Well, dear Heavenly Father, we just want to thank you and we praise you.

We thank you as we are in our Easter season.

We thank you, Lord, for what you've done for each and every one of us.

We do ask, Lord, tonight that you would bless the city council, that you would help them to make wise decisions for our city, that you would help them to know exactly how to handle business.

Arrests are being made.

So we're honored to bring to your attention the exceptional bravery and decisive action demonstrated by Officer Terrence Maher and Officer Andres Patino on the night of January 7th, 2024.

That night they were responding to a call of distress, an unknown type of a problem occurring in the 200 block of West Alsdorf Road.

When they got on scene, they encountered some uh some smoke in the area, and they heard screams and cries for help coming from a small travel trailer located toward the rear of a private property.

Um as they worked their way back to that portion of the property, they encountered a small, roughly 20-foot travel trailer where the windows and the exterior ventilation aspects of it were covered over with tar paper.

The front door had been replaced by a sheet of plywood with no exterior doorknob, and they could see smoke, significant amount of smoke emanating from the inside of the travel trailer, and they could hear screams for help coming from inside.

They moved around to the door and uh tried for several minutes to force entry in through a trailer door.

But with the lack of a doorknob and the lack of any way to force the door open, um it was very difficult and challenging for them.

Fortunately, one of the one of our victims, the male subject inside the house was able to reach up and through their commands unlocked the door, and they were able to pull the door open because they certainly couldn't push it in.

It was it was framed in.

What they faced next was a large cloud of smoke coming from inside the trailer.

What we had found out later to kind of set the stage is the couple living in that travel trailer didn't have any electricity.

And as we recall in January, it was still cold.

That night it was nearing freezing temperatures, and the couple had taken a steel of steel drum inside the trailer, propped it up on blocks, and had a wood fire going on inside this small travel trailer with no ventilation inside at all.

And as you can imagine, the fire, the smoke, and the carbon monoxide had built up to nearly fatal levels.

Once they got the door open, um Officer Maher and Officer Patino were able to drag the man out of the house.

Uh he was able to barely communicate with them that his wife was still trapped inside.

Um as they got him outside to fresh air, they developed a plan.

Uh they made entry the first time into the trailer and were forced back by the cloud of smoke until they could catch their breath, hold their breath, and go back in for two more uh entries into the trailer to find and they they were able to find the the man's wife, the woman located in the far back of the travel trailer.

She was completely unresponsive, unconscious, um, and had was about to succumb to the effects of the carbon monoxide poisoning and the smoke inhalation.

Um they grabbed her, they were able to pull her out, um, and that was no easy task considering they were unable to breathe with no breathing apparatus or safety equipment at all.

Um they worked uh as a team getting her outside about the time that the fire department arrived and were able to provide more advanced life-saving care to both of our victims.

Both Officer Maher and Officer Patino suffered significant smoke inhalation that night.

Um they were ill at the scene, they were vomiting, they had to be transported by ground ambulance to the hospital in Casagran, where they were kept in the hospital for nearly eight hours receiving oxygen therapy and treatment to make sure they weren't suffering from lasting effects of smoke inhalation.

Uh fortunately, because of their heroic efforts, both the man and the woman were eventually released from the hospital and recovered.

Umce that time, the the trailer has been removed and the safety hazard has been has been mitigated.

But that night, had it not been for their quick action, placing other people's lives ahead of their own, we would have had two uh likely two fatalities that night from significant smoke inhalation.

So uh that is the story that occurred on January 7th, and these are our two heroes that night that risked it all to go in and pull a couple people out of a very dangerous environment.

And for that, tonight, uh, with your permission, we would like to present them with the Eloy Police Department life saving medals.

Um first up will be Officer Terrence Maher.

Mayor, I'm turned uh over to you if you have anything you would like to say in the meantime, we'll get some some photographs.

One, two, three, and I'm short, so your kids want pictures in front of that.

The council would permit, just one more one more family photo to recognize what awesome job dad did.

Welcome I go to the background.

And thank you all so much for for giving us this time tonight.

No, I I just want to say uh we sometimes forget, don't we, that uh we've got people uh volunteers like this running uh this interference force and taking care of us, and it's not until something like this happens that we really get a chance to uh show our appreciation, but uh I think they're involved with things like this that could be potentially dangerous almost every day, and we sometimes forget about it.

So uh thank you, both of you.

And uh I'm glad you're part of Eloy.

Thanks, guys.

You guys are the true superheroes.

We really appreciate you, and so does the whole community.

You know, I work next door as a volunteer, like with Bill over here, and I've met the most amazing individuals across that street, and you guys are no exception.

Gentlemen, um you guys protect us day and night, and um we often think of you guys as just pulling us over and doing the hard work.

It's life-saving events like this that we truly appreciate from all the hard work that you guys do.

It's it's tough.

Um, you guys are risking your lives for us day and night, and that's why I appreciate all the hard work you guys do for the city of Eloy.

Um, it's appreciated.

Um, you guys just don't even think twice, you just spring into action, and everybody on the police department is is truly appreciated.

All the hard work you guys do.

So continue being safe, continue uh making our streets safe.

And uh we we um you guys are in our prayers.

And so thank you for everything you guys do.

Um I mean it's it's amazing.

It's amazing what we have here representing the city of Eloy.

On Friday the 15th, I went and delivered your letter from the City of Eloy to the Arizona Department of Transportation Executive Board.

For the people in the audience, the letter outlined planned work and funding for the improvements on Sunland Gin Road, including in the correspondence was a request for additional funding for design to improve the TI or traffic interchange at the I-10 and Sunland Gym Road exit.

I explained the concerns to the board of traffic backing up into the travel lanes on the I-10 at a creates.

And fingers crossed this will lead to a positive outcome in the change.

The board seemed receptive to what uh we delivered in our correspondence to them, and we'll see where it goes from there.

I was there at the dinner the night before and kind of talked to some of the board members that were there.

I just want to let everyone know who looked up in the sky on Thursday, Friday, and Saturday night, and then saw all the um meteors coming down.

Um a group of skydivers, an international group of skydivers did set a world record that will be listed as a world record set in Eloy, Arizona.

Um we actually set two records.

The first was 42 skydivers holding hands at night, flying upside down at vertical speeds of 180 miles per hour.

The second record was um a similar record.

It was half the group, 21 people holding hands, releasing hands, and then picking up hands again, which I know that doesn't sound like a big deal, but it's really hard.

So we did those two records, and I think we got some kind of fun happening in the community.

Everybody got to see some fireworks, and um lots of people from all the world came and had a really good time.

That was pretty cool seeing that.

Even the pictures, pictures and videos that people were posting on social media, so really nice.

Quiet week, it really was.

Um yeah, I mean, it was very quiet for me.

It was nice seeing all the skydivers and my grandkids were freaking out because there was things falling from the sky.

And um it was it was nice though.

And uh I kept trying to tell them they're gonna do it again, but they're asleep.

So um, yeah.

Uh the cruise night, the chamber had their event on Saturday night, and it was it was a very nice event with all the food trucks and everybody that was there.

So um, yeah, that's thanks, Andy, once again for for being there.

Uh, today we had the PRTA meeting.

Um, if you don't know that is Panell Regional Transportation Authority, uh, we went into uh an agreement with um Panaw County.

Um Andy was uh there with me and just kind of worked out the kinks regarding the funds that the Arizona Department of Revenue has for us.

Um one day, hopefully we'll see that money, but until then it's just all held up in an escrow account.

87 million dollars, I think it was.

Um, that's it for me.

Members of council, a few things on the city manager's announcement.

Um, first I'll start with good news.

Our public works crews are actively out mowing and taking care of weed trimming since we've had all this glorious rain.

So we're staying on top of that.

Please, residents to take care of your yards too.

So we'll make our code enforcement job easier if our residents help out as well.

So we'll do this as a team effort and get our community cleaned up.

Um, but for the residents and listeners out there, if there is a concern that anybody wants to report, you can certainly do that.

It's on the city of Eloy's main page.

There's an icon that says report a concern.

And you can go on there, fill it out, add pictures, write whatever you need to write, and that goes to the public works department for them to log into their work orders.

So feel free to do that as well.

Speaking of projects, the public works department is working on getting quotes right now to restripe Frontier Street.

And this will be restriping and sandblasting.

So I know a lot of folks that travel into town from the uh during the morning with the sun coming the way that it comes, it makes the old lines come up and people oftentimes get confused.

So uh the our director Matt Rentcher and his team are working with a contractor to get quotes to do that project the right way.

Sandblast get all those old lines taken care of, paint all brand new lines down so it'll be easier for drivers driving on Frontier Street.

So that is coming later this month.

I did send um a reminder about the Pennell County strategic transportation safety update plan.

Um so please take a look at that and click on the QR code and uh fill out that survey and anybody that would like to participate as well.

It's it's available through the Sun Corridor Metropolitan or Metropolitan Planning Organization and Penell County.

And then fun this weekend.

And consider adoption of resolution number 24-1569.

So I know I'd like to call this meeting to a public hearing.

The item before you is a request for an extension to an existing conditional use permit, would actually have four conditional uses of it.

Car wash, which is an analogous or truck wash is analogous to a car wash.

And she drive through restaurants.

The original conditional use permit was approved in September 25th, 2023.

And the applicant is requesting a two-year extension.

That our criteria for an extension says as a modification to the original approval, which is why the report indicates two years from that day.

But staff does not have any opposition to that.

So it'll be essentially two years from today.

Also, there's some tweaking of the verbiage that makes the applicant and their consultant a little bit more comfortable that they can come back for a future extension.

Uh that's already covered in the code, is not necessary, but it's here or there, so we were okay with the modification.

And I believe the applicants here are from anything.

Good evening, Mayor Powell and members of the council.

My name is Heather Dukes.

Um, I have an address of 5527 North 25th Street in Phoenix.

I'm here tonight on behalf of Love's travel stops and country stores, and we're requesting approval of the conditional use permit extension.

Um as the director mentioned.

I do want to keep my my presentation brief.

Um there's there's one reason that we're here today.

There's a very unique provision in your zoning ordinance where once you get a CUP approval, it states in section 21-6-7.5a, that it says in any case where a conditional use permit has not been used within six months from the date of granting by the Eloy City Council, it shall become null and void.

And so that would be an okay section or okay language if you have a built property and you're just adding a use, but in this case, we're developing a brand new site.

Um it's completely vacant.

Usually by the time you get your building permit and then you go to construction, um, that takes some time.

So we are asking for two years.

Um, as a brief update, I spoke with Kimley Horn, which is the engineering consultant used by Loves.

They have been working with ADOT.

Um, there's been some additional requirements by ADOT, and one of which is a new right turn lane that goes on to the freeway.

So as you hit the on ramp to go eastbound, they're having to put in a new right turn lane.

So they've been conducting uh meetings with ADOT, um, and now they're working on finishing the construction drawings, and they should have those submitted for building permit approval within about the next month.

They said by the end of April.

So Loves is moving forward.

We just want to make sure that we're we're granting enough time because the language of when a conditional use permit has not been used, that's that's kind of vague in in some ways.

Like, does that mean when the building permits issued?

Does that mean when you have your C of O and you're up and operating?

So we just want to make sure again that we're we um are protecting the CUP approval for the next two years.

Um, I sent an email like the director mentioned, just asking for a modification to the resolution.

I had one other thing that I noticed just sitting here, and I'm sorry for not including it in my email, but in the list of uses at the very top of resolution number 24-1569, it talks about um what the CUP uses are, and right now it states for a truck stop, truck wash, and two fast food restaurants with drive-throughs, it's missing two uses.

It should also say truck scale and five overnight RV parking spaces with hookups.

So we just want to make sure that when we're if if you do decide to approve this extension that we include truck scale and the five overnight RV parking spaces throughout this resolution.

And if you have any questions, I'd be happy to answer them at this time.

Uh the point of clarification: the uses that she indicated are accessory uses to the truck stop, and they're not specifically conditional uses that require an approval.

They're included as part of the truck stop.

So they're accessory too.

So there is not a need to identify those additional uses in the resolution.

So we can go ahead and approve it with the truck scale and five overnight RV parking.

That's part of the conditional use, but that's in as those accessory uses to the truck stop itself.

They're not they're not specific in the zoning orders, they specifically says truck stop, conditional use.

Restaurant with drive-through a conditional use.

Those accessory uses are not they're not conditional, they're a part of the accessory, and as they're showing on the site plan there, too.

Our original CUP had those two additional uses listed in the actual approval, so I just want to make sure it's consistent and we're not vacating those two uses.

We do want to continue the truck scale and the overnight RV.

Correct, which would be today is the expiration of the CUP.

So we would like it for two years from the expiration date.

And staff is okay with that.

So I'm I'm hoping construction starts within the year or so in 2024.

Item B.

Authorization to award a contract to dance and construction.

McKinsey.

Yes.

Good afternoon, Mayor and Council.

Uh staff recommends that the mayor and council approve the authorization to award the contract for abatement and demolition of the Dust Bowl Theater and the Veterans Center to dance and construction under job order contract 2008-25.

So to give you guys a little bit of background on this, I'm sure you're all familiar with it.

But um in fiscal year 2022-23, an allocation of 200,000 was approved within the five-year capital improvement plan for the demolition of the Dust Bowl Theater.

Since that point, our staff has been doing an assessment of the project, and so that's what's kind of getting brought to you guys tonight.

Um, throughout that process, uh, we were found to realize that there was a cost reduction for both the demolition of the dust bowl and the veteran center.

I believe in the original report back in 2020, it was kind of cost neutral.

It was going to be 200,000, regardless if you demolished just the dust bowl or if you demolished them both.

Um but what we ended up actually finding due to the um cost of the wall shoring of that shared wall, uh, if we demolish both buildings, it actually saves the city $55,000.

So there's a significant uh savings there.

When we were found when we found this information, we reached out to uh Ralph Arella, the CEO of Panel Hispanic Council to discuss the potential demolition and kind of see what options they had for uh relocation of the veteran center, and he actually brought to us the idea of moving the veterans to the building that they have located on 529 North Main, which is essentially right next to the chamber building and across the street from the park.

And so that was great news to us because then now we're able to bring that to you guys tonight.

Um so kind of pending their relocation is the kind of timeline for this entire project.

So uh they've been moving over the last month, um, starting in March, and so we're hoping that they'll be fully relocated uh either towards the end of March, which is rapidly approaching, or the beginning of April.

Um, with that taking place, the following timeline of uh 10 days for uh basically national um environmental safety and hazards uh study will have to take place.

That'll take 10 days.

Uh after that, they will do the five days of uh abatement for the asbestos, and then after that, it's gonna be three weeks total for the demolition.

So we're looking at somewhere roughly between 35 to 40 days for the entirety of the demolition to take place.

So I guess with the conservative estimate, you're probably looking at about a May timeline, uh late May, early June for the site to be completely demolished and ready for redevelopment.

Um so the contracting, the process and the fiscal impact of this process is under job order contract to JOC with Cave Creek Unified School District number 93 job order RFP 2008 25, and that's essentially just a state contract, so it allows us to kind of forego going through the competitive bidding process ourselves because that would take a significantly you know increased amount of time, and as we all know, this process has already been going on for a very long time.

Um so the fiscal impact of this project in its total is 145,935 funded through the capital improvement project CIP fund 1844 eight fifty sixty-three.

Um, and then lastly, I just wanted to provide credit uh towards due to Paul and his team.

They put in a lot of work and a lot of the heavy lifting of getting the assessment and all this stuff done to bring it to this point.

I I'm merely here as the mouthpiece today.

Uh I didn't do a whole lot in doing that.

It's it's all his team, and then also give credit to Dave and uh John Vlaming because when they brought it to the revitalization committee and all of that, uh they went through that whole public outreach process, and it's I've worked on processes like this in the past, and even though the timeline has been extremely extended to get to this point, a lot of communities don't even get to this point to even sign a contract for the demolition of blighted buildings.

So just kind of wanted to put that in perspective before because I know it's taking a long time.

So with that being said, I would be happy to answer any questions.

And if there's any historical stuff that I might not know, maybe Dave or Paul can bail me out.

So I I've got a couple questions.

Yeah, for sure.

Of course.

Um there's a lot of seats in there.

Of course, they're gonna take all that out.

Is that all going and all the demolition, all the walls, everything going to our landfill?

Or are they taken to a special processing center?

Any of the as I understand any of the stuff that has asbastics related to it, it will have to be disposed of properly in accordance with any of the hazmat rules and regulations.

But outside of that, I you know, I don't think we've gotten into the weeds of where the trash is gonna go.

So it could go to our landfill, probably will.

Paul's shaking his head, yes.

Um, but on the chairs, uh, Paul and I were talking about that today, actually.

And when those guys go in, they're gonna take an assessment of the you know furniture that's there, the chairs, and if there are some that are salvageable, we are gonna try to take some of those and hold those back for eventually for like uh I don't I don't know, something commemorate, maybe give them to the museum, and they can do a piece on the dust bowl with with two of those chairs or whatnot.

But we're gonna look.

I can't say that we'll find any.

It's it's pretty rough in there.

Some of you have been in that site, but we're we're gonna see what we can do.

And then the three weeks from demo after everything's been taken care of.

Are they gonna do a brick by brick?

That seems like a long time for demolition.

I know some people that can do it over a weekend.

Well, I mean, if you want to put in an offer, I don't know if it's under that, right?

But no, it's uh yeah, I I think that's probably pretty common.

I don't know, we didn't really discuss the timeline.

I thought, you know, if you're looking at 35, 40 days for a full demolition of two buildings, seems reasonable, at least to me.

Because we're gonna be shutting down Main Street, the whole corner, the whole intersection, we're at the rerouting traffic with all the machinery.

So yeah, those dancing will submit a traffic site plan that the public works department will review, but I'm sure there'll be some street closures or at least lane closures.

Yeah, I think all mayor members of council, I don't think the actual demo process will take 45 days.

It's from start to finish.

So we have abatement to completion of project.

I'd be more comfortable saying 60 to 90 days.

Once you have machinery on site and the demos, then the demolition is taking place, it should be done in a few days.

Okay, it's just from start to finish.

So once we start um with the payment, which may be as early as Wednesday, and then we're looking at probably 60 to 90 days somewhere in between there.

And a lot of it's a scheduling issue too with their with their subcontractors.

Hopefully, not white five years to put it on the middle of that.

Yeah, no, so there's already been some discussions internally.

Uh, we have some ideas for potentially uh you know making it a landmark destination, either if we want to bring in economic development down there, so there's been some internal staff discussions of what we want to do.

I think ultimately what's gonna end up happening is we're gonna bring these opinions back to council to kind of get your guys' approval and your decision on what you want to move forward with with doing it.

But um, staff has already I know Dan has some fantastic ideas.

Uh Paul's been throwing some around, and then also David and I have been talking as well.

So uh we are having some things in the planning process right now.

Yeah, because we got 55,000 uh play with for on a temporary basis, I guess.

Uh if the uh veterans that are moving up to the corner was there's some agreement with uh the Dell Hispanic on the painting of that building to be consistent with the uh other paintings we've done and maybe uh uh to make a part more that building's just sitting there, it's been vacant, and now it's gonna be occupied.

So uh benches or something to kind of make it uh blend in with the work we've done on Main Street.

Yeah, so as far as I'm aware, that hasn't been discussed yet.

I think we wanted to get this approved before we started having those discussions, but I think that's definitely something we can look into uh and discuss with Ralph and kind of see what their opinion is is on it.

I don't know if Dave has any other thoughts on that.
