Historic Preservation Commission Meeting - May 12, 2022
The City of Frederick Historic Preservation Commission met on May 12, 2022, at 6:00 PM at City Hall (101 North Court Street). Commissioners present included Chair Pro Tem Carrie Alby, Paul Fitzgerald, Anne Hart, Iva Saller, Robert Van Rens, and Jeff DePetro. Staff included Gabrielle Collard, Christina Martinkosky, Sarah Hoffeditz, Lisa Mroszczyk Murphy, and legal counsel Scott Waxter. The meeting covered administrative approvals, tax credit certifications, an election, and several case hearings.
Consent Calendar
- Administrative Approval Report: 24 administrative approvals were issued in April 2022. The report was entered into the record without objection.
- 2021 Historic Preservation Property Tax Credits (Group II): The commission certified 13 applications totaling $119,877.68 in investment and $28,976.92 in credits, forwarding the recommendations to the Director of Finance. The motion passed unanimously.
- Consent Items: Two extension/re-approval applications for properties at 200 E. Patrick Street (HPC22-333 and HPC22-336) were approved as a consent agenda without discussion.

Election of Chairman
- Following the resignation of Chairman Philip Bailey, Commissioner Jeff DePetro nominated Commissioner Carrie Alby to serve as Chairman. The nomination was approved unanimously.
Cases Heard
- HPC21-288 (700 N. Market Street): Not heard due to failure to post public notice sign; applicant not present.
- HPC22-79 (410 N. Market Street): Applicant Terry Gladhill requested withdrawal of a portion of the application (small metal fence). The remaining request for a paddock-style fence made of composite/vinyl material was denied by a vote of 4–2. Commissioners cited that the material (non-traditional) and style (agricultural) are not allowed under design guidelines.
- HPC22-242 (10 N. Carroll Street): Partial demolition of a second-story brick facade was approved unanimously, subject to approval of a replacement plan and associated permits, based on a structural engineering report.
- HPC22-243 (10 N. Carroll Street): The rehabilitation application was split: the window infill component (windows E1–E4, N1–N4 except N3, and W6) was continued to the May 26, 2022 hearing to allow the applicant to submit detailed documentation. The remainder of the application was approved unanimously with conditions including use of hand tools for vertical mortar removal, test patches for parging removal, and limits on water pressure for cleaning.
- HPC22-258 (401 Linden Avenue): The commission unanimously found the dwelling (the Kramer House, a prefabricated tuberculosis cure cottage) to be a resource of unusual importance. No further action was taken; demolition review will occur at a future hearing.
- HPC22-301 (33 E. Patrick Street): Applicant requested a metal cap on the parapet. Staff recommended denial. The commission continued the application to the June 23, 2022 hearing and scheduled a workshop prior to that date for further discussion.
- HPC22-329 (154 N. Market Street): Not heard because the applicant was not present.
- HPC22-334 (212 E. Patrick Street): A three-year extension of the original demolition approval for the Byrley Tannery was granted unanimously, with revised conditions removing state review requirements and adding that demolition permits require full approval of the replacement plan and rehabilitation of the railway terminal building at 200 E. Patrick Street.
- HPC22-335 (200 E. Patrick Street): A three-year extension and level one approval of amended replacement plans were granted unanimously, subject to conditions requiring a historical plaque/marker related to the tannery site and identification of salvaged stone wall features along Carroll Creek. Final details will be reviewed at level two.

I hereby uh call to order the May 12th, 2022 hearing of the City of Frederick Historic Preservation Commission. A reminder that listening devices are available. If anyone should like one, please see Ms. Piles over here to your right. The technical qualifications of the Commission and the staff are on file with the City of Frederick and are made a part of each and every case before the Commission. The Frederick City Historic Preservation Commission uses the guidelines adopted by the mayor and board of aldermen and the city Secretary of the Interior Standards for Rehabilitation published by the U.S. Department of the Interior, National Park Service, and these guidelines are made a part of each and every case. All cases were duly advertised in the Frederick News Post in accordance with Section 301 of the Land Management Code. At this time, I would like to introduce the Commissioners and City staff. To your far right, um HPC Administrative Assistant, Miss Shannon Piles, and the Commissioners, Commissioner Elizabeth Burns, Commissioner Eva Sower, Commissioner Jeff De Petro, I am Commissioner Carrie Alby, Commissioner Ann Hart, and Commissioner Robert Van Renz. To your left, we have Historic Preservation Planners Lisa Moranzic Murphy, Christina Martinkowski, and uh Assistant City Attorney Scott Waxter, and our Aldermanic liaison, Ms. Donna Kazomchek. All applicants and authorized agents and members of the public who wish to speak tonight must be sworn in. Please stand if you are able. If so, answer I do. Thank you very much. You may be seated. It is the purpose of the Historic Preservation Commission to safeguard the historical and cultural heritage of the City of Frederick by preserving sites, structures, or districts that reflect elements of cultural, social, economic, political, archaeological, or architectural history, to stabilize and improve property values of such sites, structures, or districts, to foster civic beauty, to strengthen the local economy, and to promote the preservation and appreciation of such sites, structures, and districts for the education and welfare of the residents of the City of Frederick. In order to be eligible to vote on an application, a commissioner must have made the required site visit and attended any and all meetings at which such application was discussed. In the event that the commissioner is absent from any such meeting, the commissioner may satisfy the attendance requirement by reviewing the record of that meeting. That's correct. And then Ms. Martin Kosky, I might have to ask you to restate the second property. I didn't quite hear. I think I heard 700 North Market Street.
