Tonight I'll start on my right side.

So I just wanted to share that I um volunteered Friday for the homeless point in time count here in Eloy.

And um I just wanted to give a shout out to our compliance officers who were very helpful.

Both of them took lead on a team.

They knew the area very well.

They they um really saved us a lot of time and uh and a lot of effort.

What I found in in I found the same thing when I volunteered Thursday in Cassagran, was there's a lot less homeless people that were around to be surveyed.

Uh we'll find out later on when we get the full count.

But I know that we hardly found any unsheltered citizens on on the team that I was on.

I think we only got one survey, and we maybe found about three or four people.

Were you going out in the desert to do this?

Yes.

And that's another point I wanted to make was that there's a lot of illegal dumping out there.

And we found a boat hidden in the bushes and in the shrubs and stuff.

So I I tried to send an email earlier to you and to the city manager about a meeting I was on in one of the things.

I thought that property maybe it's because it it is isolated out there and it's barren right behind um North Talltech.

That people are just assume nobody's gonna watch them out there and they're just dumping.

Yeah, there's a lot of furniture, there's a lot of bedding, quite a bit of illegal dumping out there.

Yeah.

Yeah.

I had occasion uh with uh some other council members to attend the Pennell partnership last Friday morning.

And I it was interesting for me because there was a discussion around Santana Valley and the annexation proposition, uh and how many people live in that Santana Valley area and what is happening as far as uh a petition to annex that property and what effect it may have on the county.

The other interesting discussion had to do with uh what they call the 505.

Uh we used to call it the north south, uh, if you will, but they they've destinated just like the 101, the 303 and so forth, they've now have a new road that designated the 505, which is basically connecting like uh Apache Junction with the 10 below us here, and so the idea was to have an expressway that would connect the east side of uh Phoenix area to Tucson.

So their discussion about where that might be, and also a road called the 24, uh, which would be connect into that.

So the whole idea was to try to take some of the traffic off of 60 and get it on this 505 so they could eliminate uh Bass Gold Canyon and that whole area up there and Apache Junction.

So it was a very interesting discussion.

It had some maps, and so I learned a lot from that because I was not really aware of what the whole discussion was.

So stay tuned, it's not gonna happen tomorrow or next year, but it's in the planning stages, discussion stages, and so it will eventually affect us because it'll come down on each side of us here.

So uh there's another expressway close by.

On Tuesday, we had the Sun Carrid or Metropolitan Planning Organization meeting here in Eloy in these chambers, and we discussed traffic safety and crash data from Panell County and air quality.

And the traffic data was really the traffic crash data was really eye-opening.

We have got to do a better job driving.

We really do.

On Friday, I attended the same Penell Partner breakfast along with Councilmember Galindo Snyder, Bod Roska, and assistant city manager McKenzie.

And along with what Dan was talking about was discussed, we also discussed the need for trade schools and affordable housing in Penell County.

And I am all for trade schools.

You can graduate at high school and have a trade and go out and immediately hit the ground running and make money.

I'm a product of that, and I I full full enforce it.

We wish him well in his new role.

It is not an easy job by any means.

Also on Wednesday the 22nd, myself along with the vice mayor, we attended a ribbon cutting at the newly updated Pennell County Animal Shelter.

It's a wonderful facility.

Staff and volunteers there do such great work.

And the facility, the facility is state of the art, there's no doubt about it.

And they're what they call uh no-kill facility with 94% rate actually walks out the door, the the little pets, which is really a good thing.

On Saturday evening, I attended the toll tech school superintendent forum that was at the Arizona City Elementary School.

The candidates flying for the position of superintendent were all well prepared, and I wish them all luck.

And it's just nice seeing how the process works.

And hopefully a lot of those will come to fruition.

And that's it for me.

Vice Mayor, members of council, just a few things on my docket.

Number one is we reiterated this at the last council meeting, and just again, still looking for applicants for the planning and zoning commission.

So we did not receive all seven that we needed to move forward with forming a subcommittee from council and then providing recommendations for council approval.

So right now we have five.

We have three of the previous commissioners, um, and then we have two other folks, one from the airport board that is looking to serve.

But if you know anybody, even those in the public and listening, please encourage, go on our website, fill out an application, and once we get to the seven, we'll present those seven applications to the city council for a subcommittee formation and move forward the process from there.

Then road closure update.

Um moving along great.

Matt and his public works team have been working with the contractors on that.

Uh, you saw communications last week that sped up a little bit of that process.

So they're on Main Street today, chugging along.

We've got sunshine done, Santa Cruz is done, uh, Main Street today.

Striping will occur later this week.

That's temporary striping.

Uh, they'll be coming back in 30 days to lay the thermoplast down.

But uh these guys really really worked hard and really got it done.

So happy about that.

We had very little complaints, just a couple of uh, you know, help people out with getting in and out of their driveway.

There were some school issues that we worked through with the bus drivers.

But overall, I mean this went pretty seemingly.

Um, I checked some social media posts, and everybody seems pretty happy to see stuff happening in Eloy.

So that's good.

Um next up, we've got uh February 7th, next week, Friday from 6 to 9 at Ropes and Ranch is the father-daughter banquet.

Uh still accepting applications, so folks out there want to get together.

We're we go online and call community services and get your team put together for that.

Um, but also that day is our budget retreat.

Okay, on to item number eight, business and possible discussion andor action on the following.

Item A, acceptance of the fiscal year 23-24 annual comprehensive financial report.

Yes, uh, Mr.

Mayor, members of the council.

Um, tonight um I have Josh Joshua Jumper from Heidenfeld and Meaches, the audit partner that conducted the audit for us for the fiscal year 23-24 audit.

Um, before I have him come up and he's gonna kind of go through a little presentation, it'll take about five, ten minutes at the most.

Uh, just a little bit about Heinfeld and Meets.

They're staff that came in and did the presentation this year were very polite, very professional.

We met all the time, they met all the timelines so we could uh get our application and the the audit to the GFOA of the government finance officers association to for consideration for our the certificate of excellence and financial reporting.

So they met all those guidelines and everything.

So per Arizona revised statute 9-481 section H it states that within 90 days of after completing the audit, the uh government body shall require the certified public accountant who performed the audit to present the audit results to the governor body in regular council meeting.

And uh then once by what they're gonna kind of go over that tonight, and then by approving it, um, the 2324 audit, it will be in compliance with the statute that I said.

So I'll let Josh come up and uh kind of go through his presentation.

Um, if you guys have any questions for him regarding the audit or anything that went on, please you can address them at that time.

Uh good evening, council, uh city management.

It's my pleasure to be here uh this evening.

Uh just a couple uh prepared slides.

Uh I'll be brief, everyone's favorite topic, the audit.

Uh, but uh again, if you have any questions for me, I'm happy to answer them along the way.

Uh so the city has to get an annual audit.

Why is it required?

Well, it's in state statute to have the financial statements audited, and then as Brian mentioned, it is an Arizona revised statutes from 2021 that I must come present outside of the consent agenda.

So it wouldn't be an audit presentation if I didn't touch on the importance of an audit.

Uh so uh why does the city have an annual audit?

Well, uh the auditors are verifying management's representations on the finances of the city.

Uh, you're also demonstrating stewardship and accountability to a host of different potential entities and governing body you, the council, grantors, state agencies, federal agencies, and ultimately your citizens.

Uh additionally, you're uh ensuring compliance with laws and regulations, and then you're also ensuring uh as a council that management is fulfilling their responsibility to get the annual audit completed.

Uh so just touching briefly on the audit process.

So, way back in the spring, uh the engagement letter was signed, which initiates the annual audit.

Uh, we performed preliminary audit procedures over the summer.

Then in September and October, we performed final audit procedures after the year was ended, and the general ledger was closed out.

In November, the draft of the audit report was provided uh for audit review, and then the ACFR annual comprehensive financial report was issued in December.

And then in January, other reports were also issued.

So, what's included in the term annual audit?

Uh, there's lots of different reports uh issued as part of the annual audit contract.

Uh the first one being a communication to governance letter, which is included in your agenda packet.

That is uh for the council uh to the council, and I'll touch on that in a little bit more detail in a minute.

The annual comprehensive financial report, that's the big one.

That's the city's annual financial statements, uh, and it includes our audit opinion, the single audit reporting package, uh, which reports on the city's compliance with its expenditure of federal dollars.

So all the federal grants the city receives, uh, that single audit report has to be submitted to the federal government.

Uh the city's annual expenditure limitation report.

Additionally, landfill assurance report that gets submitted to ADEQ.

And then also submitted to the state of Arizona is uh the city's compliance with HERF highway user revenue fund compliance.

So spending those HERF monies in compliance with uh state law.

So after all that, uh the key items I wanted to communicate to you uh in this presentation.

The most important being uh the city's financial statements received an unmodified audit opinion dated December 19th, 2024.

Unmodified opinion in non-accounting speak is a clean opinion.

Uh so pleased report that this evening.

Uh, number two, also important.

Uh so as part of the annual audit, we look at the internal controls over financial reporting, non-federal compliance.

Please report no internal control deficiencies noted.

This past audit.

And then number three, in terms of that single audit, the federal grant, the federal dollars we looked at uh in-depth were the airport improvement program this year.

Uh so back to that letter to governance that's also included in your agenda.

Uh there's it's a three-page letter, but attached to that letter is a copy of that engagement letter at the beginning of the audit.

It's signed management representation letter signed at the end of the audit.

That's also attached.

But that three-plage letter uh just touches on a couple different things.

Uh things I wanted to point out specifically.

We had no difficulties in completing the audit this past fiscal year.

We had no disagreements with management in doing the audit, and there were no uncorrected misstatements this past fiscal year.

And this last slide, so just talking about fraud that not to alarm anyone, uh, but just that as part of the annual audit process, we do inquire about any knowledge or allegations of fraud.

Uh it's a standard audit practice we do for every audit, but that ultimately fraud at every organization rests with its management and its council.

So just wanting to delineate those responsibilities as well.

And then when it wouldn't be an audit presentation if I didn't disclaim a little bit, but the audit is designed to provide reasonable, not absolute assurance on the financial statements, and that ultimately the financial statements are the responsibility of management.

But uh prepared slides aside, uh the audit went well.

Uh we got the report submitted timely, as Brian mentioned, but that's all my prepared remarks, but I'm happy to answer any questions that you may have.

We satisfy go ahead, sir.

Uh in my uh I guess previous life, I was subject to many audits, and it seemed like the auditor always would find something.

I mean, you never got a clear, I mean, it was just suggestions, whatever, so it wasn't uh could you share anything like that?

Maybe the suggestions that uh improvements we could make along the way in certain things.

Uh yeah, that's a good question.

Uh uh there in every audit we we uh find minor things or suggested best practices, a lot of best practice suggestions is what we encounter in uh just in going uh through the audit with Brian.

Uh just uh one thing specifically is just tightening up some general ledger uh entry type processes just to uh better document segregation of duties in certain areas, but again, that's minor and more just a best practice recommendation.

Okay, now we'll go on to item B, which is discussion and approval of accepting the estimate provided by CAID district to provide sand removal from well number three for an amount and up to exceed $30,000.

Members of the council.

And this item is brought to you before uh brought to you brought to you tonight for consideration.

We have an intergovernmental agreement with the Central Air Zone Irrigation Greenage District.

Uh as you know, they they have wells throughout the community, and they have staff may have equipment that we don't have with the with uh within our our department.

Um in 2007, they entered into an agreement that was approved by council for maintenance and repairs and and basically lending their staff, their manpower, their equipment to us, uh, so that we can diagnose them and make some repairs on our wells.

Um, this one is is for the removal of well number three.

Uh well number three is one of our most important uh wells for the city of the Loy for two reasons.

One, the water quality in well three is is quite a bit better than the the other than the well five and well six that we're currently using.

Uh just because the wells five and well six, the way they're located, there is it's just has a high nitrate concentration, and so well three has a lower nitrate concentration.

So what we do is we blend the water between the two wells or the three wells to get to keep our nitrates down and to improve our our our water quality.

Um the well three also is one of our largest producing.

It produces up to about 1250 gallons per minute, so it really helps to meet our demand.

Uh a few years ago we noticed that there was a lot of sand and sediment coming in from well three, and so we approached the Central Arizona irrigation drainage district and asked if they had equipment and manpower to to help us determine what was going on with well three, and they said yes, absolutely.

They they provided this estimate to us for $30,000 or not to exceed $30,000.

Um if council approves this, we will work with the Central Arizona Irrigation Drainage District to have them come in and remove the sand from our well, and then it will also lead to a video inspection of the well casing so we can determine if there are if there are other problems with that well casing.

Uh this intergovernmental agreement is is automatically renewable every five years.

And so we're in the next cycle of of renewals.

We have three um two years left in this current renewal cycle, but then after that it just automatically renews.

Matt, um I'm not a civil engineer, so uh bear with me a little bit.

I have a couple questions.

Um, how often is maintenance done on these wells?

And they're correct me, there's four wells, is that correct?

That's correct.

We do have we do have four wells.

Um three of them are operational.

Well three is the moment's down.

Typically, we try and go in and do maintenance every three to four years.

Okay.

And last time you checked the maintenance on well three, you you mentioned it was noticed that there was sand building up.

And what is what does it entail in that maintenance that they discovered the uh the sand in the well?

I'm sorry, what type of maintenance?

So what we did is is it wasn't that good.

Yes, it's not so much testing the water, it's just testing the mechanics of the pump.

Um so what we'll do is is when we noticed it, we noticed there was a lot of sand coming in.

And so we drained the sand out of the well casing and basically just let it discharge to the ground until we could get it to clear up.

But then since we've noticed more and more sand coming in, we decided to shut it down completely so we can go in and find out exactly what's going on with it.

Okay, and how long ago was it shut down?

That was about four years ago when we noticed it.

Four years.

So we've been operating with three wells since that time.

That's correct.

Um I think that's it.

And we're gonna take this whole well apart and not find anything else wrong, right?

We hope not, but we'll find out.

Uh go ahead, sir.

What could be the cause of the sand coming in?

Without doing the the actual video inspection, there's there's a few a few things that we we anticipate could be leading to the problem.

It could be a crack in the well casing, it could be um when the well was was installed, it wasn't necessarily installed correctly with the with the proper protection around the well casing.

And so maybe some of the sand is infiltrating from outside of of the well casing.

So that's one of the things that we're gonna look at once once we remove the sand, we will look at it and see where if we can find out what's going on within why we're getting so much sand.

So potentially when you do that, you may be back with some extra request to replace the casing or something.

That's correct.

And worst case scenario, if we find that it wasn't constructed properly, uh, we will relocate the well site and we'll come to council with a with the request to approve moving well three from where it's currently located, somewhere in the same vicinity, making sure that it's corrected and that it's installed properly with the with the correct protections in place.

If you have to do that, any danger with the nitrates in the other wells.

When you say you blend uh well three now with the other wells to keep the nitrate level down, but if you have to relocate well three, does that pose an issue with those uh with the nitrates with the other wells?

Potentially it could, but we don't see that as an issue because if we relocate well three, it will be relocated within the within maybe a hundred feet or 150 feet of the of the current well site.

Item C is approval of a change order number one submitted by Sunland Asphalt and construction for an amount not to exceed 100,000 dollars for mill and overlay pavement preservation project on East 11th Street between Santa Cruz and Sunshine Boulevard.

Um a lot of times I understand when when the phrase change order comes, no, no, no, we don't want change orders.

However, change orders can sometimes be good as well.

In this case it is, because when we were going through the scope of work that that Sunland Asphalt provided to us originally, we found that there were some cost savings that we had by going through their quantities and and by removing some of the scope of work that we originally had.

In that we found that there was enough to um do the pavement preservation on 11th Street between Sunshine and Santa Cruz, which I um if you're familiar with connects the two.

It's those that connecting street.

And we figured they would be in the best interest of the community to do that all as one piece, so we didn't have a nice new section, nice new section, and not nice new section connecting the two.

Um so in that we we were able to negotiate with Sunland asphalt to to put this together for our proposal, and and we believe that we are we are we are confident that we are under the the budgeted amounts that have been approved by council and and presented in our budget.

Do you have any idea when this will be done?

Will they try to work it around spring, break, summer, or or will school still be in session so that we have to worry about the kids walking around that or no?

And and and if if council approves it tonight, we will authorize them to go ahead and move forward with it so they can do it with the same project so they don't have to come back and do a remobilization for a second mobilization.

So it will be done if council approves it tonight, it will be done by the by the end of next week.

Yeah, they have all the equipment out there now.

Let's not have to remobilize and bring everything.

Just because it's part of the current project that's going on right now with Sunshine and Santa Cruz and Main Street.

And it was a 400-foot piece that just you know okay.

Well, I just wanted to make sure that it the letter that was sent out, it's within that scope of time that you said this project would take place, right?

That's correct.

Because I believe it was 227 was what was given the completion of this project.

So it's it's still well within that scope of time.

Matt, there was a second part of this um removal of bricks.

That's correct.

As we discussed previously, and in I believe it was December, the brick the brick crosswalks on Main Street.

We're we're removing them.

We'll come back to council after we they do the the paving on top of it, so we have a clean slate and we will present to council on other alternatives for replacing and reinstalling this the sidewalks.

And I I believe the quote was approximately 45,000.

That's correct.

About 1600 square feet area.

How are they removing that?

Is it they'll go in with with jackhammers?

Um, they have jackhammer attachment on one of the pieces of equipment, they'll remove the brick, they'll jackhammer the concrete, and then they'll backfill it with uh with the with the roadway base, and then just pave right over the top of it.

Okay, well.

Um regards to the workmanship of this company.

Any have we had any issues with them as far as maybe corrections and how quickly they came back and corrected any of the work?

removing that is it they'll go in with with jackhammers um they have jackhammer attachment on one of the pieces of equipment they'll remove the brick they'll jackhammer the the concrete and then they'll backfill it with uh with the with the roadway base and then just pave right over the top of it okay well um in regards to the workmanship of this company any have we had any issues with them as far as maybe corrections and how quickly they came back and corrected any of the work no we haven't we we've we've worked with i and my staff have worked with this company not only here in eloy but also in in salarita in coolidge and other municipalities that we've been employed with and and we found that that sunland asphalt is very responsive and very capable and we haven't had any issues with them in the past thank you Matt thank you all right any other questions go ahead thank you mayor I have some questions um do you or some of your staff go through their work and check where new roadway connects to old roadway to make sure that those are a seamless connection and not lumpy or large Mr.

Mayor Madam Vice Mayor yes we do absolutely we have somebody on staff all the time when they're there with it and and so far the reports from my staff and from my my observations they they've had uh a really good quality product that that they've been putting down even with the transitions from new to old pavement and then one other just um sunshine and frontier the way it goes um if you're going north on sunshine um from frontier um it's there's quite a transition right there because of parking on the street um there's not a lot of room for two vehicles to be traveling north off of frontier onto sunshine still have the vehicles parking there in front of those businesses on sunshine so that might be something that needs to be looked at and we've we've addressed that with the businesses we've addressed that with the parking we haven't had any issues during the course of this whole project we haven't had any issues with any cars parking on the street in that in the way of the equipment but once it's done those two lanes of travel headed north off of frontier onto sunshine it's quite a narrow passageway if vehicles are parked on that curb not talking about while it's being um completed but afterwards understood I'm sorry I misunderstood your question yes we're we're aware of that and we'll make sure that that the traffic is is flowing freely and that there aren't any obstacles or obstructions okay thank you thank you anybody else all right this time for item C looking to get a motion for approval of change order number one submitted by Sunland asphalt and construction for the amount not to exceed 100 thousand dollars mill and overlay pavement preservation project on east 11th Street do I have a motion for approval mayor I'll make a motion we approve item C second please a second go ahead sir who wins okay councilmember Curtis yes Councilmember Snyder yes Councilmember Garcia yes councilmember Rodroska yes Councilmember Galindo yes Mayor Sutton yes Vice Mayor Tarango yes the motion passed unanimously mayor uh thank you mayor thank you very much thank you Matt okay now for item number D is the chair's discretion I will move that item to after the executive session and at this time I'm looking for a motion to go into executive session how much time do we need mayor council members I would suggest 45 minutes and also you designate what individuals you want in the executive session.
