Frederick Historic Preservation Commission Meeting - October 26, 2023
The Frederick Historic Preservation Commission (HPC) met on Thursday, October 26, 2023, at 6:00 PM at City Hall to consider multiple demolition review requests for properties on East South Street, a consent item, and an amendment to a previous approval. The meeting was broadcast live on Channel 99. All cases were duly advertised. The commission voted on several motions, with split decisions on whether to initiate historic preservation overlays for individual properties.

Discussion Items
- Demolition Review Requests (136-152 E. South Street): Nine applications for demolition review were presented collectively due to being part of a larger redevelopment block. Staff recommended not initiating historic preservation overlay for any individual property, stating they were contributing to the National Register district but not individually eligible. Commissioner Hart argued that the properties embody distinctive characteristics of a type/period and should be protected, while Commissioner Fitzgerald and Van Rens cited alterations and lack of individual distinction.
- 136 E. South Street (HPC23-1106DR): The dwelling and former garage. Staff recommended no overlay. Motion to not initiate failed (2-3), with Commissioners Van Rens and Fitzgerald in favor, and Wilson, Saller, Hart opposed. Subsequently, a motion to initiate overlay for the dwelling only passed (3-2).
- 138 E. South Street (HPC23-1107DR): A frame structure attached to the postponed 140 property. Motion to not initiate overlay passed (3-2).
- 142-152 E. South Street (HPC23-1109DR through HPC23-1114DR): Six brick dwellings built by police officer Andrew Renner. Each was voted on individually. Motions to not initiate overlay passed for all six (3-2 each time), with Commissioners Saller, Van Rens, and Fitzgerald in favor, and Wilson and Hart opposed.
- HPC23-1117 (10 N. Carroll Street): Amendment to previous approvals to relocate a fire egress from the front elevation to the south side by modifying a historic window into a door, plus new gutters. Applicant Marty Bates explained an easement arrangement with the post office. Staff recommended approval with condition. Commissioner Hart noted the lamp post pinch point was addressed. Approved unanimously with condition that shop drawings be submitted.

Good evening. I'd like to call to order the Thursday, October 26th, 2023 session of the Frederick Frederick City Historic Preservation Commission. The technical qualifications of the Commission and the staff are on file with the City of Frederick and are made a part of each and every case before the Commission. The Frederick City Historic Preservation Commission uses the guidelines adopted by the mayor and board of Alderman and the Secretary of the Interior Standards for Rehabilitation published by the U.S. Department of the Interior National Park Service, and these guidelines are made a part of each and every case. All cases were duly advertised in the Frederick News Post in accordance with Section 301 of the Land Management Code. To begin with introductions, on my left, the audience's right, we have HPC Administrative Assistant, Shannon Piles, Commissioner Blair Wilson, Commissioner Eva Soller, myself, Commissioner Robert Van Rennes, Commissioner Paul Fitzgerald, and Commissioner Ann Hart. And then moving on to city staff, we have Commissioner Commissioner Lisa Mrotchik Murphy, Assistant City Attorney Michael Fry. Well, everyone with business before the Commission this evening, please stand up and be sworn in. Do you solemnly swear or affirm that the response is given and statements made in this hearing before the Historic Preservation Preservation Commission will be the whole truth and nothing but the truth? If so, answer I do. I do. Thank you. Please be seated. It is the purpose of the Historic Preservation Commission to safeguard the historical and cultural heritage of the City of Frederick by preserving sites, structures, or districts that reflect elements of the cultural, social, economic, political, archaeological, or architectural history to stabilize and improve property values of such site structures or districts, to foster civic beauties, to strengthen the local economy, and to promote the preservation and appreciation of such site structures and districts for the education and welfare of the residents of the City of Frederick. In order to be eligible to vote on an application, a commissioner must have made the required site visit and attended any and all meetings at which such an application was discussed. In the event that a commissioner is absent from any such meeting, the commissioner may satisfy the attendance requirement by reviewing the record of that meeting. That being said, are any commissioners are there any commissioners with statements of eligibility? All right. Seeing none, let's move on. If the city city staff, do you have any announcements this evening? Um just one regarding item number four on the agenda. Um HBC 231108 DR at 140 East South Street. Um the applicant has requested a postponement of that item, which they can do under Section 423A 7 or 30 days after the original 15-day deadline. Um so that's not something the commission needs to vote on at this time, but it'll it will be automatically postponed. I'm sorry, I missed the last part of what we're doing. It'll be just be automatically postponed. Okay, thank you. All right, moving on to approval of minutes. The October 12th, 2023 hearing and workshop minutes. And those are unanimously approved. Moving on to HPC business. Uh HPC 23-1106 DR. Request for demolition review 136 East South Street. Ms. Martin Koskey. Um, this request for demolition review is submitted per section 423A of the land management code for a dwelling and former garage at 136 East South Street. Planning staff has determined that the structures are in whole or in part 50 years older older. And based on this evaluation, the commission is charged with determining if the property is potentially eligible for individual historic designation. The designation criteria from Section 423D are outlined in the staff memo. For this property, it is identified as a contributing resource in the 2022 Frederick Historic District National Register nomination. However, the former garage was evaluated as a separate resource and is identified as non-contributing to the historic district. The property is situated on the former site of the BF Winchester Brickyard. The area was platted into residential lots in 1894.
