The variance will be an exception to section 14-52, section C5, and uh sections E1 and 2, which reads as follows.

2:27

Uh one residential uh line is supplied on the COVID stack for the line of state reduced as we reduce the funding of the radius of the street, the maximum approved area for the vehicle with 50% of the post funding is here, side yard, and area.

2:44

Variances and instances for strict enforcement of the requirements of subsections B through B through D of this section would cause undue hardship, due circumstances unique to the individual property consideration and granting of such variants demonstrated to be within the spirit and tenant provisions of this article.

3:02

3:46

Riff is here for today on September 3rd.

3:49

Uh letters went out to the uh contiguous property, property owners within the 300 areas, and notification was also sent to Mr.

3:57

Griffin.

3:58

We have uh the director of the building services, uh Jesse Banner with us today, also building official who will speak to the uh uh the property itself and the office request.

4:13

Well, you all have diagram in front of you as you can tell the uh the phone of this lot is really narrow.

4:19

The multi-use trail also some of this uh some of the property back towards the structure itself.

4:28

Uh back with this um uh illustration.

4:33

There are easements back there, you can all use bad neighborhoods structure back to uh to gain more square footage of three space in the front as an option here.

4:44

So uh looking at what is provided for us and the shape and dimensions of this lot uh buildings that you do support this tip that's little button here so this burning.

5:00

Just hit that little button here so that's the extra.

5:04

Thank you for that.

5:05

Thank you all for um considering this today.

5:07

So this is a little bit unique situation with uh you know it's a plan zoning district, the subdivision, so it's mixed use up front, and we've got um single family in the bag with uh a private gated one-way street.

5:21

So they were meant to have really small lots, and that's what my wife and I really like about it.

5:26

We're in connectors, we're downsizing, and we want something that's really easy to maintain.

5:30

Um this lot specifically being so narrow, it's only 16 feet at the front.

5:35

So with our house design, we pushed it as far to the front as we could just to minimize the driveway length.

5:42

Um it's almost 60, it's a little over 60 feet from the garage to the actual roadway.

Summary of Proceedings

Fort Smith Property Owners Appeal Board Regular Meeting – September 14, 2026

The Property Owners Appeal Board of Fort Smith, Arkansas, held a regular meeting on September 14, 2026, at 11:00 AM at the Blue Lion facility, 101 North 2nd Street, Room B. The board considered one variance request and unanimously approved it.

Consent Calendar

  • Approval of Minutes (July 13, 2026): The board voted unanimously to approve the minutes from the July 13, 2026 meeting as presented.

Discussion Items

  • Variance No. 26-0002 – 6916 Alianna Way: Applicant Nicholas Griffin requested a variance from Section 14-52(c)(5) of the Fort Smith Municipal Code, which limits improved surface area for parking vehicles in the front yard to 50% of the gross front yard area for lots on a cul-de-sac. The property is located in the Alianna at the Hub Planned Zoning District (PZD), a private gated community with small lots. Lot 6 is only 16 feet wide at the front, has a multi-use trail along one side, and the house design was pushed forward to minimize driveway length, resulting in over 60 feet from garage to roadway. Griffin stated the lot’s narrowness and the trail make it impossible to meet the 50% requirement while providing a serviceable driveway. Staff from the Neighborhood Services Division (including Director Shawn Gard and Building Official Jesse Bennett) recommended approval, noting the lot’s exceptional narrowness and that the variance would not be detrimental to the public interest. Board members expressed support, noting the unique lot shape and that the proposal did not stand out from the neighborhood.

Key Outcomes

  • Motion and Unanimous Approval: Member Pete Hanham made a motion to approve Variance No. 26-0002, seconded by Randy Hall. The board voted unanimously (4-0) in favor. The variance allows the applicant to exceed the 50% improved surface area limit for the front yard on the cul-de-sac lot.
  • Adjournment: The meeting adjourned after the vote.
