Frederick Historic Preservation Commission Hearing and Workshop - July 11, 2024
The Historic Preservation Commission met on Thursday, July 11, 2024, at 6:00 PM in City Hall to conduct a public hearing, review administrative approvals, and workshop several cases. The meeting included swearing-in of testimony, approval of previous minutes, a demolition review, a rehabilitation case, and workshops on three properties. The meeting adjourned at approximately 10:30 PM.

- HPC24-610 (24 E. 7th Street): Postponed to the July 25, 2024 hearing due to failure of public notice. The commission voted unanimously to move the item.
Discussion Items
- HPC24-623DR (719 Motter Avenue) – Demolition Review: Staff found the rear carport (built circa 1947) not individually eligible for historic designation. The commission unanimously voted not to pursue a designation application.
- HPC24-475 (111 E. 7th Street) – Rehabilitation: The applicant proposed replacing deteriorated slate with synthetic slate on the gable roof and converting the rear standing-seam metal roof to TPO roofing. Staff recommended approval with conditions including color matching, documentation of exposure, and use of the same synthetic slate on the dormer slope. After discussion, the commission voted unanimously to approve with those conditions.
- Workshop – HPC24-425 (100 E. 2nd Street) – Porch Infill: The applicant proposed infilling a second-story rear porch by replicating an existing enclosed section. Staff requested combined elevation drawings and product literature for windows. The commission directed the applicant to submit corrected drawings and product info for further review.
- Workshop – HPC24-518 (107 S. East Street) – Level 1 Submission: A large mixed-use development along Carroll Creek (up to 7 stories) was workshopped. The applicant presented updated massing, setbacks, and materials, including a 15-foot setback from the Delaplaine Arts Center, varied brick colors, and fenestration patterns. Staff and commissioners generally appreciated the improvements. The applicant was asked to provide a complete set of four elevations and a vignette of the west elevation. The next deadline for resubmission is July 15 or July 29, with a hearing possible on August 8 if the later date is chosen.
- Workshop – HPC24-603 (1730 N. Market Street) – Tesla Solar Shingles: The applicant explored replacing the synthetic slate roof with Tesla solar shingles on three historic Old Fellows Home buildings. Commissioners noted that the guidelines prohibit solar features visible from the street and that all roof slopes are now visible due to surrounding development. The commission advised that the proposal appears incompatible with historic preservation guidelines and discouraged a formal application.

Good evening, and welcome to the July 11th, 2024 Frederick City Historic Preservation Commission hearing and workshop. Technical qualifications of the Commission and the staff are on file at the City of Frederick and are made a part of each and every case before the Commission. All cases were duly advertised in the Frederick News Post in accordance with Section 301 of the Land Management Code. Introductions. Creighton um for uh we with your parking pass or I'm sorry with your your parking ticket you can have it uh validated so and then please go ahead um staff would like to enter one uh announcement into the record um under the consent items HBC 24610 we're I'm asking to continue that case due to the applicant not meeting signs postage requirements all right we will um we will take that under advisement when we get that far thank you moving on to approval of minutes uh the June 27th 2024 hearing and workshop minutes commissioners any questions or concerns regarding those minutes yes sir I have a few um corrections I'm going to make a motion that we approve them with the following corrections start with the hearing minutes section three approval of the minutes from June 13th that motion was made by Ann Hart and was seconded by Alyssa Fortune Item two June 13th workshop minutes also motion by Ann Hart seconded by Alyssa Fortune under section four item three the second was by Alyssa Fortune under section seven item seven the sentence that starts the design shall be and it should be corrected to the design shall minimize physical and visual impact to the historic structure and the last sentence in that paragraph of the motion all conditions shall be met before applying for permit and those are my corrections for suggested corrections for the hearing minutes all right I would like to enter one more under um section six continuances the motion um if my first name could be spelled correctly I would appreciate that sorry I didn't see that nope that's okay sorry all right any others not for the hearing minutes I second the motion as the corrected minutes all right any further discussion all in favor please raise your hand all right and motion to motion for the motion to pass the corrected minutes passes unanimously sir I just would like to make a note that that was for the hearing minutes only and yes okay for the hearing minutes only sorry your and then moving on to the workshop minutes and again I'd like to make a motion with the following corrections under comments um for HPC 24535 the second bullet voted in hearing to find this building a significant contributing resource in the third bullet very last sentence that are reversible so that it can be uncovered and not recovered then moving to HPC 24584 second bullet were not included in the demolition application in the fifth bullet the addition with only one structure or one story in the fifth bullet a commissioner and then the last sentence of that same bullet unfortunately there is no evidence that it did exist on earlier maps on the sixth bullet a commissioner commented on the green space around the building and that ends the suggested corrections all right thank you any other suggested um corrections or comments A commissioner commented on the green space around the building. Um motion to approve the workshop when it's as corrected. All in favor, please raise your hand. And that passes unanimously. Thank you. Moving on to HPC business, the administrative approval report. I would like to enter the entire administrative approval record and to the excuse me, the entire administrative approval report into the record and note that 21 cases were processed by staff last month. All right, thank you. And uh moving on to HPC 24-62 623 DR requests for demolition review. 719 Motor Avenue. I'd like to enter the whole staff report into the record. A request for demolition review has been submitted per section 423 of the land management code for the rear carport at 719 Matter Avenue. Planning staff had determined that the structure is in whole or in part 50 years or older. Based on this evaluation, the historic preservation commission is charged with determining if the property is eligible for individual historic designation. A property is eligible for designation for historic preservation overlay. If it's at least 50 years, retains historic integrity integrity and meets at least one of the following criteria listed in the memo. The carport associated with the property at 719 Moder Avenue was constructed circa 1947. The 1947 sandboard map first reflects an automotive structure on the rear of the property. The longest residents of the property were John and Edna Kern. The structure retains its original location, setting, feeling, and association, but lacks its original material design workmanship and high level of architectural significance. Research has not indicated that property that the property holds significance for an event or culture group, nor was any information found to indicate that it is associated with the lives of significant persons. Staff finds that the structure is not individually eligible for designation and recommends the commission not to pursue a designation application. All right, thank you. Commissioners, any questions or concerns regarding the staff report? I have a couple of questions, if I may. So if I'm reading the second document within the packet, it says the scope of work. Implies to me that it is only a partial demolition. And when I made a site visit, I feel as if the work has already been done. That's what it appears, so yeah. It's still very difficult to see at that point, but I mean, yes. Because there are other buildings beside it. So understanding what this partial demolition is and the fact that it's post-work. Do we need to document that? I guess is what I'm looking for. That is the only documentation I was able to receive from the applicant regarding what it looked like. What's happened? And this is not a stat this is not a staff issue. This is an applicant issue, is we're being asked to approve the application post-work. Which is a thing that happens, especially outside the historic district where quite possibly the applicant had no idea that this would become an issue because they didn't they they they're outside the historic district, and it would not have occurred to them that that this that our review would apply to this.
