great, thanks for that, Mary.

8:06

Who will second that motion?

8:08

I'll second.

8:09

All right.

8:10

Thanks, Lisa.

8:11

Okay, let's go ahead and put that to a vote.

8:12

So first we have Mary.

8:14

Yes.

8:15

Lisa?

8:15

Yes.

8:16

Laura?

8:16

Yes.

8:17

Christine?

8:18

Yes.

8:18

And Susan.

8:19

Yes.

8:20

All right.

8:21

Congrats on that.

8:22

We'll see you again soon.

8:24

All right, let's go ahead and move on to our next public hearing.

8:27

This is the T Mobile Steep Mountain Park Amendment, conditional use permit request.

8:32

It's on the behalf of Declan Murphy representing Cole Creek Consulting and T Mobile.

8:36

A conditional use permit to amend details and conditions for a previously approved wireless telecommunications facility on approximately 9.51 acres at approximately 351 east steep mountain drive.

8:48

This is known as application 2025-0275-USE.

8:52

And Todd Draper's our staff contacts.

8:54

Go ahead, Todd.

8:56

Yes, thank you.

8:57

So as you mentioned, this is the uh conditional use permit for uh T Mobile.

9:02

They are proposing to do some upgrades uh to the existing uh pole and tower.

9:09

This is the vicinity, steep mountain park.

9:12

And if my mouse will stop rolling back.

9:17

We'll try another one.

9:21

That one might be it'll work.

9:23

Uh this is the aerial view and the tower.

9:28

Wow, it really likes that today.

9:31

Tower located right in that uh location there next to the basketball.

9:36

Uh and again there on the land use map.

9:40

This is uh marked as open space and parks and uh OS uh zoned as well.

9:49

This is the site plan again if it'll stay.

9:53

Wow.

9:55

Uh right here we've got uh that basketball court and then the tower next to it.

10:00

The uh associated equipment is in a building that's actually designed to match with the restrooms there, so it just all looks like one building.

10:09

Uh there is no change to the rest of the site necessarily that's being proposed or uh anything to exterior the building.

10:18

There'll be a few uh appurtenances inside the building that will be swapped out, and then with the elevations, part of the reason this is coming as a conditional use.

10:29

They are uh going to uh take the canister off where the existing antennas are uh inside.

10:40

Um I don't know which mouse, it might be a different mouse that's keeps jumping us around.

10:46

But anyway, um, and then they are going to put a new antenna array on the top of that pole, extend the poll a a little bit.

10:57

The overall height actually increases, I believe, by two feet from 40 to 42.

11:02

They will be painting the antennas to match the poll color, which is just changing that method of concealment.

11:09

Uh that is an allowable method to conceal uh in the ordinance, and we have kind of addressed that in the staff report as well as one of those mitigating conditions, and then just some site photos here.

11:24

Again, this is taken, I believe, from Red Leaf Drive, and then just a closer up shot across the basketball court looking towards the uh east, and then this is in the uh northeast corner of the park looking to the southwest corner, and you can kind of see where that is there.

11:43

Uh the impact would be minimal.

11:48

Any other questions you may have for me?

11:51

Do you know what the width of the antennas are?

11:54

The proposed width.

11:55

I know you talk you mentioned the height, but what is do we know what the width is?

12:00

Um I know it's less than the lights that are existing there.

12:03

I can probably figure that out here.

12:04

You can use the applicant too when they come up.

12:06

Yeah, yeah.

12:09

For all I'll add for stealth design, one thing we look at is you know, are those antenna kind of more flush with the poll versus that you know, larger, wider array?

12:21

Yeah, so this still qualifies technically as a stealth.

12:26

Okay, thanks.

12:33

All right, no other questions.

12:35

Thank you, staff.

12:36

Is the applicant here?

12:37

If you want to come on down, same drill, just uh state your name and then add anything you like my name is Jacob Ryans with Cole Creek Consulting.

12:46

Unfortunately, Declan is out of state, and there's some technical issues for him calling in, so I'm subbing in tonight.

12:52

Um I don't have anything to add to that, but if you have any questions, I'm happy to answer them.

12:59

This is a random question, maybe for staff, maybe for you.

13:02

When T Mobile or any other company puts a poll in a public or city-owned park, is there a fee that's paid to the park or the city for that or to the city, not the park?

13:13

Yes, there is.

13:14

They've they have a lease with the city.

13:16

Okay, thank you.

13:20

All right, any other questions on width on the antennas?

13:22

Are you good, Susan?

13:23

Yep.

13:24

Okay, great.

13:25

Well, it looks like you got off easy, so that's it from us.

13:27

So we'll put it up to again the hot public comment here, and we'll let you know if we need to have it come back up.

13:32

This is a public hearing.

13:33

We'll open it up to public comment.

13:34

Who would like to address this item?

13:37

No one, so we'll go ahead and close the public hearing.

13:40

All right, commissioners.

13:41

Any discussion on this.

13:45

I don't I don't have an opinion one way or the other.

13:47

I think it's fine.

13:48

Does anybody else um want to comment on that or discuss it?

13:52

Okay, I'm I'm good with clarifications.

13:55

I'll make a motion then.

13:57

I move that we approve the conditional use permit amendments as requested by DeClan Murray, representing Cole Creek Consulting and T-Mobile for the proposed T Mobile Wireless Telecommunication Facility, application 2025-0275-USE based on the findings and criteria for approval and the conditions listed in the staff report dated December 10, 2025.

14:18

Um findings for approval is there in the staff report, and I agree with them.

14:25

Great, thank you, Lisa.

14:26

Who will second that motion?

14:28

I'll second it.

14:29

All right, thanks, Susan.

14:30

Okay, let's put it to a vote.

14:31

Lisa.

14:32

Yes, Susan?

14:33

Yes, Christine?

14:35

Yes, Mary?

14:36

Yes.

14:36

And Laura.

14:37

Yes.

14:37

All right, for the last vote of the year.

14:39

Nice job.

14:40

All right, congrats on that.

14:41

Thanks for coming in and spend some time with us.

14:43

All right.

14:44

That's what we've got now for tonight.

14:46

It looks like any other items on the agenda.

14:49

Yeah, so we just wanted to remind you all about your training for the year.

14:53

Um, Todd's been busy calculating where everybody's at, so all of you have emails if you have outstanding training.

15:00

So all of you have emails if you have outstanding training.

15:02

He sent you links to those trainings.

15:04

Please email him when you've completed them.

15:06

You have until the end of the year.

15:08

Yep.

15:09

And I can report we we did talk about it briefly before this meeting, but we only have one of you that needed a the few minutes from uh last week's training, and everybody else here is good.

15:22

You've got your four hours for the year or much greater.

15:27

Thank you, Susan.

15:29

My pleasure.

15:30

Thank you.

15:30

I think you're around 24 or so.

15:32

Is that all?

15:33

Yeah, so at least that you've turned in to us.

15:36

So we appreciate that.

15:37

Good, good.

15:38

Perfect.

15:39

All right.

15:39

Well, well done, staff.

15:41

Well done, commissioners.

15:42

Is there any updates from city council before we close?

15:45

Or were you gonna get to that?

15:47

Um, yeah, why don't why don't we go over Tuesday's meeting there just real quick if you want to give some updates?

15:54

Yeah.

15:54

Um so Tuesday for Bangater Crossroads, uh, zoning map and land use map amendments, as well as the open shaw zoning and land use map amendments.

16:05

Um City Council did approve those.

16:08

Um the ordinance was set the ordinance that would actually change the the zoning that was approved, sets it so that it doesn't take effect until May 7th, um, and it requires the applicants to come in with a development agreement.

16:24

So they have to make that development agreement application before the end of the year.

16:29

Um and then that gives us five months, well, four months to really kind of work through that process, have those public hearings, bring it to planning commission council, and get something approved for the development agreement before the zoning takes effect.

16:44

Great.

16:45

The other item on that agenda was the wildly popular um geotechnical uh text amendment.

16:52

Yeah, and that also passed as well as the uh uh appendix standards as a separate standalone document.

17:02

So those will help us uh do that part of the ordinance a lot better and uh make changes as they become applicable over time.

17:13

Perfect.

17:14

Well, great.

17:14

Well, thanks again, staff.

17:16

Um if there's nothing else on our on our agenda tonight, uh before I wish everyone a great holiday break and then a good nice switch over to the new year.

17:25

What would we like to do?

17:26

Anything else?

17:28

All right, seeing no other business?

17:30

I move we adjourn.

17:32

Great, adjourned we're gonna.

Public Comments & Testimony

  • Break Subdivision Plat Amendment: No members of the public attended or provided testimony during the open public comment period.
  • T-Mobile Steep Mountain Park Amendment: No members of the public attended or provided testimony during the open public comment period.

Discussion Items

  • Break Subdivision Plat Amendment (App 2025-0174-SUB):

    • Staff and the applicant (Gary Knapp) presented a request to consolidate portions of Lot 7 and Lot 8 in the Draperville Plat to create a single lot for commercial development.
    • Commissioners sought clarification regarding existing structures shown on the submitted plat. Staff confirmed the structures were recently demolished and would be removed from the final recorded plat.
    • Concerns were raised regarding liquor licensing and distancing requirements for a potential bar. Staff clarified that the Planning Commission does not review the liquor license application or the specific distancing standards; the Business License Official will verify state-mandated distancing standards at the time of the license application.
    • The applicant confirmed the intent is to locate a commercial establishment (referenced in prior meetings as a potential bar and grill) on the property.
  • T-Mobile Steep Mountain Park Amendment (App 2025-0275-USE):

    • Staff and the applicant (Jacob Ryans) presented a request to amend conditions for an existing wireless telecommunications facility at Steep Mountain Park. The proposal includes increasing pole height by two feet (40 to 42 feet), removing a canister, and installing a new antenna array painted to match the pole color.
    • A commissioner questioned the width of the proposed antennas. Staff noted they would be less wide than existing lights and qualified as a "stealth" design.
    • A commissioner inquired about lease fees paid to the city for pole placement in a public park. Staff confirmed a lease exists between T-Mobile and the city.

Key Outcomes

  • Approval of Subdivision Plat Amendment:
    • Motion passed unanimously (5-0, with Mary moving and Lisa seconding) to approve the subdivision plat amendment based on findings of good cause and no vacated easements.

  • Training Updates: Staff confirmed all commissioners have completed their required annual training hours.
  • City Council Updates: Staff relayed that City Council recently approved zoning map and land use map amendments for Bangater Crossroads and Open Shaw, as well as a geotechnical text amendment and appendix standards. A development agreement application is required before the zoning changes take effect on May 7th.
