The Dunedin Code Enforcement Board met on May 6, 2025, at 2:00 PM in City Hall, 737 Louden Avenue. The meeting was called to order by Chair Phil Stone and adjourned at 2:48 PM. The board heard six agenda items, including two cases from old business, two from new business, and a selection of an alternate member.

Old Business – Cases 24-569 & 24-570 (City vs. Walvekar Florida Properties LLC, 2602 Bayshore Boulevard): These cases involved violations of the International Property Maintenance Code §304.6 (Exterior Walls) and §304.9 (Overhang Extensions). The original compliance date of April 13, 2025, was extended from a December 2024 board order. Respondent’s contractor, Cody Vogt of Synergy Property Restoration, reported that Hurricane Helene (September 2024) had caused additional damage, delaying repairs. He stated the building is watertight and that engineering plans had been submitted for permit amendment. The contractor requested a minimum 90‑day extension. Code Compliance Supervisor Julie Phillips supported the extension, noting the property owner had completed other required work. The board granted an extension to August 26, 2025, with a fine of $250 per day if not then in compliance. The motion passed 5‑1 (Matthew Wielinski dissented).

New Business – Case 25-1167 (City vs. 2010 Heidelberg Ave LLC, 2010 Heidelberg Avenue): The violation concerned Dunedin Code of Ordinances §105-27.1.1(F)(1) and (5)—utility trailers stored in the front yard. The property had been non‑compliant since March 2025; the trailer was removed by April 29, 2025. No respondent appeared. The city requested a declaration of violation (now in compliance). The board found the property in violation after the compliance date but now compliant, with a warning that any future similar violation within five years would be considered a repeat violation subject to an immediate fine of up to $500 per day. (Motion by Matthew Wielinski, second by Jaime Ballard; carried unanimously.)

New Business – Case 25-1279 (City vs. Matthew G Roell TRE / Kelly C Roell TRE, 2673 St. Josephs Drive East): This was a repeat violation of DCO §103-14.8.1 (transient uses/bed‑and‑breakfast without a conditional use permit in a multi‑family zoning district). The property had previously been fined $4,000 in May 2024. On April 24–25, 2025, Code Compliance Supervisor Julie Phillips verified the property was still being advertised for short‑term rentals (VRBO listing allowing bookings under 90 days). The board imposed a fine of $500 per day for those two days, totaling $1,000. (Motion by Jaime Ballard, second by Walter Sweetser; carried unanimously.)

Other Business – Selection of Alternate Member: The board considered applicants for an alternate member position. Chair Stone noted that only one applicant (Chris Alexander) was present. Chris Alexander stated he had previously appeared before the board regarding shipping container violations, which he corrected, and expressed a desire to serve. The board voted unanimously to recommend his appointment to the City Commission. (Motion by Jaime Ballard, second by Matthew Wielinski.)

I chair the Code Enforcement Board. For those of you who haven't had the pleasure of being here before, I ask you all to turn off your cell phones. These meetings are recorded and transcribed. When you come up and speak into the microphone, please say your name first. That makes it easier for the transcribers to know who is speaking. And as I said, kiss the mic. Lisa, would you like to take over? The Code Enforcement Board is charged with conducting hearings to determine whether a violation of the codes and ordinances of the City of Dunedin has occurred. In order to meet that obligation, all parties or their representative will be allowed the opportunity to be heard on matters relevant to the alleged violation. All witnesses offering testimony or presenting evidence will be required to swear or affirm that the testimony they offer is the truth. The city, through its staff, will present its evidence of the alleged violation. After the city has completed its presentation, the respondent shall be afforded the opportunity to present its evidence. Any members of the board, the person presenting the city's case, or the city attorney may question any witnesses before the board. The respondent or his or her representative shall be permitted to question any of the witnesses before the board and present brief opening and closing statements if so desired. The board will then openly deliberate considering the evidence presented, the law and common knowledge. By motion, duly made and seconded, seconded, discussed and approved by at least four members of the board. An order will be issued. The order will contain one findings of facts, findings of fact, two, conclusions of law, and three affirm affirmative action to be taken. The order will be forwarded to the respondent by certified mail. We will now continue with our hearings. Thank you. Do we have anybody uh in the room who wants to speak on an item that is not on the agenda? No. Okay, the first item on the agenda is approval of the minutes from our last meeting in April. Uh those minutes were circulated to members of the board beforehand today. Would anyone care to uh offer any comments, questions, suggestions, edits, or yes, no? Okay, then I'll entertain a motion to approve. Accept. Approve. Well, you need to make a motion. I make a motion that we accept the minutes. I accept. Jamie Ballard, I second. All in favor. Aye.
