5:49

Resolution 26 171 to the end of today's agenda.

5:54

Is there any objections?

5:56

Seeing none moving forward to agenda item number one for action.

6:00

Resolution 26-183.

6:03

This resolution grants a special management area major permit to Barbara Pollen to allow for the demolition of an existing single unit dwelling and the decommission of an existing cesspool and the construction of a new two-story single dwelling unit with three lunaies, two carp carport on the ground, and a second story living space open one car parking area, rock garden, in ground swimming pool, concrete rubble masonry wall, and individual wastewater system on an 11,591 square foot shoreline lot zone R5 residential district, located at 57329 Pahi Alua Street in Kahuku.

6:44

We have posted on the agenda CD1 version of the resolution for your information.

6:49

A summary of the amendments is listed on the agenda.

6:52

The entire project site will be impacted by 3.2 feet of sea level rise by the year 2100.

6:58

The project is located as far Malca as possible on the most elevated portion of the zoning lot available and is outside of the shoreline setback of 66.65 feet.

7:09

There is no other suitable location for the project on the site.

7:12

However, the project's roof overhangs encroach into the shoreline setback area and requires a minor shoreline structure permit.

7:21

The project swimming pool is located under the second floor under on the Mackay side of the dwelling, and there is no wall that could serve as a shoreline hardening structure.

7:31

The proposed CD1 includes applicant acknowledgments regarding the risks and responsibilities associated with development in the sea level rise exposure area and requires that pervious surface materials be used for the project driveway and certain areas under the elevated dwelling.

7:49

Joining us in the chamber is Jim Hayes from Planning Solutions Inc., who will be providing a brief presentation for your information.

7:56

The presentation is available online as miscellaneous communication 397 2026.

8:03

Thank you, Chair.

8:05

Jim Hayes with Planning Solutions.

8:37

Unfortunately, uh that project uh was unable to obtain building permits in a timely manner.

8:44

And so we're now reapplying essentially a very similar project, but the uh dwelling has been moved Malca as far as possible to address sea level rise concerns and uh be outside the shoreline setback.

9:00

So this map illustrates where the location of the project is there in Cavella Bay, and um it's in the R5 zone, it's in the flood zone and it's in the sea level rise exposure area, as this next slide shows.

9:15

Um a substantial portion of uh that side of Cavella Bay is in the sea level rise exposure area.

9:22

Uh but as I mentioned, uh the project's been moved as far as Malca as possible, and the current erosion rate there is only 0.08 feet per year.

9:34

Um hasn't been experiencing much erosion recently due to uh offshore reefs in the area that break up the the wave energy there.

9:44

Uh, this illustrates the project plan showing the street on the bottom of the diagram, and then the house, as you can see, as far Malca as possible and outside of the shoreline setback area.

10:00

The industrial excuse me, the individual wastewater system is to the right of the dwelling, also as far from the ocean as possible.

10:07

Uh this final slide, which is a rendering of what the project will look like from the street side.

10:14

Um yeah, and you can see uh that it's a two-level structure, so the living area is elevated above the garage, so that's elevated above the flood zone hazard elevation, the base flood elevation.

10:29

Um, and that concludes my presentations.

10:33

Thank you so much.

10:34

Members, are there any questions for Mr.

10:37

Hayes?

10:38

Seeing no questions before thank you so much.

10:41

Before I call up the administration, I would like to take public testimony, proceeding first with in-person testimony in the council chamber clerks.

10:48

We have any in-person testifiers.

10:50

Chair, there are none.

10:51

Is there anyone?

10:52

Um, is there any remote testifiers?

10:54

Chair, there are none.

10:56

For the administration.

11:00

Good morning, Chair Kia Aina, Vice Chair Waters and Committee members.

11:04

I'm Elizabeth Krieger, the land use permits division chief with the Department of Planning and Permitting, and we support this project and we support the CD1.

11:13

Thank you.

11:14

Are there any questions or discussion before I make my recommendation?

11:17

Seeing none, the chair recommends that resolution 26-183 be amended to the posted CD1.

11:23

Any discussion, any objections or reservations hearing none, the resolution has been amended to a CD1.

11:29

The chair then recommends that resolution 26 183 CD1 be reported out for adoption.

Summary of Proceedings

Honolulu Zoning & Planning Committee Meeting – September 24, 2026

The Honolulu City Council Committee on Zoning and Planning met on Thursday, September 24, 2026, at 9:04 AM in the council chamber. The meeting was chaired by Councilmember Kia Aina, with Vice Chair Waters, Councilmembers Topola, Dos Santos Tam, and Cordero present. Councilmember Okimoto was excused. The committee considered nine agenda items, including resolutions and bills related to land use permits, transit-oriented development (TOD) plans, zone changes, and pedestrian mall designations. Extensive public testimony was heard, particularly on Resolution 26-171 (1588 Ala Moana project). All items were advanced to the full council for adoption or passage.

Public Comments & Testimony

  • Resolution 26-183 (Kahuku shoreline project): No public testimony was offered.
  • Resolution 26-207 (Pohu Kaina Commons amendment): No public testimony was offered.
  • Bill 37, 38, 39 (East Kapalay TOD): No public testimony was offered on Bill 37. On Bill 38, Dalen Cam (Oahu Transit Riders) urged support. On Bill 39, Councilmember Topola noted community concerns from a prior neighborhood board meeting but explained the bill conforms existing zoning to the TOD plan.
  • Bill 42 (Haleiwa corporation yard): No public testimony was offered.
  • Bill 43 (Wayalua rezone): No public testimony was offered.
  • Bill 48 (pedestrian malls): Dylan Armstrong (individual capacity) supported the bill as a public safety and economic development measure.
  • Resolution 26-171 (1588 Ala Moana): Over 30 individuals testified. Supporters included representatives from local businesses, unions (Hawaii Regional Council of Carpenters, Operating Engineers Local 3), and community members who cited job creation (6,000 construction jobs, 800 permanent jobs), affordable housing (69 affordable rental units at 80% AMI), economic benefits, and alignment with the Ala Moana TOD plan. Opponents, primarily from Unite Here Local 5, argued that the affordable housing is not truly affordable for local workers (80% AMI is $85,000/year, with rents around $2,300/month for a one-bedroom), that the project benefits tourists over locals, and that the developer should provide more community benefits. Some also raised concerns about traffic, parking, and pedestrian safety.

Discussion Items

  • Resolution 26-183: The committee amended the resolution to CD1 (including applicant acknowledgments of sea level rise risks and pervious surface requirements) and reported it out for adoption without objection.
  • Resolution 26-207: The committee amended the resolution to CD1 (correcting a typo in Howard Hughes’ name, adding a warehouse clause explaining a 60-month extension due to financing uncertainty, and extending the construction deadline to June 7, 2032). The Hawaii Housing Finance Development Corporation (HHFDC) supported the 60-month extension. The resolution was reported out for adoption.
  • Bill 37, 38, 39 (East Kapalay TOD): After discussion on Bill 38 (including concerns about parking standards, connectivity, and school sites), the committee reported all three bills out for passage on third reading. Councilmember Topola clarified that the zone changes conform to the TOD plan and that benefits such as schools and parks come from unilateral agreements, not this legislation.
  • Bill 42 (Haleiwa corporation yard): The committee reported the CD1 out for passage on third reading without objection.
  • Bill 43 (Wayalua rezone): The committee reported the CD1 out for passage on third reading. Vice Chair Waters noted the surrounding area also has non-conforming units and suggested DPP consider rezoning the broader area in the future.
  • Bill 48 (pedestrian malls): The committee amended the bill to CD1 (expanding Fort Street Mall to include Chaplin Lane, adding bicycle requirements) and reported it out for passage on third reading. The Department of Transportation Services supported the bill.
  • Resolution 26-171 (1588 Ala Moana): The committee engaged in extensive discussion. DPP presented the project’s community benefits: 69 affordable rental units (34% of total residential units), $5 million for complete streets improvements in the Ala Moana TOD area, $1.5 million for urban forestry, a new bus stop or adoption of an existing stop, a bike share station, and widened sidewalks. The developer (Kobayashi Group) emphasized the project’s alignment with the TOD plan, which allows up to 400-foot height and FAR of 7.0. The project has a FAR of 6.17 and includes 294 hotel units, 136 market-rate condos, 20,000 sq ft of commercial space, and 1,229 parking spaces. DPP staff explained that the monetary benefits were negotiated to mitigate viewshed impacts on Ala Moana Beach Park and to fund streetscape improvements. Committee members expressed support, noting the project’s consistency with the TOD plan, the generous community benefits package, and the need for affordable housing and economic activity. Vice Chair Waters and others encouraged the developer to consider using unionized labor (Unite Here Local 5) for hotel staffing. The committee amended the resolution (deleting a driveway design condition and making technical amendments) and reported out the CD1 for adoption.

Key Outcomes

  • Resolution 26-183 (Kahuku project): Amended to CD1 and reported out for adoption.
  • Resolution 26-207 (Pohu Kaina Commons): Amended to CD1 (60-month extension) and reported out for adoption.
  • Bill 37 (state land use boundary amendment – East Kapalay): Reported out for passage on third reading.
  • Bill 38 (LUO amendments – TOD Special District): Reported out for passage on third reading.
  • Bill 39 (rezoning – East Kapalay): Reported out for passage on third reading.
  • Bill 42 (state land use boundary amendment – Haleiwa): Reported out for passage on third reading.
  • Bill 43 (rezoning – Wayalua): Reported out for passage on third reading.
  • Bill 48 (pedestrian malls): Amended to CD1 and reported out for passage on third reading.
  • Resolution 26-171 (1588 Ala Moana): Amended to CD1 (with minor changes) and reported out for adoption. The meeting adjourned at approximately 11:45 AM.
