Discussion Items
Variance at 201 Magnolia Avenue (CBA 13-337 V)
- Applicant Lee Lushbaum requested two variances from Section 405 of the Land Management Code to reduce the required street setbacks on a corner lot at Magnolia Avenue and West 2nd Street. The property is an irregularly shaped corner lot with three frontages, and the existing house was built in 1940. The variances would allow a 626-square-foot addition and a two-car garage.
- Staff recommended approval, finding that the lot's size and shape create a practical difficulty, and the variances would not be contrary to public interest.
- A neighbor (adjacent property owner) asked about the zero lot line and potential removal of trees. The applicant clarified the zero lot line applies only at two points adjacent to city right-of-way, and the house will remain about 35 feet from the street.

Appeal of Zoning Administrator Decision at 329 East 2nd Street (ZBA 13-347A)
- The appellant (Chapin Family LLC, represented by Ann Rollins) sought to reverse the zoning administrator's determination that the proposed "Exotic Lumber" business should be classified as "building supplies and lumber" (not permitted in the DB district) rather than "retail sales not otherwise listed" (permitted). The business sells exotic and domestic hardwoods to hobbyists, woodworkers, and artists, not to contractors or large-scale builders.
- Staff defended the zoning administrator's decision, arguing that the classification matrix prefers specific over general categories, and the business sells lumber, which falls under building supplies.
- The appellant argued that the business is a specialty retail store with low traffic, no outdoor storage, and a different clientele, and thus should be classified under the catch-all category "retail sales not otherwise listed."
- The board discussed the four criteria for appeal and debated whether the zoning administrator's decision was arbitrary or capricious. Ultimately, the board voted 4-0 to reverse the determination, reclassifying the use as "retail sales not otherwise listed." The board found that the zoning administrator had not properly interpreted the code given the unique nature of the business.
Public Comments & Testimony
- At the conclusion of the appeal case, a resident from 328 East 3rd Street expressed frustration that the public was not given an opportunity to speak during the appeal process, despite signs and notices being posted. The resident argued that the process was unfair because the applicant was allowed to testify while residents were not.
- Another resident, John Daniels from 335 East 3rd Street, echoed the concern and suggested that if the board was conducting an administrative review, it should not accept testimony from anyone, including the applicant. He also expressed concern that the classification of the business as "retail" could allow more intensive uses in the future without public input.
- The Chairman acknowledged the frustration and noted that the board is bound by the Land Management Code and a prior circuit court ruling that prohibits taking public testimony in such appeals. The board encouraged the residents to raise their concerns with the Mayor and Board of Aldermen.

Welcome to the June 25th, 2013 meeting of the City of Frederick Zoning Board of Appeals. For the sake of folks uh watching at home and some uh people who may not have been here before, uh we'll start tonight. I'll go over sort of uh um our rules of procedure. Uh we'll see if there's any questions there uh in and uh if not, then we'll get on to tonight's uh agenda. So that's all right with everyone. Uh the zoning board of appeals. We are all uh residents of the City of Frederick and uh volunteers. We are uh appointed by the mayor, and those appointments are confirmed by the Board of Aldernade. Um supporting uh the members in our activities uh tonight, I'll introduce uh for for your benefit. To my far, far right and your far far left is Ms. Pan Rupert. She is a planner with the uh City of Frederick. Uh seated next to Mr. Repert is Ms. Rachel DePo. She is the assistant city attorney, City of Frederick. And next to Ms. DePoe is Ms. Gabrielle Dunn. She is the division manager of current planning. I always get those backwards. And then to my far left and your far right is Ms. Leo Ortiz, and she is the office manager with the planning department, and uh she also uh does a great job supporting the zoning board of appeals in our activities. A little bit about our proceedings uh for tonight. Uh I'll call uh your case. Um I have a feeling that everyone uh is here tonight, but if you could just give me a little wave and let me know that uh the applicant is here, that would be great. Um first thing I'm gonna do is ask for the staff report. We'll have the staff report read into the record at the end of the staff report. The staff will make a recommendation concerning the case. That is one element that we will use in our decision making tonight, but it is not the only element. Following that, we will ask for public testimony from the applicant, and we'll see if uh the applicant has anything they want to add to the staff report or um want to disagree with. Uh during that time, members of the board may ask the applicant uh questions. Following uh the applicant's comments, we will see if there's any general public comment regarding the case. Following any public comment, we'll have the applicant have an opportunity uh to sort of respond and wrap up their position. That'll end our public testimony section uh of the proceedings. And I will call for a vote from the board. Uh just uh so everyone is aware, our rules of procedure uh require us to have four votes in the affirmative for a motion to pass. So it requires four out of the five members uh present to vote for uh for a motion to pass. So a simple majority of three does not pass a motion. If you happen to be speaking tonight, the first time you come to the microphone, if we could have your name and your address for the record. Um and if you happen to leave and happen to come back, if we could have your name again, uh that would be great. Reason for that is that all tonight's proceedings are being recorded. And anyone who feels aggrieved by a decision of the zoning board of appeals has the right to appeal our decision to circuit court. And when the judge is reviewing the transcripts and the recordings of tonight's proceedings, that helps them keep straight who happens to be speaking at any one time. Um questions about tonight's proceedings. No? Well, if um uh and I used to be in the old days, I'd say if anyone has a cell phone, I know today everyone has a cell phone. Um if you guys can make sure those are are set to vibrate as as we will. I'll make sure my set is vibrate too.
