Meeting Transcript
Call the meeting to order. Today we're meeting uh the zoning board of appeals is meeting for the city of Frederick May 23rd, 2017. I will be filling in for the uh chairman of the uh board, Jim Radcliffe. Uh Ratcheff, who is called out of town uh to be with his father uh who is very ill. Uh our prayers are with Jim and his family this week. Um we in addition to Jim uh Sean Butcher could not make it uh tonight, and so filling in on the board is our alternate, Mr. Tom Overbay. And uh joining us tonight is uh Gabrielle Collard, division of man uh director, no, your division manager of current planning for the city of Frederick. Okay. Um we have a short, very short agenda, but uh I will go on to the next item on the agenda, general public comment. And it appears as if we do not have anybody in the audience, so we can skip that section. Uh the next item on the agenda is the approval of minutes for our last meeting on April 25, 2017. I would entertain a motion uh regarding the minutes. I make a motion to approve the minutes for April 25th, 2017. Okay, we have the motion from Mr. Overbay. Do I hear a second? I second it. Okay. Uh any further discussion on the motion. If not, uh signify approval uh by saying aye. I mean uh uh any in opposition to the motion. Hearing none, the motion is uh approved. Uh uh to the motion that carries to approve the minutes from the uh April 25, 2017 meeting as written. Um as I go down further, we'll skip the swearing in of witnesses since we again don't have anyone here, and that brings us to the next item on the agenda continuances. Gabrielle, can uh you explain that? Absolutely. Um this is a request for continuance for 30 days to the June 27, 2017 meeting. And this is in the case of ZBA 17182, which is a conditional use application for a telecommunications facility at 110 Airport Drive East. Um, this item was before you last month, also requesting a 30-day continuance to today in reassessing with the applicant to see if they were ready to move forward to this meeting. They they were not and requested an additional 30-day continuance. Uh the issue at hand um has to do with some of the criteria relative to the visual impact of the facility on any historic vistas. The property is approximate to um sections of the Minoxy battlefield, and our historic preservation commission had reviewed the application um as part of a uh a section 106 process and um did express concern. The applicant's going to spend the next 30 days working with our historic preservation staff to meet with the Historic Preservation Commission, understand their concerns and um be able to explain the project a little bit further. Um and the goal of which would be to um hopefully identify some mitigation measures that may turn into conditions of approval associated with your um application. So that is the goal over the next 30 days. I'm sorry. Um I didn't have my mic on, so I'll repeat that. Uh there were no questions for Gabrielle, and so I will entertain a motion for ZBA 17-182CU conditional use at 110 Airport Drive East. And so I will entertain a motion for CBA seventeen dash one eight two CU Conditional use at one ten airport drive east. Do I have a motion? I make a motion for continuation for ZBA seventeen dash one eight two at one ten east airport drive. Okay, we have a motion uh to approve from Mr. Overbay. Do I have a second? Uh I second. We have a second from Dr. Ying. Um discussion on the motion. All in favor, uh indicate by saying aye.
