Next, we're gonna have uh council member uh report reports or announcements.

Start on my right side.

I got a lot on the list here, and I'm sure other people will will expand on it, so I'm just gonna give the quick overview on this.

He's preparing himself for November 25th, so I run.

On the Friday the 27th, I attended the Panel Partner Breakfast in Florence, where we discussed Prop 486 and its needs.

That was a very informative breakfast uh attended by many here in council.

On Monday the 30th, I attended the RPTA meeting in Florence where Mayor Powell was given an achievement award for his hard work and dedication to the RPTA and its causes.

During that meeting, we discussed the eighty million dollar tax surplus for lack of a better word.

And to this day, 27 million of that monies has been refunded to 120 applicants.

There are a total of 146 applicants.

So few are still pending.

Went to the town of Superior to show support for their state of the town address hosted by their mayor.

It was a wonderful night out, and just to see what they were doing.

On Friday the 4th, myself along with other council members who I'm sure will expand on this.

We attended the opening of the den.

That's the teen space in the library that provides a safe and fun environments to for teens to congregate and learn.

And I really thought it was great.

There was a big investment made over there.

And it looks just like a cool place for kids to hang out and accidentally learn something that can help them later.

On Saturday the 5th, I attended the Hope Coalition Street Fest and Car Show here in Eloy, right outside here at the park.

My motorcycle did not win a trophy.

I think it was rigged.

It was really on Thursday the 10th.

Uh myself along with the Eloy Housing Authority met, and we have an RFQ going out to the public for a reel to represent the sale of 26 units located here in the city of Eloy.

And on Saturday, this past Saturday 12th, music in the park.

A nice affair sponsored by the city.

We had all the right ingredients out there.

We really did.

But I really think the turnout was a little light.

So we may want to approach that a little differently.

I mean, the ingredients were there.

The music was fantastic.

The street was set up and heck, we even had giveaways, but I think the turnout could have been a little bit better.

So we might might want to just look at a different way to address that to get the word out a little bit more.

He pretty much covered everything, but I would like to add that when we attended Superior State of the City.

Um I was just in awe at their celebration.

They went all out.

They had it outside at their central park there on their main road, and um their whole community showed up.

Like there were so many people there, they had food.

It was really nice, a nice event and well attended, and um maybe we can try something like that here.

Like next year, an outdoor event, they had dance by le Flocorico dancers and um and all girls, little girls, dance crew.

They at the end they did a tribute to Selena, and each little girl dressed in uh different costume, and it was the cutest thing ever.

Um, but yeah, it was a really good event.

Um just thank you for sharing about the the den and then the music at the park.

I kind of fell the same with um Andy about the attendance.

Um and that's it.

We had more this year.

I mean, this time around, we had a big stage out on Main Street.

Um, but there the number of people weren't there.

It could be that there's a lot going on now, a lot more events since the weather is getting better, cooler.

Um, but I just know that um earlier earlier this year when we had it, the stage was um you know, at the part, um there were more people, so just my thoughts.

Well, in addition to Superior and the concert on Saturday, which I do agree with both of you on.

We we held our ninth annual 5K for that benefits of food pantry on Saturday.

Great turnout, a lot of fun.

And you need to remember to get some practice then before I start walking.

It hurts like heck, even today.

Uh, but we had a good time, and I think we did well on the event.

So I just have um I don't want to make any excuses.

I had a hand surgery two weeks ago, so I'm kind of like backed out of going to a few things, but I have a question about police logs.

Um, this is more just a question than anything.

Um, I know that several other communities do it.

We used to do it, and I don't know why we don't anymore.

And I think it's I mean, we as council get emails with what's going on in town, but I think it's important that the community knows what's going on in town to the extent that they can release that information.

Um, so at least they kind of have an idea of what's going on as opposed to just being in the dark of what our police department does.

And that's in the newspaper.

Yeah, okay.

Excuse me, I have a couple things.

First of all, I'd like to echo what uh Councilman uh Sutton said about the uh T den and uh hats off to uh Paul and Chad for the uh effort they made to I guess the to find the grant money to do that.

Um I thought it was a likewise uh a great place.

I was gonna challenge one of the kids in there, one of the video games, but I thought I didn't want to show him up, so I didn't do it.

But uh Chad and I talked, I think uh maybe uh around the first of the year that maybe prior to one of the council meetings, we'll get the council over there and we can have some uh fun playing some games just uh to get to know the place a little bit.

But I think it's a we need some places like that.

Uh I think particularly the age group that's headed for uh it's not just you walk in, it's like the library, but it's back in an area by itself and uh it's walled off and and such it uh it's a great place to sit there and they've got all the all the internet connections, the high speed stuff.

There's a 3D printer in there.

There's a lot of things that uh that could attract some uh I guess some teens, if you will, to take it to the next level uh beyond my head anyway.

And the other thing, uh, there was a group of us, uh council and some local people attended a movie premiere on Friday night in Tucson uh for the uh Space Cowboy.

Uh those of you who've been over to uh Skydive Arizona and see a lot of the skydivers and some of the things they do in competitions.

There was a movie produced, uh really a documentary on basically the life of uh a Joe Jennings, who is a cinematographer that takes all the pictures of the skydivers, and you've seen the probably the Eloy spelled out by the skydivers, that type of thing.

And really some great footage, including uh our car flying through the air with our own uh council member Sarah Cutters in the back seat and her husband driving it.

But uh very very uh interesting.

It was shot, a lot of it was shot here in E-Lay.

So uh Brown's Auto Body, the Tower, there's a lot of things I recognize in the Skydive Arizona.

So I think if you get the chance, it's kind of a uh a good movie, it's a documentary, and it's uh some I guess sad parts in it too, uh dealing with some personal tragedies and so forth.

But if you get the chance and the movie comes back around, I recommend uh seeing it.

Sarah, did you want to add in to anything on the line?

Um yeah, just you know, thanks to everybody who attended Space Cowboy.

There was probably about you know 50 skydivers in attendance, a lot of counsel.

Thank you so much for um doing that.

And I think it's just really cool to feature a place like Eloy, um, past and present in a big movie like that, and hopefully we can get maybe attract some more things now that we've taken notice of the Tucson Film Association.

Uh so that was really exciting.

And then I don't know if anyone mentioned there was all a whole bunch of stuff happening in the last couple weeks that uh everybody went to, but there was also the um opening of the Orsted Solar Center, which is partly in Panell County, partly in Coolidge, partly in Eloy.

They had a big grand opening, and uh they're they were pretty excited about that and getting going and being part of the community.

Um they're doing you know a number of initiatives to help with community stuff, so you know we can keep after them for that and make sure that um we're getting the most out of our community partners.

That's it.

Well, uh everybody said everything.

I mean, we we're very busy these past couple weeks.

I mean, a lot going on.

Um yeah, the 5K, you have a great announcer, Violet, who does it uh pro bono, and we'll continue to do that.

So uh I'm always glad to be asked and participate.

Um I don't want to you know beat anybody running because I know my skills, so that's why I do the announcing.

Um I don't want to show out as the mayor, you know.

So um, but I I always enjoy doing that.

And it is it's for a good cause for the food banks of Eloy.

And so it's it was really nice.

And then Chad um gave me and David a personal tour of the den because we're VIPs, and so we went over there and had a good time and saw it and uh took have my grandson there for a little while.

And um you can even see the excitement from the adults playing games as these two were trying to be competitive on one of the the race car games, and so um if the uh the adults are just excited, can you imagine how the kids are gonna be?

And so it is really nice to see that and you know how they put it all together, and um yeah, it's it's a good thing.

Uh starting tomorrow, myself and McKenzie and Council Member uh Andy Sutton will be going to Prescott for the Arizona Rural Transportation Summit.

Um it's a two three-day Wednesday, Thursday, and partially Friday.

Friday ends with the state board of transportation transportation state board meeting, and we'll be there listening, observing, and uh receiving.

I I'll be receiving a champion of transportation award um from uh the summit from the Rule of Transportation.

So pretty excited for that.

And it's being represented by CAG, uh, Central Arizona Government, which I'm the executive, or not exactly the chairman of Scampo, uh Sun Corridor Metropolitan Planning Organization, which I'm on the board of, um, and then all the other um cogs and um MPOs within the state of Arizona.

So it's it's they sold out this year, and so they McKenzie just found out he's not staying in the host hotel, and I'm sad about that.

Um yeah, I said he could he could bunk with you, Andy.

So uh but it's a good time to do a lot of networking and see what what we can do and how we can do it, and it's just a good time.

So um we'll be there starting tomorrow.

We'll me and Andy are leaving tomorrow evening.

And uh yeah, it's it's been crazy.

Um, the space cowboy movie was amazing, well produced, well put together.

Um, you're right, a lot of emotions were in that.

And and and Sarah, your husband is amazing.

He just, I mean, you could tell he was not acting, he was being himself, and he did an amazing job with everybody else on there.

And so um thank you for the invite.

And um, you know, it shows how we are here as a council to support each other, and uh um it was just good times.

So yeah, I really had a good time.

And then uh shoot, what else going on?

Oh, I participated in the stand down for veterans at the HOHP transitional housing on McCartney.

Um they invited all the mayors, and I was the only one that showed up.

And so uh it was nice to give pins, uh Vietnam veteran pins and Iraqi uh you know war pins in Afghanistan, uh those those conflicts.

And so I was able to to meet and talk to a lot of people, and um and give them the resources that some of them need as they're here.

Um some of them are still struggling.

Um support our troops from ropes and ranches there, and they have a huge uh shoe giveaway they give away shoes, shoes and socks.

Yep, and so they're they're one of the main ones there, and I believe they gave almost every single one of them out, too.

So there's a shoes up.

Yeah, there was a lot.

So it was hot too.

So uh, as you can tell, we're all busy here.

Just a couple of things on the manager's update for tonight.

There was a letter that went out, speaking of fundraising efforts for our annual Christmas event with the that the police put on.

So residents, employees received this letter.

Just wanted everybody to know that it is not fake news.

It is it is a real letter.

The police are doing their annual um uh uh Xmas Christmas event that they do where they buy presents for the children, they have an event, they hand out all the presents to the families.

But as always, you know, these things don't go without the help of people, and they're in need of donations to continue to make this a successful event again this year.

So uh if you did receive this letter, it is a real letter at this time.

You know, a lot of spam goes around, so we just wanted to point out this is a good letter, and hopefully you can make donations to the police department.

So, as noted in the letter, you can mail or drop off at Eloy PD, make checks payable to the friends of Apache Junction, and then just put in the memo line CO Eloy Community Service Funds.

If you have any questions, you can reach out to Trisha Wilcox, that's in the letter, or uh call City Hall and ask to get in touch with uh Trisha, and she'll be able to help you out with anything you want.

But real letter, looking for help, please make this another help make this another successful event for Eloy and the Eloy Police Department and the uh community members in need of a good Christmas this year.

Next yeah, they usually put it up on Facebook and they'll do um the question from the audience was is this going to be advertised?

And yes, we generally do Facebook social media posts, we'll have it up on the website.

We'll make sure that we continue to plug this and get this out in the community so that folks know how to do it.

We'd love to have donations and love to make this a great Christmas for those families and children in need.

Uh next up is Adopt a Street.

So if you have a street that you've adopted in Eloy, that cleanup is this Saturday starting at 7 a.m.

in Shomway Park, North Park, right there off of Bataglia in 11 mile corner.

So please, everyone that's uh signed up for an adopt a street program, come on out, get your vest, donuts, and let's make Eloy cleaner after Saturday.

We'll be there.

We the city have a stretch on frontier.

And then another fun festival is a harvest festival on October 26, 6 to 9 p.m.

That's our annual trunk or tree costume contest, carnival rides.

So come on down for that.

That'll be fun.

Last on my list is this week is the League of Cities and Towns, City and Town Champions Week.

So every year during this year, they try to focus they do a focus on cities and towns, what's going on this whole week?

We've got community and culture, administrative, public safety, parks and reconomic development, public works, and mayor and council.

So our PIOs or those who serve as our PIOs in the city, which is Lorena, um Sergeant Maestis that's in here today, and Sergeant Salmons are all working on putting together videos.

So we did our first post today.

So it's on the city's Facebook page.

Please check it out.

It's pretty cool, and we'll be doing that throughout the week to be part of this program with the rest of the cities and towns in the state.

We're going to start with item B.

I just have a couple questions.

Sure.

Um, I noticed that in the two um quotes that the quote from Cactus was much more detailed than the one from Sunlin.

Um, cactus actually mentioned like the arrows and DOT letters and numbers.

Is that all included in this?

Is that something that's required?

Um, as opposed to the Sunland asphalt one, which was very generic.

Mr.

Mayor, um, madam council member, yes, it is all included.

We provided the same scope of work to both contractor.

Well, actually, all four contractors, both of the contractors that responded had the exact same scope of work.

So the exact same markings will be in the Sunland asphalt project.

Okay, one more question.

Then they included cactus included in theirs, traffic control, off-duty officers.

I'm assuming traffic control is the is like the barricades, which is in Sunlands, but the off-duty officers.

Um, because that's a considerable amount in cactuses, and Sunland doesn't mention that.

Is that in their work or is that not required?

That's not required.

Once we establish the traffic control, we have it set up so that when they submit the traffic control plan, we approve it as the engineering department and say, yes, this will keep the motoring public safe.

It will provide enough guidance.

We don't need we don't believe that we need to have the the off-duty police officers there to monitor the traffic.

Okay.

And then lastly, that thermoplastic, is that highly reflective?

Because you know, that whole road is a mess right now.

And I've seen some um lines in different areas of the state that is very reflective, whether it's nighttime or adverse weather.

Um Mr.

Mayor, Madam Councilmember, this is part of the thermoplastic part of the application of that is there's some glass beads that go down on top of that.

That's what provides the retro reflectivity.

So it's not necessarily the paint per se, but with the glass beads, yes, it it'll it'll light up and it'll be pretty it it'll be very retro-reflective.

So to piggyback one of our questions about the police traffic control, would that increase the sun land bid?

If we were to require it, yes, it would, but but cactus put that in there hoping that we would we would see the need for it and and we don't, so they put that in as an extra.

We didn't specifically request the off-duty police officers.

So if we submit it or subtract that from cactus, would they be at the same amount or close to Sunland?

They would they would still be a little bit higher than Sunland, even with the omission of the of the off-duty police officers.

And both vendors have worked on our streets before.

I think Sunland was really active for a while.

Okay, and and we we in the engineering and the public works department have worked with both both firms extensively, so we're confident with with either one of the firms could do the job well.

Yes, uh Councilmember Snyder contacted me this morning so graciously pointed out to me that there was two applications attached to the um tonight's agenda item.

And so I wanted to uh make that correction.

The first six pages after the council report or the staff report, it pertains to Lucky Star Market, and this application is not is not about Lucky Star, it's about food town.

So the rest of the paperwork uh pertains to food town, and so I'm asking council to please disregard the first six pages.

So do you mean in the first liquor license application with K.

So we're only going to approve the PATEL, the Patel one.

You're only gonna approve uh the Food Town IGA.

You've council's already approved the lucky star.

And I believe what happened as I explained to Councilmember Snyder is that uh when we have um uh similar items, a lot of times we can just copy from previous council meetings and just make the changes at the time of that according to uh what's going to be presented.

And I believe what happened is that I probably hit the attachments, so the attachments were came along with the with the copy.

So that was oversight on my part, and I apologize.

But everything else is good.

Next, we're going to go to business item A, approval of change order number three.

To the contract with Sunrise Engineering.

Mr.

Mayor, members of the council, thank you very much for the opportunity to present this to you tonight.

This is a for the design.

Some some of the design that was overlooked when we originally purchased our belt press.

We entered into a contract with Sunrise Engineering to do the design for the belt press.

However, in with that, we we um through the through an oversight, we neglected to take into consideration the design for the concrete pad for the geotechnical analysis to make sure that it would support it.

One of the things that we're also adding with this is to have a design for a building so our belt press is not out in the elements, it'll extend the the service life of that piece of equipment.

You'll notice that this is change order number three that we're requesting.

Change order one was to provide for the additional um electrical work for a second unit to be installed in the f at the at a future date.

Change order two was actually um for the second belt press unit.

We said that's too much too soon, we don't need it.

So in house, we we rejected that change order number two.

This is why we're bringing change order three to to council to you tonight for for action and and approval.

What will be the total roughly the total cost of this project that uh if I'm look reading this?

We started out at what 390,000?

Right.

We started out with the 390,000, and that was for the purchase of the belt press equipment.

Um however, with the additional design work that's required of as we're looking at that now.

We can't really put that into service until we have the design until we have it.

Anyway, so all total with the building, uh, we're looking at close to close to 800 between 800,000 to a million dollars.

So it's pretty pretty substantial compared to what was originally presented to council, but we we feel that that the additional price is worth it to make sure that the project is done right.

And it's just taking something away from uh the CAP that in order to do this, finish this up.

Yes, we've we've looked at some of the additional projects that were listed in the CIP originally.

We don't believe that they're viable projects right now, they're too far out, they're too vague.

Um we have higher priority projects such as the 11 mile corner sewer alignment, which is moving forward, which was not in the original CIP.

So we've we've shuffled some of that around, and all of those are presented to council as as as an annual update for the budgets.

Okay, so the the impact of this is uh other than uh financial impact is is handled, yes.

Um, so since this belt press has been sitting there and used for over a year now, is there a warranty on that?

And does that affect the warranty that it's not being used?

It does affect the warranty.

Um we are working with the providers to to maybe um honor at least a little bit of the warranty uh once we get it up in operation.

So right now that the discussions that we have with the manufacturer of the belt press are saying that we have probably about six months of warranty that that could still be covered under warranty.

Declaring a public record for certain for that certain document filed with the city clerk.

Mayor members of the council, this item is directly related to the next, but first of all, it is the adoption of the resolution to create a public record, primarily so that we don't have to publish all I think it's 16 pages or so in the newspaper and save some publication costs.

I noticed we've been doing uh several of these similar resolutions as far as to avoid publishing in a paper because of the size and so forth.

And I think I asked the question the last meeting if someone would would like this documentation, there is a charge for it.

So I wonder if if there's some way we can for the after we approve these things, and uh I mean it gets published that there's a period of a couple weeks or even a month that people can get this uh free of charge.

We'll make every effort to do that, but if not we'll have to have a we'll have to do like maybe burn a CD or thumb drive, and then that's when the charge comes in.

This is a council initiated text amendments to the zoning ordinance.

Just gonna give you since we've discussed it previously, it just gonna give you a high level overview of it.

It's a request by the council to amend the zoning ordinance to require walls and fences on residential residential developments, residential single family that is dwelling, excuse me.

Single family attached and detached dwelling is duplexes, modular homes, and manufacture homes that are in the residential and commercial districts on one acre or less.

The primary purpose of this amendment is to require opaque uh fences and wallets to enclosed the side and rear yard.

Uh it's good to point out that this amendment will not affect those properties on with the PAD overlay.

That is intentional so that so that those uh developments have that have specific guidelines about their development and how they want to develop uh can be achieved.

Uh the minimum heights for these are five feet, although there are exceptions built into the ordinance, and this is for primarily for a handful of different reasons, but the primary one is for enjoying open space and the ability for accepted prevalence uh over open space areas.

So when an open space area is narrower, uh we have we will reduce the wall height to four feet.

When it's a hundred feet wide, we'll reduce it down to two, and when it's two hundred feet wide, it'll be reduced down to zero.

That does not say that they cannot put a solid wall, it just allows them to do a reduced sense.

So and finally, the amendment allows city council to approve modification as fine as part of a final plat approval.

And I just it I for my personal experience and uh the ropes and ranch, and we have of course have holes, but they're specific on the height relative to grade.

And so they specify a wall height relative to the street grade.

If you have a lot to have a slope on them or a height, uh is there any consideration given to where that height is measured from?

The ordinance already discloses that the uh height is measured directly adjacent to the fence.

So we have to go back to the uh resolution, but if this is the wall, and right here from the grade right next to it to the top of the height.

If uh the there's a slope.

Let's say there's a drop of 20 feet in the in the uh lot.

So from front to back, there could be a big change in the wall heights relative to seeing over the wall and how opaque it is.

That guess that's what I'm asking.

Relative to our community.

I understand your point.

Having worked in regulated communities that have such a thing.

Our community is fairly flat.

Uh and I do not see such an example as the the intent of it is to screen the backyard.

So even if let's say you measure a lower wall, you will still see the backyard if you're measuring from a lower elevation or from a higher elevation.

So it's the purpose is to screen the backyard from the grade elevation adjacent to the wall.

So I got a question.

Um I know in some areas in the Taltic area, there's there, I know we're requiring the block or you know, non-viewing, I guess, of the backyard.

There's some that are already set up with like chain link or chicken wire, I guess, but it actually looks pretty nice.

Um does that is that part of the approval, or do that those residents have to take that down and put up a new wall that is now being asked of.

Sure.

The point of chicken wire, that's not allowed in the city code or even in the it's actually not even in the zoning or city code, that's not allowed.

So those uses that are currently out there already.

We're dealing with a couple code enforcement actions at this time.

Uh if it exists at this time, it will be considered legal non-conforming, and they will not be required to modify their fence.

It's just as adoption date forward.

It's the actual item for consideration and adoption of an amendment to the city code to consolidate the responsibilities of the Board of Adjustment, the Airport Board, and the Revitalization Commission into the responsibilities of the planning and zoning commission.

Make a note this is the planning and zoning commission is not a new commission.

It is just acquiring the responsibilities.

So the planning com planning and zoning commission will remain.

And there is a requirement that's built into the provisions that require at least one person of for each of the following tasks.

So you have one person for focusing on with an interest to focus on revitalization and redevelopment and historic preservation.

One person for focusing on economic development and housing, and one person focusing on airport and air park planning.

Now, as I said, focusing their intent is their interest, but the planning and zoning commission has many functions, and planning and zoning of the city is the is one of the paradigm ones.

So they will be all focusing on that as well.

Will we be we will be maintaining the ex officio the council and one non-voting member to fill in as needed when a person from the voting members is absent.

In summary, the planning and zoning commission will now take if approved, take on responsibilities.

Some of these already exist.

The general plan, specific plan, and master plans.

These are our guiding documents for out the city.

The general plan is that it's primary policy guidance document that's uh approved by the voters and approved by the council for the city.

Land use and zoning matters, we call those rezoning.

Pretty simple and conditional use permits.

And of course, we just mentioned historic preservation resign, uh, revitalization and other assigned tasks, uh, including the economic vitality, uh, providing from a planning perspective.

I'll be happy to answer any questions of the council.

And as we take this step, we're really kicking the uh requirements of this planning and zoning commission up a notch because there's a lot of uh information and a lot of things are gonna be coming to this board now that they may have not seen in the past, and as we move forward and things happen in the city, they become much more important.

And so I'd look at this planning and zoning commission a new one almost like a mini uh council member, council, because it will have responsibility for subgroups and uh and so I I see uh a time commitment from some of the people on this commission.

So I think uh as we move forward, we have to be very selective and be sure that people understand being part of this organization, be this commission is vital to the city, and it takes a commitment.

They need to understand that we expect them to attend the meetings and not uh well, I don't feel like going tonight, and I've seen that happen too many times, and we struggle for forms.

So I think going forward, but we have to as we appoint people to this commission that they understand what the requirement is.

So that's comment.

Well, let me rephrase it.

Some of these boards, they're aware of what's going on with their boards, like the airport and um board adjustments.

Has there been any interest from the board members already regarding joining this new planning and zoning commission?

To my knowledge, the year has been interest of the existing commission.

Uh to there's two members that are current two members that are in the process of filling out the paperwork to possibly consider it for reappointment.

Um I spoke to the commit some of my direct board commissioners.

Um there were some interests, some wanted, some didn't, you know, they were already termed out, like board of adjustment.

They're like we've done it, it's time for something else to go on.

Um at the last meeting, and I don't wish to speak for Vice Mayor Curtis, but I believe she received a comment from one of her board members that was interested, but uh refer to David.

Have you heard anything from the airport?

Yeah, I've heard from a few of my airport members, uh, Frank Frazetto and Michelle Peters, especially that they would be interested in submitting applications to serve on the larger board.

What that was a lot of the impetus to where we are today is just because there was no meat on the bones in a lot of those commissions, and we're just kind of rolling the ball constantly.

So, with having this larger commission and consolidating the this the commitment will be there and they'll be making a real impact in our community.

I think those folks that were serving on previous commissions, that's what they want to see.

They want to know that their time is valued and that they're having an input in the community.

So uh I'm proud that we've got members that are still and the ones that are consolidating are like, yeah, I want to be part of this.

Federal law, state law requires that our state law very specific on zoning ordinance variances, meaning that the person who needs the variance cannot cause it.

Also it incorporates the ability for the Board of Adjustment to review the zoning administrators' interpretations and actions as it pertains to the subdivision ordinance.

This is a request once again by the council to initiate a tax amendment for to create the historic preservation overlay.

This this item is to create a historic preservation overlay.

Uh so that we can designate those properties with the zoning so that they can be preserved in their integrity.

And also is preferred for the resign uh recognition and enhancement of the community and to protect uh cultural awareness and the public welfare.

Also the zoning ours uh includes accommodations for zoning provisions, in other words, many of these uses are legal non-conforming, so the overlay allows for modifications to those to make those uses conforming in those developments.

Furthermore, the ordinance uh will allow this the zoning order to be in conformance with state and local state and national guidelines for historic preservation.

Uh conduct a public hearing, consider the adoption of ordinance number 24-981, approving case number z TA, 2024-004, development standards and building heights exceptions.

Dan Mayor members are council for the last show of the evening for me.

This is a zoning administrator initiated text amendment uh to revise and restate the development standards as I was going through the standards when I got here and over the past several months of implementing them.

There are a lot of clarity and conflicts that need to be resolved.

Uh they do lead to decisions being made and last habits growing and not in concept with the code, so we wanted to do uh fix those.

And for example, uh the residential districts say that you can have detached single family, but a little subscript note elsewhere.

You can have attached single family as I call true town home, which is you're on the dirt and the billing.

Uh that is now clarified in the allowed uses.

Uh if you weren't looking at for that note, you would not know that was allowed to use.

I stumbled across it.

Oh, that's kind of nice, especially for providing affordable housing.

So those items will be uh corrected and restated.

In addition, we're adding a square footage allowance for our mixed use district.

Coming from a community that did not have this provision, you will end up with a for example in Flagstaff, we would end up with 200,000 square feet of residential apartments and a 5,000 square foot commercial use, if that's not the intent of mixed use.

It meets the definition, but that wasn't what was intended.

So that provision that we have enacted here is one I've used in other communities outside that uh equates so much commercial to a square footage allowance.

Um for example, ours is a little different than what we did in Scottsdale.

It's uh 50% of the total commercial areas allowed as residential there.

I kind of flip that number mostly because residential is necessary to support commercial uses.

So in addition, the building heights have been updated just mild mildly a foot here, maybe two maximum to conform with uh standard construction standards, uh which are multiples or divisibles of threes and fours, sometimes fives.

Getting into steel, that's a different animal, but most of it's wood.

So when you're doing divisibles by eight, so it's kind of that different animal.

So that also will be done, but it's mainly to reduce simplified construction and reduce waste.

Uh in addition, when the ordinance was adopted in 2018, I will call this an oversight.

Several of the districts, well, all the all the districts uh with the exception of the industrial, allow for unspecified uses as a conditional use.

An unspecified use is a use that has not been listed in the code elsewhere or in that district.

So industrial, we recently had a couple questions on this, and um, having been aware of it, I added it to it.

So, and the biggest one is for allowance for building height exceptions.

I also like to call this an oversight because we have this everywhere throughout our city is building height exceptions for tower steeples, silos, unoccupied air tower elements of a building, uh churches and synagogues, and many other uh one of the main reasons for doing this is over the past few years since the ordinance has been adopted.

We've done a handful of variances for building height exceptions, especially for our industrial districts.

Uh industrial any type of uh exception to the code that's created by the user is technically not allowed by state law.

Uh so it puts into question the possibility of a variance.

So to make us conforming with that, we added these, which are standard throughout the community, throughout the valley, and throughout the state, and in fact, without the nation.

Also, those provisions that may not meet the requirements, they'll be allowed to ask for a conditional use permit uh for modifications from the council.

A great example of that is goldbottom.

They got a variance for 110 feet because of their shed and their grain, not grain, but their aggregate loading of this of the warehouse billing, and instead of having to go through a variance, they just go through a use permit process so that the council can evaluate what is necessary.

Uh there's been some questions about a lot of the food trucks coming about and their requirements, and I like to kind of look it over whether it's this council or the next council, because we're getting a lot of interest and confusion about what's going on.

And I want to kind of dive into the food truck business and what their stuff are.

So I would echo that.

I've had questions relative to notice tonight in a way, and there's one that's uh not really a truck, it's a trailer.

It's parked.

Yeah.

And so just I think we need to clarify that in parking spaces, particularly on Main Street on what the use of uh food trucks using those on a regular basis.

So uh I think I'd clarify I'd like to say that same thing.

Yeah, because it yeah, we just need to go through it, I guess.
