The Dunedin Code Enforcement Board met on April 7, 2026, at 2:00 PM in City Hall. Chair Phil Stone presided. The board addressed one consent item, one affidavit of compliance, one old business case, and four new business cases. Key decisions included fines and compliance deadlines.
Consent Calendar
- Approval of Minutes (March 3, 2026): The board approved the minutes as written. Motion by Walter Sweetser, seconded by Lisa Hunt. Vote: unanimous (6-0).
Affidavits of Compliance
- Case 25-2068 – City vs. Bennis Properties LLC (620 Dexter Drive): Violations of Florida Building Code Sections 105.1 and 115.3 (permits and stop work order) were corrected by February 24, 2026. The board accepted the affidavit of compliance. Motion by Vice-Chair Jaime Ballard, seconded by Jason Gillette. Vote: unanimous (6-0).
Old Business
- Case 25-1955 – City vs. Julie & Phyllis Williams (50 Squire Court): Violation of IPMC Section 501.2 (plumbing facilities) remained uncorrected after the February 23, 2026 compliance date. Code Compliance Inspector Michelle Gilbert reported the property lacks electricity and water, with a utility balance of $722.92. The daughter residing there has substance abuse issues. A honeybee hive and a backyard fire incident were noted. The board found the violation severe and imposed a fine of $250.00 per day from February 24, 2026, capped at 20 days ($5,000.00). Motion by Vice-Chair Ballard, seconded by Chris Alexander. Vote: unanimous (6-0).

Case 25-2117 – City vs. Sean C. Hubner (1518 Fairway Drive): Violations of DCO Sections 34-1(A) and 34-32 (offensive accumulation of debris, building materials, tires, etc.). Respondent Hubner appeared, acknowledged the violation, and requested two weeks to clean up. The board ordered compliance by April 21, 2026, with a fine of $250.00 per day if not met. Motion by Vice-Chair Ballard, seconded by Lisa Hunt. Vote: unanimous (6-0).

Case 25-2172 – City vs. Sean C. Hubner (same property): Violation of DCO Section 34-31 (excessive growth of weeds/grasses over 10 inches). Hubner stated he acquired a lawnmower and could borrow other tools. The board ordered compliance by April 21, 2026 (coordinated with the previous case), with a fine of $150.00 per day if not met. Motion by Lisa Hunt, seconded by Vice-Chair Ballard. Vote: unanimous (6-0).

Case 26-161 – City vs. Sean C. Hubner (same property): Violation of DCO Section 105-27.1.1.1 (right-of-way standards). The city withdrew this case; no board action taken.

Case 26-68 – City vs. 2243 Harborview Trust/Laura Lyons (2243 Harbor View Drive): Violation of IPMC Section 302.8 (unlicensed motor vehicle). The vehicle lacked a current tag as of February 13, 2026 compliance date. On April 2, 2026, a relative reported the vehicle was registered, confirmed by Inspector Laurel. The board found a violation but assessed no fines as compliance was achieved before the hearing. A declaration of violation was issued: any future violation of the same code within five years may incur a fine of up to $500.00 per day. Motion by Vice-Chair Ballard, seconded by Jason Gillette. Vote: unanimous (6-0).

2 o'clock and we are going to get started. Welcome to the April meeting of the Code Enforcement Board of the City of Dunedin. I would ask that everybody silence their digital devices, put them on vibrate if you expect a call. If you have not been here before, we do make an audio recording of our meetings. When you do come and speak, please state your name for the record so the transcribers know who is speaking and also do what I'm doing. Keep your mouth close to the microphone so uh the recording devices can pick up what you are saying clearly. Okay. I am going to go ahead and uh Jamie Ballard. I'm going to read the statement of purpose. Uh before proceeding, I will set forth the purpose of this board. The Code Enforcement Board is charged with conducting hearings to determine whether a violation of the codes and ordinances of the City of Dunedin has occurred. In order to meet the obligation, all parties or the representative will be allowed the opportunity to be heard on matters relevant to the alleged violation. All witnesses offering testimony or presenting evidence will be required to swear or affirm that the testimony they offer is the truth. The city, through its staff, will present its evidence of the out alleged violation. After the city has completed its presentation, the respondent shall be afforded the opportunity to present its evidence. The respondent may be represented by an attorney or some other representative. If the respondent uh presents photographs or written materials as evidence, they'll be submitted to the board secretary for inclusion in the case. Any members of the board, the person presenting the city's case, or the city attorney may question any witnesses before the board. The respondent and uh I'm sorry, the respondent or his or her representative shall also be permitted to question any of the witnesses before the board and present brief opening and closing statements if so desired. The board will then openly deliberate, considering only the evidence presented, the law and common knowledge. By motion duly made and second seconded, discussed and approved by at least four members of the board. An order will be issued. The order will contain findings of fact, conclusions of law, affirmative action to be taken. The order will be forwarded to the respondent by certified mail. We will now continue with our hearings.
