Summary of Proceedings

Hudson Planning Commission Meeting - February 11, 2019

The Hudson Planning Commission met on Monday, February 11, 2019 at 7:32 PM at Town Hall. Chair Kagler called the meeting to order with five members present (Chuparkoff, Harvie, Kagler, Lehman, Vitale) and two absent (Anglewicz, Stolle). The meeting featured two public hearings: approval of a new building site plan at 44 Clinton Street and a continued discussion on the Land Development Code (LDC) update. No public comments were received during the meeting.

Oath of Office

  • City Solicitor Matt Vazzana swore in David Lehman as a new Planning Commission member, appointed by City Council.

Public Hearings

PC 2018-3897 – Site Plan for New Building at 44 Clinton Street

  • Applicant: Laura Yeager Smith Home and Design and JMS Property Group LTD, represented by architect Russ Marchetta.
  • Proposal: Construct a 5,472 square foot freestanding two-story building (retail first floor, offices second floor) on a newly created parcel west of 44 Clinton Street, in the 5-Village Core District.
  • Staff Report: City Planner Kris McMaster introduced the application and recommended approval with four conditions. A lot split was in process at Summit County. A revised site plan incorporated on-street parking and moved the building foundation six inches.
  • Discussion: Commission members questioned trees removal, stormwater easements, parking counts (8 on-site plus 28 within 300 feet), and delivery access. Assistant City Manager Thom Sheridan clarified that a 30-foot emergency access easement for the underground detention system is standard. The applicant agreed to comply with all conditions.
  • Public Testimony: None.
  • Outcome: Motion by Harvie, seconded by Vitale, to approve the site plan subject to conditions: 1) administrative lot split approval; 2) cross-access and shared parking easements acceptable to the city solicitor; 3) addressing Assistant City Engineer Nate Wonsick’s comments per January 29, 2019 letter (condition 3 was excluded after staff confirmed lighting plan met requirements). The motion passed unanimously (5-0).

PC 2018-4526 – Hudson Land Development Code 2018 Update (Continued)

  • Background: The public hearing was continued from January 28, 2019. City Council granted a 60-day extension to April 14, 2019.
  • Staff Update: Kris McMaster reported that a revised redline draft would be delivered to commissioners on February 15, 2019. The final draft would be posted on the city website and advertised in the Hudson Hub-Times. Key revisions included:
    • Standardizing notification periods to 15 days (previously 7, 10, or 15 days).
    • Removing the clause that failure to post would not invalidate hearings.
    • Clarifying sign regulations: instructional signs may express non-commercial speech; temporary ground signs (including A-frame signs) will require registration (not a zoning certificate) and a license agreement for use in public right-of-way.
    • Maintaining a 5-foot clear pedestrian path on sidewalks.
  • Discussion: Commissioners discussed the notification change’s impact on scheduling, the removal of the non-invalidation clause, and A-frame sign placement. David Lehman, as a new member, requested a briefing on prior discussions. The goal was to present the draft on February 25, with public comment and a potential recommendation in March.
  • Public Testimony: None.
  • Outcome: Motion by Chuparkoff, seconded by Lehman, to continue the public hearing to February 25, 2019 at 7:30 PM. The motion passed unanimously (5-0).

Other Business

  • Staff announced upcoming meetings for Downtown Phase II plan development, possible dates March 18, March 20, or April 1, 2019. Final date to be confirmed by February 13.

Approval of Minutes

  • Minutes of January 28, 2019 Special Meeting: Motion by Harvie, seconded by Chuparkoff. Approved 3-0 (Kagler, Chuparkoff, Harvie) with Lehman and Vitale abstaining.

Adjournment

  • Motion to adjourn by Vitale, seconded by Harvie. Unanimous. Meeting adjourned at 8:39 PM.
