Um just to remind everybody uh given the the um deliberations that we had on August 28th.

Um according to the ZBA rules of procedures, uh any motion uh may uh before the ZBA requires four out of five members uh to pass a motion.

So a simple majority of three out of five does not hold.

Um we have five voting members on the ZBA and one alternate, Mr.

Um I thought you said that it takes four votes to do and to make any decision as a board.

Um so we have had those situations occur before when a supermajority can cannot be reached.

Um that you know if that is the situation tonight, we will have to see if we can reach some sort of consensus that that brings the board to a majority uh decision.

Um if the board cannot reach a decision, then the um decision of the planning commission will stand as as it was written, because the appeal that is before us tonight is to overturn that decision.

Well, I think maybe uh starting point is when we adjourned on the 28th, um we seemed to at least by straw vote have a consensus uh that affirmed the planning decision the planning commission decision um and there were five actions that they took on uh within that case that was actually um five separate approvals.

Uh but we were in consensus on four.

Um one under the 1986 ordinance, the 12 foot uh street setback from the face of the curve for non-residential mix uses, according to section 16105.

Um eighty-six ordinance is zero foot side setbacks uh for non-residential and mixed uses within village uh center permitted under 16105.

Um setback from face of the curb uh in accordance with section 14E1 of the current land management code and a zero foot setback along adjoining property lines of parcels within the village center as permitted under section 410 E1 of the LMC.
