The Board of Adjustment and Appeal (BAA) of Dunedin, Florida, met on September 16, 2026, at Dunedin City Hall, 737 Louden Ave. In the absence of a chair and vice chair, the board elected a chair pro tem pursuant to Robert's rules. The board approved the April 15, 2026 meeting minutes, recommended approval of a rear-yard setback variance for 518 Bay Street, and made membership recommendations for the board.
Application BAA-2026-0001 — 518 Bay Street (Setback Variance): The applicant requested a 10-foot variance to reduce the required 20-foot rear-yard setback to 10 feet in the Multifamily Residential (MF-15) zoning district for the construction of a new single-family residence. The property owner is Corey Orzak (with Gina Orzak present); the applicant's representative also appeared on behalf of Brian Onx.
Staff (Kevin) recommended approval, stating that the requested 10-foot variance is the minimum variance necessary for reasonable use of the property, would not confer any special privilege, and would not affect future enforcement of building setback lines. Staff explained that the lot is only 88 feet deep rather than the 100 feet typically required, the property was grandfathered into the MF-15 zoning district, and the older neighborhood consists of irregular, non-cookie-cutter lot shapes. Staff also noted the front setback of 25 feet and side setbacks of 10 feet would be maintained.
The applicant's representative expressed support for the request, stating the rear of the property backs up to the side of the neighbor to the north, so the home would not encroach further on the neighbor, and the requested 10-foot setback is larger than the setback of the home previously on the lot. The representative noted the concept designs were illustrative only and that only a portion of the home would be within the 10-foot setback. The pool deck may extend to within five feet of the property line.
Board discussion: Member Lambert expressed the view that the variance would not set a detrimental precedent because it is a rear setback rather than a front setback, would maintain the existing character of the neighborhood, and would keep the front setback at 25 feet. The member noted future redevelopment in the area might require similar variances due to the irregular shapes and sizes of the lots.
Board Membership Recommendation: The board discussed a recommendation to move a current alternate member into one regular vacancy and to select one new alternate member. These recommendations will be brought before the City Commission for approval. The board also discussed the election of officers and planned to address the process at the next meeting, noting that board officers do not have motion initiative.
Is this one right here? Place of honor. Yeah. Oh, yeah, thank you. Okay. I I apologize. I'm very, very sorry. So the meeting's over. It's over. What did I do? So anyway. Um supposed to have the gravel. And then um the September 16th, 2026, meeting of the Board of Adjustment Appeals City of Danin will now come to order. Um in the absence of the chair and the vice chair. The board of the board of the jump. That's a that's not me, right? That's another thing. No, I can't. Someone will need them to make a motion to appoint Virginia to serve as chair pro tem. It's not reliable. Sure. Okay. This is what we chair. Member Lambert advised that in the absence of a chair and a vice chair, the Board of Adjustment and Appeal would be following Robert's rules, which provide for the election of a chair pro tem. Um Matthew Morrissey make a uh move that we um allow Virginia Lamberton, Lamberton as uh chair pro tem for this proceeding. Second. Aye. Okay, thank you. Okay, let's see. The introduction, read it. Yes. And can you put pull your mic up so it's closer to your mouth? It's I don't know what's down there. Is that okay? That's okay, you know. Yeah. Thank you. The Board of Adjustment and Appeal is a quasi-judicial, I can never say that word right, body. Certain procedures must be followed by the board and a person's appearing before it. The purpose of this meeting is to provide applicants the opportunity to present their cases for review by the Board of Adjustment and Appeal. The BAA is responsible for determining if such applications comply with city regulations. This meeting is open to the public and all persons present to the hearing of a right to voice their views regarding this application. If the competent and substantial evidence before the board does not meet the necessary standards set out in code, the BAA will have no recourse but to deny the request. When the board votes to approve or deny an application, the vote of the board is the rendition of an order on the application. It is a responsibility of the parties to create and preserve a transcript of the proceedings. In case a full board not being present, the applicant has the option of postponing the the case until the full board is present. If the applicant wishes to proceed with an even with an even number, it will vote board members to type vote. What the heck? Proceeds with an even numbered board, a tie vote constitute denial of the application. The format for this meeting is as follows.
