Summary of Proceedings

Hudson City Council Meeting – October 15, 2024

The Hudson City Council met on Tuesday, October 15, 2024, at 7:30 PM at Town Hall. The meeting included four proclamations, public comments, a motion to censure Councilwoman Nicole Kowalski that passed 4-2-1, approval of the consent agenda, and the adoption of several financing ordinances. The meeting concluded with two executive sessions on litigation and adjournment at 10:19 PM.

Proclamations

  • Clayton Rakes Fundraiser / National Day of Raking: Mayor Anzevino proclaimed November 2, 2024, as the National Day of Raking, recognizing the Yozwiak family’s efforts raising over $225,000 for ALS research. Council members expressed support; Councilwoman Goetz noted ALS occurs in veterans at twice the rate of the general public.
  • Take a Second, Make a Difference Day: October 24, 2024, was proclaimed, accepted by Laura Jones of Hudson Community First.
  • World Singing Day: October 19, 2024, was proclaimed, accepted by Kathy Sluzewski of the Hudson Community Chorus.
  • Comprehensive Plan Steering Committee: Members were recognized and thanked for their work on the 2024 Comprehensive Plan, adopted October 1, 2024.

Public Comments

  • Todd Zedak (16 Hudson Common) reminded the community of the 40th anniversary of the Sister City partnership with Landsberg and encouraged participation.
  • Roseanne Thomas (2573 Brunswick Lane) asked for an explanation of the “Discussion Item” heading on the agenda, which had no subject listed. Council did not provide an on-the-spot answer.
  • Ron Brubaker (7593 Partridge Meadows Dr. East), representing Trail Advocates of Summit County (TASK Force), thanked staff for meeting with the Rails to Trails Conservancy and supported the city’s plan to purchase a one-mile section of Norfolk Southern Railway, stating the unconditional abandonment request is the best path forward.

Council Comments & Censure Motion

  • Council updates included the Cemetery Board (over $140,000 in revenue this year), thanks for the Fire/EMS Open House, Veterans Day ceremony details, and HCTV open house.
  • Council President Foster made a motion to censure Councilwoman Nicole Kowalski, alleging she emailed privileged documents to resident Don Reed on December 10, 2022, four days after a previous censure. He cited a Summit County Court of Common Pleas order holding the documents were privileged and that her actions violated Ohio Revised Code Section 102.03(B). The motion was seconded by Councilman Banweg.
  • Debate: Councilwoman Kowalski defended herself, stating the privilege waiver was ambiguous, she was denied due process, and the motion was a third attempt to censure her. Council members Bird and Goetz opposed, questioning timing and Open Meetings Act compliance. Council members Banweg, Heater, and Sutton supported the motion, arguing the court had ruled and accountability was needed.
  • Vote: The motion to censure Councilwoman Kowalski passed 4-2-1 (Ayes: Foster, Heater, Sutton, Banweg; Nays: Bird, Goetz; Abstain: Kowalski). The censure was a verbal warning with no additional penalty.

Consent Agenda

  • 24-0102: Acknowledged receipt of the September 2024 Monthly Financial Report.
  • 24-122: Authorized the Director of Public Works to serve on AMP Board of Trustees sub-committees.
  • 24-123: Authorized a professional services contract with CT Consultants (a Verdantas company) for engineering design services for the Water Treatment Plant Softener Rehabilitation Project. All items were approved unanimously.

Legislation – Third Reading (All passed 7-0)

  • 24-86: Ordinance permitting funds-in-lieu of sidewalks citywide, reaffirming commitment to non-vehicular connectivity.
  • 24-110: Amended City Council rules to streamline referrals to boards and commissions by motion (declared an emergency).
  • 24-111: Issuance of $740,000 in taxable economic development bond anticipation notes for refinancing of the former Windstream property (100 Owen Brown Street).
  • 24-112: Issuance of $925,000 in taxable economic development bond anticipation notes for financing of the former Windstream property (94 Owen Brown Street).
  • 24-113: Issuance of up to $7,300,000 in notes for a new salt storage facility and bus maintenance/storage facility at 5810 Hudson Drive.
  • 24-114: Issuance of up to $3,295,000 in notes for acquisition of approximately 31 acres at 5431 Hudson Drive for a new Public Works facility and design costs.
  • 24-115: Issuance of up to $2,700,000 in notes for a new clubhouse at Ellsworth Meadows Golf Club (total project cost $3.1 million; balance from golf course fund).
  • 24-116: Issuance of up to $1,750,000 in notes for a multipurpose trail along Boston Mills Road between Timberline Trail and Lake Forest Drive.
  • 24-117: Issuance of up to $1,000,000 in notes for a multipurpose trail along Valley View Road between SR 91 and Hunting Hollow Drive, continuing to Prospect Road.

Legislation – First Readings

  • 24-121 (Second Reading): Resolution authorizing the City Manager to purchase approximately 10.77 acres from Norfolk Southern Railway for $540,000 ($510,000 for land, $30,000 for abandonment) for a future rails-to-trail project.
  • 24-124: Resolution authorizing license agreements for East Hudson Hills Homeowners Association signs within public right-of-way.
  • 24-125: Ordinance vacating a 380-foot unimproved portion of Harding Boulevard in Boston Park Subdivision. A motion to suspend the rule requiring three readings failed 3-4 (Ayes: Bird, Foster, Heater; Nays: Sutton, Banweg, Goetz, Kowalski).
  • 24-126: Resolution adopting in concept the City of Hudson Five-Year Plan 2025-2029.
  • 24-127: Ordinance making appropriations for the 2025 fiscal year budget.

Appointments

  • Council President Foster announced the application deadline for full-term vacancies on Planning Commission, Board of Zoning and Building Appeals, Environmental Awareness Committee, and Cemetery Board is extended to October 25, 2024.
  • He appointed Councilmembers Banweg, Heater, and Bird to an ad hoc committee to study the financial viability of a recreation center.

Executive Session

  • Council voted unanimously (7-0) to enter executive session to discuss pending litigation (ORC 121.22(G)(3) and (5)). After a recess, a second executive session was held with only those members without a conflict (5-0-1 excused, 1 abstention) to discuss a separate litigation matter. No votes were taken after the sessions.

Adjournment

The meeting adjourned at 10:19 PM.
