17:32We're gonna conduct a public hearing and make a recommendation to the US City Council on the following.
17:38This is case number GPA 2024-005 and RZ 2024-004.
17:49This is known as E310.
17:52Uh this is a request by Julie Vermilion and Cole of Co.
17:58and Van Lu consultants on behalf of TES Farms for a major major general plan amendment from community commercial and light industrial to mixed use, consisting of approximately 310 acres located approximately 1,237 feet east of the northeast corner of North Sun June Road and West Shed Road, and a request to rezone an approximately 310 acre site located at the same place, approximately 1,237 feet east of the northeast corner of Sun Lin Boulevard and West Shed Road from single family residential I112 to light industrial I1 and multifamily residential R3.

19:08All right, so my name is Julie Vermillion with CBL Consultants, located at 4550 North 12th Street in Phoenix.
19:16Um with me today is Rome Green and representative of the developer Augie Gomez.
19:33Thank you so much for hearing our case this evening.
19:36So, as you've mentioned, this is for E1310, a rezoning and major general plan amendment.
19:41I know this is a very similar presentation to what you saw last time, so I'll be brief.
19:48Here's our vicinity map, as you mentioned.
19:51We're south of the I-10 and east of the northeast corner of Sunlingen and Shed, approximately 310 acres.
20:00We had our neighborhood meeting, some posting, yelled notification to everyone within the required 300 feet of the site.
20:05We had no opposition.
20:18So here's that existing general plan.
20:20You can see that it's currently a patchwork of community commercial and light industrial.
20:25We'd like to do our cohesive overall general plan designation.
20:30The community commercial and light industrial, we believe would be more appropriate for mixed use.
20:52That's general industrial, so that's a higher intensity industrial development.
20:57To the east, we have community commercial, and then to the south we have residential.
21:01So we believe mixed use would better uh be a better transition for these uses in the area.
21:10So the existing zoning on the site is R112.
21:14That's a single family residential zoning district requiring a minimum of 12,000 square foot acre lots or square foot minimum lots.
21:24So that is a rather large lot size for this area, especially considering the frontage on the I-10, the adjacent commercial, and then the planned industrial to the northeast.
21:36We believe a more appropriate zoning would be that I-1 light industrial with a R3 multiple family residential on that southwest corner.
21:46Um that residential will transition to the uh planned residential to the south of the site.
21:53Uh additionally, we know that there is a zoning update planned to the west, and then we have that existing commercial development to the northwest.
22:01So I think we believe that this would be a great land use solution for the property.
22:05Uh the zoning would adhere to the city's uh conventional design standards and the permitted uses that you've noted for each of these zoning districts in the ordinance.
22:17We are proposing other modifications to those.
22:23So here's the land plan.
22:24You can see the adjacent land is primarily undeveloped.
22:28Um there's that existing commercial development to the northwest.
22:35Here's our preliminary sewer layout.
22:37Uh, this layer is just a conceptual sketch uh to give us an idea of where we're going in the future.
22:42But you can see that's your connection from the northeast, ours or northwest.
22:50Here's the conceptual water layout.
22:52We can see that connection from the west.
22:58And then as part of this proposal, we would anticipate um development impact fees that would go towards parts and recreation, police and fire and road improvements for the city.
23:11And we anticipate additional benefits such as job creation.
23:14Uh, we'd be establishing a zoning for those uh light industrial uses, business opportunities, um, and additional uses that will support employment and economic growth in the area.
23:25And then those development impact fees, we're anticipating approximately two million towards public safety, approximately three million towards parks, and about 3.5 million towards roadway improvements based on the current development impact fee schedule, and of course that's subject to adjustment in the future.

24:00So going back to the road improvements.
24:02Um there's currently no shed road out.
24:06Well, there's nothing that looks like shed road out there right now.
24:09I don't even see the dirt road.
24:13Um I presume at least some of that is going to go towards putting in Shed Road out there.
24:19Yes, so as part of this uh major general plan amendment application and this rezon, um we did have um a circulation plan in place where we would be improving uh portion of shed road uh and a commercial collector access to the site.
24:37And then, and this is maybe getting beyond the scope of your project, but it's a concern, and that is that uh I did see a lot of another traffic or saw the traffic study and the cons the uh road conditions that are well, actually, we've already got them out there, not to mention the future development that's coming online.
25:00And uh that I guess I want to just bring this up only from the standpoint, maybe staff or can give me some ideas, what's gonna happen to that two-lane bridge over I-10 that uh already is probably at capacity.
25:13We got industrial going on up north of uh I-10, and of course, if this happens, uh we're gonna put more vehicles on the road and with uh love's station there, it's already pretty congested.
25:28So is there some way that we can mitigate or somehow form a improvement district to get that bridge widened and improved?
25:37That's the question, I guess.
25:39Okay, but first answers.
25:42Uh I've been on the zone commission for more than a decade, and we've talked about that for nearly a decade.
25:51So it's it's been it's been out there and you can see what's happened with it.
25:57Okay, so anyway, that's just my uh opinion.
26:04Chair members of the commission, that's a that's an excellent question.
26:08Um the nice thing about that the traffic impact study that they did uh does address it not specific to their project, but addresses some off site situations.
26:21Now we currently have a capital improvement project that is funded that will be doing modifications to the intersection and south of the I-10 to approximately uh Mountain View Drive, which is kind of hard to see it on the map, but it's about halfway between the Lubs and um what we refer to as well Wilcox Peak Avenue.
26:50So we will be in as part of that project, we will be improving the intersections going south of that area.
26:58The interchange in itself is not currently at capacity, the interchange bridge itself.
27:05Um we are, and the mayor may be able to help me with this.
27:10We are asking to have the interchanges looked at with the Sun Corridor.
27:16Yeah, I can uh I can speak to that at this point in time through the Sun Corridor myself.
27:21I have petitioned ADOT to perform a study of the whole TI.
27:25That's like the first step of getting that role and is is to study because what I brought to ADOT's attention, this has nothing to do with your project, actually.
27:34It that whole TI is as cars are coming down the 10 doing the speed limit of about 95 miles an hour, as they get to Sunday and June Road, the traffic is actually backed up into the travel lane, so very close to it at this point, and it's becoming a more and more dangerous situation daily.
27:52So I brought this to the attention of ADOT, and I've been speaking monthly with them along with some corridor.
27:59And the first step is getting the study done.
28:03And these studies go for millions of dollars.
28:06But we are at that first step right now.
28:08This is something we are not looking over to your point.

28:27Um I scan through them, and it looks like with regarding the mixed use that the city still has a um as they go in there with improvements.

31:11First of all, I would like to touch space with the commission about the public comments that were received last month at the last hearing as it pertains to JW Waters improvements north of Roberson Ranch.
31:28We did investigate the construction activity that was going on.
31:35The existing sewer plan held had has had and is permitted.
31:40That's being modified.
31:42The water tank expansion have not been permitted.
31:46So when I went off to say I was a little bit shocked by the by the fact that they hadn't moved uh forward with that project.
31:55Um we have issued a stop work order on that.
32:00Um they have as of last week submitted plans for permits.
32:06And I believe those plans came out of review earlier today.
32:10So they will be moving forward through the permitting process.
32:15Um can't speak for JW, but they did we're relying on their contractors to obtain proper permits.
32:29And um they brought to the their attention, they got on it right away and addressed the issue.
32:36So we are moving forward with potential permits on that.
32:39Uh firstly that coming next month sometime if they uh update their plans properly.
32:46So on that issue that gets back to the public comments that were asked at that time.
32:52Uh next month, as we're going into the agenda, we will have the general plan update.
32:59We're moving very quickly on getting a draft plan together.
33:05Um we won't get too much into it, but we will be following up with a potential uh general plan study session uh as we move into the final uh six day draft of that plan.
33:17Furthermore, next month of those of us that are on the commission that uh help represent the air part or your port, we will be providing an update on the proposed CIP projects for the airport and where we're at on those as part of the um your guys' role as appearing an advisory to the council so you can have an opportunity to see where we're at and what we're gonna be proposing at a council uh in that role.
33:47Um we will again have a meeting next month.
33:50Uh right now I only have one case on the agenda, but I'm mainly focusing on uh doing updates as it is to fulfill your other roles.

35:05And that is the impact that you people have on this commission to this community.

35:21It's a fantastic looking facility.
35:23We drove by it the other night.

35:34Chairman members of the commission, I plan to sign the temporary certificate of occupancy tomorrow morning.
35:40When I'm out there, it's been a it's been a race.
35:44They have paid for their TCO fees, and there are just some odds and ends that they needed to do, like parking lot lights and get the construction equipment off of it so that it's in a safe uh area.
35:57When I went out there today, there's a few odds and ends that needed to be touched up, but they will be operating under a temporary uh certificate of occupancy.
36:05The truck wash will not be done, that'll be sectioned off, and as will the RV, because we don't have running water to the RV yet.
36:14So but otherwise, the rest of the facility.
36:18Uh literally in the hour I was there, I went from almost no stock in the convenience store to like two-thirds of the way stocked.
36:27Uh so it's it will be up and running.
36:29I don't know if they'll be able to open at seven, uh, but they are planning to work around the clock tonight to make sure that they meet that deadline.
36:38Well, to that point, the three of us went by that last night around six o'clock as we came from a meeting up in Scottsdale.
36:45They were doing landscaping by flashlight.
36:51So I I just wanted to bring that to this group's attention that the decisions you make here you can't take lightly because they are big impacts to this community.
37:02On 1015, this PNZ, you guys okay to CUP 2025-006.
37:08That was for Poblano Solar for 80 acres.
37:11When that came up to council, it was denied.
37:15Council felt that they had gone over the requisite percentage, and we denied it, but don't let that's the way the process goes.
37:25And we thank you for your hard work on that.
37:28But then in 1110, council approved a one-year extension for case PP 2022-009E2.
37:38That was for the Vista di Pocasio.
37:41That's the 365 residents that was uh submitted and brought to us by Christina Dawn.
37:49You guys okay that uh when it got to council, we gave them a one-year extension with a hard stop at one year.
37:56One year it all falls down.
37:57We're not doing another one.
37:59So I just want to let you guys know how that went.

38:11One of the other things that I was really happy to see recently is back about a year or so, maybe maybe 18 months, we approve a uh exceptional care facility.
38:24And well, they just made just made that happen like rubbing a magic lamp, and it's up and running, and I've had uh comments from some of my uh fellow residents out there at Robson Ranch, and they had a couple people who are really happy with it.
38:44So, you know, sometimes the work we do is rather mundane, but other times I really get stuff done, and that's I'm really happy about that.
38:56So that's just my pontificating.

39:15This is 660 acre facility.

39:37That's important as well.
39:38It's amazing how fast people can work when they want something.
