I've talked to several of you about this issue uh paving of North North Toltec Road and quite a bit with with McKenzie, and I appreciate that the information.

But I just wanted to come and ask that if there's any way that you can prioritize that paving.

It's um so I'm going on the sixth year here.

First year it wasn't too bad because COVID, people weren't using that road, but now it's just it's just horrible.

I can't even use the um my patio anymore.

So we get semis and buses going down there, and I've literally seen clouds of dust come over the the back wall.

You know, if I'm out with a cup of coffee and a computer, I'm not gonna be having to run into the house to try to avoid the the dust storm.

Um but it's just and it's just it's a health issue too.

Um I know we've we've contacted my my neighbor, John Duncan here came along, but we had a um we had some petitions go out.

I know we sent him to rubs and then we sent them to you, so I know this is an issue that's um more than just my concern.

Uh generally the call to the public, we can the staff can and city council can respond to criticism and uh I'm sure your your response is not gonna be a criticism, but could be just really brief, the comments, but because it's called to the public, it's not per se a discussion item, so you can respond to it, but we can't discuss it any further than that.

Yeah, Keith, I just wanted to provide you with an update, and actually this is getting brought before council at the end of this month.

The construction approval, I believe, through Sunrise or Sunland Gin or Sun Sun Linda construction.

So for the Toltec double chip seal paving um should be approved at the end of this month.

I'm at 508 West 13th Street.

I've been a citizen here in Mori for about two years now.

I love you, Laura.

Reminds me of my hometown back in Morris, Illinois, small sm uh niche town, love it.

It makes me feel safer, honestly.

I didn't know I was gonna start this out, but when we do the Pledge of Allegiance and I heard Liberty and Justice for All, I'm like, there we go, that's my end, right?

So about a month ago, my girlfriend was out uh with our dog in our backyard, fence in the backyard, and about 5 30 in the morning to get ready for work, and I heard her screaming.

I got one an hour, my girlfriend's getting attacked, my girlfriend and our dogs getting attacked by American Bulldog, the neighbor's dog has seven dogs, audiences, you know, ordinances.

And the thing that bothered me, like the justice part, there's nobody really at fault, right?

The neighbors didn't like the economy outside where the the the incident happened, what do we want the dog to do?

It's like one of those situations where you don't really want somebody to be in trouble, but at the same time, I want my girlfriend and our family to feel safe in our backyard.

So I take the proper procedures.

I started digging out the fence line and putting chicken wire down.

The thing that bothered me, and I'm trying to let it go, is that any control didn't show up the 7 at 5 30 in the morning, and who control didn't show up to June.

They were very rude sometimes on the phone, I was being very polite.

Um, and also nothing happened with anything.

They just walk still there for weeks to come on, and I'm just like, and like I said, it's one of those situations where it's like, what do you want to happen?

But at the same time, not anything at all.

You know what I'm saying?

My girlfriend was very mentally disturbed by it all, and she's a dog lover.

Like we had a lot of dogs at one time too.

They were the borrow family.

You guys know the Laura family.

Like I said, I just want to bring this to awareness because I'm a solution person, right?

And I'll bring the other topic up two weeks from now.

You just get to know me.

First up, there's Mayor's announcements.

And you know the mayor has a few things to announce.

On Tuesday, the 28th, several council members and I attended of what we thought would be an open house at CARA.

That's the community action human resource agency.

Instead, it turned out to be a wonderful surprise dedication of their conference room to Mary Lou Rosales.

It was a touching moment honoring somebody who's truly a part of the fabric of Eloy.

Many residents and VIPs joined us.

There were four mayors in attendance for this.

And that was just very fitting for Mary Lou.

She deserves every bit of it.

And on Wednesday the 29th, I had the honor of being featured as a guest at the chamber's fireside chat.

It was a fun, engaging experience, and I enjoyed the great questions and conversations that arose at that meeting.

That was a lot of fun.

It was tough being the headliner, I gotta tell you.

Then on Thursday the 30th, I stopped by the Head Start Open House over here on Third Street.

Now I've driven past that building a million times.

I was never inside it, and I have to say I was really impressed going in there.

Currently, they serve uh approximately 50 children, and the staff are doing an outstanding job supporting families in this community.

And I was even sitting in one of those little seats and reading to the kids and helping them make collages.

It was just such a fun day.

And of course, the big day we had all been waiting for.

It was the ribbon cutting of our new hospital, a truly historic moment for Eloy.

We began at the hospital for the ceremony and wrapped up with a reception here at City Hall.

And once again, just a big shout out to the owners and staff of Executive Health for their partnership and commitment to our community and this can the future of this community.

These guys at Exceptional Health are really really great partners to the city.

So with that, that's all I have.

Um, I also attended the Exceptional Health reception, the ribbon cutting and the reception, and I was able to meet a uh representative from Resolution Energy Solutions, who which has started an office at the end of Main Street, wanting to be very involved in the community.

And I invited him to the Eloy Lions Club.

Um committed to sponsor the golf tournament and do some other things for the community.

Um he's also I was also able to introduce him to the director at CARA as well as uh Corporal Crane.

Is that correct?

Um with the Eloy PD, and he wants to help out with uh Eloy PD as well.

Um I also on the 31st uh attended the uh 12th annual business education uh summit uh in Florence along with an uh quite a uh uh large group of partners within our community um looking at workforce de workforce development and how cities and schools and communities can all work together to build a strong workforce.

Um there's a lot of problems, a lot of issues.

Uh we tried to come up with solutions.

Um but uh there was some really great information about the uh the um recent data collection of Arizona First, which has been it's a starting nonprofit that started about 12 years ago to kind of track just where education-wise Arizona is.

Penau county is is right on track and is looking really well.

Um I did get the slides from the presentation.

I will share them with the city manager that he can um pass out to the rest of you, and and you can see all that information yourself.

That was about it for me.

Mayor, like you, I attended the dedication from Mary Lew.

Right.

I had a talk.

I was quite a stocked.

Anyhow.

It was a nice evening.

It was a great crowd of people.

Well, not just the four mayors, but several more and more board members.

And then I went to the ribbon cutting at the hospital.

And then on Saturday the first, I attended the Day of the Dead celebration at the Eloy Cemetery.

Very nice event seems to be growing more and more.

I'm not sure if it's more people just coming out or more people joining the residents there.

Either way, it was a nice celebration, and Father did a wonderful job.

Well, thank you, Jose.

Then uh busy week for me, busy couple weeks, I guess.

Uh the uh exceptional health care.

I have to admit that uh I attended both the uh groundbreaking and the ribbon cutting, and it was kind of interesting that uh thank thank everybody that showed up because I was really impressed with the crowd that came for the ribbon cutting.

That's kind of I've been to several ribbon cuttings in Eloy, and we don't get a lot of people, but people showed up that night.

It was really a nice event.

But uh the mayor uh wanted to introduce me to the CEO.

And it was very interesting.

The CEO comes up and he says, Oh, I remember you, you were to groundbreaking.

And it was like, well, a year and a half, two years ago, and that's the only time I've seen him.

Uh so that's a lot to me right here about this man investment in the community and so forth.

I was impressed, but very nice event.

Uh the next day, uh attended the uh Eloy Detention Center had a uh uh luncheon at Robson Ranch, and there was a this is the ICE facility out uh uh the uh corsivic functions.

And they went over their uh the number of detainees they had, and the thing that uh kind of impressed me is the fact that they're in there and they're short time and moving on.

So they just it's almost like a long stay hotel type thing, and it's I think the average stay now is 70 days for some.

It used to be in the 30s, 40s, but that's going on, and they talked about the number of women, number of men, and uh they have no idea where they go afterwards, they just uh offering a service, but it was pretty interesting.

Uh just you know, you think about offer operating a prison and the facilities, but what they have to do out there is totally different.

And and so it's kind of that was interesting.

And then after that, uh I'll have to keep looking here.

I went and attended an Arcia convention, a couldn't have uh conference, which is the Arizona Solar Energy Industry Association, I see you.

And this is uh a group of people who are involved in the solar business.

And they have an annual meeting.

I went last year, this is the second year I've gone.

And it's interesting because they're dealing with what's going on in the future, what's coming.

And so some of the topics were what's happening in the state level as far as uh legislation was happening at the uh federal level.

Of course, there's the uh I guess feedback or not feedback, but the incentives from the government to build solar and the green energy.

They didn't seem to be too concerned about that because they said the need in Arizona is driven by demand.

The uh the power requirements are what's driving it, not the incentives.

So they did felt pretty good about what's happening with solar here.

But one of the interesting things was there's some discussion about local communities not receiving back much from the power credit.

We've been through that is either way that we've uh supplying the power with all our solar panels here but it doesn't stay here.

It goes someplace else.

So there's some discussion about well it's for the good of Arizona because Arizona grows you'll grow to type of thing.

But then there was some recognition that it was two things brought forward that I don't think are gonna fly but one of them was the property taxes find some way that you can prepay some of the property taxes to the cities ahead of time.

Well that's an interesting thought within reading 20 or 25 years to get the money in total.

And the other one was maybe having some third party that the solar panels sell the uh power to then that third party sells it to an APS or SRP because then there's a sales tax with it.

Oh that's two interesting things they got floating out there for discussion anyway.

Yeah.

Uh the other interesting thing was something called uh V PP.

Anybody heard of VPP?

Virtual power plant we're looking now the technologies there that you can use all these batteries you have in your car whether a golf cart you have an electric car you've got batteries that can charge that can drive things to your house.

So we're looking at now taking battery storages that are might be available in your home and using that to drive some of the devices to cut down on the peak demand.

And that's is down the road but it's a very interesting concept and think of all the things we have our home right now is bio and you charge them up at the downtime but then when you got peak demand you can use draw from that to maybe uh help the grid very interesting discussion on that.

So uh and I think I had one other thing oh attend uh Penal Partnership last Friday and that had to do with the um Santa Valley and I have to say uh it sounds good but they got a lot of work at them I mean uh they don't they've got uh some people who are on council now but that council could get re-elected and having been through a lot of organizational changes every time George is will change the expectations are very high that all these things are going to happen and so now you can imagine at Santa and oh we're gonna get a community center we're gonna get this gotta get that but that's way down the road and so many things have to happen for it to happen so it's good interesting to see if the all the enthusiasm for this incorporation stays uh as uh things don't move and how soon it is before people start complaining about oh you promised this it's not happening and type of things it's it's gonna be a I think I'm not gonna worry about uh losing a lot of money here at ELA right now because they're not anywhere near the point they can spend money yet so I think uh but anyway that's my uh activity the last couple weeks so it's kind of kind of interesting time well thank you councilman and yeah and that VPP does sound very interesting that's really outside the box or outside the box concept to use what's already here I like that all right I want to keep this going right down Vice Mayor do you have anything yes Mayor thank you just a few things I'm not gonna I don't want to say beat a dead horse because you know how I am about animals but I went to the Head Start open house as well um and got to hang out with some littles um I was glad to see how well they're doing now I was there at their grand opening back in I think 2019 when I still worked for the city um and to go again now and see that people are using it because I think for a few years they struggled with um with getting enough kiddos to go yeah and then also the exceptional hospital ribbon cutting and um the event after and yes I keep threatening my husband if he doesn't straighten up or going to that emergency room so there's no more excuses we don't have to go all the way to Cassagran.

So um I I also wanted to just make sure people are aware I don't know how many people are online as well Penau County Animal Care and Control are doing several vaccination clinics and they're using our parking lot here so there's no excuse for not having your animals vaccinated I believe there was one on the first they have one plan for the 16th and I believe one for the 22nd as well and also I'm I'm pretty great about getting on Facebook and making sure people know but the city of Eloy helps fund um a low cost free Spain neuter clinic and I think the PD is working on trying to make sure we do four of those a year so if you need that um make sure you reach out to the police department or to Penau County Animal Care and Control and if Penau County says they don't have vouchers remind them you are in the city of Eloy and we have vouchers.

So if you need that, um make sure you reach out to the police department or to Penau County Animal Care and Control.

And if Penau County says they don't have vouchers, remind them you are in the city of Eloy, and we have vouchers.

Um, not to be the dead horse either, but I've also really excited to be at the hospital ribbon cutting.

I think um it's such a great thing for Eloy.

We've been waiting a long time for this to happen and come to fruition.

And I even heard of some friends of mine's parents that went there for um for a medical situation and had great service.

So I think it's really wonderful that we have this going on now.

And we were I think we were all there actually, and it was great to see everybody supporting it.

Um last week I also attended the women leading government conference, and Celine was there with me, and Michelle, who's uh running the internet stuff for this meeting outside.

Uh it was uh basically um a conference just about women in government, and it's just a bunch of people getting together um talking about the topics of leadership, adapting to change, overcoming adversity, and even stuff like finding your career path.

So I want to encourage um McKenzie maybe next year to you know let sort of some possibly junior up and coming members of staff.

I think it could be a really good thing for um newer members of staff to attend this conference because there's a lot of um sort of seminars and topics that I think would it would help young women that are in government in their careers.

And then um on a different note, we have the Eloy Glow this weekend.

I think some of us have talked about it, but it was a lot of fun.

There was lots of cool shaped balloons, and there was a bar and all sorts of food food trucks, and I think everybody had a good time, and I was fortunate to be able to jump in at sunset onto the track with the balloons.

Um we had two other skydivers with me, both professional skydivers at the top of their game, donating their time um for the city and for the event, so that um it could be great for for people.

And I also want to thank Skydive Arizona for flying the plane plane.

Um Dawson, new young pilots, date after hours to fly us to the event.

So thanks for everybody who made that happen.

Yeah, no, the your jump-ins are just so exciting to the people on the ground.

They really are.

People get so charged up, especially when you you first see the little dot in the sky coming down.

Uh I had volunteered and and I saw staff there, um, chief of police was there as well.

But it was a long pretty long day for me.

I got there about 7:30 in the morning, had about a half hour break, came back, and left just about 10 minutes to 9.

So that's a birthday.

Yeah, there were huge lines, and it looks like a real big crowd.

I didn't get to see the landing here of from Sarah, but she's always wonderful in her her um her colleagues there as well.

Um so that was fun.

I do have a kind of a public announcement uh thing I'd like to share, and I do have up there a couple of um uh posters as well if you want to take a uh shot of them and take it home with you.

Otherwise, I'm gonna post this on my Facebook page under um the councilman.

Um today I was contacted by Angela Okuna.

I don't know if I think most of you probably know who she is.

Um she's with the uh Parent Support Center for Eloy Elementary School, and she wanted me to get out there and she asked if I can volunteer, unfortunately.

I'm gonna be in Chicago, but on Friday, November 21st, uh there is a free community uh Thanksgiving meal, and it's gonna be from 5 to 7 p.m.

at Eloy Junior High on Phoenix Avenue.

It is sponsored by the Eloy Ministral Alliance, City of Eloy in Eloy Junior High.

And in addition to that, um she's opening up they have a shop there, and it's gonna be a free shop with Lucky Bucks, is what she's calling them, and it's free items for those that are needing items during the uh the tough times right now, and that will be from four to seven p.m.

And she just asked if I could plug that tonight, and I thought I I said definitely.

Uh, if you go to the city web page, you don't you're not on socials, go to the city web page, go to PD, and then it's got a link to Animal Control's web page, and on the main page, you scroll down, there's events, and it's got the 15th, the 16th, and the 22nd in December 6 events.

So if you need more information out there, please go there and get it and call if you need to make special arrangements because there are special arrangements will be made for aggressive animals or cats that need that extra help.

They'll they'll help that out.

So resources are available, just gotta reach out and get them.

Um the next thing on my list is just a reminder that city offices will be closed tomorrow in observance of Veterans Day.

So we have a parade celebration starting at 9 o'clock, and then followed by a Veterans Day event in the main street park.

Our illustrious mayor's son will be presenting a speech at that event, and it's it's a good time.

I mean, we all go every year, and it's good to see the people out.

We got 12 entries into the float parade this year, so that's gonna we had 11 last year, so we're up by one.

But you know, we always do good.

So it'll be a fun event.

So um please come out um if you have time, but again, those seeking business at the city offices will be closed that day in observance of Veterans Day.

Uh next up is November 19th.

Uh just a reminder that our planning and zoning meeting is going to be at the Toltec Elementary at 6 o'clock.

And the reason that we're at the Toltec Elementary is because of the general plan, major general plan amendment requires one hearing at an off-site location.

So to meet that requirement for the state, we have to have it somewhere else.

So this meeting coming up on the 19th again, Toltec elementary school, six o'clock.

So come on out for that.

Our friends from the Pennell County Sheriff's Office will be helping out with all of the dispatch calls.

So, in order to get the whole team together, um, the chief reached out to Penama County Sheriff's Office.

They said we will absolutely help with all the calls.

So calls will still go in and out.

We'll still do what we need to do to meet community needs, but that's happening that afternoon.

In addition to that, they're having a big old department photo.

So we haven't had that in a couple of years, so that's gonna be exciting.

I think the last department photo, Tino was when we did the open the PD station, right?

So this will be good to get everybody back out, and then their class days looking all good.

Dan's worked a lot with Angel Madrid and his code enforcement team to identify some well-deserving families and individuals that could use our help.

So we'll be out there with fire department, whoever can join from staff and council, more hands the better, the quicker it goes.

Um, Ms.

Mayor members of council, I'll give a brief uh overview of the first quarter ending September 30th, 2025 for the council and the the public.

So the first quarter um ending in September 30th, 2025.

Um the city is still meeting the budget expectations that uh that we brought forward.

Um I'll highlight just briefly the the general fund talking a little bit about sales tax, state share revenues, um, just kind of going over our maybe special revenue funds a little bit, and then uh just we'll briefly talk about some of the capital projects, but overall the everything for the first few months, first three months of the fiscal year, um, everything is going accordingly to the budget that we have passed at this time.

So uh the first page um you'll see in the report just given some of the statistical highlights from the first three months this year compared to last year.

So that's good, some good information for yourself and the members of the public just to review.

Um we also talk about a little bit about the grants that uh happened in the first quarter.

Um the second uh going on, but really um kind of want to focus on the kind of the general fund.

Right now, when you kind of look at uh our financial statements, someone would look on wow, you the city is losing about four point you know three million.

Well, that's because the general fund we ended up transferring the five million dollars for the economic incentive out of the general fund over to the economic um incentive fund.

So on the financials for the books, it's gonna look like we have a negative variance.

But once you back that out, we're actually for the first quarter, we're about 700,000 above revenue over expenditures.

So that's because we still have we have very large contingency built in this year that's built into our uh budget.

So everything accordingly to the budget and the general fund is is meeting expectations right now.

We do have several positions that uh um haven't been filled, that's leading helping with this uh very positive variance.

Uh the construction sales tax right now for the what we bring in is actually exceeding those expectations uh due to some of the commercial and uh residential development that we're still having um happening in the city.

There are a couple categories within the um with the sales tag set.

We're you know, I'm gonna keep continuing to monitor retail is a little down below last year at this time, but that's it's it could just be the way that things are being reported.

Um restaurant and bars are about the same as what it was last year, even though with prices going up, it's still meeting that expectation.

Um, along with the um uh the the services, the service category that's kind of down a little bit, but overall city sales tax is still meeting the budget expectations we have at this time.

Um permits, those are um are above expectations due to some of the one-time uh building permits that are being done with solar and stuff of that nature.

So things are looking good in the general fund when it comes to our revenue base expense-wise.

Um things are everybody's meeting expectations at this time.

Um, there's a few departments that are a little above right now.

Um that's just because there's a lot of one-time expenses happening with subscriptions and memberships that are due at the first part of the year, and they just kind of tailor out at the throughout the the year on it.

So overall the general fund is in is is uh meeting the budget expectations that uh we brought forward.

Um just uh also mention about some of the revenues with state shared revenues, those are um meeting expectations right now.

However, once that Sandan incorporation happened, they swore the first council and they will start to receive some of the state income tax.

So that those expectations are those figures that we got, everybody in the whole state will see a little bit of dip in that because they will start right when they have uh brought in the new council.

The other ones, state share the income tax and VLT will happen starting next fiscal year on it.

So we will probably see a little bit of a maybe towards the third quarter, a little bit of a variance just in the income tax portion of it.

Um the enterprise funds are meeting expectations with revenues starting this month, November 1st, we're gonna start to see the new rates kick in.

So we'll those are gonna have uh we'll see a positive variance um year over or month over month, so as we move forward, and sanitation is uh is doing is meeting expectations as well.

Every other special revenue fund streets or some of our uh food for home based consumption, those are on track right now as well.

But throughout this report, you'll just go through um kind of just what I talked about.

Um we'll go through gives you some good statistical information on the quarters of where it's at.

You'll see you know, the bull we're kind of trending up on some of the categories, some other ones are kind of like a little teeter totter.

So those are the ones that uh if they're starting to dip, we're gonna just pay a little more closer attention to them, especially when we get into the end of the second quarter, starting the third.

So overall, um I just want to present the first quarter to you moving forward.

Um, once we get into some of these, you'll start we'll start to do the projecting out to June 30th.

The first quarter, I don't do anything with it because it's so new on it.

So but uh kind of going into the capital projects um we have in here, um, a lot of them you'll see that are in progress.

They're blue, they're they're starting work.

We don't really have it.

We might have one that has been completed, but every we have numerous ones that are in progress right now.

Um the biggest ones uh out there is the public works, as you see.

We have two that have been paid or they're completed, just waiting for the payment.

Everything else is in progress, or they haven't started this time.

A lot of the NSs that you see on this page, the two and on this one, a lot of them are are our capital projects that we're looking at for uh WIFA funding or another source of funding.

So once we get those projects as we move forward, we'll we'll get those a little better descriptions on those as we move forward with it.

But we got to get those uh settled with probably public works and identified before we can uh get the funding underway with it.

So at this time, I'd gladly entertain any questions or comments regarding the September 30th report.

Brian the uh what we're looking at right now, the not started, and you mentioned the WIPA fund.

Does that mean that these projects probably will not start this year?

Um these are in the CIP for this year, and but we won't know anything on the WIPA fund till probably first quarter or later.

So will these projects start this year?

Will they be pushed out in the next year?

Uh Sutton, uh Councilman Snyder, a lot of them that are on here, if they are with the WIFA, probably will not be started this fiscal year because once we get them and you start to you have to get the first step is you get them on the it's called the project priority list with WIFA.

Then they they lit ranked those projects on it.

Since we went to since council adopted the new rates study or the new rates, and we have a new structure to it.

I want to bring forward one good project for it's called the drinking water application, one for the the clean water instead of doing two or three different applications.

We want to bring together the one full application for the drinking water and one for the clean water.

So that way we're not we're not paying different uh looking at four different loan applications.

Let's get one in sold in the next probably three to six months.

I know we we've already met with public works to say, okay, let's let's start to move forward.

We're the first one we're bringing forward on some of the projects is going to be the utility obligation bond.

That utility obligation bond, which Nick and Zach came up and spoke about when we gave council an overview of uh some of the projects.

That's gonna be probably three.

You know, the minimum would be three projects up to about six or seven.

That's gonna be in the next probably three months, the first probably the late part of February to the first part of March.

That obligation is gonna be coming to the council, and that's gonna be the one of them is gonna be the soul or the sewer line on uh Batagular Road, and two water projects on Sunland Gin.

And then we're trying to identify with bonding capacity which one other projects we're gonna do into the obligation we're gonna bring forward.

All the other ones we're going to bring forward into one big WIFA, one for drinking water and a water, but we're gonna get this series moving first because we can start the engineering design on it, and then bring in the obligation to council.

So we'll have a lot more updates probably by December or when we have our before we retreat of what we're looking at, but uh I know public works and myself were trying to identify those for our project priority list.

Should we be looking then at maybe if it's delays in some ways for some reason and what's in the budget there for next year that we could identify maybe moving something forward that so we don't you know I don't want to get caught like we have in past years, we don't get some things done, we just keep pushing things out like a download effect.

There was maybe some things that if there's money allocated, even though we're not gonna spend it this year's way.

We can move some things around to get some projects done or scheduled for next year, something.

Yeah, Mr.

Mayor, members of the council, um, Councilmember Schneider is the when we start to go through, we're not they'll probably be delayed because when we go to WIFA, you'll have three years to complete all the required projects.

Staff doesn't have time.

If we bring uh $18 million, for example, with a project, it's gonna take multiple years, but we've got to identify those projects, get the application on it.

Right now, I believe I'm talking to with Cookie and Christina.

We're identifying the major ones, which is gonna be two on uh two of the water and one with the sewer that's gonna come to council on the utility obligation bond.

That's the most critical one for development and uh for water and wastewater.

These will be identified in the CAP as multiple multiple year projects.

So it's yes, and we'll update those and we'll bring those with comments of what what's going on in the next several months.

A 12-month extension time limit for the Vista Picasso preliminary plot total of 365 residential lots submitted by Vista del Picaccio LLC.

This is a request for a 12-month extension onto the previously approved preliminary plot.

It was originally approved in 2023.

But uh was extended last November for one year to November 22nd, 2024, and this request is for an additional 12-month extension from November 22nd to uh 2026.

So at this time I'll be happy to answer any questions or hand it off to the applicant.

Any questions from council on this?

Anything moving.

Well, Mayor and City Council member, we have been actively in the last 12 month working on the revitalization district formation, which will be a huge financial tool and bound uh financial tool for national beautiers.

However, uh because of the softened market in the national beautiful market and the persistently high interest rate.

So we wanted to assure you that we are not national builders and we're not developers.

So we have spent it's trust me, it's not easy to be the brush cutter and troll blazer, but I have been coming here for at least 20 times and from 2021.

And you know, in every development in CDO Eloy and everything happens to the city on the development, I'm very excited.

I'm on the same page with the City Council members and want to see things happen and all the economic development here.

So we have been actively working with brokers and in touch with uh national builders.

We wanted to get it ready once the market pick up and we're the first one to go.

Because we're um our lot at sounds of uh houser and is of 11 miles corner, we're closer to the sewer uh treatment plan, and so uh we hope to get everything ready and we hope to get the uh pre-plan still uh valid and not expired so when the market picks up and we can work with the national builders and for uh final plan and to get it going fast.

We're very excited about that.

We would like to see that more than anything to come to fruition.

And in your professional opinion, do you think a year is long enough?

You think so we're gonna see a movement on that in 12 months?

Well, I wish I have the crystal wall to answer that question, but um the interest rate we have um, you know, we have a little bit of adjustment on the interest rate, and it's not out of the question that there's another 25 basis point uh drop in December because we just had one in uh October 29th.

So we hope to see the interest rate keep dropping and you know, and that'll be a boost for the race to work in general.

So um hopefully now bring more activities in a uh housing market because in this country still it's um uh there's a shortage of housing and you know, and of course, every um uh the industrial and commercial and the uh job opportunities and bring to this area and will help with uh demand as well.

Yeah, I fully agree with the shortage of housing, and I look around in our surrounding communities, they're building like crazy.

And I'm just wondering why Eloy isn't.

So hypothetically, if the interest rate went down tremendously, how long do you think a developer would take to say yes?

I mean, it's I'm sure it's just not one phone call.

How do you think it takes for development to get developer to get on board?

Well, um, they probably need to work through their inventories and then you know, there's some uh absorption rate into you know, but again, it really depends on you know whether um it's uh it's such a multi-factoral question, it's a very loaded question.

The yes the cost of construction and demand in this area, but we have provided a market study when we first started this um uh project in 2021, and we have also spent hundreds of thousands of dollars, and we're land developers, we're not builders, to um get the plan in place and just to get it ready when the market is ready, and so we have the pre-plat available, and you know, and we're one of the first ones.

We're the very first one to uh get a subdivision down.

Go ahead, sir.

Uh this question is actually for uh Director Dan Seimer.

Dan, um you state that this would be no additional extensions after this year.

Um what happens to the project at that point um if if we go ahead and tonight and extend it one year, one year from now, um what happens to this project?

Well, there was a council councilman Roska.

It's a it's an interesting interesting question.

Now technically, if you don't approve it today or you do approve it, it goes on it if you don't approve today, it's done.

They have to start over.

Um the reason we're supportive of uh just saying no more after next year is because my goal is to rewrite the subdivision ordinance, they would have to start over.

They would have to bring the application back, update it to the current standards.

Um we were talking about earlier how some of the zoning has changed, actually to their benefit to be able to get smaller lots and more developable area, but essentially they have to start over.

Um development costs would go up potentially, but the reality situation, if you have a good engineer, a good designer, uh it shouldn't take that long.

Um but the reality of situation it's expired.

There's a there's a direct intention to not allow these things to go on forever because there is case law that says if you do not expire the plot, it does go on forever.

So thank you.

I have a follow-up to that.

If uh they are aware that you rewriting some of the code, does that put them as a risk that if they start the project and in the middle of the project uh the we're changing our uh guidelines?

What how's that how does that work?

That's a good question.

The subdivision ones and under Prop 27.

There's benefits to them, benefits to us.

The benefit to them is they're locked in on our preliminary plot.

So unless there's new infrastructure requirements that necessitate, then we could negotiate on those infrastructure requirements.

The subdivision or zoning ordinance standards that are available to them right now.

So if they wish to take advantage of those and redesign their plat, they could do that right now.

Otherwise, they are just gonna go forward with their existing plot.

The major changes we see coming forward are infrastructure requirements and um more for traffic common and making sure we have adequate sidewalk and water resource uh pipe sizing requirements, bringing up the current standards.

So those are stuff that they would probably normally do anyway.

So the the bigger advantage to them is actually in their favor, so other than it cost them more.

So I have a couple of questions.

One, um if they we do provide the extension and the market values don't go, interest rates don't go down and stuff, in order to stay with the the uh uh current uh project that they have with the city right now, would they require would they be required to do some kind of development like sidewalks and street lights and without actually building houses?

One, um, if they we do provide the extension and the market values don't go, interest rates don't go down and stuff, in order to stay with the the uh uh current uh project that they have with the city right now, would they require would they be required to do some kind of development like sidewalks and street lights and without actually building houses because I I just don't want to see like another end of Main Street or you know to take advantage of uh some of the the fees that they've already paid, they went out and just put you know uh skeleton structure and and didn't put an effort in to put like a full development in there.

That's my first question.

My second question is if the the uh if within a year they they have to start all over because they didn't get the development and stuff, does that mean they have to pay the fines the fees again with uh planning and zoning?

Council, council and first call first part of the question is the one at the end of the industry was a total at risk development, didn't have any civil approval, so if we can just set that aside.

Um the answer is yes.

Uh the fees they paid or substantially little compared to their overall cost.

You know, fees.

I think we just did one the other day.

Compared to multi-million dollars.

So our costs are very little uh comparatively so that they would have to pay additional new fees.

Uh the first program, I lost track in the room, so if I didn't get answered, actually and refraints, oh, we have to start some of the project.

Uh that's their choice.

Um we don't require them to start projects, and to do something like that, I would probably move towards Steve, you know.

I think we probably would have to require a development agreement to require them to actually start building if we so dictated such a requirement.

Mayor, council members, uh we wouldn't want to give you legal advice in the public session that's there, but um the philosophy that's always been brought to us through city manager, assistant city manager and city council is that we want the community to develop, and if there's someone here ready, willing and able, we're gonna sit down with them and try to do what we can to make it work and basically not try to put roadblocks in the place that's there, but basically, if we had that situation, we would basically put all hands on deck to try to come up with something that would work for them.

Um as Mr.

Simon pointed out, basically, because of the rewriting of the city codes, next subdivision ordinances there, that extending beyond a year basically is going to cause a problem with the lack of consistency with the new city codes, although it could possibly be advantageous to the applicant in this matter, but it is basically start over and spend more fees.

And so this recommendation basically is to give them that extension so that they have the opportunity to make it work on their side.

But it's as Ms.

Dong pointed out, there's a lot of factors that are beyond their control.

And you know from the number of development agreements that we've had over the years before the council that um basically we do everything possible to make them work, but sometimes but when they don't work, it's not because we didn't try.

I'm sorry, Dan, I just have one more thing.

Um I can't get back to the meeting page and stuff, but I do remember seeing that in their contract with the city, the city was going to provide um sewer water and police uh services, but I didn't see trash pickup as that part of uh the sewer um obligation.

Are we talking about only the stipulations of the case?

That's our they would have to complain with all and city would provide all normal services that we would normally do.

Absolutely.

Okay, I I wanted to um you know uh uh answer the question regarding the application fees in addition to uh Dan's comments, and I really appreciate you know in the city that it has been very supportive and for the fees, it's not is it doesn't sound very high for the application is eight thousand or ten thousand dollars compared to other cities, especially um if comparing to California.

However, if we had to redo the application, we have all these studies uh we have to up to date and we have to hire the engineering firm and to do all the studies, you know, in including the uh phase one gene tech report, traffic study, cultural resource study, and the landscaping and uh water system and losses report and everything is uh has to be updated.

And so far we have spent 500,000 to bring us to this point to get the pre-plat approved.

So I have to say that if it had to expire, because we don't know what's gonna happen next year, it depends on the economic cycle.

Maybe hopefully it's gonna pick up a little bit, but um I don't think there's a very high probability that uh national builders is gonna start building next year.

So if that happens and with our pre-plat expired, our land value will drop to the agriculture land value, which is a very detrimental to our investors and to our shareholders.

So as an investment company, it's a great loss for us.

And so we uh you sincerely hope you could reconsider and not just as a last time extension.

And then secondly, you know, not only it's gonna uh impact us and our net value, um the other developers and land owners in this area, if they look at you know the pre-plat and only be able to be extended for a couple of years, maybe they will not move forward with their applications and for the subdivision.

And thirdly, you know, if we don't have the pre-plat uh in place ready, and the when the national computers start buying, they're not going to they have to start from square one, they have to start from scratch again, and which took us over a year and probably about 18 months to um get the pre-plat approved.

So I'm not saying that we're not going to do anything uh, you know, to bring it to City Code and first, you know, our frontage changes.

It doesn't there's no conflict to um uh uh incompines to the new city code.

Um but it is uh a huge difference if we do a revision versus we start from the scratch.

So um I hope that you can consider and just to you know help us and to help you and help the development in general.

Yes, there's basically it's a financing tool to uh to give the to attract the national builders.

So um we were gonna address it in a different time because you know this time uh on the agenda it's for the extension, but we actually we got a letter from the city council uh just uh uh two days ago saying that uh we're not going to consider this application and which we haven't worked on for three years, which is very uh critical for to attract national beaters to um to invest in this uh uh area because we're competing with uh um competitor cities and with uh adjacent cities and you know uh Casa Grande and uh college and they all have uh either RD or a CFD in place.

So um we're not going to issue any debt and using this financial financing vehicle now is just to set this up in place so when the national bidder come in to um to uh to start building and we will have a district and we will provide the uh market studies and to be able to issue that and it also this is uh only for acquisition, it's not for infrastructure viewing.

So the city is not liable to uh have the risk for um to be worried about um you know we're going to issue some data and to uh build like a skeleton and infrastructures and not finishing the project.

It's only for the builders to um in and knowing that they have this bond um in the future after they have put their money and to boot the houses and sold it and they can get it reimbursement.

It's for acquisition only.

I don't know that you know addressed the questions, but you said it's called it that's at a later meeting, the RD stuff.

So yeah, we had right.

We have got a reply in which uh we started this application in 2021-2022, a long time ago, and we followed the city's instruction, because first we wanted to initiate to uh form the CFD, um, but the city, you know, which CFD need a staff member to manage in the city, uh, give us advice and for us to form the RD zone.

So we have spent hundreds of thousands of dollars in trying to form this RD zone.

Dong, I sincerely apologize for interrupting you, but I do need to advise the council that this matter is not on our agenda, it's not a discussion item, and the they're not related to the issue before us, which is basically the preliminary plat extension.

And I think you've done that here, and uh you've not only uh developed anyway, but you've brought city council along with you.

I think uh years ago and Joanne uh you can relate to this what city council meetings used to be like.

And uh we're talking about CIP now and three and five-year plans, and I remember when I first got on council, we used to have those retreats in January, and and Brian and Cope said, Here's the revenue for this coming year, and we'd have the stickers when I go around, pull out the board, what we all want to do.

Remember those days?

And we put together the yearly plan and next Jedi would do the same thing again.

We've gotten away from that, thank goodness.

And I said that I think I said back to you though, whatever you need, we're gonna help you grow too.

Um I do appreciate uh you know your availability to us, um, always being open to have it having discussions whether you know on a phone or in the office.

There was a lot of um cool changes and in sort of all sorts of aspects um from the journey we've had over the last four years, and I think um we're all stoked about um the fact that you're moving on, not because we want you to go, but because we're excited that you have are going to a new life that you're excited about.

And and I'm one of those people that thinks change is good.

Um I like when you know something can grow, but when it's time for someone to go into a new part of our life, I'm really happy for them.

So I'm happy for you and your family to go to California and and do some things that you want to do.

Um I'm happy for Mackenzie's gonna have now have an opportunity to you know uh step up his game and do the man, so that's really exciting for everybody here.

So thanks.

It's been interesting coming from working in government my whole adult life.

Um I've learned a lot in the last three years.

Um it's still frustrating.

I can't believe things can't get done faster than they do.

But um, you know, you've had to, I'm sure learn a lot being in this type of community with two, three different cultural differences.

I mean, with Eloy proper, ropes and Tolic in between.

So we appreciate the growth that we've had up to this point, and I'm sure um McKenzie's gonna do a great job.

Um getting us even further down the line.

Um, but at least you don't have to hear me complain about the dogs anymore, right?

Yeah, oh I probably okay.

You can't you kept that door open.

Just get ready, McKenzie.

So he's like, I'm gonna change that as soon as I get out the door.

Yeah, and I echo everybody's uh sentiments here, David, and thank you for taking your tournament break in a new mayor, and I know that that was a pretty difficult show.

Thank you for that wish I'd got some use.

And thank you for the tool that you have provided, McKenzie.

Because I know this man is gonna hit the girl running, full steam because of what you did.

Because it's an amical break amicable breakup.

He's really gonna hit the ground running.

So I I thank you for that.

So at this time, if anybody from the audience would like to come up and say a few words about David there, Mr.

Powell, please come and do that.

I thought you locked the doors.

I was I was a mayor, vice mayor, city council members, staff.

Um I was on the way home um tonight about 6.20.

I said I looked at, I said, man, I said, what's today's date?

And I remembered second Monday, fourth, Monday.

And then I put the date together and I said, This is David's last meeting, so I raced over here because I couldn't miss this for anything.

I remember when um the position was opened when Harvey was going out for um applicants, and he nailed it down to a couple um Bible sources, and um, but he wouldn't tell who was who he was talking, who was he interviewing.

And then finally he Harvey came up to me and said, Okay, well, I found my the one I'm gonna pick.

He's from Virginia with Virginia, right?

Yeah.

I go, Why don't you get somebody from the East Coast?

And uh Harvey goes, Well, you're gonna like him, he's gonna be gonna do this, do this, he has great background, but it's in parking.

I said, parking, what do we have to do with parking?

Um, but um I kind of looked into the the resume of of David and I said he's smart, he's he seems okay, and then I saw his picture, I said, Well, he's good looking.

So uh the only change on him is the gray in his beard.

Um but I can tell you when we had the change over from Harvey to you, um was a blessing in disguise, David.

I had the opportunity to work with you before the transition and then during the transition, and then as I transitioned.

And you've been not just professionally awesome to work, but but professionally, but personally, you're a dear friend of not just myself, my family, but all of us who have had the opportunity to cross your path, shake your hand, um, and just get to know you.

Um it's sad that you're leaving.

And I always know I was knew you're gonna you're gonna go, and I know he's gonna go the next because you guys are just rising stars.

Um it's good that we have had the opportunity to bring in amazing talent to our community.

Now, yes, we may be a stepping stone for some, but the legacy that not just I have or you guys have or our brothers have, but you have brought to the community, David.

Um shows.

And you never shied away from a challenge.

You were always able to get up early to take a meeting with me, to stay late to take a meeting with either my work schedule or something.

Um, and we always have some knockdown drag outs.

And that's something that usors know that there's always a difference of opinion when it comes to ideas as a council member or staff.

And there was a few times where you put me in check.

And looked at you and was like, man, I'm the mayor, you don't talk to me that way.

But out of respect, I did have to listen to you because you taught me as much as I taught you.

You taught me more what I needed to know as a mayor and as a friend, as a colleague, um, as a resident.

So thank you.

Thank you for accepting the job under stress at the time.

Thank you for your long hours, your time, your love, your friendship.

Um you're gonna be missed dearly.

Um you're not gonna, you know, you're still gonna have that this marker fear.

And what's awesome about this is on your next resume, it's gonna show all the accomplishments that you did as a city manager here at the city of Eloy.

Because without any of that, who knows?

Um, but no, um, you know, like you're you're a rising star, and I've told you that from the very beginning.

When when I first found out that you're coming over from the city of Castle Grand, um Larry, uh, he sent me pulling the side as a dudes.

You got one of the best guys in the world.

And so um, he said he's a writing star, and and you're you this is perfect for him.

So uh take this and run with it.

Learn everything you can.

You had a great teacher.

Um, and uh yeah, it's it's fun.

The the future of the city is is in great position because of the leaders that we have here in the staff that is here and willing to give their time, effort, blood, sweat, and tears to our community.

So good luck.
