0:24This is our last meeting of the year, so you've done great all year, so kudos.
0:28We appreciate you uh getting the reports put together and to us with plenty of time to review.
0:33Thanks to the um volunteers up here, the commissioners that spend their time looking at those, and we also appreciate the applicants that are here tonight.
0:40And then if anyone's listening in, we welcome the public.
0:42So let's go ahead and get things started.
0:46We have two items on there uh as posted, and there's no changes to the agenda, correct?
0:53So let's go ahead and get things started off.
0:55Uh we have two public hearings.
0:56The first of which is the break subdivision plat amendment.
1:00It's on the request of Gary Knapp representing LM Restaurant Group LC, a subdivision plat amendment located on 1.02 acres of property located at approximately 1240 south 700 east and 12258 south and 700 east.
1:16No one is application 2025-0174-SUB.
1:21So Nick Whitaker's our contact, so go ahead, Nick.
1:25Uh so yes, this is the break subdivision plat amendment request.
1:32Uh here's a vicinity map of the property.
1:35That's right off of 700 east and uh uh 123rd south, more or less.
1:44Here's an aerial map of the property.
1:47Um this may look familiar almost exactly a year ago.
1:50The applicant was here um requesting a zone change.
1:57Uh here's the land use map.
1:58It's uh neighborhood commercial and zoning is CC, which is community commercial.
2:09So here the project summary is um the project summary is amending the Draperville plat to consolidate portions of lot seven, which is one, two, two, four, zero south, seven hundred east, and lot eight, which is one two two five eight south, seven hundred east, located on block seventeen of the Draperville Platte.
2:30The consolidation of the subject property is to uh the subject properties is to accommodate the creation of a commercial development, and a geotechnical study was conducted at the subject property and determined to be acceptable.
2:47So here is the Draperville Platte.
2:49Right here are the subject properties.
2:59So the applicant is wanting to combine portions of um lot seven and eight to create a single lot to develop that property.
3:09This is the um uh amended plat.
3:14Um the final version will have the uh uh structures removed from the um from the mylar.
3:28Uh any questions or comments.

3:36Um I couldn't understand what this is.
3:38What what is what's this plat of?
3:43So this is lot seven and eight of the Draperville plat.
3:46Uh combining it together into one.
3:49What are these structures?
3:50I mean, what are they showing me?
3:52Because aren't we aren't we reviewing the plat?
3:54Yeah, so the so uh and this is in the conditions of the report.
3:59So um the final plat that are that will be sent in um will not have these.
4:03This this is represents structures on the property.
4:06Currently, currently, yeah.
4:09Um, and they will be uh removed from the plat for the final uh version.
4:16The structures have actually already been demolished, um, just recently demolished.
4:21Um so we'll have the plot updated before it gets recorded.
4:25So all we're approving tonight is the combination of the two plots.
4:33Well will the use for the pro for the property eventually come back to the planning commission for site plan.
4:40They will be, yes, they'll be coming.
4:42Does it seem to me like this was going to be a bar and grill if I recall?
4:46Yeah, uh and there was a question on it as far as the distancing for that um entrance from a residential had to be 600 feet or 200 feet is the clo flies.
5:00Uh in that that'll be addressed in the in the in the actual site plan when when we bring that to planning commission, and the applicant is working on that.
5:08Um and staff, of course, we're working on that as well.
5:11So assuming that would still work.
5:12I'm assuming they've checked into that as far as the distance requirements and that well uh regarding the the plat amendment.
5:22Um that I mean that wouldn't be in the in consideration.
5:29I it would be am I mistaken on that, Jen?
5:33Yeah, so the um when they come in and apply for their liquor license at that time our business license official will verify distancing standards based on state requirements.
5:46Um that will go to the city council as a uh local consent item.
5:51Um so the actual liquor license won't come before you.
5:55Um there is a bar license available with the city through the business license uh standards, and for my understanding, this property does meet the distancing standards.
6:06Okay, that's I know it's not part of this application.
6:09I just assumed that they have checked into it, they're aware of that, and it hopefully checks out.

7:56Finding for approval being there's good cause for the amendment, and no public street or municipal utility easement will be vacated or amended.

8:27This is the T Mobile Steep Mountain Park Amendment, conditional use permit request.
8:32It's on the behalf of Declan Murphy representing Cole Creek Consulting and T Mobile.
8:36A conditional use permit to amend details and conditions for a previously approved wireless telecommunications facility on approximately 9.51 acres at approximately 351 east steep mountain drive.
8:48This is known as application 2025-0275-USE.
8:52And Todd Draper's our staff contacts.
8:57So as you mentioned, this is the uh conditional use permit for uh T Mobile.
9:02They are proposing to do some upgrades uh to the existing uh pole and tower.
9:09This is the vicinity, steep mountain park.
9:12And if my mouse will stop rolling back.
9:17We'll try another one.
9:21That one might be it'll work.
9:23Uh this is the aerial view and the tower.
9:28Wow, it really likes that today.
9:31Tower located right in that uh location there next to the basketball.
9:36Uh and again there on the land use map.
9:40This is uh marked as open space and parks and uh OS uh zoned as well.
9:49This is the site plan again if it'll stay.
9:55Uh right here we've got uh that basketball court and then the tower next to it.
10:00The uh associated equipment is in a building that's actually designed to match with the restrooms there, so it just all looks like one building.
10:09Uh there is no change to the rest of the site necessarily that's being proposed or uh anything to exterior the building.
10:18There'll be a few uh appurtenances inside the building that will be swapped out, and then with the elevations, part of the reason this is coming as a conditional use.
10:29They are uh going to uh take the canister off where the existing antennas are uh inside.
10:40Um I don't know which mouse, it might be a different mouse that's keeps jumping us around.
10:46But anyway, um, and then they are going to put a new antenna array on the top of that pole, extend the poll a a little bit.
10:57The overall height actually increases, I believe, by two feet from 40 to 42.
11:02They will be painting the antennas to match the poll color, which is just changing that method of concealment.
11:09Uh that is an allowable method to conceal uh in the ordinance, and we have kind of addressed that in the staff report as well as one of those mitigating conditions, and then just some site photos here.
11:24Again, this is taken, I believe, from Red Leaf Drive, and then just a closer up shot across the basketball court looking towards the uh east, and then this is in the uh northeast corner of the park looking to the southwest corner, and you can kind of see where that is there.
11:43Uh the impact would be minimal.

11:51Do you know what the width of the antennas are?
11:55I know you talk you mentioned the height, but what is do we know what the width is?
12:00Um I know it's less than the lights that are existing there.
12:03I can probably figure that out here.
12:04You can use the applicant too when they come up.
12:09For all I'll add for stealth design, one thing we look at is you know, are those antenna kind of more flush with the poll versus that you know, larger, wider array?
12:21Yeah, so this still qualifies technically as a stealth.

15:42Is there any updates from city council before we close?

15:47Um, yeah, why don't why don't we go over Tuesday's meeting there just real quick if you want to give some updates?
15:54Um so Tuesday for Bangater Crossroads, uh, zoning map and land use map amendments, as well as the open shaw zoning and land use map amendments.
16:05Um City Council did approve those.
16:08Um the ordinance was set the ordinance that would actually change the the zoning that was approved, sets it so that it doesn't take effect until May 7th, um, and it requires the applicants to come in with a development agreement.
16:24So they have to make that development agreement application before the end of the year.
16:29Um and then that gives us five months, well, four months to really kind of work through that process, have those public hearings, bring it to planning commission council, and get something approved for the development agreement before the zoning takes effect.
16:45The other item on that agenda was the wildly popular um geotechnical uh text amendment.
16:52Yeah, and that also passed as well as the uh uh appendix standards as a separate standalone document.
17:02So those will help us uh do that part of the ordinance a lot better and uh make changes as they become applicable over time.
